Flag Salute Mayor Booth called the meeting to order at 7:30 p.m. and led those in attendance in the Pledge of Allegiance. B. Roll Call Mayor Booth and the following members of the City Council were present: Rich Wagner, Sue Singer, Jeanne Barber, Trish Borden, Fred Poe, and Stacey Brothers. Councilmember Gene Cerino was excused from the meeting. Staff members present included: Police Chief Dave Purdy, Fire Chief Bob Johnson, Personnel Director Brenda Kennedy, Acting Parks and Recreation Director Dick Deal, Recreation Manager Brian Petty, Recreation Coordinator Sharon LaVigne, Finance Director Diane L. Supler, Public Works Director Frank Currie, Planning and Community Development Director Paul Krauss, City Attorney Michael J. Reynolds, City Clerk Robin Wohlhueter, and Deputy City Clerk Dani Daskam. C. Announcements and Appointments 1. Announcements a) Boy Scout Troop 331 Mayor Booth recognized the following members of Boy Scout Troop 331 in attendance this evening: Michael Turner, Weston Haines, Aaron Bouttiller, and Chris Thiele. The scouts were accompanied by Troop Leader Lynn Barker. Other members of Boy Scout Troop 331 expected to arrive later during the Page1 City of Auburn Council Meeting Minutes October 21, 1996 meeting include Rolf Ericksen and Mathew Thiele accompanied by Troop Leader Clod Thiele b) Specialized Recreation Athletic Program Donations Representatives from Boeing Employees Recycling Program, Ball Foster Glass, and Oshman's Super Sports USA will present donations to Mayor Charles A. Booth for the Specialized Recreation Athletic Programs. Recreation Manager Brian Petty introduced Recreation Coordinator Sharon LaVigne who supervises the City's Specialized Recreation Program. He also introduced Brian Dorfler, Rachel Willett and Ken Minkler, who are participants in the Specialized Recreation Athletic Programs. The Specialized Recreation Program serves those with special needs, and is dependent upon financial and volunteer support from the community. The program serves approximately 300 individuals annually and provides cultural, educational and sports events. The City has been fortunate to receive support for the program from a variety of sources. Mr. Petty then introduced representatives from three organizations in attendance this evening to present the City of Auburn Parks and Recreation Departmenrs Specialized Recreation Athletic Program with financial contributions. Mr. Jim Eagle, Store Manager at Oshman's Super Sports USA, presented Mayor Booth with a donation for $1,846 from the "Oshman's Grants for Girls" program. Mr. Nick Nicholson, Recycling Chairperson from the Boeing Employees Recycling Program, presented Mayor Booth with a donation in the amount of $2,413 to be used towards the cost of uniforms for the Specialized Recreation Athletic Program. Mr. Charles Benedict, Chairman of the Glass Awareness Committee from the Ball Foster Glass Page 2 City of Auburn Council Meeting Minutes October 21, 1996 employees, presented Mayor Booth with a donation in the amount of $1,000 in memory of Ted Ford, who had been an avid supporter of specialized recreation programs. Recreation Manager Brian Petty explained that the donations tonight will be used towards the cost of supplies, uniforms, and equipment used in the Specialized Recreation Athletic Program. Mr. Nick Nicholson of the Boeing Employees Recycling Program presented Jim Eagle of Oshman's Super/Sports USA with a certificate of appreciation acknowledging Mr. Eagle's generosity and cooperation in providing support to specialized recreation programs throughout the state. Mayor Booth expressed the City's appreciation for the donations received this evening. He also commended Recreation Coordinator Sharon LaVigne for her contributions to the City's Specialized Recreation Athletic Program. 2. Appointments There were no appointments for City Council review. D. Agenda Modifications An agenda modification included a correction to Ordinance No. 4914 to correct a scrivener's error in Chapter 18.50.020(B) included as part of the amendment to Ordinance No. 4914 and transmitted under Item VII.A.3 of these minutes. II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings There were no public hearings scheduled for this evening. B. Audience Participation 1. Richard Fiddler, 1915 "U" Street NE, Auburn, WA Mr. Fiddler expressed his support for the adoption of Ordinance No. 4919. C. Correspondence There was no correspondence for City Council review. III. COUNCIL COMMITTEE REPORTS A. Municipal Services Chair Brothers reported the Municipal Services Committee did not meet this afternoon. The next regular meeting of the Municipal Services Committee is scheduled for November 4, 1996 at 4:30 p.m. B. Planning & Community Development Chair Borden reported the Planning and Community Development Committee met October 14, 1996. The Committee discussed Ordinance No. 4898 accepting a Washington State Arts Commission grant and Ordinance No. 4919 regarding golf course green fees. The Committee also received an update on the skate park study, The next regular meeting of the Planning and Community Development Committee is scheduled for October 28, 1996 at 7:30 p.m. C. Public Works Chair Wagner reported the Public Works Committee met October 14, 1996. The Committee discussed budgets for the engineering, utilities, and building and inspections departments. The Committee also reviewed the financial section of the Transportation Plan. The next regular meeting of the Public Works Committee is scheduled for October 28, 1996 at 5:30 p.m. D. Finance Chair Barber reported the Finance Committee met this evening at 6:30 p.m. The Committee reviewed and discussed the Personnel Department budget, Ordinance No. 4920, Ordinance No. 4921, Resolution No. 2775, Resolution No. 2776, Resolution No. 2779, hearing dates on the 1997 Final Budget, real estate excise tax, and claims and payroll vouchers. Chair Barber requested the City Council's support for Finance Committee items appearing on this evening's City Council agenda. Minutes of the October 7, 1996 regular City Council meeting. B. Vouchers F4.9.2, F4.9.5 1. Claims Claims check numbers 115783 through 116668 in the amount of $473,675.79 for Period 10 and dated October 21, 1996. 2. Payroll Payroll check numbers 233280 to 234687 in the amount of $800,492.52 and Direct Payroll Deposit transmissions in the amount of $223,719.95 for a grand total of $1,024,212.47 for the pay period covering September 23, 1996 to October 8, 1996. C. Call for Public Hearing 1. 1997 Final Budget F3.11 City Council to call for a public hearing to be held at the November 18, 1996 meeting to receive public comment on the 1997 Preliminary Budget. Motion by Councilmember Barber, second by Councilmember Brothers to approve Consent Agenda Items IV.A.1 through IV.C.1. MOTION CARRIED UNANIMOUSLY. 6-0. V. Ordinance No. 4898 F5.2.16 An Ordinance of the City Council of the City of Auburn, Washington, approving acceptance of the Washington State Arts Commission appropriation and expenditure of grant funds in the amount of Three Thousand Seven Hundred thirty and 00/100 dollars, ($3,730.00), and authorizing the Mayor to execute Contract No. 97056. Motion by Councilmember Borden, second by Councilmember Singer to introduce and adopt Ordinance No. 4898. MOTION CARRIED UNANIMOUSLY. '6-0. 2.Ordinance No. 4911 A3.13.4 An Ordinance of the City of Auburn, Washington, accepting the donation of approximately twenty acres of land within the city of Auburn, Washington and authorizes the execution of an Agreement for Approval of Permits to permit the filling of the former City sewage lagoon by the D. A. Garrett Company. Motion by Councilmember Borden, second by Councilmember Wagner to introduce and adopt Ordinance No. 4911. MOTION CARRIED UNANIMOUSLY. 6-0. 3. Ordinance No. 4914 O3.4.2.1.2, A3.5.5.18 An Ordinance of the City of Auburn, Washington, amending Auburn City Code Section 18.28.040 entitled "Development Standards", 18.28.050 entitled "Supplemental Development Standards" contained in Chapter 18.28 entitled "C-2 Central Business District"; and Auburn City Code Section 18.50.050 Page 6 City of Auburn Council Meeting Minutes October 21, 1996 entitled "Regulations by Zone" contained in Chapter 18.50 entitled "Landscaping and Screening". Motion by Councilmember Borden, second by Councilmember Singer to introduce and adopt Ordinance No. 4914. MOTION CARRIED UNANIMOUSLY. 6-0. 4. Ordinance No. 4915 O3.10.1 CUP0008-95 An Ordinance of the City of Auburn, Washington, providing for Conditional Use Permit to allow the construction of six duplexes on property zoned R-2 (Single Family) located at 1108 3rd Street SE, within the City of Auburn, Washington. Motion by Councilmember Borden, second by Councilmember Wagner to introduce and adopt Ordinance No. 4915. MOTION CARRIED UNANIMOUSLY. 6-0. Councilmember Poe abstained from voting. His vote is counted with the majority vote. 5. Ordinance No. 4916 O3.10.1 CUP0002-96 An Ordinance of the City of Auburn, Washington, providing for a Conditional Use Permit to allow the construction of a 60-foot high antenna support structure for a wireless telecommunications facility located on property zoned M-2 (Heavy Industrial) located at 412 8th Street SW, within the City of Auburn, Washington. Motion by Councilmember Borden, second by Councilmember Singer to introduce and adopt Ordinance No. 4916. MOTION CARRIED UNANIMOUSLY. 6-0. Ordinance No. 4917 O3.10.1 CUP0003-96 An Ordinance of the City of Auburn, Washington, providing for a Conditional Use Permit to allow expansion of the food bank located on property zoned R-4 (Multi-Family) located at 1720 "1" Street N E, within the City of Auburn, Washington. Motion by Councilmember Borden, second by Councilmember Wagner to introduce and adopt Ordinance No. 4917. MOTION CARRIED UNANIMOUSLY. 6-0. 7. Ordinance No. 4918 03.5 PLT0001-94 An Ordinance of the City Council of the City of Auburn, Washington, approving the final plat of a 24-1ot single-family subdivision to be known as "Riverwalk, Division 2A" located south of Howard Road, north of the Game Farm Park, within the City of Auburn, Washington, according to the plat on file with the Clerk of the City of Auburn. Motion by Councilmember Borden, second by Councilmember Singer to introduce and adopt Ordinance No. 4918. Councilmember Wagner expressed his opposition to the street design for Division 2A of the Riverwalk Subdivision. He explained that his vote against the ordinance does not indicate a lack of support for the closure of the Riverwalk Subdivision from the adjacent Forest Ridge neighborhood. Councilmember Barber expressed her support for the closure of the Riverwalk Subdivision from the adjacent Forest Ridge neighborhood. MOTION CARRIED. 5-1. Councilmember Wagner voted no. Ordinance No. 4919 F4.3, 04.4.7 An Ordinance of the City of Auburn, Washington, amending Ordinance No. 4412 authorizing the Director of Parks and Recreation to set reasonable fees and charges and establishing policies upon which fees and charges are set for the Auburn Golf Course. Motion by Councilmember Borden, second by Councilmember Wagner to introduce and adopt Ordinance No. 4919. Acting Parks and Recreation Director Deal responded to a question from Councilmember Brothers. Mr. Deal explained that Ordinance No. 4412, which was adopted in 1990, established the existing fees for the Auburn Golf Course. The existing ordinance does not allow the flexibility to offer rates less than those established by the ordinance. Over the last six years, several'new courses have been constructed in the area, and the number of golfers has decreased. Additionally, almost all courses in the area offer discounted green fee rates during slow play times such as in the winter and early morning and late evenings during the summer. Ordinance No. 4919 will allow the City to offer competitive green fee rates during slow play times. Ordinance No. 4919 includes winter rates effective November 1 through approximately mid-March. Mr. Deal reported that in 1991, 69,000 rounds were played at the Auburn Golf Course. In 1995, approximately 63,000 rounds were played. The number of rounds played has decreased each year since 1991. A committee consisting of Councilmember Cerino, Golf Pro Doug Campbell, Greens Superintendent Kevin Van, Park Board Member Cal Scarif, and Acting Parks and Recreation Director Deal reviewed the rates of other courses in the area and recommended the rates included in Ordinance No, 4919. Mr. Deal advised that the City will closely monitor the activity at the golf course to determine whether the discounted rates result in an increase in rounds played. MOTION CARRIED UNANIMOUSLY. 6-0. Ordinance No. 4920 F4.6.3 An Ordinance of the City Council of the City of Auburn, Washington, authorizing the transfer of funds for the purpose of making an interest free loan from the General Fund to the Housing and Community Development Fund for up to a two-year period of time. Motion by Councilmember Barber, second by Councilmember Brothere to introduce and adopt Ordinance No. 4920. MOTION CARRIED UNANIMOUSLY. 6-0. 10. Ordinance No. 4921 F4.6.3 An Ordinance of the City Council of the City of Auburn, Washington, authorizing the transfer of funds for the purpose of making a loan or loans from the General Fund and/or the Cumulative Reserve Fund to the Arterial Street Fund for up to a two-year period of time. Motion by Councilmember Barber, second by Councilmember Poe to introduce and adopt Ordinance No. 4921. MOTION CARRIED UNANIMOUSLY. 6-0. B. Resolutions 1. Resolution No. 2775 A1.4.1, A4.5.2 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor to appoint King County District Court Commissioner Ann Harper as a Judge Pro Tem for the Municipal Court. Motion by Councilmember Barber, second by Councilmember Brothers to adopt Resolution No. 2775. MOTION CARRIED UNANIMOUSLY. 6-0. Page 10 City of Auburn Council Meeting Minutes October 21. 1996 2. Resolution No. 2776 A1.4.1, A4.5.2 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor to appoint King County District Court Judges and District Court Judges Pro Tem as Judges Pro Tem for the Municipal Court. Motion by Councilmember Barber, second by Councilmember Poe to adopt Resolution No. 2776. MOTION CARRIED UNANIMOUSLY. 6-0. 3. Resolution No. 2779 A5.3.13, F1.7 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an Interlocal Agreement with the South King County Community Network authorizing the City of Auburn to act as a depository of funds belonging to the South King County Community Network. Motion by Councilmember Barber, second by Councilmember Brothers to adopt Resolution No. 2779. In response to a question from Councilmember Singer, Finance Director Supler advised that the $600.00 annual fee charged to the South King County Community Network reflects the cost of providing the City's service. The annual fee is based upon an analysis of the transactions performed in the past for the Network and the City's labor and burden rate. MOTION CARRIED UNANIMOUSLY. 6-0. VIII. MAYOR'S REPORT A. Curfew Study Session Discussion to set a date for a study session to review the curfew issue was postponed until the November 4, 1996 regular City Council meeting to allow staff more time to compile data on crime repoding. Executive Session Mayor Booth recessed the regular meeting to executive session at 8:10 p.m. for approximately 30 minutes in order to discuss potential litigation and personnel matters. Mayor Booth indicated no action is expected as a result of the executive session. Mayor Booth reconvened the meeting at 9:53 p.m. IX.
