The December 15, 1997 regular meeting of the Auburn City Council was
recessed to meet on December 29, 1997 at 4:00 PM.
I. CALL TO ORDER
Mayor Booth reconvened the December 15, 1997 regular meeting, which
was recessed to meet December 29, 1997 at 4:00 p.m. Mayor Booth and
the following members of the Auburn City Council were present: Rich
Wagner, Sue Singer, Jeanne Barber, Trish Borden, Fred Poe, Gene
Cerino, and Stacey Brothers. Staff members present included: Finance
Director Diane L. Supler, City Engineer Dennis Dowdy, Assistant City
Attorney Judith Ausman, Planning and Community Development Director
Paul Krauss, Associate Planner Jeff Dixon, Deputy Chief Bob Almy, and
City Clerk Danielle Daskam.
II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE
There was no citizen input, public hearings or correspondence.
III. COUNCIL COMMITTEE REPORTS
No committee reports were given this evening.

VI. NEW BUSINESS
A. Application No. CUP0005-97'

City Council to consider the request of Auburn North Associates for
a conditional use permit to allow the construction of a 296-unit
multi-family housing complex located on the south side of 10th
Street NE, if extended.
In response to a question from Councilmember Borden, Planning
and Community Development Director Krauss advised that the
planned extension of "A" Street NW from 3rd to 15th Street runs
along the western edge of the project property. Associate Planner
Dixon displayed a map of the project area and illustrated the
location of the "A" Street extension. "A" Street will extend along the
western edge of one of the project parcels, which is not planned for
development.
Councilmember Wagner spoke regarding discussions held in Public
Works Committee regarding the requirement to have "A" Street
right-of-way deeded as part of the conditional use permit and the
requirement to have 10t" Street improved to projected "A" Street.
He suggested including both requirements as part of the
conditional use permit.
City Engineer Dennis Dowdy explained that the requirements
described by Councilmember Wagner are included in the Street
Delay Agreement between the City and the developer.
Assistant City Attorney Ausman reminded the Council that to
modify the conditions of the conditional use permit would require
remanding the application to the Hearing Examiner or scheduling a
closed record hearing for the Council.
Arthur Martin, 334 Wells Avenue South, Suite B, Renton, WA
Mr. Martin clarified that the requirements described by
Councilmember Wagner are included in the building permit
requirements. He indicated the Street Delay Agreement has been
executed, and that forwarding the Agreement to the City has been
delayed only because of a need to correct the legal description.

Councilmember Wagner expressed concern that the Hearing
Examiner's report does not address development of 10th Street to
"A" Street, if extended, but only references improvements along
365 feet of 10th Street.
At the request of Councilmember Brothers, Associate Planner
Dixon outlined the nearest north-south and east-west railroad lines
to the project site. The nearest north-south line is the Burlington
Northern Santa Fe railroad located west of the project. It was
estimated there will be an approximate 600-foot barrier between
the railroad and the project buildings.
Councilmemember Brothers inquired regarding the public funding
involved in the project. King County Housing Authority issued
bonds to provide funding to construct a total of 585 housing units in
King County. The Auburn North Associates' project is one housing
project which will receive funding from the proceeds of the bonds.
Bryan Park, 7347 25th Avenue NW, Seattle, WA
Mr. Park explained that the project has received an allocation of
tax-exempt bond authority from the state of Washington, which has
been given to King County to issue bonds on the projecrs behalf.
The bonds have been issued to meet the end of the year deadline,
but the bond proceeds cannot be released until the conditional use
permit is approved. The bonds are revenue bonds which will be
repaid from project.
Councilmember Brothers inquired regarding the level of
landscaping for the project. Associate Planner Dixon explained the
project is located within the North Auburn Business Area, a special
planning area identified in the Comprehensive Plan, which imposes
some additional requirements for landscape amenities. The
Hearing Examiner's decision includes the staff recommendation for
preparation of a landscape plan and submittal to the Planning
Department for review and approval. Councilmember Brothers
expressed the hope that the landscape design will create more
homey environs than some other senior housing projects in the
South County area.
Motion by Councilmember Borden, second by Councilmember
Wagner to approve the conditional use permit based upon the

Hearing Examiner's findings of fact, conclusions and conditions
and instruct the City Attorney to prepare the necessary ordinance.
Councilmember Poe inquired whether the maximum density for the
project site has been utilized or if further development could take
place on the project site. Associate Planner Dixon explained that
the C-1 zone requires 1,200 square feet of lot area per dwelling
unit. In order to meet the density calculation, the western part of
the project site, reserved for open space, has been encumbered
and cannot be developed beyond the density limitation.
Councilmember Poe inquired whether any of the "A" Street right-off
way is wetland. Associate Planner Dixon reported the wetland
study performed for the site a few years ago identified wetlands on
the western part of the site. The earlier wetland study was done
under a different methodology currently used, and results could be
different today. Councilmember Poe spoke in favor of identifying
the project proponent as responsible for mitigating any wetlands
along the portion of "A" Street adjacent to the project site. Planning
and Community Development Director Krauss advised that staff
reviewed and concluded that the benefit to the project from the
improvement of "A" Street was marginal, and the provision of right-
of-way probably satisfies the benefit.
City Engineer Dowdy interjected that the cost of mitigating a
wetland as a result of construction of "A" Street would be included
in the cost of the Street Delay under the City's halffstreet
ordinance.
Councilmember Poe expressed concern with allocating costs
based on equal benefits. He spoke in favor of development under
the half-street ordinance,
Councilmember Wagner agreed that the developer should be
required to construct the street under the City's halffstreet
ordinance. He disagreed that dedication of the right-of-way would
satisfy the Street Delay.
Planning and Community Development Director Krauss explained
that the Planning staff processed the application pursuant to SEPA
and the conditional use permit. The standards used to measure
the projecrs impact are strict. A determination was made that the

methods under SEPA were not the appropriate methods to have
the applicant contribute to the improvements. However, the City
has a half-street ordinance with which the developer must comply.
Councilmember Wagner reiterated his concerns that the conditional
use permit should include the requirement to have "A" Street right-
of-way deeded and the requirement to have 10th Street improved to
projected "A" Street.
City Engineer Dowdy advised that the half-street ordinance is
applied to any development independent of the SEPA process.

Mr. Park acknowledged there is a half-street requirement for the
project, although it is not part of the SEPA determination and the
conditional use permit.
Councilmember Poe inquired as to the owners of the project.

Mr. Park advised the owner is a Washington limited partnership,
whose general partner is a non-profit organization called Senior
Housing Assistance Group.
In response to a question from Councilmember Borden, the City
Council can either affirm, remand or schedule a closed record
hearing on the application. The Council can modify the Hearing
Examiner's decision only after conducting a closed record hearing.
Councilmember Poe questioned whether the property will be a
taxable piece of property.

Mr. White pointed out that under the terms of their development,
they cannot sell the property for at least 35 years.

An Ordinance of the City of Auburn, Washington, authorizing
the Mayor and City Clerk to accept donations and approving
the expenditure and appropriation of such donations to be
used by the Auburn Parks and Recreation Department for
programs and services in 1997.
Motion by Councilmember Borden, second by
Councilmember Singer to introduce and adopt Ordinance
No. 5061.
MOTION CARRIED UNANIMOUSLY. 7-0.
2. Ordinance No. 5062
O3.10.1 CUP0005-97
An Ordinance of the City of Auburn, Washington, providing
for a conditional use permit to allow for the construction of a
296-unit multi-family complex on property zoned C-1 (light
commercial) located on 10th Street Northeast, within the city
of Auburn, Washington.
Motion by Councilmember Borden, second by
Councilmember Wagner to introduce and adopt Ordinance
No. 5062.
MOTION CARRIED UNANIMOUSLY. 7-0.
