Mayor Booth reconvened the August 21, 1995 meeting at 7:30 p.m.
and led those in attendance in the pledge of allegiance.
Roll Call
Those in attendance included Mayor Booth and members of the
Auburn City Council as follows: Pat Burns, Rich Wagner, Virginia
Haugen, Trish Borden, Jeanne Barber, Stacey Brothers, and Don
Kurle.
Staff members present included: Police Chief Dave Purdy,
Assistant Fire Chief Monroe Shropshire, Personnel Director
Brenda Kennedy, Parks and Recreation Director Len Chapman,
Finance Director Victor Thompson, Public Works Director Frank
Currie, Utilities Engineer Dwight Holobaugh, Assistant Planning
Director Lynn Rued, City Attorney Michael Reynolds, and Deputy

C. Announcements and Appointments
1. Announcements
a)
Puget Power Outage
Mayor Booth announced he received a letter from the
General Manager of South King County Puget Power
and read the letter aloud for the benefit of the
audience. The letter expressed regret for the
inconvenience of the power outage which occurred
during the August 21, 1995 City Council meeting, and

further explained the power outage was due to a
small animal which entered the transformer which
provides service to City Hall.

There were no appointments for consideration.

A. Public Hearings
Application No. V-01-95
03.9 V-01-95
A petition filed by Stevens Tire Sales and Cenex Supply &
Marketing Inc., to vacate the alley south of 8th Street SE
and east of "D" Street SE. All persons interested in said
petition may voice their opinion during this public hearing.
Mayor Booth opened the public hearing and requested
public comment either for or against the petition for
vacation. There were no requests from the audience for
recognition.
Motion by Councilmember Wagner, second
Councilmember Burns to close the public hearing.

B. Audience Participation
M. ary Farden, 2005 "M" Street SE, Auburn, WA
Ms. Farden addressed the City Council regarding Ordinance
No. 4783 which provides for increasing the speed on 37th
Street SE. Ms. Farden asked which section of 37th Street
SE will be affected by the ordinance. Public Works Director
Currie explained the speed increase is proposed for 37th
Street SE from "M" Street to "A" Street. Ms. Farden stated

the proposal to increase the speed limit is a concern to her
as there are two schools in the area. Ms. Farden stated she
lives on a 25 mph freeway. She stated the police protection
is not adequate, and the speed limit is not enforced. Ms.
Farden asked the City Council members to consider the
safety of the school children before voting in favor of the
ordinance.
Porter Si,qler, 802 - 37th Street SE, Auburn, WA
Mr. Sigler stated he lives in the area for the proposed
change of speed limits. Mr. Sigler stated that increasing the
speed limit to 35 mph on the curves on 37th Street between
the two schools would be hazardous to drivers entering the
street from cross streets or other accesses. Mr. Sigler
stated the majority of the population living on 37th Street
consists of young families with very young children and
elderly people. Mr. Sigler asked that the ordinance be
tabled this evening and returned to committee for further
study.
Julia Greely, 11260 SE 325th Street, Auburn, WA
Ms. Greely stated she is a board member of the Domestic
Abuse Women's Network (DAWN). Ms. Greely reported
some of the highlights from the first half of 1995 as they
apply to the City of Auburn. Ms. Greely stated 249 calls
were made to DAWN's 24-hour crisis line. Ms. Greely
stated 47 women with 91 children had intakes with the
Auburn advocate enabling them to receive all DAWN
services such as support and legal clinics. Ms. Greely also
stated 18 women were helped by their legal advocate and
two women and one child received shelter at DAWN's
House, which equates to 17 bednights and 52 meals. Ms.
Greely added that 33 residents requested shelter at
DAWN's House but 31 of them were turned away because
of lack of facilities or because they would be safer in another
area. She stated, overall DAWN turned away 766 women in
the first quarter of 1995 while at the same time sheltering 63
women and 85 children. Ms. Greely also reported that on
July 1, 1995 DAWN's House expanded its capacity by 75%,
adding nine beds for a total of 21 which were filled very
quickly. Ms. Greely thanked the City of Auburn for its
support of DAWN Community Office and DAWN's House,

and the City's leadership in addressing the issue of
domestic violence.
In response to a question from Councilmember Kurle, Ms.
Greely stated that the 766 women turned away in the first
quarter of 1995 were all from the South King County area.
C. Correspondence
There was no correspondence other than as announced by Mayor
Booth under Item I.C.1 of these minutes.
COUNCIL COMMITTEE REPORTS
Municipal Services
Chair Brothers deferred to Vice Chair Barber for the report on the
last Municipal Services Committee meeting. Vice Chair Barber
reported the Committee met yesterday and discussed the new
COPS Fast Program presented by Police Chief Purdy. The next
regular meeting of the Municipal Services Committee is scheduled
for Tuesday, September 5, 1995 at 4:30 p.m.
Planning & Community Development
Chair Burns reported the Planning and Community Development
Committee met August 14, 1995, and the matters discussed are
public record. Chair Burns noted that the Committee directed staff
to develop a Planned Unit Development ordinance that is designed
to allow different standards for lot size, setback requirements, and
other related standards for the Henderson Home development area
because of its size and because of the encouragement of the
Growth Management Act for greater, use of housing patterns in
urbanized areas. Chair Burns stated the City Council can
anticipate the ordinance in the near future. The next regular
meeting of the Planning and Community Development Committee
is scheduled for Monday, August 28, 1995 at 7:30 p.m.
Public Works
Chair Wagner stated the Public Works Committee met on August
14, 1995, and considered the speed limit change on 37th Street
SE. Chair Wagner reported the Committee received updates on
the Water Comprehensive Plan and the Transportation
Comprehensive Plan. The Committee also received an update on
the Thormod site, which is the wetlands the City will acquire as a

result of the racetrack project. Chair Wagner reported the
Committee also discussed contract items. The next regular
meeting of the Public Works Committee is scheduled for August
28, 1995 at 5:30 p.m.

Finance
Chair Barber stated the Finance Committee received an update
from Mayor Booth and Personnel Director Kennedy on the
preparation for the Council work session on city-wide goals which
is scheduled for August 30, 1995, at 4:30 p.m. Chair Barber stated
the Committee also reviewed claims and payroll vouchers, and
requests their approval by the City Council. The next regular
meeting of the Finance Committee is scheduled for Tuesday,
September 5, 1995 at 7:00 p.m.

ORDINANCES AND RESOLUTIONS
A. Ordinances
Ordinance No. 4782
03.9 V01-95
An Ordinance of the City Council of the City of Auburn,
Washington, approving the vacation of the alley south of 8th
Street SE and east of "D" Street SE, within the City of
Auburn, Washington.
City Attorney Reynolds noted that the word "obtain" in
Section 3 of Ordinance No. 4782 should be "retain".
Motion by Councilmember Wagner, second by
Councilmember Kurle for the introduction and adoption of
Ordinance No. 4782.
Councilmember Borden noted that in the staff report Traffic
Engineer Mullen questioned alley access for the other two
parcels. Councilmember Borden asked if both owners agree
with the alley vacation. Public Works Director Currie stated
the turnaround was not necessary and stated the ordinance
contains a condition for a lot line adjustment.

Councilmember Haugen stated she does not feel
comfortable with the ordinance. In response to a question
from Councilmember Haugen, Public Works Director Currie
stated there are no other property owners adjacent to the
alley other than those who petitioned for the alley vacation.
MOTION CARRIED. 6-1. Councilmember Haugen voted
rio.
Ordinance No. 4783
A3.5.5.10, O4.10
An Ordinance of the City of Auburn, Washington, amending
Auburn City Code Chapter 10.12 Traffic Regulations,
Section 10.12.110 Increases arid Decreases on Arterials.
(Increases the speed on 37th Street SE from 25 mph to 35
mph.)
Councilmember Wagner stated, if the ordinance is passed, it
will be reviewed by the Public Works Committee in
December, not by staff as is noted in the agenda bill.
Motion by Councilmember Wagner to introduce and adopt
Ordinance No. 4783 amended to read 30 mph instead of 35
mph. Motion was seconded by Councilmember Kurle.
Councilmember Wagner stated the ordinance was debated
at length in Committee. Councilmember Wagner stated the
improvements were done to 37th Street for safety reasons.
He also stated the speed increase was debated with the
traffic engineers and other engineers who have already
measured traffic on the street. Chair Wagner stated he is
not comfortable that all the data is exact, therefore the
Public Works Committee is requesting a review in
December. Councilmember Wagner noted that the areas
around the school are posted for 20 mph when children are
present which encompasses most of the street and the
curves on 37th Street.
Councilmember Kurle stated that in discussions in
Committee, it was pointed out that the street has been
upgraded and can probably accommodate 35 mph, the
sidewalks are wide, and the street will be posted for 20 mph

when children are present. Councilmember Kurle stated 30
mph is a reasonable compromise. He also stated he is
uncomfortable with a 35 mph speed limit in the area of the
schools, but believes 25 mph is unrealistic. Councilmember
Kurle noted the Public Works Committee will review the
speed limit again in December.
Councilmember Barber stated she is more comfortable with
30 mph until it is re-evaluated. Councilmember Barber
stated one of the reasons the improvements were made to
37th Street SE was for the safety of the children.
Councilmember Brothers stated his concern is that the
improvements to 37th Street in the beginning were larger in
scope. He stated the road surface has been narrowed some
from the original plan and the street consists of some
curves. Councilmember Brothers compared the street to
wider streets such as East Main Street which is posted as
25 mph. He stated he sees no reason why the street should
not be posted at 25 mph because two schools front the
street. Councilmember Brothers stated he will not support a
decrease from 35 to 30 mph, and supports a 25 mph speed
limit.
Councilmember Haugen stated she agrees with
Councilmembers Borden, Barber and Kurle.
Councilmember Haugen stated she believes a 30 mph
speed limit is more realistic.
Councilmember Borden asked whether the speed limit can
remain at 25 mph until it is reviewed again in December.
Councilmember Wagner stated consideration was given to
leaving the speed limit at 25 mph. He stated the traffic
engineers argued that 35 mph was the correct speed limit
for the street and that many of the drivers will exceed the 30
mph speed limit. Councilmember Wagner stated the data
received will be from a radar gun and taken from many
places along 37th Street at different times of the day.
Councilmember Wagner stated the Committee wanted to
consider advice of the engineers but did not agree with their
exact recommendation.

Councilmember Kurle stated one of the ways staff
recommends a speed limit is to monitor the existing traffic on
the street and then recommends a speed at approximately
the 85 percentile. Councilmember Kurle stated a
compromise of 30 mph is recommended because of the
schools.
MOTION CARRIED. 5-2. Councilmembers Borden and
Brothers voted no.
Ordinance No. 4784
A3.13.4
An Ordinance of the City Council of the City of Auburn,
Washington, providing authority for the Mayor to enter into
all agreements necessary for the purchase of "Fenster
Parcel No. 215400-0133".
Motion by Councilmember Burns, second by Councilmember
Wagner for the introduction and adoption of Ordinance No.
4784.
MOTION CARRIED UNANIMOUSLY.
Ordinance No. 4785
03.5 PLT0001-94, O3.10.3 MIN0001-94
An Ordinance of the City of Auburn, Washington, amending
Ordinance No. 4725, Section 4, to clarify conditions for the
type of barricading during construction and after completion
of construction for a surface mining permit to allow the
excavation of approximately 220,000 cubic yards of material
to accommodate construction of a 176 lot single family
residential subdivision within the City of Auburn,
Washington, by Centex Real Estate Corporation.
Motion by Councilmember Burns, second by Councilmember
Barber for the introduction and adoption of Ordinance No.
4785 as presented in this evening's agenda modification.
Councilmember Barber stated the ordinance does not
change the original ordinance but merely clarifies the
language. Councilmember Barber stated the original
language is misleading, and the new language clarifies the

intent of the City Council at the time the ordinance was
adopted.
Councilmember Borden suggested additional language to
clarify the ordinance further. Councilmember Borden
suggested the ordinance reflect the language "permanently
locked and barricaded".
Councilmember Barber noted the language in Ordinance
No. 4785 states "shall remain locked and barricaded", and
she interprets the language to mean permanent.
Councilmember Burns stated he is comfortable with the
language in the ordinance as presented.
Councilmember Haugen stated she is in favor of adding the
word "permanent".
Councilmember Brothers stated he believes the intent of the
City Council at the time the ordinance was adopted was that
the barricade shall be permanent, and he is satisfied with
the language contained in Ordinance No. 4785 as
presented.
Councilmember Wagner stated he voted against Ordinance
4725 because he wanted the project sent back to the
drawing board to eliminate the steep street that enters the
Riverwalk subdivision, which in the future may cause the
residents of the subdivision to lobby the City Council to
remove the barricades. Councilmember Wagner stated he
supports Councilmember Borden's proposal to make it very
clear that it is not the City Council's intent to open the
barricades.
Councilmember Haugen stated she will not vote for the
ordinance if the word "permanent" is not included.
Councilmember Burns stated the addition of the word
"permanent" does not guarantee that in five years another
City Council will not move to change it. Councilmember
Burns stated he believes inserting the word "permanent" is
in conflict where it is contemplated there will be access for
emergency vehicles if needed. Councilmember Burns

stated he believes the language in the ordinance is
consistent with what the City Council ruled and is consistent
with the public safety needs.
MOTION CARRIED. 4-3. Councilmembers Borden, Haugen
and Wagner voted no.
Resolutions
Resolution No. 2663

Washington, authorizing the Mayor and City Clerk to

Motion by Councilmember Wagner, second

Resolution No. 2665

A Resolution of the City Council of the City of Auburn,
Washington, amending Resolution No. 2587, Section 5 to
clarify the type of barricading during construction and after
completion of construction as a required condition approving
the preliminary plat of the 176 lot single-family subdivision
known as "Riverwalk" located south of Howard Road, north
of Game Farm Park, within the City of Auburn, Washington.

Motion by Councilmember Burns, second by Councilmember
Barber to adopt Resolution No. 2665 as presented in this
evening's agenda modification.
In response to a question from Councilmember Borden, City
Attorney Reynolds explained there exists a Resolution
approving the Riverwalk plat and there exists an Ordinance
approving the Riverwalk mining permit. The two documents
contain the same condition, and in order to be consistent, it
is necessary to amend both the ordinance and the
resolution.
MOTION CARRIED. 6-1. Councilmember Wagner voted
rio.
MAYOR'S REPORT
There was no report from Mayor Booth.
IX. ADJOURNMENT
There being no further business to come before the City Council, Mayor
Booth adjourned the meeting at 8:09 p.m.
