Flag Salute Mayor Booth called the meeting to order at 7:30 p.m. and led those in attendance in the Pledge of Allegiance. B. Roll Call Mayor Booth and the following members of the City Council were present: Rich Wagner, Sue Singer, Jeanne Barber, Trish Borden, Fred Poe, Gene Cerino, and Stacey Brothers. Staff members present included: Parks and Recreation Director Dick Deal, Personnel Director Brenda Heineman, Fire Chief Bob Johnson, Police Captain Bill Pitzl, Finance Director Diane L. Supler, Public Works Director Frank Currie, City Engineer Dennis Dowdy, Planning and Community Development Director Paul Krauss, Assistant Planning Director Lynn Rued, Senior Planner AI Hicks, City Attorney Michael J. Reynolds, City Clerk Robin Wohlhueter, and Deputy City Clerk Dani Daskam. C. Announcements and Appointments 1. Announcements a) Proclamation AI Jorgensen from Free and Accepted Masons of Washington and the King Solomon Lodge of Auburn will accept a proclamation proclaiming August 3 through August 9, 1997 as "Up With People Week". Mayor Booth read and presented a proclamation declaring August 3 through August 9, 1997 as "Up With People Week" to AI Jorgensen from the Free Page I City of Auburn Council Meeting Minutes July 21. 1997 and Accepted Masons of Washington. Up With People is a musical sponsored by the Free Masons to benefit charities. Mr. Jorgensen introduced two members of the cast in attendance this evening. 2. Appointments There were no appointments for City Council consideration this evening. D. Agenda Modifications An agenda modification was submitted to add Ordinance No. 4996 not available at the time of publication of the Council agenda and transmitted under Item VII.A.8 of these minutes. II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings The following hearing is considered a closed record hearing. A closed record hearing is a hearing where comments are limited to the existing record and no new evidence or information is allowed to be submitted. 1. Application No. CAP0001-97 A3.23.1 An appeal filed by Paul and Tina Christiansen on the Hearing Examiner's decision dated June 25, 1997 to deny a special home occupation permit that would have allowed the Christiansens to install car stereos and alarm systems within automobiles at their residence located at 409 "U" Street S.E, in Auburn. Assistant Planning Director Lynn Rued presented the staff report on Application No. CAP0001-97. He reported that at the Hearing Examiner's public hearing on Mr. and Mrs. Christiansen's application for a special home occupation, several neighbors expressed concerns and opposition to the special home occupation. Additionally, a petition in opposition to the special home occupation and signed by numerous neighbors was submitted. Based on the concerns expressed by the neighboring residents and other criteria, the Hearing Examiner denied the Christiansen's request for a special home occupation. Subsequently, the Page 2 City of Auburn Council Meeting Minutes July 21, 1997 Christiansen's appealed the Hearing Examiner's decision to the City Council. Mayor Booth opened the closed record hearing. Tina Christiansen, 409 "U" Street SE, Auburn, WA Mrs. Christiansen spoke in favor of her application for a special home occupation. She objected to the Hearing Examiner decision's reference to her residence as a rental or leased property. Mrs. Christiansen explained their application was for a temporary special home occupation permit for a period of six months in order to establish their business and open a permanent shop in another location. In response to a question from Councilmember Singer, Mrs. Christiansen advised that she and her husband currently have a business registration for a mobile operation. When the Christiansens indicated a change to their business registration to include automotive stereo and alarm installations at their home, the Planning Department staff advised them a special home occupation permit would be required. Judy Scott, 407 "V" Street SE, Auburn, WA Ms. Scott spoke in favor of the Hearing Examiner's decision to deny the Christiansen's application for a special home occupation. She indicated there have been problems in the past with car alarm and stereo noise coming from the Christiansen residence. According to Mrs. Scott, some of the incidents have resulted in calls to the police department for response. Mrs. Scott expressed concern with the effect of such a home occupation on neighboring property owners' property values, and the precedent that may be established. She also expressed concern with the potential for increased traffic on the cul-de-sac if the Christiansen's are allowed a special home occupation. In response to questions from Councilmember Brothers, Ms. Scott advised she has resided in her present home for approximately four years and estimated the Christiansen's have lived in their home for approximately 18 months to two years. Page 3 City of Auburn Council Meeting Minutes July 21. 1997 Bill Robinson, 408 "U" Street SE, Auburn, WA Mr. Robinson indicated he resides directly across the street from Mr. and Mrs. Christiansen. He noted that all residents of the cul-de-sac have signed a petition opposing Mr. and Mrs. Christiansen's application for a special home occupation because of past noise problems from the Christiansen residence. Mr. Robinson reported he has called 9-1-1 because of the noise. He expressed concern that additional traffic will be created on the cul-de-sac as a result of the special home occupation. In response to questions from Councilmember Brothers regarding noise complaint citations, City Attorney Reynolds advised that the City can prosecute noise complaints under the City's nuisance ordinance without the responding officer witnessing the noise. The cases are difficult to prove and require neighbors to testify that the noise will disturb their peace and tranquillity. Judy Scott, 407 "V" Street SE, Auburn, WA Ms. Scott informed the Council that in the past she was advised by the Police Department there is no noise ordinance; however, they will respond to noise complaints but cannot issue a citation if challenged. In response to questions from Council, City Attorney Reynolds explained the City can prosecute noise complaints under the Washington Administrative Code, which requires decibel level readings or under the City's nuisance ordinance, which requires an investigation and testimony of neighboring residents. The nuisance ordinance was adopted within the last 18 months, and the City has prosecuted cases under the nuisance ordinance. Tina Christiansen, 409 "U" Street SE, Auburn, WA Ms. Christiansen spoke in favor of her appeal and to allow her special home occupation. She noted the business will be conducted completely within an enclosed garage. She indicated the complaints and calls to 9-1~1 about stereo noise from her residence are a result of a neighborhood dispute and not related to her and her husband's business. Page 4 City of Auburn Council Meeting Minutes July 21, 1997 Kristina Hicks, 1113 - 3rd Street NE, Auburn, WA Ms. Hicks reported that her mother and mentally disabled sister live next door to Mr. and Mrs. Christiansen. She spoke on behalf of her mother who opposes the Christiansen's application for a special home occupation. She expressed concern with noise, additional traffic and parking problems which may be created by the special home occupation. Tina Christiansen, 409 "U" Street SE, Auburn, WA Mrs. Christiansen spoke in favor of allowing her and her husband to conduct their livelihood at their residence and indicated they do not intend to be disruptive to the neighborhood. Motion by Councilmember Borden, second by Councilmember Wagner to close the public hearing. MOTION CARRIED UNANIMOUSLY. 7-0. Councilmember Borden indicated that when considering home occupation permits, the City must ensure that the activity is not disruptive to the neighborhoods. She expressed her belief that Mr. and Mrs. Christiansen's special home occupation could potentially disrupt the neighborhood. Motion by Councilmember Borden, second by Councilmember Wagner to affirm the Hearing Examiner's decision. Councilmember Cerino spoke in favor of affirming the Hearing Examiner's decision in light of the number of neighboring residents who oppose the special home occupation. MOTION CARRIED UNANIMOUSLY. 7-0. Page 5 City of Auburn Council Meeting Minutes July 21, 1997 B. Audience Participation 1. Lee McDaniel, 623 - 1 st Avenue East, Pacific, WA Mr. Lee spoke on behalf of his sister, Marilyn, who resides at 222 "D" Street SW in Auburn and is developmentally disabled. Mr. Lee reported that his sister was attacked Monday by a pit bull dog. He has begun an effort to prevent further pit bull attacks and require all pit bull dog owners to have the resources to pay for damages caused by such an attack. Mr. Lee indicated he will compile his ideas in a letter to the Council later this week. Mr. Lee also reported that the pit bull dog which attacked his sister was previously involved in staged dog fights. Mayor Booth recommended that Mr. Lee also bring the matter to the attention of King County. Mr. Lee reported that King County Animal Control did not respond to his sister's attack until 30 hours after the incident. Mayor Booth encouraged Mr. Lee to advise the King County Executive of King County Animal Contrel's failure to respond in a timely manner. City Attorney Reynolds also added that King County Animal Control is under contract to the City to respond to animal complaints within the city of Auburn. If Mr. Lee's description of King County Animal Contrel's response time is correct, the City would address the issue under the City's contract with King County. Mr. Lee advised that he has attempted to contact King County Councilmembers, but they have not returned his calls. Mr. Lee advised he will submit a letter to the City Council as soon as possible, and requested the City Council address his concerns. Councilmember Borden thanked Mr. McDaniels for attending the meeting this evening. She indicated her desire to review the contract with King County for animal control services. Mayor Booth advised that he will refer review of the contract with King County for animal control services to the Municipal Services Committee. Vicari regarding Application No. CAP0001-97 Appeal - Special Home Occupation Permit. 2. Letter dated July 11, 1997 to the City Council from Alda H. Wilkinson regarding Resolution and Hearing Decision, File No. 1990 - City of Auburn - Stewart Annexation. III. COUNCIL COMMITTEE REPORTS A. Municipal Services Chair Brothers reported the Municipal Services Committee did not meet this afternoon. The next regular meeting of the Municipal Services Committee is scheduled for Monday, August 4, 1997 at 4:30 p.m. B. Planning & Community Development Chair Borden reported the Planning and Community Development Committee met July 14, 1997. The Committee held a public hearing on water and sewer certificates for Donald Johnson, Jr. The Committee discussed the Auburn Park preliminary plat extension, the Boundary Review Board's action on the Stewart annexation, the Auburn Downtown Association/Business Improvement Area contract, agreements with DAWN, an Art Commission grant, and a proposed Planned Unit Development ordinance. The next regular meeting of the Planning and Community Development Committee is scheduled for Monday, July 28, 1997 at 7:30 p.m. C. Public Works Chair Wagner reported the Public Works Committee met July 14, 1997. The Committee discussed and reviewed the Metricore Franchise Agreement, a grant from the Federal Railroad Administration to study traffic impacts related to railroad changes, the Six Year Transportation Improvement Program, and several contract administration items. The Committee also discussed a cost of service study for sanitary sewer, the Comprehensive Storm Plan, the Comprehensive Transportation Plan, and the 8th Street Page 7 City of Auburn Council Meeting Minutes July 21, 1997 corridor project. The next regular meeting of the Public Works Committee is scheduled for Monday, July 28, 1997 at 5:00 p.m. D. Finance Chair Barber reported the Finance Committee met this evening at 7:00 p.m. The Committee discussed Ordinance No. 4996, Resolution No. 2864, claims and payroll vouchers, and the proposed mid-year budget adjustment. The next regular meeting of the Finance Committee is scheduled for Monday, August 4, 1997 at 6:30 p.m. IV. CONSENT AGENDA A. Minutes 1. Minutes of the July 7, 1997 regular City Council meeting. B. Public Works Project Number 596 04.8.1 a) Request City Council approval on a Change Order Number 1 to Contract No. 96-18, 37th Street Storm Drainage Improvement, in the amount of $6,657.88 with Pivetta Brothers Construction, Inc. b) City Council to approve the Final Pay Estimate Number 2 in the amount of $13,268.45, and accept construction for Contract No. 96-18 according to the contract for the 37th Street Storm Drainage Improvement project with Pivetta Brothers Construction. 2. Motion by Councilmember Barber, second by Councilmember Brothers to approve the Consent Agenda. Councilmember Poe requested Item IV.D.3.b, Public Works Project Number 620A, removed from the Consent Agenda and considered separately. MOTION TO APPROVE THE CONSENT AGENDA, EXCLUDING ITEM IV.D.3.b, CARRIED UNANIMOUSLY. 7-0. Councilmember Poe requested that the mural paintings for reservoirs 4A and 4B be deleted from the bid proposal for Public Works Project Number 620A. He expressed opposition to the proposed expenditure of funds for mural painting. In response to a question from Councilmember Brothers, Public Works Director Currie advised that staff is requesting permission to advertise the project for bids. The mural painting is included in the bid proposal as a separate schedule for separate consideration. Councilmember Wagner reported that the Public Works Committee was not presented with the same bid cost detail as presented to the City Council this evening. He indicated the Public Works Committee members were of the understanding that the mural painting would be bidtied as a separate project. He agreed with Councilmember Poe to delete it from the bid proposal. Motion by Councilmember Poe, second by Councilmember Wagner to delete the mural painting from the bid proposal for Public Works Project Number 620A. Councilmember Barber spoke in favor of deleting the mural painting from the bid proposal. MOTION CARRIED UNANIMOUSLY. 7-0. Page 10 City of Auburn Council Meeting Minutes July 21. 1997 Motion by Councilmember Wagner, second by Councilmember Cerino to grant permission to advertise for PR 620A, Lea Hill Reservoir Protective Coating, as modified. Councilmember Cerino requested that the exterior overcoat be an aesthetically pleasing color. Councilmember Brothers added that the reservoir overcoating should be a color which blends into the surroundings. Councilmember Poe agreed with Councilmember Brothers that the exterior overcoating should be a color which blends into the surroundings. MOTION CARRIED UNANIMOUSLY. 7-0. Councilmember Poe requested the Council receive more detailed project budget information in light of the project cost increase from $200,000 to $500,000. Motion by Councilmember Wagner, second by Councilmember Cerino to advertise for bids Public Works Project Number PR 620A, as modified, and direct the Director of Public Works to provide a background statement regarding the financial change justifying the project cost increase from $200,000 to $500,000. MOTION CARRIED UNANIMOUSLY. 7-0. Finance Director Supler advised that at this evening's Finance Committee meeting, the Committee requested Finance Department staff to provide additional information on the water reservoir project prior to any recommendation on the mid-year budget adjustment. V. UNFINISHED BUSINESS A. 1998-2003 Six Year Transportation Improvement Program At the July 7, 1997 regular City Council meeting, Resolution No. 2855 was returned to the Public Works Committee for further study. See Item VII.B.4 of these minutes for action on the 1998-2003 Six Year Transportation Improvement Program. Page 11 City of Auburn Council Meeting Minutes July 21, 1997 VI. NEW BUSINESS A. Application No. PLT0009-90 03.5 PLT0009-90 City Council to consider granting a l-year extension to the preliminary plat of Northward Development (Auburn Park), 53 acres located on the north side of 37th Street N.E. and westerly of Auburn Way North and consists of a 12 lot industrial plat, to July 20, 1998. Motion by Councilmember Borden, second by Councilmember Wagner to grant an extension to the preliminary plat of Auburn Park to July 20, 1998; and instruct the City Attorney to prepare the necessary Resolution. In response to a question from Councilmember Poe, Assistant Planning Director Rued advised that the previous one year plat extensions coincide with the July 20 preliminary plat date. MOTION CARRIED UNANIMOUSLY. 7-0. B. Development Agreement A3.13.8 WSC 0018-97 City Council to consider the request of Donald Johnson, Jr. for the issuance of water and sewer availability certificates and approval of a development agreement for a short plat into two lots on property located at 30619 124th Avenue S.E., Auburn. Motion by Councilmember Borden, second by Councilmember Wagner to approve the Development Agreement and issue the water and sewer availability certificates to the applicant. Ordinance No. 4981 A3.14 An Ordinance of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute a Franchise Agreement between the City and Metricom, Inc. Motion by Councilmember Wagner, second by Councilmember Cerino to introduce and adopt Ordinance No. 4981. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Ordinance No. 4990 F5.4, 03.4.1.1 An Ordinance of the City Council of the City of Auburn, Washington, authorizing the acceptance of a grant from the Federal Railroad Administration (FRA) to be used for an examination of the impact of grade separation construction and amendment of the Auburn Downtown Plan for the City of Auburn. Motion by Councilmember Wagner, second by Councilmember Poe to introduce and adopt Ordinance No. 4990. MOTION CARRIED UNANIMOUSLY. 7-0. 3. Ordinance No. 4991 F5.3 An Ordinance of the City Council of the City of Auburn, Washington, approving an appropriation of grant funds in the amount of three thousand nine hundred seventy and 00/100 dollars, ($3,970.00) as partial support for Auburn Arts Commission grants to local arts organizations and authorizing the Mayor to accept the grant from King County Office of Cultural Resources. Motion by Councilmember Barber, second by Councilmember Wagner to introduce and adopt Ordinance No. 4991. MOTION CARRIED. 6-0. 4. Ordinance No. 4992 O3.10.1 CUP0004-97 An Ordinance of the City of Auburn, Washington, providing for a Conditional Use Permit to allow the construction of a wireless telecommunications facility that consists of an 80- foot high monopole with six antennas on property zoned M-2 (Heavy Industrial) located at 25 30th Street NE, within the city of Auburn, Washington. Motion by Councilmember Borden, second by Councilmember Wagner to introduce and adopt Ordinance No. 4992 MOTION CARRIED UNANIMOUSLY. 7-0. 5. Ordinance No. 4993 03.5 PLT0002-89R An Ordinance of the City of Auburn, Washington, providing for the alteration of the Final Plat of Vistara, Phase I, located on the west side of the West Valley Highway and north of Aaby Drive, within the city of Auburn, Washington. Motion by Councilmember Borden, second by Councilmember Wagner to introduce and adopt Ordinance No. 4993. MOTION CARRIED UNANIMOUSLY. 7-0. Ordinance No. 4994 O3.1 ANX0003-97 An Ordinance of the City of Auburn, Washington, annexing to the City for municipal purposes certain land thereto, known as the Fenster property which is adjacent to the east City of Auburn city limits. Motion by Councilmember Borden, second by Councilmember Wagner to introduce and adopt Ordinance No. 4994. MOTION CARRIED UNANIMOUSLY. 7-0. 7. Ordinance No. 4995 A3.13.8 WSC0018-97 An Ordinance of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn to execute a Development Agreement between the City and Donald W. Johnson. Motion by Councilmember Borden, second by Councilmember Wagner to introduce and adopt Ordinance No. 4995. MOTION CARRIED UNANIMOUSLY. 7-0. 8. Ordinance No. 4996 F5.3, O1.8 An Ordinance of the City Council of the City of Auburn, Washington, authorizing the Mayor to execute the Chief Executive Officer Cerlification in support of King County Housing Authority's "Working Together" drug elimination grant application to HUD, approving the City's commitment to contract with the King County Housing Authority to provide certain services in return for receipt of grant moneys in the amount of fifty eight thousand ($58.000.00) dollars with the City contributing services and benefits with an in- kind value of thirty-six thousand three hundred fifty seven ($36,357.00) dollars and the King County Housing Authority contributing in-kind services in the amount of five thousand ($5,000.00) if the grant is awarded. MOTION CARRIED UNANIMOUSLY. 7-0. B. Resolutions 1. Resolution No. 2792 O3.11.2 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn, to execute a contract between the City of Auburn and Domestic Abuse Women's Network (DAWN) relating to funds received from a portion of the criminal justice two percent sales tax revenues received by the City pursuant to RCW 82.14.340 to provide domestic violence community advocacy services for 1997. Councilmember Borden reported that during the Planning and Community Development Committee review of Resolution No. 2792, she had requested an expanded nondiscrimination clause in the Contract for Services. She noted the language was not contained in the Contract. Motion by Councilmember Borden, second by Councilmember Wagner to adopt Resolution No. 2792 with the following amendment to Article 2, subparagraph D.b contained on page 3 and Article 8 on page 11 to read in part: "race, color, sex, religion, nationality, creed, marital status, sexual orientation, age, or presence of any sensory, mental or physical handicap." In response to a question from Councilmember Brothers, Mayor Booth explained that the nondiscrimination clauses are intended to protect individuals who are seeking services from the organization. Resolution No, 2793 03.11.2 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn, to execute a 1997 Contract for Services between the City of Auburn and Domestic Abuse Women's Network (DAWN). Motion by Councilmember Borden, second by Councilmember Wagner to adopt Resolution No. 2793 with the following amendment to Article 8, Nondiscrimination, to include in part: "race, color, Sex, religion, nationality, creed, marital status, sexual orientation, age, or presence of any sensory, mental or physical handicap." MOTION CARRIED UNANIMOUSLY. 7-0. 3. Resolution No, 2854 A1.10 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn to execute a contract with the Auburn Downtown Association, a non-profit organization, to administer the operation of the Business Improvement Area. Motion by Councilmember Borden, second by Councilmember Wagner to adopt Resolution No. 2854. Councilmember Poe questioned paragraph 3 of the Agency Service Agreement regarding the City's appointment of the Committee of Ratepayers. Planning and Community Development Director Krauss advised that the Mayor submits appointments to the Committee of Ratepayers for confirmation by the City Council. Councilmember Cerino expressed regret that Kris Susee, Executive Director of the Auburn Downtown Association, will be leaving her position to pursue other career goals. Resolution No. 2855 04.9.3 A Resolution of the City Council of the City of Auburn, Washington, adopting the 1998-2003 revisions and extensions of the Six Year Transportation Improvement Program of the City of Auburn pursuant to R.C.W. Chapter 35.77 of the laws of the State of Washington. Motion by Councilmember Wagner, second by Councilmember Cerino to adopt Ordinance No. 2855. MOTION CARRIED UNANIMOUSLY. 7-0. 5. Mayor Booth recessed the meeting to executive session at 8:51 p.m. for approximately 20 minutes in order to discuss collective bargaining negotiations and potential litigation.
