Flag Salute Due to the absence of Mayor Booth and Mayor Pro-tem Jeanne Barber, Councilmember Wagner presided over the meeting. Councilmember Wagner called the meeting to order at 7:30 PM and led those in attendance in the Pledge of Allegiance. B. Roll Call The following Councilmembers were present: Pete Lewis, Sue Singer, Trish Borden, Fred Poe, Gene Cerino, and Rich Wagner. Mayor Booth and Councilmember Jeanne Barber were excused from the meeting. The following staff members were in attendance: Parks and Recreation Director Dick Deal, Fire Chief Bob Johnson, Finance Director Diane L. Supler, Assistant Planning Director Lynn Rued, and City Clerk Danielle Daskam. C. Announcements and APPointments 1. Announcements Councilmember Wagner announced that Mayor Booth and staff members are not in attendance due to their required presence at the mediation of litigation between the City and Burlington Northern Railroad. Because of Mayor Booth's and other key staff members' necessary absence, the public hearings scheduled for this evening will be opened and immediately continued until Wednesday, July 22, 1998. Page 1 City of Auburn Council Meetin¢l Minutes July 20, 1998 Steve DiJulio, Foster Pepper & Shefelman, 1111 Third Avenue, Suite 3400, Seattle, WA Mr. DiJulio identified himself as legal counsel for the City Council this evening. He explained that the City Council will open the public hearings, receive written submissions, recognize any written submissions received by the City Clerk prior to the commencement of the hearings, and then continue the hearings to Wednesday, July 22, 1998. For clarification of these minutes, the preceding announcements occurred immediately following Item I.D of these minutes. 2. Appointments There were no appointments for City Council consideration this evening. D. A.clenda Modifications The agenda modification dated July 20, 1998 included correspondence dated June 18, 1998 from Donald Gillooly transmitted under Item II.C.3 of these minutes. II, CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings 1. Application No. V-02-97 03.9 A petition to vacate that portion of "J" Street SE (Main to 2nd Street SE), within the city of Auburn, Washington, has been filed by two-thirds or more of the abutting property owners. Public comments are invited on the petition for vacation. Councilmember Wagner opened the public hearing. Councilmember Cerino moved and Councilmember Poe seconded to continue the public hearing to Wednesday, July 22, 1998. MOTION CARRIED UNANIMOUSLY. 6-0. Local Improvement District No. 347 Final Assessment Roll F2.4.9 A public hearing for the purpose of receiving public comments from any person desiring to object to any assessment appearing on the final assessment roll for Local Improvement District No. 347 as ordered by Ordinance No. 4955 for the purpose of street improvements including 24 foot pavement, curb and gutters, sidewalk, driveways, water, sewer stubs for future extension, storm drainage, lighting and undergrounding existing power to "B" Street NW and other improvements related thereto. Councilmember Wagner opened the public hearing. Attorney DiJulio identified for the record the receipt of the following correspondence related to Local Improvement District No. 347: letter dated dated July 17, 1998 from John Paul Turner of the law firm of Rodgers Deutsch & Turner, a letter dated July 10, 1998 from David M. Young, President of D. M. Young Construction Company, Inc., and letter dated July 16, 1998 from John Keegan from the law firm of Davis Wright Tremaine. LLP. No other written submissions were received from the audience. Councilmember Poe moved and Councilmember Cerino seconded to continue the public hearing to Wednesday, July 22, 1998. MOTION CARRIED UNANIMOUSLY. 6-0. 3. Application No. REZ0004-98 03.8 The following is a closed record hearing where comments are limited to the existing record and no new evidence or infoi~ation is allowed to be submitted. The request of Les Schwab Tire Center for a rezone of property located at the northwest corner of "1" Street NE and 26th Street NE from R-4, multi-family residential, to C-3, heavy commercial. Councilmember Borden moved and Councilmember Poe seconded to continue the public hearing to Wednesday, July 22, 1998 at 7:30 PM. Councilmember Borden requested that the Council receive the June 16, 1998 Hearing Examiner minutes regarding Application No. REZ0004-98. MOTION CARRIED UNANIMOUSLY. 6-0. 4. Application No. PLT0002-98 03.8 PLT0002-98 The following is a closed record heating where comments are limited to the existing record and no new evidence or information is allowed to be submitted. The request of Zions Securities for preliminary plat approval for 33-1ot single-family subdivision to be known as Lakeland Hills Division 5B located in the southern portion of the Lakeland Hills Development. Councilmember Wagner opened the public hearing. Councilmember Borden moved and Councilmember Poe seconded to continue the hearing to Wednesday July 22, 1998 at 7:30 PM Councilmember Borden requested the Council receive the June 16, 1998 Hearing Examiner minutes and any correspondence regarding Application No. PLT0002-98. MOTION CARRIED UNANIMOUSLY. 6-0. 5. Interlocal Agreement between King County and the City of Auburn regarding Potential Annexation Area Designation 03.4.1.12 Public comments are invited regarding an Interlocal Agreement between King County and the City of Auburn regarding Potential Annexation Area designation and future Service provision. In 1995, the City adopted its potential Page 4 City of Auburn Council Meetin~l Minutes July 20, t998 annexation areas as part of its Comprehensive Plan and has signed intergovemmental agreements with the cities of Kent, Federal Way, Pacific and Sumner establishing the boundaries of the potential annexation areas. Through this agreement King County will also recognize those boundaries. Under this agreement, however, Auburn will not annex land within the Lower Green River Agricultural Production District until it adopts a natural resource/agricultural zoning district and establishes a transfer of development rights program for that area. Councilmember Wagner opened the public hearing. A letter dated July 20, 1998 addressed to Mayor Booth and Auburn City Council from Rita Bailie was submitted for the record. Councilmember Borden moved and Councilmember Poe seconded to continue the public hearing to Wednesday, July 22, 1998 at 7:30 PM. MOTION CARRIED UNANIMOUSLY. 6-0. B. Audience Participation Sylvia Kane, 21312 109th Avenue SE, Kent, WA Ms. Kane indicated her comments this evening were on behalf of her father, James Auker, who lives in Auburn. She expressed opposition to the construction of a detention facility in the city of Auburn. C. Correspondence 1. A letter dated July 15, 1998 addressed to the Mayor and City Councilmembers from Amy L. Kosterlitz regarding Application No. REZ0004-98. 2. A letter dated July 16, 1998 addressed to the Auburn Department of Planning and Community Development from David E. Bockrath of Pacific Engineering Design, Inc., regarding Application No. PLT0002-98. III. COUNCIL COMMITTEE REPORTS A3,7.6 A. Municipal Services Chair Poe reported the Municipal Services Committee met this afternoon at 5:00 PM. The Committee discussed specifications for roof repairs to the hangars at the Auburn Municipal Airport. The next regular meeting of the Municipal Services Committee is scheduled for Monday, August 3, 1998 at 5:00 PM. B. Planning & Community Development Chair Borden reported the Planning and Community Development Committee met July 13, 1998. The Committee discussed the Planned Unit Development ordinance. The next regular meeting of the Planning and Community Development Committee is scheduled for Monday, July 27, 1998 at 7:30 PM. C. Public Works Member Cerino reported the Public Works Committee met July 13, 1998 at 4:30 PM. The Committee discussed and recommended approval of Ordinance Nos. 5118 and and 5119 approving the acceptance of grant funds. The Committee also discussed and recommended Council approval of Ordinance No. 5120 and several contract administration items. The next regular meeting of the Public Works Committee is scheduled for Monday, July 27, 1998 at 4:30 PM. D. Finance Member Lewis reported the Finance Committee met this evening at 6:30 PM. The Committee discussed and recommended approval of claims and payroll vouchers and Ordinance No. 5122. The next regular meeting of the Finance Committee is scheduled for Monday, August 3, 1998 at 6:30 PM. IV. CONSENT AGENDA A. Minutes 1. Minutes of the July 6, 1998 regular City Council meeting.
