TO ORDER Fla.q Salute Mayor Booth called the meeting to order at 7:30 p.m. and led those in attendance in the pledge of allegiance. Roll Call Those in attendance included Mayor Booth and members of the Auburn City Council as follows: Pat Burns, Rich Wagner, Virginia Haugen, and Jeanne Barber. Mayor Booth indicated Councilmembers Trish Borden, Stacey Brothers and Don Kurle are excused from attending this evening's meeting. Staff members present included: Police Captain Ray Sherman, Fire Chief Bob Johnson, Personnel Director Brenda Kennedy, Parks and Recreation Director Len Chapman, Finance Director Victor Thompson, Public Works Director Frank Currie, City Engineer Dennis Dowdy, Utilities Engineer Dwight Holobaugh, Water Quality Compliance Officer Chris Thorn, Planning and Community Development Director Paul Krauss, City Attorney Michael Reynolds, Assistant City Attorney Judy Ausman, City Clerk Robin Wohlhueter, and Deputy City Clerk Dani Daskam. Announcements and Appointments 1. Announcements a) Proclamations (1) Mayor Booth read and presented a proclamation declaring May 15 - 20, 1995 as "Optimist Bike Safety Week" in the City of Auburn to Mr. Roger Thordarson and Ms. Pat Page1 City of Auburn Council Meetinq Minutes May 1, 1995 b) Narowitz. Mr. Thordarson announced the Bike Rodeo will be held at Game Farm Park on May 20, 1995 beginning at 9:00 a.m. and invited everyone to bring their children and grandchildren. (2) Mayor Booth read and presented a proclamation declaring May 12 through May 19, 1995 as Law Enforcement Torch Run Week to Police Captain Ray Sherman. (3) Mayor Booth read and presented a proclamation declaring May 1 through 7, 1995 as Municipal Clerks Week to Deputy City Clerk Dani Daskam. Employee Reco.qnition Mayor Booth introduced Mr. Jim Webster, Executive Director, Washington Recreation and Park Association, who is in attendance to present a Citation of Merit Award to Sharon LaVigne, Recreation Coordinator. Mr. Webster explained there are over 1,100 members of the Washington Recreation and Park Association. Annually awards are presented to members of the association, other organizations, and individuals who have given their time and energy to their profession, the association, and their community. Mr. Webster further explained the award presented this evening is the Citation of Merit Professional Award, which is awarded to a parks and recreation professional for continuing service. Mr. Webster thanked the Mayor and City Council for their support of the Parks and Recreation Department programs. Mr. Webster stated Sharon LaVigne chaired the association's professional certification program and has been instrumental in developing the state certification plan and obtaining its approval through the National Recreation and Park Association. Mr. Webster presented to Recreation Coordinator Sharon LaVigne the Citation of Merit from the Washington Recreation and Park Association. Agenda Modifications Agenda modifications include correspondence transmitted under Item II.C.2 of these minutes, the removal of Ordinance Number 4742 from this evening's agenda, and the addition of Ordinance Number 4744 as Item VII.A. 3 of these minutes. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearin,qs Petition No. V-04-94 03.9 V-04o94 The request of Myron and Madeleine Massey to vacate an alley south of East Main Street and east of "D" Street Southeast. Mayor Booth stated the applicants are requesting the vacation of an alley. The owners have made application to develop senior housing on the site. However, the current request is focused solely on the vacation. Mayor Booth declared the public hearing open and requested citizen comment. Donald Spellman, 101 "E" Street SE, Auburn, WA Mr. Spellman stated he lives on the east side of the proposed construction project. Mr. Spellman asked if the vacation of the alley is necessary. Mr. Spellman stated the alley is frequently used by children and bicyclists. Jim Nicholson, 25 "E" Street SE, Auburn, WA Mr. Nicholson stated he is concerned with adequate parking in the area. Mr. Nicholson stated students attending the high school use his street for parking. Mr. Nicholson asked if he will receive any tax relief from the proposed development. Page 3 City of Auburn Council Meetinq Minutes May 1, 1995 Lola Rogers, 19 "E" Street SE, Auburn, WA Ms. Rogers asked why senior citizen housing is planned for downtown Auburn. Ms. Rogers stated the vacation of the alley will disrupt the route for solid waste disposal. Mr. John Versolenko, 15 "E" Street SE, Auburn, WA Mr. Versolenko asked for assurance the property will be developed for senior housing and not family housing. Mr. Versolenko stated he enjoys his home and is opposed to the property being developed as family housing because of an increased need for parking and increased noise. Planning and Community Director Paul Krauss stated no proposal for development of the property has been presented to the City yet. Mr. Krauss stated he anticipates the City will conduct a hearing on the senior housing proposal in a month or two. City Engineer Dennis Dowdy stated proponents of the development are present to speak to the necessity of the vacation of approximately 120 feet of the alley between "E" Street SE and "D" Street SE. Dino Price, 8746 South 113 Street, Seattle, WA Mr. Price displayed a preliminary site/landscape plan of the proposed development. Mr. Price stated the alley is in the center of the property proposed for development. Mr. Price stated there is not a great need for parking for seniors as he has discovered seniors on fixed incomes cannot afford automobiles and their related expenses. Mr. Price explained the proposed development includes utilizing parking off "D" Street SE near Parker Paints. Mr. Price also explained the proposed senior housing development will be subsidized by the federal government and will remain senior housing for the life of the building. In response to a question from Mr. Jim Nicholson, Mr. Price stated that according to his experience there is a small percentage of tenants of senior housing that can afford automobiles. Mr. Price also stated he believes seniors like to be in the core of the city where they are close to amenities. Page 4 City of Auburn Council Meetinq Minutes May 1, 1995 In response to a question from Mr. Spellman, Mr. Price stated this is the only piece of property in the downtown area available to accommodate the proposed development. Mr. Price stated that to his knowledge the only utility line located in the alley is a dead-end sewer line. Councilmember Haugen asked Mr. Price for the locations of other senior housing he developed. Mr. Price identified the following developments: a 92-unit development in Kent called Webster Court, a 100-unit in downtown Kent under construction, a 100-unit complex in Renton under construction, and a 74-unit complex in downtown Renton. Councilmember Haugen asked how many parking spaces will be provided as part of the proposed development in Auburn. Mr. Price stated he plans to provide more than one space per every four units. Madeleine Massey, 414 Riverview Drive NE, Auburn, WA Mrs. Massey confirmed with Mr. Price that parking will be available across "D" Street SE. Mr. Price responded in the affirmative. Michelle Boyd, 17825 SE 311th, Auburn, WA Miss Boyd asked if the developer considered the high traffic area and the safety of citizens in such a high traffic area. Mr. Price stated consideration was given to these concerns, but seniors prefer to be close to amenities and accessible to public transportation. In response to a question from Mr. Spellman, Mr. Price displayed an illustration of a building in Kent which he said is very similar to the one proposed for Auburn. Mr. Price stated the building is a four-story structure. Motion by Councilmember Wagner, second Councilmember Burns to close the public hearing. by MOTION CARRIED UNANIMOUSLY. 4-0. Audience Participation Mr. Jim Farrell, Auburn High School teacher, introduced the following Auburn High School Civics students in attendance this evening to observe the City Council meeting: Michelle Boyd, Corey Martin, Nathan Rawlings, Matt Sugarbaker, Matt Olsen, Kelly Wiesner, and Ruth Gordon. Mayor Booth asked for citizen participation. There were no other requests for recognition. C. Correspondence 1. Letter dated April 18, 1995 to Mayor Booth and Councilmembers from Sharon Mattioli regarding Comprehensive Plan Policy CE-10. A petition filed on May 1, 1995 by residents of "M" Street NE and 17th Street NE in Auburn with regard to a recreational vehicle located in a single family residential neighborhood. III. COUNCIL COMMITTEE REPORTS Municipal Services Mayor Booth noted the regularly scheduled Municipal Committee meeting for this afternoon was canceled. Services Planning & Community Development Chair Burns reported the Planning and Community Development Committee has not met since the last City Council meeting. The next regular meeting of the Planning and Community Development Committee is scheduled for Monday, May 8, 1995 at 7:30 p.m. In response to a question from Mayor Booth, Planning and Community Development Director Krauss advised there is an unusual hearing tentatively scheduled for the Planning and Community Development Committee meeting on May 8, 1995. Mr. Krauss explained a property owner has requested open space designation for his property for tax purposes. Mr. Krauss stated it requires three members of the City Council as well as three members of the County Council to authorize the designation. Public Works Chair Wagner reported the Public Works Committee met on April 24, 1995, and discussed the calls for public hearing on LID's 341 and 348, received a report on water rights, and continued the review of the Water Comprehensive Plan. The next regular meeting of the Public Works Committee is scheduled for Monday, May 8, 1995 at 5:30 p.m. Do Finance Chair Barber reported the Finance Committee reviewed claims and payroll vouchers and recommends their approval. The next regular meeting of the Finance Committee is scheduled for Monday, May 15, 1995 at 7:00 p.m. CONSENT AGENDA Ao Minutes 1. Minutes of the April 17, 1995 regular Council meeting. B. Vouchers F4.9.2, F4.9.5 Claims check numbers 101203 through 101531 in the amount of $772,914.63 and dated May 1, 1995. Payroll check numbers 214562 to 214893 in the amount of $728,823.09 and Direct Payroll Deposit transmissions in the amount of $160,305.52 for a grand total of $889,128.61 for the pay period covering April 8, 1995 to April 21, 1995. Utility Billin,q Adiustment F4.5.2 Recommend approval of utility adjustment to the account number 3.12.1770 in the amount of $3,779.86. D. Contract Administration Proiect No. 505 04.9.1 PR 505 Request permission to advertise for bids for Public Work Project No. 505 Contract 95-07, Auburn Way North, 4th to 15th Street NE. Councilmember Haugen abstained from voting, and her vote is counted with the majority. ~ UNFINISHED BUSINESS - None. NEW BUSINESS - None. ORDINANCES AND RESOLUTIONS A. Ordinances Ordinance No. 4742 O3.3.1, 03.8 REZ0009-90 An Ordinance of the City Council of the City of Auburn, amending Ordinance No. 4627 by revising Condition 8.K.3 that required the developer to provide landscaping along the interurban trail prior to occupancy of Phase I of the Supermall. Ordinance No. 4742 was removed from 'the agenda under Item I.D of these minutes. Ordinance No. 4743 03.10.3 MIN0001-90 An Ordinance of the City of Auburn, Washington, approving amendments to the surface mining permit to allow additional excavation of material to accommodate the construction of Lakeland Hills Divisions 9, 10, 12, 13, and 14 within the Lakeland Hills development located south of the Stuck River within the City of Auburn, Washington, and repealing Auburn City Ordinance No. 4732 adopted March 20, 1995. Motion by Councilmember Burns, second by Councilmember Wagner to introduce and adopt Ordinance No. 4743. MOTION CARRIED UNANIMOUSLY. 4-0. Page 8 City of Auburn Council Meetinq Minutes May 1, 1995 Ordinance No. 4744 04.9.1 PR 505, Contract 95-07, F5.2.14 An Ordinance of the City Council of the City of Auburn, Washington approving State Urban Arterial Board Grant Funds with Local Matching Funds as provided in the Urban Arterial Board Project Agreement between the City and the Washington State Urban Arterial Board for roadway widening and construction Auburn Way North and installation of related utilities from 4th Street NE to 15th Street NE. Motion by Councilmember Wagner, second by Councilmember Haugen to introduce and adopt Ordinance No. 4744. MOTION FAILED. 2-2. Councilmembers Burns and Haugen voted no. City Attorney Reynolds pointed out that Ordinance No. 4744 approves the grant funds related to the construction project approved as Consent Agenda Item IV.D. 1 of these minutes. City Attorney Reynolds respectfully suggested that Council approve the grant funds at the time of calling for bids. Councilmember Burns stated staff should be prepared for reconsideration of Ordinance No. 4744 at the next City Council meeting. Resolutions Resolution No. 2628 F2.4.9 LID 341 A Resolution of the City of Auburn, Washington, fixing a time and place for hearing on the final assessment roll for Local Improvement District No. 341, and directing that notice thereof be given in the manner required by law. Motion by Councilmember Wagner, second Councilmember Haugen to adopt Resolution No. 2628. by MOTION CARRIED UNANIMOUSLY. 4-0. Page 9 City of Auburn Council Meetinq Minutes May 1, 1995 Resolution No. 2629 F2.4.9 LID 348 A Resolution of the City of Auburn, Washington, fixing a time and place for hearing on the final assessment roll for Local Improvement District No. 348, and directing that notice thereof be given in the manner required by law. Motion by Councilmember Wagner, second Councilmember Haugen to adopt Resolution No. 2629. by MOTION CARRIED UNANIMOUSLY. 4-0. Resolution No. 2637 O4.11 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an Agreement for Professional Services between the City and McGowan Broz Engineers, Inc., for the purpose of designing the Academy pressure rezone project including the selection of a city-wide standard pressure reducing station. Motion by Councilmember Wagner, second Councilmember Haugen to adopt Resolution No. 2637. by MOTION CARRIED UNANIMOUSLY. 4-0. Resolution No. 2640 03.5 PLT0005-90 A Resolution of the City Council of the City of Auburn, Washington, amending the Preliminary Plat of Lakeland Hills development located south of the Stuck River, within the City of Auburn, Washington, and repealing City of Auburn Resolution No. 2622, dated March 20, 1995. Motion by Councilmember Burns, second by Councilmember Haugen to adopt Resolution No. 2640. MOTION CARRIED UNANIMOUSLY. 4-0. Page 10 City of Auburn Council Meetinq Minutes May 1, 1995 VIII. MAYOR'S REPORT A. Executive Session Mayor Booth recessed the regular meeting to Executive Session at 8:18 p.m. for approximately forty-five minutes in order to discuss litigation, contract review, and personnel matters. At 9:08 p.m. Mayor Booth reconvened the regular meeting. IX. ADJOURNMENT There being no further business to come before the City Council, the meeting adjourned at 9:08 p.m. Charles A.
