Flag Salute Mayor Booth called the meeting to order at 7:30 p.m. and led those in attendance in the Pledge of Allegiance. B. Roll Call Mayor Booth and the following members of the Auburn City Council were present: Rich Wagner, Sue Singer, Jeanne Barber, Trish Borden, Fred Poe, Gene Cerino, and Stacey Brothers. Staff members present included: Police Chief Dave Purdy, Fire Chief Bob Johnson, Personnel Director Brenda Kennedy, Acting Parks and Recreation Director Dick Deal, Finance Director Diane L. Supler, Public Works Director Frank Curde, Design Engineer Jack Locke, Engineering Aide Pam Miller, Planning and Community Development Director Paul Krauss, Assistant Planning Director Lynn Rued, Senior Planner Bob Sokol, City Attorney Michael J. Reynolds, City Clerk Robin Wohlhueter, and Deputy City Clerk Dani Daskam. C. Announcements and Appointments 1. Announcements a) Proclamation For the clarification purposes, the following proclamation was presented after Item I.D of these minutes. Appointments There were no appointments scheduled for review. D. Agenda Modifications Agenda modifications include correspondence transmitted under Item II.C.2 of these minutes, the December 2, 1996 Municipal Services Committee meeting minutes transmitted under Item III.A of these minutes, and Ordinance No. 4927 transmitted under Item VII.A.2 of these minutes. II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings 1. Local Improvement District No. 346 F2.4.9 LID 346 A public hearing for the purpose of receiving public input from any person desiring to object to any assessment appearing on the final assessment roll for Local Improvement District No. 346 as ordered by Ordinance No. 4708 for the improvement of sidewalks, driveways, handicap ramps, curb cuts and other improvements related thereto. The improvements consist of seven separate units of improvements in designated Units A, B, C, D, E, F, and G. Mayor Booth opened the public hearing, and Design Engineer Jack Locke presented the staff report. Mr. Locke reviewed the history of the Local Improvement Distr'ict (LID) No. 346 project which began in 1994. The project focused on the northeast portion of the City, roughly north of Highway 18 and east of Auburn Way North. The project completes a sidewalk linkage program on Auburn Way North and other areas to create major walking corridors. The project consisted of sidewalk installation to fill in gaps in sidewalks where curbs and gutters exist and installation of wheelchair ramps. The project affected 138 parcels and included 29 property acquisitions. The total project cost to date is $883,800. Approximately 38% of the Page 2 City of Auburn Council Meeting Minutes December 16, 1996 project or $338,650 is being funded through the LID. Grants in the amount of $243,000 and the City's match of $302,150 comprise the remaining funding for the project. Property owners of 32 parcels received $54,604.20 in Housing and Urban Development (HUD) Block Grant low income assistance to pay for their LID assessments. Mr. Locke explained that any protest to the LID assessment must prove that the assessment is unfair in relation to the benefit or unfair in relation to other properties. The deadline for submitting written protests is January 6, 1997. Mr. Locke noted that Ordinance No. 4936 approving and confirming the assessment roll appears later on this evening's agenda for Council consideration. If the ordinance is adopted, the assessments will be filed with the Finance Department, and the each assessment will be a lien on the property. A thirty- day prepayment period will expire February 6, 1997. The prepayment period allows property owners to pay the full assessment without interest and penalty. Following expiration of the prepayment period, the first of ten annual installments plus interest will be payable January, 1998. Mr. Locke advised that Mr. David Nelson has filed a protest of his assessment for Assessment No. 146. Mr. Locke advised that staff has reviewed Mr. Nelson's protest and recommends an amendment to the assessment roll. Mr. Lock presented memo addressed to the City Council from Public Works Director Frank Currie dated December 16, 1996 recommending and explaining the proposed amendment to the final assessmi~nt roll. Councilmember Brothers questioned the ratio of LID funding to grant and City funding. Mr. Locke responded that the cost of the previous sidewalk improvement LID was shared approximately equally between LID participants and the City. Little or no grant funding was available at that time. The grant funding for the LID 346 project comes from the federal ISTEA program and from Housing and Urban Development (HUD) Block Grant funds. The HUD funds are used for low- income assistance and installation of wheelchair ramps. Mr. Locke explained City staff devised a funding package whereby the cost to each property owner is in line with construction costs under average conditions. Page 3 City of Auburn Council Meeting Minutes December 16, 1996 In response to a question from Councilmember Poe, Design Engineer Locke reported that grant money is equally distributed. Assessment costs are determined by linear foot, and all property owners are assessed an equal amount per linear foot. Mr. Locke explained that three construction contracts were involved in the LID. Mr. Locke did not have individual contract construction costs available during the hearing, and offered to provide the information at a later date. Public Works Director Curde added that the costs included in the LID consist of construction costs, property and right-of-way acquisition, and engineering costs. No one from the audience indicated a desire to speak during the public hearing. Motion by Councilmember Wagner, second by Councilmember Borden to close the public hearing. MOTION CARRIED UNANIMOUSLY, 7-0. 2. Local Law Enforcement Block Grant O1.8, F5.4.1 The City of Auburn's application for funding under the Local Law Enforcement Block Grants Program (LLEBG) has been approved in the amount of $40,797 for the purpose of reducing crime and improving public safety. The City of Auburn proposes to pay overtime costs for police officers engaged in community policing activities. Special conditions of the grant award require the City to encourage public participation regarding the proposed use of the payment under the Local Law Enforcement Block Grant in relation to its entire budget. Mayor Booth opened the public hearing. No one from the audience indicated a desire to speak. Motion by Councilmember Borden, second by Councilmember Singer to close the public hearing. MOTION CARRIED UNANIMOUSLY. 7-0. Page 4 City of Auburn Council Meeting Minutes December 16, 1996 3. Consolidated Plan O3.4.1.7, O3.11.3, F5.4.3 In accordance with 24 CFR 91.105 of the Department of Housing and Urban Development; the City of Auburn solicits comments, opinions and ideas on housing and community development needs, including priority non-housing community development needs and Community Development Block Grant projects recommended for funding in 1997. Mayor Booth opened the public hearing, and Associate Planner Bill Mandeville presented the staff report. Mr. Mandeville explained that a public review period for the Consolidated Plan began in November and will end December 20, 1996. To date, comments on the Plan have been received from Mayor Booth and other interested parties. The comments will be incorporated in the Plan. Mr. Mandeville noted that the 1997 update to the Plan contains an ambitious action plan and includes continued participation in the HOME Consortium and the South King County Housing Forum, further development of the neighborhood family center at Mt. Baker Middle School, implementation of the crime-free multi-housing program, and the revolving loan fund to assist low-income residents purchase their first home. The Plan also includes the funding recommendations by the Human Services Committee. The City's 1997 funding entitlement is approximately $400,000. There are approximately $104,000 in prior year reappropriations as well. The total 1997-98 Community Development Block Grant (CDBG) funding will be $504,000. Approximately $60,000 is for social services, $80,000 for administration, and $364,000 for various capital improvements. Once the planning process is concluded, the Human Services Committee will review their funding recommendations and forward the 1997-98 CDBG Budget to the City Council in January or early February for consideration. Page 5 City of Auburn Council Meeting Minutes December 16, 1996 Kate Kadou, Resource Development Manager, Community Health Centers of King County, 105 "A" Street SW, Auburn, WA Ms. Kadou spoke on behalf of the Auburn Community Health Centers located at 105 "A" Street SW and I "A" Street NW. She thanked the City Council for the City's past support of primary health care for citizens of Auburn, and she encouraged the Council's support of the Consolidated Plan as written. Ms. Kadou explained that the Community Health Centers of King County has been serving the residents of Auburn since 1981, and the need for services continues to grow. The dental clinic located at 1 "A" Street NW was opened last August and has proven to be very successful. Kim McCoy, Executive Director, ACAP Child and Family Services, 1102 "J" Street SE, Auburn, WA Ms. McCoy spoke on behalf of ACAP Child and Family Services and in support of the Consolidated Plan. She expressed her appreciation for the City's continued support for child care and economic self-sufficiency. Ms. McCoy advised that ACAP is being recommended for funding for capital improvements, and a funding cut for subsidized care. She acknowledged that other programs are also deserving, but would appreciate any additional funding to soften the funding cut for subsidized care. Motion by Councilmember Borden, second by Councilmember Wagner to close the public hearing. MOTION CARRIED UNANIMOUSLY. 7-0. B. Audience Participation 1. Joel Haggard, 1200 IBM Building, Seattle, WA Mr. Haggard spoke on behalf of Insurance Auto Auction with regard to Ordinance No. 4927 and Insurance Auto Auction's application for an Administrative Use Permit. He recollected that the City Council's options on November 18, 1996 were to either affirm or reject the Hearing Examiner's decision. The City Council subsequently rejected the Hearing Page 6 City of Auburn Council Meeting Minutes December 16. '1996 Examiner's decision which required the City Council to adopt findings and conclusions. Ordinance' No. 4927 rejects the recommendation of the Hearing Examiner and sets forth findings and conclusions. Mr. Haggard stated the adoption of Ordinance No. 4927 will either be approved or fail or a member of the. prevailing side of the November 18, 1996 motion must move to reconsider or rescind. Mr. Haggard advised that two of the three residents who appealed the Administrative Use Permit settled with Insurance Auto Auction and dropped their appeals. The Hearing Examiner found that the third appellant did not present the evidence to sustain their case. He also reminded the Council that at the November 18, 1996 Council meeting, the applicant committed to the City that all tow trucks under the direction and contract of Insurance Auto Auction will enter through "A" Street SE only. Mr. Haggard urged the City Council to reconsider or rescind their action of November 18, 1996 with regard to the Hearing Examiner's recommendation on the Administrative Use Permit for Insurance Auto Auction. Mr. Haggard also requested that if the City Council reconsiders the Administrative Use Permit, an additional condition be included in the Permit to require all tow trucks under contract by Insurance Auto Auction can enter from "A" Street SE only. C. Correspondence 1. Letter dated December 9, 1996 to Charles A. Booth and Auburn City Council from June Botz, Auburn Properties, Peter Frame, GENTRA, Richard Hathaway, Fairfield Developments, and George Thurtle, Bristol Properties regarding the proposed 1996 Comprehensive Plan Amendments. 2. Letter received on December 13, 1996 from David L. Nelson to Office of City Clerk regarding LID 346, assessment number 146. Page 7 City of Auburn Council Meeting Minutes December t6, 1996 III. COUNCIL COMMITTEE REPORTS A. Municipal Services Chair Brothers reported the Municipal Services Committee met this afternoon at 4:30 p.m. The Committee discussed Ordinance No. 4932 which amends City Code Title 9 to provide compliance with Chapter 39.34 RCW as amended by the Washington State Legislature. The next regular meeting of the Municipal Services Committee is scheduled for January 6, 1997 at 4:30 p.m. B. Planning & Community Development Chair Borden reported the Planning and Community Development Committee meeting scheduled for Monday, December 9, 1996 was canceled. The regular meeting of the Planning and Community Development Committee scheduled for December 23, 1996 is also canceled. C. Public Works · Chair Wagner reported the Public Works Committee met December 9, 1996. The Committee discussed Resolution No. 2795 which will transfer the City's interest in portions of the City's sewer system to King County. King County will reimburse the City several million dollars for some of the costs for providing the regional facilities. The Committee also discussed the South 277th project with City of Kent engineers. The Committee expressed concern that the South 277th project, as currently designed, is not serving the potential annexation area of Lea Hill as well as it should. The Committee also discussed the Transportation Plan and decided that the Plan will not be forwarded to the City Council in the near future. The Committee decided that there is additional information expected in the next few months with regard to Burlington Northern and other traffic issues to delay the Plan for a few months. Chair Wagner advised that a draft version of the Transportation Plan is available for Council review. The Public Works Committee meeting scheduled for Monday, December 23, 1996 is canceled. The next regular meeting of the Public Works Committee is scheduled for January 13, 1997 at 5:30 p.m. Page 8 City of Auburn Council Meeting Minutes December 16, 1996 D. Finance Chair Barber reported that the Finance Committee met this evening at 6:30 p.m. The Committee discussed and recommends City Council adopt Ordinance No. 4923. The Committee also discussed water and storm water projects related to bond issues. The Committee also recommends the City Council approve claims and payroll vouchers as they appear on this evening's agenda. The next regular meeting of the Finance Committee is scheduled for January 6, 1997 at 7:00 p.m. E. Committee on Committees Chair Brothers reported the Committee on Committees met this evening at 5:30 p.m. The Committee requested the City Clerk prepare the necessary resolution for Committee assignments. The Resolution will be presented to the City Council at the January 6, 1997 meeting for consideration. IV. CONSENT AGENDA A. Minutes 1. Minutes of the November 20, 1996 special City Council meeting. 2. Minutes of the December 2, 1996 regular City Council meeting. B. C. Contract Administration 1. Public Works Project No. 567 Q4.8.1 Grant permission to advertise an invitation to bid for Public Works Project No. PR 567, South Central Storm Improvement, located on Howard Road between Auburn Way South and "R" Street SE. 2. Public Works Project No. 513A F2.4.9 LID 346, O4.12.1 PR 513A Accept construction of PR 513A, residential sidewalk improvements, and approve final pay estimate in the amount of $7,410.28, P.E. #7 to D.A. Zuluaga for Contract No. 95-21, LID 346. Motion by Councilmember Barber, second by Councilmember Brothers to approve Consent Agenda Items IV.A through IV.C.2. MOTION CARRIED UNANIMOUSLY. 7-0. V. UNFINISHED BUSINESS A. Comprehensive Plan Amendments 03.4.3 At its December 2, 1996 regular meeting, the City Council delayed action on consideration of 1996 Comprehensive Plan Amendments which address the following: · City's urban growth area (potential annexation area) within Pierce County. The proposal removes a small area from the City's UGA to resolve overlaps with the Cities of Sumner and Pacific; · Enlarge the Drive-in Special Plan Area to include all property to the east of Auburn Way North and west of the Green River and south of 277th Street and north of approximately 37th Street NE. The area will be renamed the Northeast Auburn Special Plan Area; Page 10 City of Auburn Council Meeting Minutes December 16, 1996 · Addition to the area covered by the City of Auburn Comprehensive Water Plan to include the City's Pierce County Urban Growth Area. Motion by Councilmember Borden, second by Councilmember Singer to adopt the 1996 Comprehensive Plan amendments excluding revisions to LU-74. MOTION CARRIED UNANIMOUSLY. 7-0. VI. NEW BUSINESS There were no items for City Council review under this section. VII. ORDINANCES AND RESOLUTIONS A. Ordinances 1. Ordinance No. 4923 F3.10 An Ordinance of the City Council of City of Auburn, Washington, amending Ordinance No. 4808, the 1996 Budget Ordinance, and authorizing the Mayor to accept Schedule "A" which relates to the City of Auburn 1996 budget reallocation of funds in various accounts in several funds pursuant to RCW 35A.33.120, and setting forth findings. Motion by Councilmember Barber, second by Councilmember Brothers to introduce and adopt Ordinance No. 4923. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Ordinance No. 4927 O3.10.4 An Ordinance of the City of Auburn, Washington, rejecting the recommendation of the Hearing Examiner in an appeal which would approve an Administrative Use Permit to allow for expansion to an existing facility located in the 3300 block of "D" Street SE in a M-2 (Heavy Industrial) zone, within the City of Auburn, Washington. Page 11 City of Auburn Council Meeting Minutes December '16, 1996 Motion by Councilmember Borden, second by Councilmember Wagner to introduce and adopt Ordinance No. 4927. MOTION FAILED. 3-4. Councilmembers Barber, Cerino, Singer and Poe voted no. Motion by Councilmember Borden to modify the Hearing Examiner's decision and request the City Attorney prepare findings of fact and conclusions dealing with off-site parking, traffic control, water quality, litter control, noise, additional landscaping, and allow the City Council review the final plan. Councilmember Wagner seconded the motion and asked that the motion include the ordinance be prepared in a way that each condition is delineated and can be penalized separately should the applicant not fulfill the conditions. Councilmember Borden accepted the addition to the motion. Councilmember Poe questioned whether the initial application addressed all the concerns identified in the motion. Councilmember Borden pointed out that the Hearing Examiner's conclusions did not address litter control or noise. Also, the landscaping requirements proposed by the Hearing Examiner are inadequate. The Hearing Examiner's conclusions also did not address the "A" Street access. Councilmember Poe disagreed with the proposed additional landscaping requirements. Councilmember Wagner expressed support for safeguards to ensure drinking water quality and protection of the City's aquifer. He pointed out that the record discusses storm water quality, but does not mention drinking water quality, well protection, or aquifer protection. Councilmember Poe indicated there is a significant amount of materials in the Planning Department requirements related to storm sewage disposal, and the City's aquifer Page12 City of Auburn Council Meeting Minutes December 16, 1996 should not be threatened if the applicant complies with the requirements of the Planning and Engineering Departments. Councilmember Cerino explained his opinion that the existing operation is uncontrolled, and the new application will allow the City to more adequately control the use. He also pointed out that the expansion of the operation will allow storage of vehicles on site instead of transporting the vehicles from an off-site location. Councilmember Singer noted that the original appeal was based on noise, traffic, parking, and visual impact. She suggested the Council limit its focus to the original four appeal issues and determine whether the appeal has sufficient merit to deny the Administrative Use Permit. She objected to adding new issues such as water quality. Councilmember Wagner explained that it is the Council's responsiSility to review and understand all impacts of projects within the city. Councilmember Brothers added that the City Council has the duty and obligation to oversee recommendations and decisions, and, if necessary, modify or rescind those decisions. In response to a question from City Attorney Reynolds, Councilmember Borden confirmed the intent of the motion is to approve the Hearing Examiner's decision and modify the findings of fact, conclusions of law, and conditions. In response to a question from Councilmember Poe, Assistant Planning Director Rued explained that the Council decision is based on the existing record. He also reviewed the process for administrative use permits which are appealed. If an administrative use permit is appealed, the Hearing Examiner conducts a hearing and makes a recommendation to the City Council. The City Council can either affirm, modify or disaffirm the Hearing Examiner's recommendation based on the record. Page 13 City of Auburn Council Meeting Minutes December 16. 1996 MOTION FAILED. 3-4. Councilmembers Barber, Cerino, Poe and Singer voted no. Councilmember Cerino asked whether a motion to rescind the previous vote and open the issue to further testimony would be appropriate. City Attorney Reynolds advised that a closed record hearing could be held to take further testimony on the existing record. Motion by Councilmember Singer, second by Councilmember Cerino to rescind the original action taken by the City Council on November 18, 1996. MOTION CARRIED. 4-3. Councilmembers Borden, Brothers and Wagner voted no. Motion by Councilmember Poe, second by Councilmember Barber to approve the Hearing Examiner decision and deny the appeal for the administrative use permit for the expansion of the Insurance Auto Auction located at the 3300 block of "D" Street SE and instruct the City Attorney to draft the necessary ordinance to include a condition that tow truck traffic under the contract and control of Insurance Auto Auction will enter and exit from "A" Street SE. Councilmember Singer advised she spoke with Traffic Engineer Mullen who suggested that including the requirement for "A" Street SE access would not allow an alternative for the tow truck drivers when unsafe traffic conditions exist on "A" Street SE. Councilmember Poe agreed to remove the condition that two truck traffic under the contract and control of Insurance Auto Auction will enter and exit from "A" Street SE from his motion. Councilmember Barber concurred. MOTION CARRIED. 4-3. Councilmembers Borden, Brothers, and Wagner voted no. Page 14 City of Auburn Council Meeting Minutes December 16, 1996 3. Ordinance No. 4932 A3.5.5.9 An Ordinance of the City Council of the City of Auburn, Washington, amending City Code Title 9 entitled "Public Peace, Morals and Welfare", Section 9.01 entitled "Specific Criminal Statutes adopted by reference" to provide for comp!iance with Chapter 39.34 RCW as amended by the Washington State Legislature in Chapter 308 Washington Laws, 1996, Section 1 entitled "Criminal Justice Costs- Interlocal Agreements and Contracts", to be effective January 1, 1997. Motion by Councilmember Brothers, second by Councilmember Singer to introduce and adopt Ordinance No. 4932. MOTION CARRIED UNANIMOUSLY. 7-0. 4. Ordinance No. 4935 03.5 PLT0001-93 An Ordinance of the City Council of the City of Auburn, Washington, approving the final plat of a 6-lot single family subdivision to be known as "Smalkamish Estates" located at the north terminus of Foster Avenue S.E., within the City of Auburn, Washington, according to the plat on file with the Clerk oftheCity of Auburn. Motion by Councilmember Borden, second by Councilmember Wagner to introduce and adopt Ordinance No. 4935. MOTION CARRIED UNANIMOUSLY. 7-0. 5. Ordinance No. 4936 F2.4.9 LID 346 An Ordinance of the City of Auburn, Washington, modifying, approving and confirming the assessments and assessment roll of Local Improvement District No. 346 for the improvement of sidewalks, driveways, handicap 'ramps, curb cuts and other improvements related thereto, as provided by Ordinance No. 4708, and levying and assessing a part of the Page 15 City of Auburn Council Meeting Minutes December 16. 1996 COSt and expense thereof against the several lots, tracts, parcels of land and other property shown on the roll. Motion by Councilmember Wagner, second by Councilmember Poe to introduce and adopt Ordinance No. 4936 as modified by Public Works Director Frank Currie's memo dated December 16, 1996. MOTION CARRIED UNANIMOUSLY. 7-0. 6. Ordinance No. 4937 03.4.3 An Ordinance of the City Council of the City of Auburn, Washington, relating to planning; adopting Comprehensive Plan Text Amendments pursuant to the provisions of R.C.W. Chapters 36.70A and 35A.63 of the laws of the State of Washington; designating these amendments as guidelines for exercising the City's authority under the Washington State Environmental Policy Act (SEPA); directing that this Ordinance and Comprehensive Plan Amendments its adopts and approves be filed with the Auburn City Clerk and be available for public inspection. Motion by Councilmember Borden, second by Councilmember Singer to introduce and adopt Ordinance No. 4937. MOTION CARRIED. 6-0. Councilmember Poe abstained from voting on Ordinance No. 4937. B. Resolutions 1. Resolution No. 2795 A1.3, A3.13.4, O4.6.1 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute a Facilities Acquisition Agreement between the City and Metropolitan King County to allow the City to transfer interest in the West Valley Interceptor Sewer, the Lakeland Hills Pump Station and the Lakeland Hills Force Main to Metropolitan King County. Resolution No. 2783 F6,3, O3.10.9 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute a Right of Way Permit Agreement with Worldcom Network Services, Inc. Motion by Councilmember Wagner, second by Councilmember Poe to adopt Resolution No. 2783. MOTION CARRIED UNANIMOUSLY. 7-0. VIII. MAYOR'S REPORT A. Executive Session Mayor Booth recessed the meeting to executive session at 8:45 p.m. for approximately 15 minutes in order to discuss matters related to personnel and labor negotiations. Mayor Booth indicated no action is anticipated as a result of the executive session. Mayor Booth reconvened the meeting at 8:59 p.m. IX, ADJOURNMENT There being no further business to come before the City Council this evening, the meeting adjourned at 8:59 p.m. Approved on the ~/~ day of ~ ,1997.
