Flag Salute Mayor Booth called the meeting to order at 7:30 PM and led those in attendance in the Pledge of Allegiance. B. Roll Call Mayor Booth and the following Councilmembers were present: Pete Lewis, Sue Singer, Jeanne Barber, Trish Borden, Fred Poe, and Rich Wagner. Councilmember Gene Cerino was excused. Staff members present included: Parks and Recreation Director Dick Deal, Personnel Director Brenda Heineman, Fire Chief Bob Johnson, Police Chief Dave Purdy, Finance Director Diane L. Supler, Public Works Director Christine Engler, Planning and Community Development Director Paul Krauss, City Attorney Michael J. Reynolds, and City Clerk Danielle Daskam. C. Announcements and Appointments 1. Announcements a) Proclamation - A Week Without Violence Mayor Booth to present a proclamation declaring October 18-24, 1998 as "A Week Without Violence" in the city of Auburn to Linda Rasmussen of the YWCA. Mayor Booth read a proclamation declaring October 24, 1998 as "Make A Difference Day" in the city of Auburn. 2. Appointments a) Human Services Committee City Council to confirm the appointment of Jeani Rottie to the Human Services Committee to fill the unexpired term of Arlista Holman which will expire December 31, 2000. Councilmember Singer moved and Councilmember Barber seconded to confirm the appointment of Jeani Rottie to the Human Services Committee. MOTION CARRIED UNANIMOUSLY. 6-0. D. Agenda Modifications Agenda modifications included the addition of Ordinance No. 5173 transmitted under Item VII.A.18 of these minutes and the addition of Resolution No. 3012 under Item VII.B.4 of these minutes. An agenda modification to add the bid award for Public Works Project Number 612R, Contract Number 98-18, to the consent agenda under Item IV.D.6 was presented from the floor by Councilmember Poe. II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings No public hearing was scheduled for this evening. B. Audience Participation Page 2 City of Auburn Council Meetin.~ Minutes October 19, 1998 Jerry Bowles, 33422 192nd SE, Auburn, WA Mr. Bowles identified himself as the head coach for the Auburn A- Team, a Parks and Recreation Department youth wrestling team. Mr. Bowles spoke against a recent decision by the Parks Board to limit enrollment for Parks and Recreation Department programs to residents of the Auburn and Deiringer School Districts. Mr. Bowles explained that the new rule will exclude members of the team who have participated on the same team in previous years. Mr. Bowles spoke in favor of allowing those team members outside the Auburn and Deiringer School District who have participated on the team in previous years to complete their youth wrestling career with the Auburn A-Team. Mr. Bowles indicated he is circulating a petition to urge the City to allow the children who have previously participated in the Auburn A-Team wrestling program to be "grandfathered" into the program. Mr. Bowles also cited Junior Wresting League rules which require individuals to compete on a team within their area unless their area has no program. Wrestlers may compete in a program out of their area under certain conditions if done during or immediately after their first year. Wrestlers changing teams after starting their second year are ineligible for any league tournament that year. Many of the children affected by the new rule have parents who act as coaches for the team. In response to a question from Councilmember Wagner, Mr. Bowles indicated approximately six children are affected by the new rule. Councilmember Wagner spoke in favor of making accommodation for the affected children to continue as members of the Auburn A-Team youth wrestling team. Parks and Recreation Director Dick Deal confirmed that all neighboring jurisdictions have a youth wrestling league with the exception of Federal Way. Mr. Deal advised that the rule requiring residency in the Auburn or Deiringer School District applies to all Parks and Recreation Department youth sports. Mr. Deal advised that the Department has agreed to allow the six or seven affected wrestlers to return to the A-Team this year and then make every effort to work with Federal Way or other agency to initiate a youth wrestling program in the Federal Way area. Mr. Deal stressed that the intent of the rule is to better serve the youth that live in the Auburn community and not to penalize youth. Page 3 City of Auburn Council Meetin~l Minutes October 19, 1998 Raleigh Salazar, 228 South 357th Street, Federal Way, WA Mr. Salazar identified himself as a resident of Federal Way. Mr. Salazar spoke regarding the Parks and Recreation rule requiring residency in the Auburn or Deiringer School District in order to participate on the youth wrestling team. He advised that the City of Federal Way does not plan to introduce youth wrestling as part of its recreation program. Mr. Salazar thanked the City for allowing the non-resident team members to participate this year, and urged the City to "grandfather" the existing six nonresident team members and allow them to continue on the team. Brian Bixenman, 32854 - 8th Court SW, Federal Way, WA Mr. Bixenman identified himself as a Federal Way resident. He reiterated the comments made by Mr. Bowles and Mr. Salazar. He encouraged the City Council to "grandfather" the few team members who live outside the Auburn and Deiringer School Districts. Raleigh Salazar, 228 South 357th Street, Federal Way, WA Raleigh Salazar identified himself as a resident of Federal Way, a fifth grade student at St. Vincent DePaul, and a member of the Auburn A-Team youth wrestling team. He spoke in favor of allowing current nonresident members of the team to continue wrestling on the Auburn youth wrestling team. Jim Mondt, 11215 SE 305th Street, Auburn, WA Mr. Mondt reported that he has been involved with youth team sports for several years including coaching for approximately 15 years for the Auburn A-Team. Mr. Mondt spoke regarding league rules and restrictions for moving team members. He spoke in favor of allowing team coaches' children to participate on the Auburn youth wrestling team even though they may reside outside the Auburn and Deiringer School Districts. Tim McLean, 110 2nd Avenue North, Algona, WA Mr. McLean spoke regarding the Park and Recreation rule to restrict enrollment in recreation teams to residents of Auburn and Deiringer School Districts. Mr. McLean's son is a member of the Auburn A-Team. He urged the Council to allow the existing nonresident team members to complete their youth wrestling career on the Auburn A-Team. Page 4 City of Auburn Council Meeting Minutes October 19, 1998 Keri Zanoni, 2405 R Street SE, Auburn, WA Ms. Zanoni spoke regarding the Park and Recreation rule to restrict enrollment in recreation teams to residents of Auburn and Deiringer School Districts. She expressed dissatisfaction with the rule adopted by the Park Board. She requested the City allow the five or six nonresident team members to continue wrestling for the Auburn A-Team. Dan Carnrite, 922 17th Street NE, Auburn, WA Mr. Carnrite reported that on October 5, 1998 he sent correspondence to the Council regarding air traffic in the northeast quadrant of the city. He expressed concern with the noise and amount of air traffic, especially rotor-wing aircraft. Planning and Community Development Director Krauss advised that staff members are investigating the complaints regarding the aircraft and are working with the Federal Aviation Administration to remedy the situation. Councilmember Barber expressed support for accommodating the existing nonresident members of the Auburn A-Team youth wrestling team by making an exception to the residency requirement. Councilmember Borden agreed with Councilmember Barber's comments and urged the City to make an exception to the residency requirement for current team members for the remainder of their youth wrestling career. Mayor Booth noted that the justification behind the Park Board rule requiring residency within the Auburn or Deiringer School District is due to the competition for available space in Auburn youth programs. Mayor Booth offered to return the issue to the Auburn Park Board for review. Auburn A-Team members in attendance included Dominic Salazar, Tyler Bowles, Raleigh Salazar, Cole Bixenman, and Brandon Zanoni. C. Municipal Services Chair Poe reported the Municipal Services Committee met this evening at 5:00 PM. The Committee discussed and recommends adoption of Ordinance No. 5165 regarding the impound of vehicles whose operators are found driving while license suspended. The Committee also discussed fuel facilities and hangar roofs at the Auburn Municipal Airport. The next regular meeting of the Municipal Services Committee is scheduled for Monday, November 2, 1998. B. Planning & Community Development Chair Borden reported the Planning and Community Development Committee met October 12, 1998. The Committee conducted public hearings on applications for water and sewer certificates. The Committee also discussed the Interlocal Agreement with King County related to potential annexation areas. The Committee also received a presentation on Lakeland parks and discussed bids for Fulmer Field backstops. The next regular meeting of the Planning and Community Development Committee is scheduled for Monday, October 26, 1998 at 6:00 PM. C. Public Works Chair Wagner reported the Public Works Committee met October 12, 1998. The Committee reviewed and recommended approval of several contract administration items that appear on the Council agenda this evening. The Committee also reviewed Ordinance No. 5161 and recommended a change in the fee for PUD's. The Committee adopted new Design and Construction Standards. The Committee expects to review and further discuss the appeal process, driveway access, lighting and crosswalks as they relate to the Design and Construction Standards. The Committee also received an update on the Lakeland Hills erosion plan, and the Committee reviewed the Non-motorized Transportation Plan. The next regular meeting of the Public Works Committee is scheduled for Monday, October 26, 1998 at 4:30 PM. D. Finance Chair Barber reported the Finance Committee met this evening at 7:00 PM. The Committee reviewed and recommended approval of claims and payroll vouchers, setting the date of November 2, 1998 Page 6 City of Auburn Council Meetinn Minutes October 19, 1998 for public hearing on the 1999 Budget, and approval of surplus items. The Committee also recommended approval of Ordinance No. 5155. The Committee discussed a proposed Ordinance No. 5167 relating to a banking services contract with Key Bank. The next regular meeting of the Finance Committee is scheduled for Monday, November 2, 1998 at 6:30 PM. IV. CONSENT AGENDA A. Minutes 1. Minutes of the October 5, 1998 regular City Council meeting. Councilmember Barber moved and Councilmember Wagner seconded to approve the Consent Agenda. Councilmember Poe expressed concern with Item IV.D.1, Small Works Contract Number 98-41. He suggested modifying the specifications to reflect the 1997 Uniform Building Code, provide that roof trusses shall be designed by a Structural Engineer licensed in the state of Washington, and add a paragraph providing that the building will be designed by a Structural Engineer licensed in the state of Washington. Public Works Director Engler indicated that amendments to the bid specifications would require a new small works solicitation. MOTION CARRIED UNANIMOUSLY. 6-0. Councilmember Poe moved and Councilmember Lewis seconded to modify the Consent Agenda to add Item IV.D.6 to authorize the award of Contract Number 98-18, for Project PR 612R, the Green River Pump Station Project, subject to a reference check. MOTION CARRIED UNANIMOUSLY. 6-0. MOTION TO APPROVE THE CONSENT AGENDA AS MODIFIED CARRIED UNANIMOUSLY. 6-0. V. UNFINISHED BUSINESS There were no items for City Council review under this section. VI. NEW BUSINESS A. Development Agreement No. WSC0012-98 A3.13.8 City Council to consider the request of Larry Worley for the issuance of water and sewer availability certificates for property located at 1222X SE 310th Street and to approve the Petition for Annexation, Annexation Agreement and Declaration of Covenant. Planning and Community Development Director Krauss explained that the applicant is requesting a water and sewer certificate for approximately twenty townhouses located on the north side of 310th Street. The request is consistent with current city standards. Based on the Planning and Community Development Committee's recommendation staff will forward a letter raising concerns about storm water issues in the area to King County. Councilmember Borden moved and Councilmember Singer seconded to approve the Development Agreement which will enable the issuance of a water and sewer certificate to the applicant. Development Agreement No. WSC0013-98 A3.13.8 City Council to consider the request of Westfair LLC for the issuance of water and sewer availability certificates for property located at the west side of 124th Avenue SE and north of SE 308th Place, and to approve the Petition for Annexation, Annexation Agreement and Declaration of Covenant. Councilmember Borden moved and Councilmember Singer seconded to approve the Development Agreement which will enable the issuance of water and sewer availability certificates to the applicant. Planning Director Krauss addressed concerns regarding the proposed driveway to serve the property. He indicated concerns regarding the driveway access will be forwarded to King County and urge them to require a width of at least 20 feet with no parking on either side and that all buildings should be fully equipped with fire sprinkler systems. MOTION CARRIED UNANIMOUSLY. 5-1. Councilmember Lewis voted no. Please refer to Item VII. A. 17 of these minutes for further action on this item. C. Interlocal Agreement between King County and the City of Auburn 03.4.1.12 City Council to consider an Interlocal Agreement between King County and the City of Auburn relating to Potential Annexation Areas. Planning Director Krauss explained that after a recent indication by King County staff that King County would be willing to entertain the permanent establishment .of an unincorporated rural agricultural island located between the cities of Kent and Auburn, Auburn staff were directed to amend the Agreement to exclude any provisions related to the Agricultural Production District. Eliminating the Page 11 City of Auburn Council Meetina Minutes October 19, 1998 Agricultural Production District from the Comprehensive Plan will be addressed later this year. Councilmember Borden moved and Councilmember Lewis seconded to approve the Interlocal Agreement and instruct the City Attorney to prepare the necessary Resolution. MOTION CARRIED UNANIMOUSLY. 6-0. VII. ORDINANCES AND RESOLUTIONS A. Ordinances 1. Ordinance No. 5134 F5.2.15 An Ordinance of the City Council of the City of Auburn, Washington, authorizing the acceptance of a grant from the Transportation Improvement Board for the construction of pedestrian improvements on Auburn Way South, between Dogwood and Fir Streets. Councilmember Wagner moved and Councilmember Poe seconded to introduce and adopt Ordinance No. 5134. MOTION CARRIED UNANIMOUSLY. 6-0. 2. Ordinance No. 5135 F5.2.15 An Ordinance of the City Council of the City of Auburn, Washington, authorizing the acceptance of a grant from the Transportation Improvement Board for the construction of pedestrian improvements on 15th Street Northwest. Councilmember Wagner moved and Councilmember Poe seconded to introduce and adopt Ordinance No. 5135. MOTION CARRIED UNANIMOUSLY. 6-0. 3. Ordinance No. 5143 A3.5.2 An Ordinance of the City of Auburn, Washington, amending Chapter 12.20 entitled "Driveways" contained in Title 12 Page 12 City of Auburn Council Meetinn Minutes October 19, 1998 entitled "Streets, Sidewalks, and Public Works" to require that driveway construction conform to standards in the manual entitled "City of Auburn Design and Construction Standards", to modify the maximum driveway width requirements, to modify requirements for the number of driveways permitted and to add the following new sections: Section 12.20.054 regarding multiple frontages, Section 12.20.056 regarding turning encroachments, Section 12.20.058 regarding location of driveways and Section 12.20.015 adopting by reference Chapter 47.50 RCW entitled "Highway Access Management" and any amendments or additions thereto and WAC 468-51, rules adopted pursuant to authority provided under RCW 47.50, and any amendments or additions thereto and directing the City Clerk to maintain copies thereof. Councilmember Wagner moved and Councilmember Poe seconded to introduce and adopt Ordinance No. 5143 deleting Sections 12.20.050 through 12.20.058. Councilmember Wagner noted there are details in Ordinance No. 5143 that are already or should be in the Design and Construction Standards rather than the Ordinance. Councilmember Wagner withdrew his motion to adopt Ordinance No. 5143. Councilmember Wagner moved and Councilmember Poe seconded to refer Ordinance No. 5143 to Public Works Committee for further study. MOTION CARRIED UNANIMOUSLY. 6-0. 4. Ordinance No. 5144 A3.5.2 An Ordinance of the City of Auburn, Washington, amending Auburn City Code Section 13.40.030 entitled "Design Plans Requirements" to require that all utility extension design plans be in conformance with the manual "City of Auburn Design and Construction Standards" which subsection is Page 13 City of Aubum Council Meetin~3 Minutes October 19, 1998 contained in Chapter 13.40 entitled "Utility Extensions" in Title 13 entitled "Water, Sewers and Public Works". Councilmember Wagner moved and Councilmember Poe seconded to adopt Ordinance No. 5144. MOTION CARRIED UNANIMOUSLY. 6-0. 5. Ordinance No. 5145 A3.5.2 An Ordinance of the City of Auburn, Washington, amending Auburn City Code Section 12.36.030 entitled "Planting or Removal-Permission Required" contained in Chapter 12.36 entitled "Street Trees" in Title 12 entitled "Streets, Sidewalks and Public Works" to require plantings be accomplished in accordance with the "City of Auburn Design and Construction Standards". Councilmember Wagner moved and Councilmember Poe seconded to introduce and adopt Ordinance No. 5145. MOTION CARRIED UNANIMOUSLY. 6-0. 6. Ordinance No. 5146 A3.5.2, 04.8 An Ordinance of the City of Auburn, Washington, amending Auburn City Code Chapter 13.48 entitled "Storm Drainage Utility" contained in Title 13 "Water, Sewers and Public Works," specifically, Sections 13.48.010 and 13.48.370 entitled respectively "Definitions" and "Storm Drainage Extensions-Adoption of Design Manuals" to reflect replacement of the "Developer's Design Manual" and the "Storm Drainage Design Manual" with the manual entitled "City of Auburn Design and Construction Standards" and to remove reference to the "Storm Drainage Design Manual", and the "Developeris Design Manual" and the "Developer's Design Manual Supplement" and Section 13.48.390 entitled "Minimum Facility Size" to change the minimum size requirement for public storm drainage pipe from eight to twelve inches and private storm drainage pipe from six to eight inches. MOTION CARRIED UNANIMOUSLY. 6-0. 7. Ordinance No. 5147 A3.5.2 An Ordinance of the City of Auburn, Washington, amending Auburn City Code Section 14.18.020 entitled "Application, Submittal and Contents" which is contained in Chapter 14.18 entitled "Water and Sewer Availability Certificates" in Title 14 entitled "Project Review" to reflect that the manual entitled "City of Auburn Design and Construction Standards" replaces the manual entitled "Developer Design Manual". Councilmember Wagner moved and Councilmember Poe seconded to introduce and adopt Ordinance No. 5147. MOTION CARRIED UNANIMOUSLY. 6-0. 8. Ordinance No. 5155 F4.21 An Ordinance of the City of Auburn, Washington, creating a new special revenue fund for the City of Auburn to account for the receipt of mitigation and impact fees, as authorized by Council. Councilmember Barber moved and Councilmember Lewis seconded to introduce and adopt Ordinance No. 5155. MOTION CARRIED UNANIMOUSLY. 6-0. 9. Ordinance No. 5161 F4.3 An Ordinance of the City Council of the City of Auburn, King County, Washington, amending Chapter 2.78 entitled "Fees for City Permits and Actions", specifically 2.78.010 "Fees Designated", to establish new fees and to update existing fees. In response to a question from Councilmember Borden, Planning Director Krauss explained that Ordinance No. 5161 Page 15 City of Auburn Council Meetin_~ Minutes October 19, 1998 was referred to the Public Works Committee for additional review. The Public Works Committee's review included the Planned Unit Development (PUD) fees. It was recommended to change the proposed PUD fee of $750 plus $50 for each unit to $750 plus $50 per acre. The Committee recommended the change in the fee structure which is comparable to surrounding cities' fees. Councilmember Borden moved and Councilmember Singer seconded to introduce and adopt Ordinance No. 5161. MOTION CARRIED UNANIMOUSLY. 6-0. 10. Ordinance No. 5162 A3.5.2 An Ordinance of the City of Auburn, Washington, amending Auburn City Code Sections 13.20.270 entitled "Public Sewers-Construction Standards" and 13.20.310 entitled "Side Sewer Requirements" to require that all utility extension design plans be in conformance with the manual "City of Auburn Design and Construction Standards" which subsections are contained in Chapter 13.20 entitled "Sewers" in Title 13 entitled "Water, Sewers and Public Works". Councilmembr Wagner moved and Councilmember Poe seconded to introduce and adopt Ordinance No. 5162. MOTION CARRIED UNANIMOUSLY. 6-0. 11. Ordinance No. 5163 A3.14 An Ordinance of the City of Auburn, Washington, authorizing the Mayor to execute a new Franchise Agreement between the City of Auburn and Pierce County to construct, operate and maintain water pipelines for a water system over, in, along, across, under, and upon certain public roads and highways in Pierce County, Washington until September, 2003. Councilmembr Wagner moved and Councilmember Poe seconded to introduce and adopt Ordinance No. 5163. Ordinance No. 5164 03.4.2.6 An Ordinance of the City Council of the City of Auburn, King County, Washington, amending Title 17 of the Auburn City Code specifically Chapter 17.12 entitled "Subdivision Improvements" and Chapter 17.14 entitled "Short Subdivision". Councilmember Borden moved and Councilmember Singer seconded to introduce and adopt Ordinance No. 5164. Councilmember Wagner noted that Ordinance No. 5164 still contains details regarding alleys on page 35, paragraph 17.12.150, that are not consistent with the new Construction and Design Standards.
