Flag Salute Mayor Booth called the meeting to order at 7:30 p.m. and led those in attendance in the Pledge of Allegiance. B. Roll Call Those in attendance included Mayor Booth and members of the City Council as follows: Rich Wagner, Sue Singer, Jeanne Barber, Trish Borden, Fred Poe, Gene Cerino, and Stacey Brothers. Staff members present included: Police Chief Dave Purdy, Fire Chief Bob Johnson, Personnel Director Brenda Kennedy, Parks and Recreation Director Len Chapman, Finance Director Diane L. Supler, Public Works Director Frank Currie, Planning and Community Development Director Paul Krauss, City Attorney Michael J. Reynolds, City Clerk Robin Wohlhueter, and Deputy City Clerk Dani Daskam. Page l City of Auburn Council Meeting Minutes April 1. 1996 II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings There were no public hearings scheduled for this evening. B. Audience Participation 1. Lisa Novak, 29226 118th Avenue SE, Auburn, WA, and Holly Miller, 31453 117th Place SE, Auburn, WA Ms. Novak stated the purpose of her and Ms. Miller's attendance this evening is to request the removal of time restricted parking zones on the streets surrounding Auburn High School. Ms. Novak stated that many of the high school students feel they should not be fined for parking in one of the 70 one and two-hour parking spaces around Auburn High School while they are attending school. She explained that students who do not arrive at school early enough to find a parking space among the 307 spaces allotted for the 1,628 potential high school drivers, must park on the street. Those who park on the street must find time during their class times or lunch to move their cars to avoid parking fines. Ms. Novak stated the purpose of one and two hour parking is to create parking spaces for local businesses. She noted the only local business in the vicinity of the high school is a television repair shop. Ms. Novak stated that today she distributed a petition regarding the parking problem among Auburn High School students, and in one day obtained nearly 300 signatures. She stated there are 305 parking spaces for 1,628 potential student drivers, and there are 153 parking spaces for less than 140 faculty members. Ms. Novak and Ms. Miller displayed a diagram of the parking areas surrounding the high school with the parking areas designated for student parking highlighted. She stated that although school starts at 7:45 a.m., the two parking lots for student parking are full by 7:15 a.m. The diagram also depicted the faculty parking area and the one and two-hour street parking. Ms. Miller stated students could face suspension or detention for leaving campus grounds during the day to move their parked cars. Ms. Miller stated she sees no benefit to the City to have the street parking in the vicinity of Auburn High School limited to one Page 2 City of Auburn Council Meeting Minutes April 1, 1996 and two-hour parking since the parking there is being used by the students. In response to questions from Councilmember Wagner, Ms. Miller stated there are approximately 70 on-street parking spaces consistently used by high school students. She stated the 70 on-street parking spaces will not solve the parking problems at Auburn High School, but the students who park there should not be fined for attending school. There will continue to be a parking problem at Auburn High School until additional parking areas or other alternatives are made available. Ms. Novak stated many students park along "J" Street, "H" Street and "G" Street which do not have limited time parking. Mayor Booth stated there may be fewer drivers attending Auburn High School next year when some students transfer to Riverside High School. Ms. Miller stated the tenth, eleventh, and twelfth grade students comprise the 1,628 figure for potential student drivers. She estimated 500-600 cars are parked in the parking lots and side streets each day. Ms. Novak stated there is a large number of students involved in after-school activities or who have jobs after school which make it necessary for the students to drive to school in order to accommodate their schedules. Councilmember Singer asked that the request be referred to the Public Works Committee. Mayor Booth stated the matter will be referred to the Public Works Committee for consideration, and Ms. Novak and Ms. Miller will be advised when the matter will be considered by the Committee. 2. Bob Cottrell, 3225 16th Street SE, Auburn, WA Mr. Cottrell stated he has had a problem with noise created by a neighbor for two and one-half years. Last year he spoke with Mayor Booth and the City Attorney regarding the matter, but nothing could be done. Mr. Cottrell stated that one of his neighbors living across the street holds "jam Page 3 City of Auburn Council Meeting Minutes April 1, 1996 sessions" at his house. The music can be loud at times, but the worst part is the bass which vibrates through the ground. Mr. Cottrell stated he has been referred to the State law regulated through the Department of Ecology. Mr. Cottrell stated the law appears to deal with industrial and commercial type noise and not residential noise. Mr. Cottrell stated the City of Kent controls noise by sending a police officer out with a decibel meter, and Mr. Cottrell asked why the City of Auburn cannot enact an ordinance to regulate noise. City Attorney Reynolds explained that some cities, including Auburn, made it a civil violation which is pursued civilly through pollution control violations. City Attorney Reynolds stated that Ordinance No. 4855 is before the City Council this evening, which adopts by reference Chapter 9.66 RCW. Chapter 9.66 RCW provides that a criminal violation occurs if the peace of more than one person is disturbed. If the ordinance is passed, it will enable the City's Police Department to issue a criminal citation for a violation. Mr, Cottrell requested a copy of the proposed ordinance and Chapter 9.66 RCW adopted by reference. C. Correspondence There was no correspondence for City Council review. Ill. COUNCIL COMMITTEE REPORTS A. Municipal Services Chair Brothers reported the Municipal Services Committee met this afternoon at 4:30 p.m. The Committee recommends City Council approval of Ordinance No. 4847, relating to a waste reduction and recycling program grant; Ordinance No. 4853, relating to a local hazardous waste program grant; and Ordinance No. 4855, relating to public nuisances. The Committee met with the City's cable television consultant and discussed the Telecommunications Act of 1996, received the annual report on the cable television franchise, and discussed the proposed TCI Cable rate increase. The next regular meeting of the Municipal Services Committee is scheduled for Monday, April 15, 1996 at 4:30 p.m. B. Planning & Community Development Chair Borden reported the Planning and Community Development Committee met March 25, 1996 at 7:30 p.m. The Committee Page 4 City of Auburn Council Meeting Minutes April 1. 1996 discussed the Community Development Block Grant (CDBG) ordinance, and will continue discussions on the ordinance April 8, 1996. A public hearing on the CDBG ordinance will be held April 15, 1996. The Committee recommends approval of an increase in cemetery fees which appears later in this evening's agenda. The Committee discussed the expansion of the Auburn Food Bank. The Committee also discussed Open Space Futures Funding. King County has requested the City submit requests for local projects for Open Space Futures Funding by April 30, 1996. The Committee will be prioritizing a list of potential projects at the April 8, 1996 Committee meeting. The Committee also discussed the library and potential locations for the library. The next regular meeting of the Planning and Community Development Committee is scheduled for April 8, 1996 at 7:30 p.m. C. Public Works Chair Wagner reported the Public Works Committee met on March 25, 1996. Public Works Committee items appearing on this evening's agenda include acceptance of ISTEA federal funds of $433,000 for pavement improvements and $75,000 in state funds to study the impacts of Burlington Northern projects within the city. The Committee discussed water rates and continued the water rate discussion at this evening's Public Works Work Session. Chair Wagner requested the City Council's support of the contract administration items appearing later on this evening's agenda. The next regular meeting of the Public Works Committee is scheduled for Monday, April 8, 1996 at 5:30 p.m. D. Finance Chair Barber reported the Finance Committee met this evening at 7:00 p.m. Finance Director Diane L. Supler presented a revenue update to the Committee. Chair Barber requested the City Council's approval of Resolution No. 2732 and claims and payroll vouchers. The next regular meeting of the Finance Committee is scheduled for April 15, 1996 at 7:00 p.m. IV. CONSENT AGENDA A. Minutes 1. Minutes of the March 18, 1996 regular City Council meeting. Contract Administration 1.Public Works Project No. 573A O4.9.1 a) City Council consideration on Change Order No. 1 in the amount of $77,333.31 for Public Works Project No. 573A according to Contract No. 95-19 with M,A. Segale, Inc. b) City Council to consider approval of the final pay estimate for Contract No. 95-19, PR 573A, Emerald Downs Roadway Improvements in the amount of $73,466.64. 2. Public Works Project No. 590 O4.9.1 Council consideration on the recommendation to award Contract 96-08 from the Small Works Project PR 590, S. Motion by Councilmember Barber, second by Councilmember Singer to approve the Consent Agenda as it appears on this evening's agenda. MOTION CARRIED UNANIMOUSLY. 7-0. V. UNFINISHED BUSINESS There were no items for City Council consideration under this section. VI. NEW BUSINESS A. Application No. CUP0014-95 O3.10.1 CUP0014-95 The request of Ken Schoenfeld for approval of a Conditional Use Permit for an office building on property zoned R4/C3 located east of Auburn Way North and north of 45th Street. Motion by Councilmember Borden, second by Councilmember Wagner to approve the conditional use permit, MOTION CARRIED UNANIMOUSLY. 7-0. VII. ORDINANCES AND RESOLUTIONS A. Ordinances 1. Ordinance No. 4847 F5.3, 04.7.3 An Ordinance of the City Council of the City of Auburn, Washington, approving reimbursement of funds in the amount of fourteen thousand seven hundred sixty-one and 00/100 dollars ($14,761), and authorizing the Mayor and City Clerk to execute an agreement with King County to accept the reimbursement of funds to be used to provide waste reduction and recycling programs and/or services to the city's businesses. Motion by Councilmember Brothers, second by Councilmember Cerino to introduce and adopt Ordinance No. 4847. Ordinance No. 4848 F5.4.4, O4.9.1 An Ordinance of the City Council of the City of Auburn, Washington, approving Federal ISTEA Grant Funds with local matching funds as provided in the Local Agency Agreement between the City and the Washington State Department of Transportation for resurfacing and repairing arterial streets. Motion by Councilmember Wagner to introduce and adopt Ordinance No. 4848 amended to include Oravetz Road from City Park to Kersey Way in the design, scope and potential construction phase in addition to those items already identified within this pavement preservation project. Councilmember Poe seconded the motion. Councilmember Brothers questioned the reason for the amendment. Councilmember Wagner explained that Oravetz Road, in addition to the streets already included in the Ordinance, is high on the list of the streets needed for improvement. The Public Works Committee approved this type of amendment to the Ordinance, because of the limited time table for submitting the application for funding. Once a cost estimate is obtained for Oravetz Road, the project will be reviewed by the Committee. The Committee hopes that improvements to Oravetz Road can be made for under $100,000; however, the City Engineer has not been able to provide a cost estimate. Public Works Director Curde estimated that a projected cost should be available within a month. MOTION CARRIED UNANIMOUSLY. 7-0. 3. Ordinance No. 4849 F5.2.15, O4.5.1 An Ordinance of the City Council of the City of Auburn, Washington, approving acceptance of Category "Z" Funds from Washington State legislative appropriation for study of Page 8 City of Auburn Council Meeting Minutes April I, '1996 traffic impacts caused by the reopening of Stampede Pass route by the Burlington Northern-Santa Fe Railway. Motion by Councilmember Wagner, second by Councilmember Borden to introduce and adopt Ordinance No. 4849. MOTION CARRIED UNANIMOUSLY. 7-0. 4. Ordinance No. 4852 F4.3, A3.5.5.2 An Ordinance of the City Council of the City of Auburn, Washington, amending Auburn City Code Chapter 2.72 entitled Cemetery, by adding a new subsection to Section 2.72.300 Cemetery Fees and Charges. Motion by Councilmember Borden, second by Councilmember Singer to introduce and adopt Ordinance No. 4852. MOTION CARRIED UNANIMOUSLY. 7-0. 5. Ordinance No. 4853 F5.3, 04.7.3 An Ordinance of the City Council of the City of Auburn, Washington, approving reimbursement of funds in the amount of twelve thousand and one hundred seventy-six and 00/100 dollars, ($12,176), and authorizing the Mayor and City Clerk to execute Memorandum of Understanding between the Seattle-King County Department of Public Health and the City of Auburn to accept the reimbursement funds for implementation of a portion of the educational element of the local hazardous waste management program. Motion by Councilmember Brothers, second by Councilmember Cerino to introduce and adopt Ordinance No. 4853. MOTION CARRIED UNANIMOUSLY. 7-0. Ordinance No. 4855 A3.5.5.9, O1.8 An Ordinance of the City Council of the City of Auburn, Washington, adding Sections 9.01.450 entitled "Public Nuisance", 9.01.460 entitled "Unequal Damages", 9.01.470 entitled "Maintaining or Permitting Nuisance", 9.01.480 "Abatement of Nuisance", and 9.01.490 entitled "Deposit of Unwholesome Substance" to the Auburn City Code Chapter 9.01 entitled "Specified Criminal Statues Adopted By Reference" contained in Auburn City Code Title 9 entitled "Public Peace, Morals, and Welfare". Motion by Councilmember Brothers, second by Councilmember Singer to introduce and adopt Ordinance No. 4855. MOTION CARRIED UNANIMOUSLY. 7-0. B. Resolutions 1. Resolution No. 2729 A3.16.9 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an Agreement for Professional Real Property Appraisal Services for the year 1996 between the City and Clendaniel, Lema & Watts, Inc. Motion by Councilmember Wagner, second by Councilmember Poe to adopt Resolution No. 2729. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Resolution No. 2732 A4.5.2, A1.4.1 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an Interlocal Agreement between King County and the City of Auburn for judicial services, appointing King County District Court Judge James D. Cayce to serve as the Auburn Municipal Court Judge for two years. MAYOR'S REPORT A.Regional Transit Authority A1.16 Mayor Booth stated the City Council may want to consider conducting a work session regarding the Regional Transit Authority (RTA) transit plan. Planning and Community Development Director Krauss stated he hopes to have the Chair of the RTA attend a City Council work session to respond to the City Council's questions. The RTA Director will be available to meet with the City Council on April 8, 9, 10 or 16. The RTA will conduct a public meeting on their proposal later in the month. Mayor Booth stated it is the City Councirs decision whether to take a position on the RTA proposal and whether there is a need for additional information. Councilmember Singer stated she would like the opportunity to present her comments to the RTA. There was no motion by'the City Council to conduct a special work session meeting. Mayor Booth stated staff will ensure that each Councilmember receives comprehensive information on the RTA proposal. Mayor Booth stated that rather than schedule a special meeting, he would invite a representative of the RTA to make a presentation at a regular meeting of the City Council. B. Executive Session Mayor Booth recessed the regular meeting to executive session at 8:16 p.m. for approximately 20 minutes in order to discuss litigation. Mayor Booth stated no action is anticipated as a result of the executive session.
