I. CALL TO ORDER
A. Flag Salute
Mayor Booth called the meeting to order at 7:30 p.m. and led those
in attendance in the Pledge of Allegiance.
B. Roll Call
Those in attendance included Mayor Booth and the following
members of the City Council: Rich Wagner, Sue Singer, Jeanne
Barber, Trish Borden, Fred Poe, Gene Cerino, and Stacey
Brothers. Staff members present included: Police Lieutenant Bob
Almy, Fire Chief Bob Johnson, Personnel Director Brenda
Kennedy, Acting Parks and Recreation Director Dick Deal, Finance
Director Diane L. Supler, Public Works Director Frank Currie,
Planning and Community Development Director Paul Krauss,
Assistant Planning Director Lynn Rued, City Attorney Michael J.
Reynolds, City Clerk Robin Wohlhueter, and Deputy City Clerk
Dani Daskam.

There were no public hearings scheduled for this evening.

III. COUNCIL COMMITTEE REPORTS

A. Municipal Services
Chair Brothers reported the Municipal Services Committee did not
meet this afternoon. The next regular meeting of the Municipal
Services Committee is scheduled for Monday, July 15, 1996 at
4:30 p.m.
B. Planning & Community Development
Chair Borden reported the Planning and Community Development
Committee met this afternoon to conduct a public hearing on
property taxes for the mitigation site for Emerald Downs. The
Committee also discussed disposition of property at "1" Street and
26th Street NE, interlocal agreements, and several liquor license
applications. The next regular meeting of the Planning and
Community Development Committee is scheduled for July 8, 1996
at 7:30 p.m.
C. Public Works
Chair Wagner reported the Public Works Committee met this
evening at 4:30 p.m. to discuss water rates. He advised that
members of the City Council can anticipate receiving a packet of
information relating to water rate increases early next week for
study and consideration at the next City Council meeting. The next
regular meeting of the Public Works Committee is scheduled for
Monday, July 22, 1996 at 5:30 p.m. The regular Public Works
Committee meeting scheduled for Monday, July 8, 1996 is
canceled.

D. Finance
Chair Barber reported the Finance Committee met this evening at
7:00 p.m. The Committee discussed Ordinance No, 4871, and it
remains tabled in Committee. The Committee reviewed and
recommends approval of claims and payroll vouchers contained in
tonight's agenda and the fire pumper purchase transmitted as an
agenda modification. The next regular meeting of the Finance
Committee is scheduled for Monday, July 15, 1996 at 7:00 p.m.

$256,331.00 to $262,738.00 for the purchase of a fire
apparatus pumper.
Motion by Councilmember Barber, second by Councilmember
Brothers to approve the Consent Agenda as modified by the
agenda modification.
MOTION CARRIED UNANIMOUSLY. 7-0.
V. UNFINISHED BUSINESS

VI. NEW BUSINESS
A. Application No. CUP0004-94
O3.10.1
The request of Steven's Tire for a Conditional Use Permit to allow
outdoor storage yard on property located at 899 West Main Street
and zoned M-l, Light Industrial.
Assistant Planning Director Rued briefly explained that staff has
been working with Mr. Stevens to bring his property into
compliance. Staff recommends approval of the Conditional Use
Permit. The Hearing Examiner conducted a public hearing and
recommends approval of the Conditional Use Permit.
Councilmember Borden asked for clarification of the landscaping
requirements. Assistant Planning Director advised that
landscaping will be required on three sides of the property and the
fourth side is bordered by the building.
Councilmember Singer questioned the location of the landscaping.
Assistant Planning Director Rued advised that the landscaping on
the Clay Street side of the property will be outside the fence line
and the landscaping on the north and east sides of the property will
be more dense and placed inside the fence and as required by the
Zoning Code.

Councilmember Singer presented members of the City Council with
a list of her concerns with the application for a Conditional Use
Permit. She expressed concern that the tire retread operation
conducted by Stevens Tire is contrary to M-1 zoning which
specifically excludes tire retreading. Assistant Planning Director
Rued interjected that the operation by Stevens Tire consists of
gluing tread onto an old tire and is not the typical retreading
operation conducted in the past. As such, the use meets the
criteria for a conditional use in an M-1 zone.
Councilmember Singer expressed concern with justifying a
Conditional Use Permit for a nonconforming use based on the
number of years it has been in existence as a nonconforming use.
She also expressed concern with the number of Conditional Use
Permits approved, and questioned the validity of the
Comprehensive Plan and Zoning Code if conditional uses continue
to be permitted. She also expressed concern with allowing a
Conditional Use Permit on Main Street which is a primary entrance
to downtown Auburn. Councilmember Singer paraphrased a
portion of the Zoning Code describing M-1 zoning that an essential
aspect of this zone is the need to maintain a quality development
that attracts others rather than discouraging further investment in
light industrial development and that site activities should be
discouraged from ones that distract from the visual quality. She
suggested that the use does not meet the Zoning Code
requirements for outdoor storage since vehicles and racks of tires
appear to be stored along the Clay Street side of the property and
above the fence line. Assistant Planning Director Rued advised
that vehicle parking is along the Clay Street side and the outdoor
storage in question is located at the rear of the property.
In response to questions from Councilmember Brothers, Assistant
Planning Director Rued advised that the building is in use by the
applicant, there are no restrictions on hours of operation, the
property has been used for tire retreading for approximately twenty
years, and the issue before the City Council this evening is the
Conditional Use Permit for outdoor storage.
Councilmember Cerino asked for clarification of the site drawings
relating to the size of the storage area. Assistant Planning Director
Rued explained that the storage area includes the landscape area.

The Conditional Use Permit would allow up to 5,440 square feet for
outdoor storage.
In response to a question from Councilmember Wagner, Assistant
Planning Director Rued estimated there have been approximately
two other Conditional Use Permits granted for outdoor storage in
an M-1 zone during the past ten years.
Councilmember Cerino asked how the landscaping requirement will
be monitored. Assistant Planning Director Rued explained that the
developer will be required to post a landscaping bond to guarantee
the landscaping for approximately two years. The applicant must
maintain the permit conditions as approved or the Conditional Use
Permit will be voided.
Councilmember Borden expressed her satisfaction with the
landscaping requirements of the Conditional Use Permit.
Motion by Councilmember Borden, second by Councilmember
Brothers to uphold the Hearing Examiner's Findings of Fact,
Conclusions and Conditions; and request the City Attorney to
prepare the necessary Ordinance.
In response to a question from Councilmember Cerino, Assistant
Planning Director Rued confirmed that the Zoning Code requires
that the applicant post a landscaping bond. He further explained
that if any conditions of the Conditional Use Permit are not met, the
permit will be voided.
Councilmember Wagner expressed his concern for the residential
dwellings in the neighborhood. He indicated his opposition to
granting the Conditional Use Permit, and suggested the business
should comply with the zoning that already exists. He believes the
Conditional Use Permit will be difficult to police and may invite the
applicant to utilize the vehicle storage area as outdoor storage
area.
Councilmember Poe questioned the applicant's alternatives for
outside storage. Assistant Planning Director Rued explained that
under the Zoning Code up to 10% of the building area is allowed
for outside storage, up to 30% of the building area can be permitted
with an Administrative Use Permit, and up to 50% of the building

area can be permitted with a Conditional Use Permit. The
applicant has requested just under the 50% limit. In response to
Councilmember Singer, Mr. Rued added that an Administrative Use
Permit would also include the same landscaping requirements.
Councilmember Singer stressed that the Zoning Code states that
outdoor storage should be strictly regulated in an M-1 zone.
Assistant Planning Director Rued advised that the surrounding
zoning is M-l, light industrial, and the landscaping will be irrigated.
Councilmember Barber questioned whether any comments have
been received from neighboring residents. Assistant Planning
Director Rued advised that no comments have been received from
neighbors and no testimony was given at the Hearing Examiner's
hearing.
Councilmember Borden expressed her approval of the request and
indicated the landscaping requirement is a good compromise.
Councilmember Poe explained that it is difficult for a business who
needs outdoor storage to find a building or location in an M-2 zone.
He expressed his approval of the request as long as the outdoor
storage is maintained correctly.
MOTION CARRIED. 5-2. Councilmembers Singer and Wagner
voted no.
B. Application No. CUP0013-95

The request of Richard James for a Conditional Use Permit for 18-
unit apartment on property zoned C-3, Heavy Commercial, located
at the northeast corner of 21 st and "A" Street S.E.
Assistant Planning Director Rued explained that the low-density,
multi-family housing project will be more compatible with the
residential uses located to the east and south of the property
compared to other uses allowed in the C-3 zone. Therefore, staff
recommends approval of the Conditional Use Permit. The Hearing
Examiner recommendation is to approve the Conditional Use
Permit.

Motion by Councilmember Borden, second by Councilmember
Wagner to approve the Conditional Use Permit based upon the
Hearing Examiner's Findings of Fact, Conclusions and Conditions;
and to instruct the City Attorney to prepare the necessary
Ordinance.
In response to a question from Councilmember Poe, Assistant
Planning Director Rued estimated the area of the lot used by the
multi-family units will be approximately 300 feet by 170 feet.
Councilmember Singer expressed her opposition and concern with
commercially zoned land being used for another purpose,
considering the limited amount of commercially zoned property
available.
MOTION CARRIED. 6-1. Councilmember Singer voted no.

Motion by Councilmember Wagner, second by
Councilmember Poe to introduce and adopt Ordinance No.
