Roll Call Those in attendance included Mayor Booth and members of the Auburn City Council as follows: Pat Burns, Rich Wagner, Virginia Haugen, Trish Borden, Jeanne Barber, Stacey Brothers, and Don Kurle. C. Announcements and Appointments 1. Announcements a) Comprehensive Transportation Plan City Engineer Dowdy explained that the various charts displayed in the Council Chambers are related to the Comprehensive Transportation Plan, and are displayed as part of the public comment process. The charts will be displayed for the next few weeks to familiarize the public with the Transportation Plan. Page I City of Auburn Council Meetinq Minutes December 18, 1995 I1. Appointments There were no appointments for consideration this evening. Agenda Modifications Agenda modifications include the addition of the December 11, 1995, Public Works Committee meeting minutes transmitted under Item III.D of these minutes; a request to contract for emergency sewer repairs transmitted under Item IV.C.5 of these minutes; a request to surplus found/unclaimed property transmitted under Item IV.F.1 of these minutes; a request to surplus Police Department equipment transmitted under Item IV.F.2 of these minutes; the addition of Resolution No. 2692 under Item VII.B.3 of these minutes; the renumbering of Resolution No. 2693 transmitted under Item VII.B.4 of these minutes; and the inclusion of the 1994 City of Auburn Audit Report transmitted under Item VIII.A of these minutes. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings 1995 Comprehensive Plan Amendments 03.4.3, O3.4.1.8, O3.4.1.5 Amendments are proposed to the City of Auburn Comprehensive Plan. The Comprehensive Plan serves as a policy framework which guides future City decisions and actions. The Comprehensive Plan amendments include clarification of the City's policies on mineral resource lands, expansion of the area designated as Downtown Auburn, correct minor technical mapping and text errors, and expand the plan map to include the potential annexation areas. Other Comprehensive Plan amendments include the Airport Master Plan and Comprehensive Water Plan, and four Map amendments at the Thomas Academy; the northeast corner of West Valley Highway and 37th Street NW; church property along 'M" Street SE and north of Auburn Way South; and West Main between G Street SW and H Street NW. The Plan amendments have been recommended for adoption by the City of Auburn Planning Commission. Mayor Booth opened the public hearing, and requested Senior Planner Bob Sokol make a presentation on the 1995 Comprehensive Plan amendment. Page 2 City of Auburn Council Meetinq Minutes December 18, 1995 Senior Planner Sokol explained that staff have worked with the Planning Commission, the Planning and Community Development Committee, and property owners to draft the Comprehensive Plan Map and text amendments presented this evening. The City Council adopted the Growth Management Comprehensive Plan earlier this year, and the City is required to meet the Growth Management Act requirement which allows Comprehensive Plan amendments once per year. The Plan amendments include the City's Comprehensive Water Plan and the Airport Master Plan. The proposed amendments are contained in the Planning and Community Development Committee's Recommended Comprehensive Plan Amendments dated December 11, 1995, and include Map 14.1, the Comprehensive Plan Map, and the Lakeland Hills South Special Planning Area map. Senior Planner Sokol stated the amendments update and clarify the policy on mineral resource lands, expand the area considered as downtown Auburn, expand the Comprehensive Plan Map to include Potential Annexation Areas, include the Airport Master Plan and the Water Comprehensive Plan, amend the Comprehensive Plan Map in four specific locations, and refine and clarify policy concerning the designation and development of industrial land throughout the city and near the Supermall. Senior Planner Sokol stated there is an additional change which is an amendment to Map 11.1 to add the 25-acre, city-owned "Clark" property located at the intersection of Oravetz Road and Kersey Way under the Open Space designation, and he requested that the City Council include this change in the amendments this evening. Senior Planner Sokol reported the Planning Commission voted November 17, 1995 to recommend adoption of the proposed Comprehensive Plan amendments. The Planning and Community Development Committee further revised the proposed amendments, and the Committee recommends adoption of the amendments. Councilmember Borden questioned the proposed amendment to LU-74. Senior Planner Sokol stated LU-74 is a policy that was adopted with the Comprehensive Plan and Page 3 .City of Auburn Council Meetinq Minutes December 18, '199,~ is also a reflection of the policy the City Council adopted with the rezone for the Supermall. Senior Planner Sokol stated the amendment is essentially a clarification of City policy concerning lands near the Supermall. He pointed out that the Zoning Ordinance provides that land zoned as light manufacturing could be easily designated or rezoned as Planned Business Park. Senior Planner Sokol explained LU-IO0 is a policy that states highly visible areas which tend to establish the image of the city should not be used by heavy industrial uses. The previous language, which stated highly visible areas should be reserved for light industrial, was misinterpreted to mean that all highly visible areas in the city should be light industrial. Senior Planner Sokol pointed out that the include slight changes in the light industrial heavy industrial district. amendments district and In response to a question from Councilmember Borden, Senior Planner Sokol explained that a business park is defined in the Zoning Ordinance, and permitted uses are only those uses specifically authorized in the contract rezone as approved by the Hearing Examiner and the City Council, and any of the uses listed as permitted administrative and conditional uses in the M-1 zone and those listed as permitted in a C-3 zone. A business park provides the City more control over a development to ensure better quality and consistent architecture and better control over signage. Planning and Community Development Director Krauss added that the area near the Supermall is subject to other overriding policies in the Comprehensive Plan which originated with the City Council at the time the Supermall was approved. Councilmember 'Haugen requested an explanation of "compact urban development", "planned unit development", and "enhanced design features." Senior Planner Sokol stated compact urban development means higher density, but not necessarily multi-family, and mixed uses. Enhanced design features include better landscaping and architecture standards. Planning and Community Development Director Krauss explained that the 1995 Airport Master Plan updates the 1978 Airport Master Plan. The Plan will guide future enhancements, operation of the facility, and is required to maintain eligibility for Federal Aviation Administration grants. The Plan discusses several airport enhancements and also establishes goals and policies for the airport. Planning and Community Development Director Krauss pointed out that the Plan does not call for any runway construction. The Plan identifies the role of the airport as a field which is optimally designed to benefit the community by serving general aviation aircraft. The Plan seeks to improve safety and operations in several ways. It calls for obtaining instrument approach technology, enlarging runway safe zones, and repairing hangar roofs. Planning and Community Development Director Krauss advised that the Airport Advisory Board is reviewing a possible public/private partnership for the construction of new hangar space in the northeast section of the airport. Stan Allison, W & H Pacific Mr. Allison represents W & H Pacific, the consulting firm retained by the City of Auburn to work on the Airport Master Plan. Mr. Allison stated the Auburn Airport is currently classified as an Airport Reference Classification (ARC) B2 airport by the Federal Aviation Administration. The ARC classification relates to the approach speed and the wing span of an aircraft. Mr. Allison stated the runway is 3400 feet long and 75 feet wide, and the airport does not have the runway length to accommodate business or corporate-type jets. The Plan is designed around the general aviation aircraft it currently serves and recommends a number of safety improvements in accordance with Federal Aviation Administration design criteria. Mr. Allison stated the City will be undertaking a Phase 2 Master Plan update in order to maintain eligibility for Federal Aviation Administration grants. However, the available funding for FAA Airport Improvement Program grants has been significantly reduced by Congress. Motion by Councilmember Burns, second by Councilmember Wagner to introduce and adopt Ordinance No. 4814. Councilmember Borden stated she has concerns with the amendments in LU-74 because it appears to open the door to more rezones in the area of the Supermall. Councilmember Borden suggested referring the amendment of LU-74 to Committee for discussion. Councilmember Burns stated the proposed amendment to LU-74 was discussed during consideration of the rezone and the Comprehensive Plan amendment which allowed the Supermall. Councilmember Burns stated the concept at that time was that there would be room for a limited amount of sprawl, but the limitations would be mostly geographical. The proposed Comprehensive Plan amendment allows commercial development within those geographical boundaries. Any rezone or conditional use permit application will require Council consideration and approval. Councilmember Burns stated he is opposed to returning the proposed amendment to Committee. Councilmember Borden stated she believes the proposed amendment relaxes the effect of LU-74. Senior Planner Sokol pointed out paragraph "a." of LU-74 which limits the type of development to office, entertainment or other uses which complement the uses at the Supermall and would allow retail uses in limited instances and only if incidental and subordinate to another use on the site. Councilmember Haugen stated she is in agreement with Councilmember Borden with regard to LU-74. Councilmember Kurle stated he believes the effect of the proposed Comprehensive Plan amendment would allow a possible rezone to business park designation. Page 6 City of Auburn Council Meetinq Minutes December 18, 1995 Senior Planner Sokol pointed out that the proposed amendment to LU-74 is consistent with the current Zoning Ordinance. Councilmember Borden stated she would prefer to consider the amendment to LU~74 more thoroughly. In response to questions from Councilmember Kurle, Senior Planner Sokol explained that the business park zone provides the City the ability to work with the developer to create a mutually agreeable development. Permitted commercial uses would be those permitted in a Mol zone. Planning and Community Development Director Krauss added that a business park designation allows for a greater range of uses. A business park designation would require a contractual rezone subject to City Council approval. In response to a question from Councilmember Wagner, Senior Planner Sokol quoted from the Zoning Ordinance regarding business parks. He stated a business park district may be applied to any part of the city designated as region serving in the Comprehensive Plan which is zoned commercial or industrial. MOTION CARRIED. 5-2. Haugen voted no. Councilmembers Borden and Audience Participation Robert Keever, 10812 -290th Street SE, Auburn, WA Mr. Keever stated he lives on Lea Hill. Mr. Keever thanked Mayor Booth, Councilmembers, Councilmembers-elect, and department directors for their attendance at the Lea Hill pre- annexation meeting. Mr. Keever stated their attendance was appreciated by the residents. He presented a copy of the audio tape of the meeting to City Clerk Wohlhueter. Mr. Keever also complimented the City and staff on their presentation and display at the North Auburn-Lea Hill Transportation workshop. Mr. Keever stated there is considerable interest in establishing a Lea Hill Citizens Advisory Committee to facilitate a dialogue among the residents of the future annexation area of Lea Hill. She thanked the City officials for their participation at the Lea Hill pre- annexation meeting. John Raeder, 4102 B Place NW, Auburn, WA Mr. Raeder, on behalf of the Board of Directors of the Chamber of Commerce, thanked outgoing Councilmembers Haugen, Kurle and Burns for their dedication and effort during their tenure on the City Council. Correspondence There was no correspondence for City Council review. COUNCIL COMMITTEE REPORTS Municipal Services Chair Brothers reported the Municipal Services Committee met this afternoon at 4:30 p.m. Chair Brothers reported the Committee reviewed the Legislative Agenda presented by Intergovernmental Affairs Manager Lisa Clausen, reviewed and recommends City Council approval of Ordinance No. 4825 approving Department of Ecology grant funds to facilitate and promote a recycling and composting program, discussed the acquisition of a new fire pumper, and recommends the surplus and disposition of unclaimed bicycles and unused lockers. The next regular meeting of the Municipal Services Committee is scheduled for January 2, 1996. Planning & Community Development Chair Burns reported the Planning and Community Development Committee has not met since the last City Council meeting. The Planning and Community Development Committee will not meet on its next regularly scheduled meeting date of December 26, 1995. Mayor Booth thanked Councilmember Burns for his service on the Planning and Community Development Committee. Public Works Chair Wagner reported the Public Works Committee met December 11, 1995 at 5:30 p.m. He noted that 15 candidates for the Miss Auburn title were in attendance at the meeting. Chair Wagner reported the Committee discussed a number of budget Page 8 City of Auburn Council Meetinq Minutes December 18, 1995 IV. adjustment items related to grants, updated the flood hazard area ordinance, and reviewed the speed limit on 37th Street SE. Chair Wagner stated the regular Public Works Committee meeting scheduled for December 26, 1995 may be canceled. The first 1996 regular meeting of the Public Works Committee is scheduled for January 8, 1996. Finance Chair Barber reported the Finance Committee met this evening at 7:00 and discussed Ordinance No. 4805, Ordinance No. 4824, Ordinance No. 4826, Resolution No. 2691, and Resolution No. 2692. Chair Barber reported the Committee recommends City Council approval of claims and payroll vouchers as they appear on tonight's agenda. The next regular meeting of the Finance Committee is scheduled for January 2, 1996. CONSENT AGENDA A. Ordinance No. 4818 F5.4.4, 04.10.2 An Ordinance of the City Council of the City of Auburn, Washington, approving Federal ISTEA Grant Funds with local matching funds as provided in the Local Agency Agreement between the City and the Washington State Department of Transportation to prepare and implement the signal interconnect system. Motion by Councilmember Wagner, second by Councilmember Burns to introduce and adopt Ordinance No. 4818. In response to a question from Councilmember Brothers, Public Works Director Currie explained that the ordinance is necessary as a housekeeping measure required by the State Auditor to authorize the appropriation and expenditure of the grant funds. MAYOR'S REPORT 1994 City of Auburn Audit Report Mayor Booth noted that a copy of the City's 1994 Audit Report is transmitted as part of this evening's agenda modifications. City Council Recognition Mayor Booth presented each Councilmember with commemorative plaques of significant projects completed during their tenure on the City Council. The plaques commemorate such accomplishments and events as the Muckleshoot Casino grand opening, Downtown Association achievements, and the Supermall. Mayor Booth presented a commemorative plaque to Councilmember Don Kurle in honor of over 13 years of service on the City Council. Councilmember Kurle stated that Auburn is a better place than when he first took office and conveyed his thanks to the City of Auburn staff for their support over the years, Councilmember Kurle and Mayor Booth presented Councilmember Burns with a commemorative plaque in honor of 11 years of service on the Auburn City Council. Councilmember Burns stated it has been an honor to serve the citizens Auburn and be a part of the city and its government. Mayor Booth noted that Councilmember Burns has given distinguished service on a number of King County, regional, and state committees and commissions, and his presence will be missed. Councilmember Kurle and Mayor Booth presented Councilmember Haugen with a plaque commemorating her two years of service on Page 18 City of Auburn Council Meetinq Minutes December t8, 1995 the City Council. Councilmember Haugen thanked each of her fellow Councilmembers individually. Executive Session City Attorney Reynolds asked whether the City Council would like to continue this evening's meeting to next week in order to discuss a settlement agreement regarding litigation between the City and Primark. There was no motion to continue the meeting to next week. Muckleshoot Indian Tribe Councilmember Burns referred to an article appearing in the Valley Daily News November 30, 1995, which reported on Governor Lowry's proclamation revoking the State's criminal and civil jurisdiction over the Muckleshoot Indian people, the Muckleshoot Reservation, territory, lands and country, and all persons being and residing therein. The article also stated that retrocession will allow the Tribe to have its own tribal police department. City Attorney Reynolds stated that the tribal police department will have jurisdiction over tribal members only. Police Chief Purdy added that the Auburn Police Department is maintaining primary and first response as a law enforcement agency for the reservation. The tribal police will respond if it involves identified tribal property or members of the Muckleshoot Tribe. IX.
