Flag Salute Mayor Booth called the meeting to order at 7:30 p.m. and led those in attendance in the Pledge of Allegiance. B. Roll Call Mayor Booth and the following members of the City Council were in attendance: Rich Wagner, Sue Singer, Trish Borden, Fred Poe, Gene Cerino, and Stacey Brothers. Councilmember Jeanne Barber was excused from attendance. Staff members present included: Parks and Recreation Director Dick Deal, Assistant Personnel Director Dan Watts, Fire Chief Bob Johnson, Police Chief Dave Purdy, Finance Director Diane L. Supler, Public Works Director Frank Currie, City Engineer Dennis Dowdy, Transportation Planner Nick Afzali, Traffic Engineer Steve Mullen, Planning and Community Development Director Paul Krauss, Senior Planner Bob Sokol, Associate Planner Bill Mandeville, City Attorney Michael J. Reynolds, and Acting City Clerk Dani Daskam. C. Announcements and Appointments 1. Announcements a) AmeriCorps Team Oath Mayor Booth to administer the AmeriCorps Oath to members of the Auburn AmeriCorps Team. Associate Planner Bill Mandeville introduced members of Auburn's first AmeriCorps team. AmeriCorps is part of the national community service movement. The average age of the AmeriCorps team member is 45 years old. Approximately two-thirds of the members are college educated. Three members are residents of Auburn and two attended Auburn schools. Mr. Mandeville introduced the following members of Auburn AmeriCorps team: Gayle Jones, Kathy Wilson, Terri Moreland, Faye Berg, Angela Pinsk, Susan Durham, Matsy Matson, and Gerry Glenn. Team members have completed two weeks of training and service learning and last week began working at their sites. Mayor Booth administered the AmeriCorps oath to the Auburn team members, and team members received the congratulations of the Mayor and City Council. The AmeriCorps team presented Mayor Booth and Planning and Community Development Director Krauss with AmeriCorps Team shirts in recognition of their support of the program. b) Proclamation A1.8 (1) American Education Week Mayor Booth to declare the week of November 16-22, 1997 as American Education Week in the city of Auburn. Mayor Booth read and presented a proclamation declaring the week of November 16-22, 1997 as American Education Week in the city of Auburn to Carolyn Olson, President of the Auburn Education Association, and Heidi Bent, Co-chair of the Auburn American Education Week. Ms. Olson presented the Mayor and members of the Council with American Education Week posters and remembrances. Agenda Modifications Agenda modifications included the full text of Ordinance No. 5037 transmitted under Item VII.A.3 of these minutes and the full text of Ordinance No. 5038 transmitted under Item VII.A.4 of these minutes. II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings 1. Comprehensive Plan Amendments 03.4.3 This public hearing is an opportunity for public input prior to consideration of the 1997 amendments to the Comprehensive Plan. In addition to this evening's hearing on the Comprehensive Plan amendments, the public hearing will be continued to the November 17, 1997 Council meeting. Although testimony can be given on either night, the following amendments will be primarily addressed this evening: IComprehensive Plan Map Amendment #t Request to change the comprehensive plan map designation for the site located at 307 Oravetz Place SE from heavy commercial to light industrial. IComprehensive Plan Map Amendment #2 Request to change the comprehensive plan map designations in the area bounded by "B" Street NW, 30th Street NW, the Auburn Airport and 16th Street NW. l, Comprehensive Plan Map Amendment #3 Request to change the comprehensive plan map designation for the property known as Terrace View located within the City's Pierce County potential annexation area. Mayor Booth explained that this evening's public hearing will allow persons to testify either for or against the proposed Comprehensive Plan amendments as each amendment is introduced during the hearing. Senior Planner Bob Sokol presented the staff report on the proposed 1997 Comprehensive Plan amendments. He explained that the Council will hold two public hearings on the proposed Comprehensive Plan amendments which will be held this evening and on November 17, 1997. He identified the proposed Comprehensive Plan amendments addressed this evening. Following conclusion of the testimony this evening, Council will be requested to continue the public hearing to November 17, 1997. The Council will be requested to act on the amendments following conclusion of the public hearing on November 17. Mayor Booth opened the public hearing. No one from the audience requested to speak regarding Comprehensive Plan Map Amendment 1. eComprehensive Plan Map Amendment #2 Request to change the comprehensive plan map designations in the area bounded by "B" Street NW, 30th Street NW, the Auburn Airport and 16th Street NW. No one from the audience requested to speak regarding Comprehensive Plan Map Amendment 2. IComprehensive Plan Map Amendment #3 Request to change the comprehensive plan map designation for the property known as Terrace View located within the City's Pierce County potential annexation area. Mary Urbach, Vandeberg, Johnson & Gandara, 1900 First Interstate Plaza, 1201 Pacific Avenue, Tacoma, WA Ms. Urbach identified herself as a representative of the Terrace View project which requests Comprehensive Plan Map Amendment 3. The project is located at the intersection of 8th Street East and East Valley Highway within the City's potential annexation area. Ms. Urbach distributed copies of the Terrace View site plans. She explained that in 1995, the City adopted Pierce County's designation of the area as Moderate Single Family. Pierce County designated the area without any physical inspection of the property. The property abuts the Lakeland Hills property to the east, and its topography does not lend itself to Moderate Single Family development. In 1996, Pierce County recognized the error in classification of the property and agreed to change the classification to Mixed Use District. The City of Auburn does not have a similar land use designation. Pierce County agreed to a zoning reclassification for three reasons: topography, site location, and transportation corridors. The topography of the land includes a significant elevation change from East Valley Page 5 City of Auburn Council Meeting Minutes November 3. 1997 Highway to the top of the property. The original plan from 1984 is the same plan which is proposed today. It is a mixed use proposal including multi-family residential and townhomes with commercial on the lower portion of the property. The property is located near major arterials and Highway 167 and major employment centers in South King County. The property is also adjacent to the planned Lake Tapps Parkway and 8th Street East corridor. Since the City does not have a comparable zoning classification to Pierce County's Mixed Use designation, the proponent requests that the City designate the area C-3 which will allow both residential and commercial uses. Ms. Urbach explained that the commercial development is intended to be limited to retail and office uses. She suggested that prior to annexation of the property to the City, it may be appropriate to provide assurances to the City of the type commercial development which will be allowed on the property. Ms. Urbach explained that the entire development is proposed for C-3 designation. The City's multi-family residential zoning classification does not allow for building height above two or two and one-half stories. Three-story residential units are proposed for portions of the south terrace of the property. The C-3 zone allows three-story structures. Councilmember Borden advised that during discussions in the Planning and Community Development Committee, concern was expressed with zoning all of the property to C-3 which may open up commercial development of the property. Ms. Urbach explained that the Terrace View proposal for a C-3 designation includes the offer to enter into a contractual agreement with the City to limit the uses for the property. Councilmember Brothers inquired regarding the artist renderings of the Terrace View four-story multi-family units. Ms. Urbach explained that the four-story complex is intended for a senior citizen complex. The complex's first floor would be partially below ground. Ms. Urbach advised that the portion of the property where the senior complex is Page 6 City of Auburn Council Meeting Minutes November 3, 1997 proposed is being condemned by Pierce County as part of the Lake Tapps Parkway project. Councilmember Poe spoke in favor of limiting a portion of the property as commercial and establishing a special planning area for the remainder. Planning and Community Development Director Krauss noted that the City can also either conditionally zone the property at time of annexation or can control the land use designation and uses through a pre-annexation agreement. He added that the topography of the property limits its use, and the only development likely to occur will be the uses proposed by the developer. Ms. Urbach spoke to the time constraints regarding the adoption of the comprehensive plan amendments and the completion of their pre-annexation agreement. Councilmember Wagner inquired whether the City can adopt the Comprehensive Plan Map Amendment 3 conditioned upon an acceptable pre-annexation agreement. Planning Director Krauss questioned the legality of conditioning comprehensive plan amendments, and agreed to look into the question further. He stressed that a number of methods exist to ensure that the City's expectations are met. In response to a question from Councilmember Borden, Planning Director Krauss advised that staff are currently reviewing the pre-annexation agreement, and he anticipates the agreement will be presented to the Planning and Community Development Committee at its first meeting in December. Councilmember Poe inquired whether the topography which exists on the site plan exists now or whether further excavation will be required. Ms. Urbach explained that a mining permit was permitted in 1984 by Pierce County and was completed in 1992. The north and south terraces, in their current state, will require minimal earth movement for site preparation. Ms. Urbach expressed her hope that progress can be made on their pre-annexation agreement before adoption of the Page 7 City of Auburn Council Meeting Minutes November 3, 1997 comprehensive plan amendments. Senior Planner Sokol advised that the 1997 Comprehensive Plan Amendments must be adopted by December 31, 1997. lComprehensive Plan Map Amendment if4 Request to change the comprehensive plan map designation for 20.8 acres located east of I Street and just north of approximately 31st Street NE from high density residential and single family residential to moderate density residential. Jenniece Severson, 1217 30th Street NE, Auburn, WA Ms. Severson inquired about the City's policy for distributing City Council minutes. Mayor Booth advised the minutes are distributed following their approval by the City Council. The minutes of the November 3, 1997 City Council meeting will be available after their approval on November 17, 1997. Ms. Severson identified herself as the spokesperson for the Riverpark Estates Homeowners Association. Ms. Severson addressed her concerns with "r' Street NE from 20th Street NE north to 31st Street NE where Riverpark Estates is located. She presented photographs of "1" Street and 30th and 31st Street NE during 1995 and 1996 flooding. Ms. Severson advised that even after installation of a bio-swale in the area, flooding occurred again in October 1997. She expressed concern with the impact of the proposed development by Arcarius Homes on adjacent properties. She recommended that the City Council review the impact of the development and the adequacy of the bio-swale. She also expressed concern with the environmental impact of further development along the Green River. She expressed opposition to the construction of a family mobile park in the area or anywhere in the city, and suggested additional low- income housing is not needed in Auburn. She recommended the City Council approve the Planning Commission's recommendation to designate the entire parcel as R-1. She also requested the City place a moratorium on construction from 22nd Street NE to the Kent city limits to prevent further storm water run-off. Page 8 City of Auburn Council Meeting Minutes November 3. t997 Allen Corbin, 3112 "K" Street NE, Auburn, WA Mr. Corbin expressed opposition to the development of a mobile home park for the area referred to in Comprehensive Plan Map Amendment 4, and concern with decreasing property values in his neighborhood. He indicated there are enough mobile homes within the city, and spoke in favor of implementing an R-1 zone for the proposed development area. Vern Needham, 3107 "L" Street NE, Auburn, WA Mr. Needham reported he lives near a low-income apartment complex, and has experienced incidents of crime which he attributes to residents of the apartment complex. He expressed concern with additional water run-off and traffic resulting from further development of the area. He recalled that the developer previously indicated both single- wide and double-wide mobiles would be included in the park. He recommended the property remain unchanged. MaW Suzanne Kuhel, 3108 "L" Street NE, Auburn, WA Ms. Kuhel advised she has been a resident of Auburn for eight years. She presented the City Council with statistics on the number of mobile homes in King County and various cities. In King County, there are 20,000 mobile homes, 12,500 of which are on rented spaces and 7,500 are real estate owned. In Auburn, there are 23 mobile home parks with 2,558 mobile homes on rented spaces and an additional 1,000 which are real estate owned. In Kent, there are 32 mobile parks with 1,778 unit on rented spaces and an additional 1,200 real estate owned mobiles. Federal Way has nine mobile home parks with 1,370 homes on rented spaces with an additional 300-400 real estate owned mobiles. SeaTac has 10 mobile home parks with approximately 921 units with an additional 100 or more real estate owned mobiles. Renton has 12 mobile home parks with 1,090 units on rented spaces with an additional 750 real estate owned mobiles. Ms. Kuhel expressed concern with the amount of stormwater in the area. She also recommended that the city of Auburn has a sufficient number of mobile home parks. She presented a map of the area identifying the mobile home sites. Page 9 City of Auburn Council Meeting Minutes November 3, 1997 Vern Krinke, 1119 30th Street NE, Auburn, WA Mr. Kinke identified himself as the Secretary-Treasurer of the Riverpark Estates Homeowners Association. Mr. Krinke requested the City Council support the R-1 zone recommendation from the Planning Commission. Sabrina Clason, 3102 "L" Street NE, Auburn, WA Ms. Clason identified herself as the manager of a four~plex located at 2441 "1" Street NE. She expressed concern with the existing traffic and visibility on "1" Street and the effect high-density development would have on the area. She urged the Council to keep the 'T' Street site low-density. Marlea Needham, 3107 "L" Street NE, Auburn, WA Ms. Needham agreed with the comments made by her neighbors this evening. She expressed concern that the proposed development on "1" Street NE would decrease property values in the area. She commended her neighbors for their efforts in keeping their neighborhood a low crime area. Brad Olschefski, Arcarius Homes, LLC, 6947 Coal Creek Parkway #257, New Castle, WA Mr. OIschefski identified himself as the proponent for Comprehensive Plan Map Amendment 4 and spoke in favor of his request. Approximately 25-30% of the subject property is currently zoned R-4 for apartments which would allow 71 dwelling units. The remainder of the property is zoned R-2 for single family residences and would allow 62 dwelling units. The comprehensive plan map amendment would change the zoning to R-3, moderate density. The proposed project is for the construction of a manufactured housing community, not a mobile home park. Although the current plans show 114 units, the number of units has been reduced to 112 to allow for a storm water detention area. Mr. Olschefski contended that the development would provide for its own storm water detention and would have no effect on surrounding properties. Mr. Olschefski reported that no wetlands have been identified on the property by either city, county or federal government. He advised the density of his proposed development would be less than that Page 10 City of Auburn Council Meeting Minutes November 3, 1997 of Riverpark Estates located south of his property and less than Bye the Green which lies north of his property. He reported that the average cost of a modular or manufactured house is $59,000 and the value of the lot and site location would bring the total cost of the house to approximately $114,000 and comparable to the value of homes at Riverpark Estates. According to Mr. Olschefski, City code allows manufactured homes on single family lots provided they are on permanent foundations and have pitched roofs. He also added that the proposed development's impact on traffic on "1" Street NE would be less than a development allowed under current zoning. Mr. Olschefski also pointed out that his development would provide a parks donation and bear part of the cost of extending "1" Street NE. In response to a question from Councilmember Borden, Mr. Olschefski indicated that some of the lots will be leased to homeowners and some will be sold to the homeowners in a similar arrangement to condominiums. Councilmember Singer questioned Mr. Olschefski's reasons for the rezone and construction of manufactured housing compared to the existing zoning for R-4 and R-2. Mr. Olschefski indicated a manufactured housing development is more manageable than an apartment complex. In response to questions from Councilmember Brothers, Mr. Olschefski advised he plans to meet all the requirements for constructing a manufactured home in an R-1 zone including permanent foundations and pitched roofs. The community will also have a six foot barrier as required by code. Councilmember Cerino requested that Fire Chief Johnson respond to the long, narrow cul-de-sac proposed in the development. Chief Johnson indicated that fire response access through a long cul-de-sac can be difficult considering the size of the response vehicles. Councilmember Cerino also inquired whether Mr. Olschefski has considered making the development a senior park and whether garages will be included with each unit. Mr. Olschefski indicated attached garages are a requirement for the development, and he has not considered limiting the park as a senior park. Page 11 City of Auburn Council Meeting Minutes November 3, 1997 Councilmember Wagner inquired regarding Mr. Olschefski's comments to sell some lots to homeowners and questioned the adequacy of the lot sizes. Mr. Olschefski reported that the lots are roughly 5,000 square feet, and sales would be handled the same as a condominium development. In response to a question from Councilmember Brothers, Planning Director Krauss advised that the City's manufactured home park district allows a maximum density per unit of 5,200 square feet and does not address lot sizes. David Dean, 3408 "1" Street NE #L104, Auburn, WA Mr. Dean expressed concern for the wildlife that occupy the undeveloped property. Laurie Lane, 1204 31st Street NE, Auburn, WA Ms. Lane expressed concern with the different descriptions of the proposed development that have been offered by the developer. She spoke against the construction of a low- income park in the area. Dale Osborne, 3103 "M" Street NE, Auburn, WA Mr. Osborne reported that at an October 4, 1997 informational meeting, the average lot size for the development was described as 3,990 square feet. He expressed concern with transient residents. He also suggested the Council consider the zoning issue only and not the proposed development since development plans and owners can change. He conveyed his opposition to designating the area for mobile home park, and spoke in favor of a single-family designation. Mr. Osborne also questioned whether wetlands exist on the property since the property has not been tested for wetlands. Councilmember Singer questioned whether the property has been tested for wetlands. Senior Planner Bob Sokol advised that approximately four to five years ago, the City conducted a survey based upon soil type and plant type to identify parcels of land that seemed to have wetlands on them. There was no indication that wetlands were on this Page 12 City of Auburn Council Meeting Minutes November 3, 1997 site. However, the site has not been specifically tested for wetlands. Carol Wilson, 1010 31st Street NE, Auburn, WA Ms. Wilson spoke in favor of designating the subject property as R-1. She expressed opposition to construction of units that even closely resemble a mobile home. She suggested that the cost of a space in a senior mobile home park may be prohibitive to many fixed-income seniors. She also expressed concern with possible wetlands on the proposed development site. Mike Uhl, 12828 Northup Way, Suite 300, Bellevue, WA Mr. Uhl identified himself as one of the engineers who designed the proposed manufactured home park, and he addressed some of the comments already made regarding the project. Mr. Uhl advised that the plans for the park have not changed as suggested by some of the area residents. Mr. Uhl reported that he offered several variations of the plan to his client, but the current plan appears to best serve the market needs. The cost of the homes will be $40,000 and up, plus set up costs, and land costs. Mr. Uhl acknowledged that the area floods, but there are stormwater detention ponds required for the project. No single wide units will be allowed in the park, and the park project provides for side-by-side parking to accommodate two vehicles. Thomas Milliden, 1205 31st Street NE, Auburn, WA Mr. Milliden reported that he purchased his home approximately six months ago with the understanding that single family homes would be constructed at the proposed project site located behind his residence. He objected to the proposed project and spoke in favor of single family residences. He also expressed concern with the number of different variations he has heard for the project. He urged the Council to consider the comments made by the area residents this evening. Mr. Milliden also expressed concern with the past maintenance of the vacant land. Page13 City of Auburn Council Meeting Minutes November 3. 1997 Mayor Booth invited anyone in the audience to comment on any of the remaining proposed comprehensive plan map or text amendments. Earl Floyd, 21017 Snag Island Drive, Sumner, WA Mr. Floyd identified himself as the representative for the Dieringer School District. He spoke regarding Policy Text Amendment 6 to amend the Capital Facilities Plan to include the capital facilities plan for the Dieringer School District to enable the collection of impact fees within the school district boundaries. He reported Pierce County adopted the Dieringer School District's capital facilities plan, and Pierce County has a mitigation fee ordinance. The main concern is to ensure that Lakeland Hills pays its fair share so that residents of Pierce County and the Dieringer School District do not subsidize the impact of the Lakeland development. Approximately $5,000,000 has been identified as the Lakeland Company's fair share of impact fees. The Comprehensive Plan text amendment will enable the collection of impact fees within the school district boundaries. In response to questions from Councilmember Wagner and Councilmember Borden, Mr. Floyd advised the school impact fees are $1,425 per single family residence and $725 per multi-family unit. The impact fees approved by Pierce County were less than the fees contained in the school district's capital facilities plan. Any differences that need to be made up will be through bond issues. Norman Buck, 659 "1" Place NE, Auburn, WA Mr. Buck spoke regarding Comprehensive Plan Map Amendment 5. He indicated he would not be able to attend the hearing on November 17 when the proposed amendment will be addressed. He asked for clarification of the map as it appears incorrect. Mr. Sokol agreed to visit the physical site to ensure the map is correct. Mr. Buck also asked if Area "B" on the map reflects a proposed change to heavy industrial. Mr. Sokol explained that Area "B" is a City- owned parcel and the proposed classification change is to Public and Quasi-public. Mr. Buck indicated no objection to the Public and Quasi-public designation. He also requested Page 14 City of Auburn Council Meeting Minutes November 3, 1997 clarification of an area near the Area "B" on Map 5. Mr. Sokol agreed to review the map further to ensure accuracy. Motion by Councilmember Wagner, second by Councilmember Poe to continue the public hearing to November 17, 1997. MOTION CARRIED UNANIMOUSLY. 6-0. 2. Moratorium on Commercial Wireless Telecommunications Facilities 03.10.9 On April 7, 1997, the City of Auburn placed a moratorium on the issuance of permits for commercial wireless telecommunication facilities and towers for a period of six (6) months, and on September 15, 1997 extended the moratorium on the issuance of permits for commercial wireless telecommunications facilities and towers on City- owned property and rights of way for an additional sixty (60) days. Commercial wireless telecommunication facilities and towers are defined to include tower and monopole facilities for television and radio transmission and towers, monopoles, satellite dishes, micro-dishes, communication node cabinets, above-ground pedestal cabinets, antennas and relay station facilities for personal pagers, cellular phones, personal communication services (PCS), enhanced specialized mobile radio (ESWR) facilities, plus any and all necessary structures or facilities appurtenant to, or related to these various telecommunication facilities. Mayor Booth opened the public hearing. There was no staff presentation, and no one in the audience requested to speak regarding the moratorium. Motion by Councilmember Singer, second by Councilmember Wagner to close the public hearing. In response to a question from Councilmember Poe, City Attorney Reynolds advised that according to state law, whenever a moratorium is imposed a public hearing must be held on the moratorium. Later this evening, the Council will Page 15 City of Auburn Council Meeting Minutes November 3. t997 consider an ordinance to extend the moratorium sixty-five days. MOTION CARRIED UNANIMOUSLY. 6-0. City Attorney Reynolds clarified that Ordinance No. 5037 will extend the moratorium for sixty-five days from its adoption. It is hoped that prior to the expiration of the sixty-five day extension, the Council will consider and adopt a new telecommunications ordinance regulating facilities on City- owned property and public rights-of-way. 3. Draft Telecommunications Ordinance O3.10.9, O4.0 This public hearing will be reset to be held on December 1, 1997. B. Audience Participation No one from the audience requested to speak. C. Correspondence No correspondence has been submitted for City Council review. III. COUNCIL COMMITTEE REPORTS A. Municipal Services Chair Brothers reported the Municipal Services Committee did not meet this afternoon. The next regular meeting of the Municipal Services Committee is scheduled for Monday, November 17, 1997 at 4:30 p.m. B. Planning & Community Development Chair Borden reported the Planning and Community Development Committee met October 27, 1997. Public Works Chair Wagner reported the Public Works Committee met October 27, 1997 at 5:00 p.m. The Committee reviewed and recommended approval of minor changes to on-street parking and a right-of-way use permit for an awning. The Committee discussed the sanitary sewer cost of service study that is underway, and will likely be presented to the City Council early next year. The Committee reviewed the Transportation Plan, particularly the residential street width. The Committee also discussed signalization of the 29th and "R" Street SE intersection in light of the additional traffic coming down from the hill. The next regular meeting of the Public Works Committee is scheduled for Monday, November 10, 1997 at 5:00 p.m. D. Finance Vice Chair Brothers reported the Finance Committee met this evening at 7:00 p.m. The Committee recommended the appointment of Danielle Daskam as City Clerk.
