Flag Salute Mayor Booth called the meeting to order at 7:30 p.m. and led those in attendance in the Pledge of Allegiance. B. Roll Call Mayor Booth and the following members of the Auburn City Council were present: Pete Lewis, Sue Singer, Trish Borden, Fred Poe, Gene Cerino, and Rich Wagner. Councilmember Jeanne Barber was excused from the meeting. Staff members present included: Finance Director Diane L. Supler, City Engineer Dennis Dowdy, Planning and Community Development Director Paul Krauss, City Attorney Michael J. Reynolds, Fire Chief Bob Johnson, Police Chief Dave Purdy, Assistant Personnel Director Dan Watts, Parks and Recreation Director Dick Deal, and City Clerk Danielle Daskam. C. Announcements and Appointments 1. Announcements a) Proclamations (1) Optimist Bike Safety Week Mayor Booth read and presented a proclamation declaring May 24 through 30, 1998 as Optimist Bike Safety Week in the city of Auburn to Mr. Jim Fletcher and Mr. Frank Nelson representing the Optimist Club. 2. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings No public hearing was scheduled for this evening. B. Audience Participation Terry Powell, Park Apartments, 510 M Street SE, Auburn Mr. Powell, who resides at the Park Apartments, reported that the manager of the apartment complex routinely inspects the individual units every few weeks. He objected to the ongoing inspections. He also questioned the method used by the manager to bill the residents for water and sewer service. Mr. Powell requested the City investigate any code violations that may be present at the apartment complex. Mayor Booth advised that the State Landlord/Tenant Law addresses most of Mr. Powell's concerns. Finance Director Supler advised that the City serves many apartment complexes and mobile home parks through one master meter per complex. The property owner or manager may contract with a third party to individually meter each unit. According to preliminary review, the City's responsibility for enforcement extends only to the master meter. Tenant issues with regard to the owner or manager billing method should be addressed through the State Landlord/Tenant Law. Mayor Booth advised that code violations are enforced by the City. City Attorney Reynolds confirmed that the State Landlord/Tenant Act specifies the relationship between landlords and tenants. Mayor Booth urged Mr. Powell to contact the Tenants' Advocate and to report any missing or stolen property to the Police Department. Ken Minkler, 607 29th Street SE, Auburn, WA Mr. Ken Minkler questioned whether City officials know of any plans to rebuild the Person Lanes bowling alley. Mayor Booth advised that he does not know of any confirmed plans to rebuild the facility. C. Correspondence No correspondence was received for City Council review. COUNCIL COMMITTEE REPORTS A3.7.6 A, Municipal Services Chair Poe reported the Municipal Services Committee met this evening at 5:00 p.m. The Committee discussed and recommended approval of Resolution No. 2964 authorizing a Professional Services Agreement with Emergency Services Consulting Group for the purpose of completing a Fire Station Location Study. The Committee also discussed fireworks sales within the city of Auburn. The next regular meeting of the Municipal Services Committee is scheduled for Monday, June 1, 1998 at 5:00 p.m. B. Plannin.a & Community Development Vice Chair Singer reported the Planning and Community Development Committee last met on April 27, 1998. The Committee recommended approval of a Water and Sewer Agreement and adoption of several resolutions related to human services funding. The Committee also discussed an interlocal agreement and fee schedule relating to school impact fees. She requested corrections to the April 27, 1998 Planning and Community Development Committee meeting minutes to delete the fifth paragraph under Action Item No. 15 and delete the last paragraph of Information Item No. 2. The Committee also discussed the Lakeland annexation, Livable Communities Conference, and Chronic Public Inebriates. The next regular meeting of the Planning and Community Development Committee is scheduled for Tuesday, May 26, 1998. C. Public Works Chair Wagner reported the Public Works Committee met May 11, 1998. The Committee discussed an amendment to the contract with Pacific Groundwater Group, and received public comments from citizens regarding flooding in the north end of the city. The Committee also completed review of design standards and recommended the installation of a four-way stop at the intersection of Terrace View and "W" Street. Finance Vice Chair Wagner reported the Finance Committee met this evening at 6:30 p.m. The Committee reviewed and recommended approval of claims and payroll vouchers. The Committee also discussed the financing mechanism for the Lake Tapps Parkway. The next regular meeting of the Finance Committee is scheduled for June 1, 1998 at 6:30 p.m. IV. CONSENT AGENDA A. Minutes 1. Minutes of the May 4, 1998 regular City Council meeting. B. Vouchers F4.9.2,F4.9.5 1. Claims Claims check numbers 132224 through 132524 in the amount of $1,476,467.87 for Period 18 and dated May 18, 1998. 2. Payroll Payroll check numbers 245915 to 246162 in the amount of $735,548.99 and electronic deposit transmissions in the amount of $463,486.22 for a grand total of $1,199,035.21 for the pay period covering April 29, 1998 to May 12, 1998. C. Contract Administration 1. Amendment No. 4 to Agreement for Professional Services between the City of Auburn and Pacific Groundwater Group City Council to approve Amendment No. 4 to Agreement for Professional Services AG-C-15 between the City of Auburn and Pacific Groundwater Group for the continuation of the Water Resources Program and data collection efforts through 1998 in an amount not to exceed $999,570. City Council to approve Amendment No. 1 to Agreement for Professional Services AG-C-45 between the City of Auburn and Consoer Townsend Envirodyne Engineers, Inc. for continued work on alternatives for improvements on capacity sewer needs on Auburn Way South in an amount not to exceed $30,000. D. Call for Public Hearing 1. Water Service Rates F4.3, 04.11.2 City Council to call for a public hearing to be held on June 1, 1998 to receive public comments with regard to rate changes for water service based on actual cost of service. Councilmember Wagner moved and Councilmember Cerino seconded to approve the consent agenda. MOTION CARRIED UNANIMOUSLY. 6-0. V. UNFINISHED BUSINESS A. Resolution No. 2950 On May 4, 1998, the City Council tabled a motion by Councilmember Poe and second by Councilmember Wagner to adopt Resolution No. 2950. A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor to execute the 1998 Service Agreement between the City of Auburn and the Economic Development Council. Councilmember Borden moved and Councilmember Lewis seconded to remove Resolution No. 2950 from the table. MOTION CARRIED UNANIMOUSLY. 6-0. NEW BUSINESS There were no items for Council consideration under this section. VII. ORDINANCES AND RESOLUTIONS A. O~inances 1. Ordinance No. 5097 03.8 An Ordinance of the City of Auburn, Washington, providing for the rezoning of property located at 300 "M" Street N.E., within the City of Auburn, Washington, changing the zoning classification thereof from R-2 (single family) to R-O (residential office). City Attorney Reynolds read the title of Ordinance No. 5097. In response to a question from Councilmember Borden, Planning and Community Development Director Krauss advised that the variance referred to in the ordinance was approved by the Hearing Examiner and does not come before the City Council. Ordinance No. 5097 addresses the rezone, which requires City Council approval. Councilmember Borden questioned the creation of nine (9) parking spaces for a small, one-person office. Planning and Community Development Director Krauss responded that city code requires seven parking spaces and the applicant is proposing nine. Mr. Krauss could not address the applicant's reason for requesting nine parking spaces. Councilmember Borden noted that during the Hearing Examiner's hearing on the application, the applicant and neighbors expressed the desire to retain trees on the property. She questioned whether retaining the trees would be possible with the creation of nine parking spaces. Councilmember Singer moved and Councilmember Lewis seconded to introduce and adopt Ordinance No. 5097. Page 6 City of Auburn Council Meetin;I Minutes May 18, 1998 Councilmember Borden moved to amend the Ordinance No. 5097 to insert the following sentence after the third sentence of Section 3.1 as follows: "The Planning Director shall have the authority to reduce the number of parking spaces in order to preserve trees on the property." Councilmember Singer seconded. In response to a question from Councilmember Cerino, Councilmember Borden indicated the intent of her motion is to allow the Planning and Community Development Director the authority to reduce the number of parking spaces to the minimum allowed, which is seven, in order to preserve the trees. Councilmember Poe requested clarification of the proposed amendment. He also spoke against reducing the number of parking spaces. Councilmember Cerino noted that the parking spaces will be on the M Street side of the property. Councilmember Borden referred to the site plan, which indicates the trees are located on the south end of the property. Some of the trees are within two parking spaces. Councilmember Wagner questioned whether the Planning Director already has the authority to reduce the number of parking spaces to seven. Councilmember Borden noted that the Findings of Fact contained in Ordinance No. 5097 calls for nine parking spaces. City Attorney Reynolds advised that the applicant would not be able to reduce the number of parking spaces to seven unless Ordinance No. 5097 is amended to allow such reduction. Councilmember Borden spoke in favor of working with the applicant to preserve trees on the property. Councilmember Wagner spoke in favor of the proposed amendment. Councilmember Poe inquired regarding the landscaping requirements for the property. Mr. Krauss advised that Type 2 landscaping is required. Councilmember Poe spoke in favor of allowing the applicant more flexibility. He suggested giving the Planning Director authority to modify the landscaping requirements. MOTION TO AMEND ORDINANCE NO. 5097 CARRIED. 4- 2. Councilmembers Cerino and Poe voted no. MOTION TO INTRODUCE AND ADOPT ORDINANCE NO. 5097, AS AMENDED, CARRIED UNANIMOUSLY. 6-0. 2. Ordinance No. 5098 O3.4.1.2 An Ordinance of the City of Auburn, Washington, providing for the zoning of the Lakeland property located in Pierce County, within the city of Auburn, Washington, establishing the zoning classification of Lakeland South PUD. City Attorney Reynolds read the title of Ordinance No. 5098. Councilmember Borden moved and Councilmember Singer seconded to introduce and adopt Ordinance No. 5098. MOTION CARRIED UNANIMOUSLY. 6-0. 3. Ordinance No. 5099 03.4.3 An Ordinance of the City Council of the City of Auburn, Washington, amending Ordinance No. 5091 passed May 4, 1998, relating to adopting emergency Comprehensive Plan map and text amendments to delete the finding of fact pertaining to a call for public hearing. City Attorney Reynolds read the title of Ordinance No. 5099. Councilmember Borden moved and Councilmember Lewis seconded to introduce and adopt Ordinance No. 5099. MOTION CARRIED UNANIMOUSLY. 6-0. Resolution No. 2957 A3.13.2, O4.11 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor to execute two public waterline facility easements between the City of Auburn Parks and Recreation Department and the City of Auburn Water Utility Enterprise Fund. City Attorney Reynolds read the title of Resolution No. 2957. Councilmember Wagner moved and Councilmember Cerino seconded to adopt Resolution No. 2957. MOTION CARRIED UNANIMOUSLY. 6-0. 2. Resolution No. 2959 A3.13.2, O4.11 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor to execute a public watermain easement between the City of Auburn Water Utility Enterprise Fund and the Lakehaven Utility District. City Attorney Reynolds read the title of Resolution No. 2959. Councilmember Wagner moved and Councilmember Cerino seconded to adopt Resolution No. 2959. MOTION CARRIED UNANIMOUSLY. 6-0. 3. Resolution No. 2961 A3.11.2 A Resolution of the City Council of the City of Auburn, Washington, repealing Resolution No. 2949 passed May 4, 1998, and creating a new resolution authorizing the Mayor and City Clerk to execute an Agreement for Services with Washington Women's Employment and Education to provide employment training services to Auburn low income residents. Councilmember Borden moved and Councilmember Singer seconded to adopt Resolution No. 2961. MOTION CARRIED UNANIMOUSLY. 6-0. 4. Resolution No. 2962 03.11.2 A Resolution of the City Council of the City of Auburn, Washington, amending Resolution No. 2944 approved by the City Council on May 4, 1998 which authorized the Mayor and City Clerk to execute an Agreement with Children's Home Society to provide child care services in order to amend Section 1, "Agreement" of Resolution No. 2944, to correct and clarify Section 1 "Agreement" by clarifying that program services will be provided to Auburn residents rather than just those who participate in the Families First Program. City Attorney Reynolds read the title of Resolution No. 2962. Councilmember Borden moved and Councilmember Lewis seconded to adopt Resolution No. 2962. MOTION CARRIED UNANIMOUSLY. 6-0. 5. Resolution No. 2964 02.0 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute a Professional Services Agreement between the City of Auburn and the Emergency Services Consulting Group for the purpose of completing a fire station location study. City Attorney Reynolds read the title of Resolution No. 2964. He also noted a correction to the first finding of fact needs to be made to change "$35,000" to "funds". Councilmember Poe moved and Councilmember Cerino seconded to adopt Resolution No. 2964. MOTION CARRIED UNANIMOUSLY. 6-0. Page 10 City of Auburn Council Meetin~l Minutes May 18, 1998 VIII. MAYOR'S REPORT A. SPecial City Council Meeting Mayor Booth announced a special City Council meeting to be held Tuesday, May 26, 1998 regarding the proposed Regional Finance and Governance Plan. B. Executive Session Mayor Booth recessed the regular meeting to executive session at 8:17 p.m. for approximately 10 minutes in order to discuss real estate matters. No action is anticipated following the executive session. Mayor Booth reconvened the meeting at 8:41 p.m. IX.
