Flag Salute Mayor Booth called the meeting to order at 7:30 p.m. and led those in attendance in the Pledge of Allegiance. B. Roll Call Mayor Booth and the following members of the City Council were in attendance: Rich Wagner, Sue Singer, Jeanne Barber, Trish Borden, Fred Poe, Gene Cerino, and Stacey Brothers. Staff members present included: Police Chief Dave Purdy, Fire Chief Bob Johnson, Personnel Director Brenda Kennedy, Parks and Recreation Director Dick Deal, Library Director Andy' Waters, Finance Director Diane L. Supler, Public Works Director Frank Currie, Planning and Community Development Director Paul Krauss, Assistant Planning Director Lynn Rued, City Attorney Michael J. Reynolds, City Clerk Robin Wohlhueter, and Deputy City Clerk Dani Daskam. C. Announcements and Appointments 1. Announcements There were no announcements this evening. 2. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings 1. Moratorium on Commercial Wireless Telecommunications Facilities O3.10.9 The City of Auburn has placed a moratorium on the issuance of permits for commercial wireless telecommunication facilities and towers for a period of six (6) months. The Auburn City Council intends to study and develop policies and regulations for permitting and siting commercial wireless telecommunication facilities. The public is invited to express any comments on the six-month moratorium placed on the issuance of permits for commercial wireless telecommunication facilities and towers. Mayor Booth opened the public hearing on the moratorium. No one from the audience spoke regarding the moratorium. Motion by Councilmember Borden, second by Councilmember Wagner to close the public hearing. MOTION CARRIED UNANIMOUSLY. 7-0. Motion by Councilmember Borden, second by Councilmember Wagner to adopt the findings of fact and continue the moratorium on telecommunication facilities. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Application No. CUP0001-97 O3.10.1 CUP0001-97 The following is a closed record hearing where comments are limited to the existing record and no new evidence or information is allowed to be submitted. The request of Recycling Northwest, Inc. for a conditional use permit to allow for sorting, separation, and transfer of construction, demolition, and land clearing materials for property located at 655 and 657 - 2nd Street NW. Page 2 City of Auburn Council Meeting Minutes May 19, 1997 Assistant Planning Director Lynn Rued presented the staff report on Application No. CUP0001-97 using an overhead slide of a vicinity map and a geographic parcel map. The site is an existing recycling facility which the City approved through a conditional use permit several years ago. The City later approved another conditional use permit which allowed a wood processing and chipping facility and the construction of a building on the site. Mr. Rued advised that the applicant is not pursuing the wood processing and chipping operation at this time. The applicant now requests a conditional use permit to allow recycling of construction, demolition, and land clearing debris material. The materials to be processed include sheetrock, concrete, asphalt, and wood. Mr. Rued explained how the operation would work. Trucks will transport the materials to the site and unload the materials inside the building where the materials will be sorted and separated. The materials will then be transported off-site to other users of the materials. All sorting, separating and loading will be conducted inside the building. Mr. Rued described the required haul route for the facility. Trucks aro required to use "H" Street NW north to 6th Street and then to "C" Street. No trucks will be allowed to travel south on "H" Street. The property is zoned M-2, heavy industrial, as is all surrounding property. Noise and dust will be contained on site. The Hearing Examiner has recommended that the conditional use permit be approved subject to conditions. The conditions include that the previous environmental review shall apply, any private haulers are made aware of the required haul route, and no outdoor storage or processing of the materials will be allowed. Councilmember Borden questioned how the required haul route will be enforced. Mr. Rued explained the City is normally advised of violations through citizen complaints. If a violation is documented, the City can pursue remediation through a civil code violation process. Councilmember Brothers questioned whether the gross weight of vehicles hauling the materials will exceed the gross weight of vehicles currently transporting to the facility. Page 3 City of Auburn Council Meeting Minutes May 19, 1997 Mr. Rued advised that the gross vehicle weight of the trucks has not been an issue since the trucks will be using the dedicated truck routes of the city. In response to a questions from Councilmember Brothers, Mr. Rued advised that approval for a wood processing/chipping operation was previously approved for the site. It is unlikely the applicant will pursue the wood processing/chipping operation at this time. Mr. Rued also advised that the building has large open ends to allow trucks access to the unloading area. The applicant will be required to comply with existing noise regulations. Councilmember Wagner questioned the haul route and access to the facility. Mr. Rued explained that trucks will enter and exit the facility on "H' Street using the same access gate. The trucks are not allowed any further south than the facility gate on "H' Street. In response to a question from Councilmember Wagner, Mr. Rued advised that the building is equipped with a system to control dust. The applicant is also required to obtain a permit from the Puget Sound Pollution Control Authority. The zoning code contains regulations for dust control, and the City would be responsible for enforcing the zoning code. The Pollution Control Authority would be responsible for pursuing any violation of their standards. Mayor Booth opened the closed record hearing. No one from the audience expressed a desire to speak. Motion by Councilmember Borden, second by Councilmember Poe to close the public hearing. MOTION CARRIED UNANIMOUSLY. 7-0. Motion by Councilmember Borden, second by Councilmember Barber to approve the conditional use permit based upon the Hearing Examiner's findings of fact, conclusions and conditions, and instruct the City Attorney to prepare the necessary ordinance. Phil Walker, 31600 SE 126th Place, Auburn, WA Mr. Walker advised he is a resident of the Lea Hill area, and he attended the recent Lea Hill Annexation meeting conducted by the City at Hazelwood Elementary School. Mr. Walker expressed concern that some of the residents believe they are not receiving information in a timely manner. He also expressed concern with the City's utilization of preannexation agreements which require property owners to agree to annex to the city prior to receiving city water service. He urged the Council to consider annulment of some of the preannexation agreements. Mayor Booth and Planning and Community Development Director Krauss advised that information regarding the proposed annexation of Lea Hill was distributed by several methods which include a mailing list developed from the first meeting with Lea Hill residents, publication in the City's newsletter, notification via utility bills, an article in the South County Journal, and posting a notice at the fire station. Mayor Booth advised the City has entered into preannexation agreements in accordance with state law, and the City is not attempting to rush the proposed annexation. 2. Laurie Pinard, PO Box 88050, Tukwila, WA, 98138 Ms. Pinard identified herself as an employee of M. A. Segale, Inc. She spoke regarding Item VI.B of these minutes, the request of M. A. Segale, Inc. for a surface mining permit. She read and submitted for the record a letter from Mr. M. A. Segale addressed to Mayor Booth and the Auburn City Council dated May 19, 1997. In his letter, Mr. Segale briefly reviewed the history of Surface Mining Permit Application No. MIN0003-90, and requested the City Council affirm the Hearing Examiner's decision this evening without further delay. Page 5 City of Auburn Council Meeting Minutes May 19, 1997 C. Correspondence No correspondence was submitted for City Council review. III. COUNCIL COMMITTEE REPORTS A. Municipal Services Chair Brothers reported the Municipal Services Committee met this afternoon at 4:30 p.m. The Committee reviewed Ordinance No. 4970, which approves funds from King County for the Local Hazardous Waste Management Program, and Resolution No. 2845, which authorizes an amendment to the Basic Life Support Services Contract. The Committee also received a presentation from Public Works Director Currie regarding operations and relations with TCI Cable. The next regular meeting of the Municipal Services Committee is scheduled for Monday, June 2, 1997 at 4:30 p.m. B. Planning & Community Development Chair Borden reported the Planning and Community Development Committee met May 12, 1997 at 8:00 p.m. The Committee reviewed a request for bids for metal roofs for airport hangars, proposed Comprehensive Plan amendments per the Growth Management Hearings Board, and an application from Hendley & Associates for a lot line adjustment. The Committee discussed proposed 1997 Comprehensive Plan amendments, a planned unit development ordinance, and the Lakeland annexation. The Committee also received a presentation from Parks and Recreation Director Deal on park plan concurrency. The next regular meeting of the Planning and Community Development Committee is scheduled for May 27, 1997 at 7:30 p.m. C. Public Works Chair Wagner reported the Public Works Committee met May 12, 1997. The Committee discussed the "B" Street LID and tabled the issue until the next Public Works Committee meeting on May 27, 1997. The affected property owners will be notified of the meeting and will be allowed to comment on the LID. Public Works Committee items on the Council agenda this evening include acceptance and expenditure of grant funds for acquisition of property for the Highway 18/"C" Street interchange and vacation of the unopened portion of Oravetz Road. The Committee also received briefings on the Central Storm Drainage project and the Tribal sewer vault. The next regular meeting of the Public Works Committee is scheduled for May 27, 1997 at 5:00 p.m. D. Finance Chair Barber reported the Finance Committee met this evening at 7:05 p.m. The Committee reviewed and recommends approval of claims and payroll vouchers. The next regular meeting of the Finance Committee is scheduled for Monday, June 2, 1997 at 7:00 p.m. IV. CONSENT AGENDA A. Minutes 1. Minutes of the May 5, 1997 regular City Council meeting. 2. Lakeland Hills Annexation O3.1 ANX0004-97 City Council to call for a public hearing to be held June 2, 1997 on a petition for annexation of approximately 280 acres of land located in Lakeland Hills, Pierce County. Motion by Councilmember Barber, second by Councilmember Brothers to approve the Consent Agenda. MOTION CARRIED UNANIMOUSLY. 7-0. V. Application No, PLT0001-95 03.5 PLT0001-95 City Council to consider the request of Ken Danielson for final plat approval of Valley View Estates, an 8-lot single family subdivision, located at the north end of Noble Court and east of Chinook Elementary School on Auburn Way South. Motion by Councilmember Borden, second by Councilmember Wagner to approve the final plat of Valley View Estates, and request the City Attorney prepare the necessary ordinance. MOTION CARRIED UNANIMOUSLY. 7-0. B. Application No. MIN0003-90 O3.10.3 MIN0003-90 City Council to consider the request of M. A. Segale, Inc., for a surface mining permit to allow for the continued mining of a 254 acre parcel located on the east side of Kersey Way and southerly of the Stuck River. Councilmember Borden prefaced her motion by explaining that, although she appreciates the letter submitted by Mr. Segale, a closed record hearing is the only opportunity the City Council has to ask questions about the project. Motion by Councilmember Borden to hold a closed record hearing at the June 2, 1997 City Council meeting on Application No. MIN0003-90. Councilmember Wagner spoke in favor of the motion to hold a closed record hearing in order to afford the City Council an opportunity to hear a staff report and ask questions on the application. Councilmember Wagner seconded the motion. Councilmember Barber spoke in favor of affirming the Hearing Examiner's decision rather than scheduling a closed record hearing. Motion by Councilmember Borden, second by Councilmember Wagner to approve the surface mining permit application based upon the Hearing Examiner's findings of fact, conclusions and conditions, and instruct the City Attorney to prepare the necessary ordinance. MOTION CARRIED UNANIMOUSLY. 7-0. C. Application No. LI A0007-97 A3.13.1.9 City Council to consider the request of P. Hendley & Associates for a lot line adjustment for parcels located near the intersection of Oravetz Road and Mill Pond Drive. Motion by Councilmember Borden, second by Councilmember Barber to authorize the Mayor to sign the lot line adjustment. MOTION CARRIED UNANIMOUSLY. 7-0. VII. ORDINANCES AND RESOLUTIONS A. O~inances 1. Ordinance No. 4969 F5.2.15 An Ordinance of the City Council of the City of Auburn, Washington, authorizing the acceptance of a grant from the Transportation Improvement Board for the reconstruction of "A" Street SW, 3rd to Main. Motion by Councilmember Wagner, second by Councilmember Cerino to introduce and adopt Ordinance No. 4969. MOTION CARRIED UNANIMOUSLY. 7-0. Ordinance No. 4970 O3.4.1.21, F5.3 An Ordinance of the City Council of the City of Auburn, Washington, approving reimbursement of funds in the amount of Eighteen Thousand One Hundred Seventy-three and 00/100 dollars, ($18,173), and authorizing the Mayor and City Clerk to execute Memorandum of Understanding between the Seattle-King County Department of Public Health and the City of Auburn to accept the reimbursement funds for implementation of a portion of the educational element of the Local Hazardous Waste Management Program. Motion by Councilmember Brothers, second by Councilmember Poe to introduce and adopt Ordinance No. 4970. MOTION CARRIED UNANIMOUSLY. 7-0. 3. Ordinance No. 4971 O3.10.3 MIN0002-94R An Ordinance of the City of Auburn, Washington, approving the revisions to Ordinance No. 4909 to amend the surface mining permit to allow the excavation of approximately 170,000 cubic yards of material to accommodate the construction of a 102 lot residential single family subdivision within the city of Auburn, Washington. Motion by Councilmember Borden, second by Councilmember Barber to introduce and adopt Ordinance No. 4971. MOTION CARRIED UNANIMOUSLY. 7-0. 4. Resolution No. 2842 A3.13.4, O4.9.1 PR 529 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor of the City of Auburn to execute a Purchase and Sale Agreement with the owners of real property designated as Tax Parcel Number 395440- 0050-01, Washington State Department of Transportation Parcel Number 1-15841 relating to the State Route 18/"C" Street S.W. Interchange Improvement Project (PR 529). Motion by Councilmember Wagner, second by Councilmember Poe to adopt Resolution No. 2842. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Resolution No. 2843 03.9 V-03-94 A Resolution of the City Council of the City of Auburn, Washington, fixing a time for a public hearing on the petition for vacation of the unopened portion of Oravetz Road from east of Mill Pond Drive SE to approximately "A" Street SE, within the city of Auburn, Washington. Resolution No. 2844 03.5 PLT0002-94R A Resolution of the City Council of the City of Auburn, Washington, approving the revisions to Resolution No. 2774 to amend the preliminary plat to reduce the number of single-family lots located east of "W" Street NW and west of the terminus of 15th Street NW, within the city of Auburn, Washington. Motion by Councilmember Borden, second by Councilmember Wagner to adopt Resolution No. 2844. MOTION CARRIED UNANIMOUSLY. 7-0. 4. Resolution No. 2845 02.2 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn, to execute Contract Amendment to Emergency Medical Services Contract No. D17775D between the City of Auburn and King County for 1992-1997 and specifying the 1997 funding total for Basic Life Support Services. Motion by Councilmember Brothers, second by Councilmember Poe to adopt Resolution No. 2845. MOTION CARRIED UNANIMOUSLY. 7-0. VIII. MAYOR'S REPORT A. Executive Session Mayor Booth recessed the regular meeting to executive session at 8:13 p.m. for approximately 40 minutes in order to discuss litigation.
