Roll Call Mayor Booth and the following Councilmembers were present: Pete Lewis, Sue Singer, Jeanne Barber, Trish Borden, Fred Poe, Gene Cerino, and Rich Wagner. Mayor Booth presented a plaque to Ron Carson in recognition of his dedicated service to the Auburn Arts Commission from 1995 to 1999. Appointments There were no appointments for City Council consideration. Agenda Modifications The following agenda modifications were accepted: a corrected Petition for Annexation, Annexation Amendment and Declaration of Covenant was transmitted under Item VI.B of these minutes, the addition of a request to amend Ordinance No. 4689 to allow for miscellaneous temporary events at the Emerald Downs Racetrack transmitted under Item VI.C of these minutes, a corrected Ordinance No. 5231 was transmitted under Item VII.A.3 of these minutes, a corrected Ordinance No. 5234 was transmitted under Item VII.A.6 of these minutes, the addition of Ordinance No. 5235 transmitted under Item VII.A.7 of these minutes, and the removal of Resolution No. 3077 from the agenda. Public Hearings Interiocal Agreements and Fee Schedules RelatinR to School Impact Fees for the Auburn and Kent School Districts F4.3 The City Council invites public comments regarding the Interlocal Agreements and Fee Schedules relating to school impact fees for the Auburn and Kent School Districts. Assistant Planning Director Lynn Rued presented the staff report. The school districts of Auburn and Kent have requested the City approve impact fees for each school district. The Auburn School District Capital Facilities Plan calls for an impact fee of $3,125 for a single family home and $1,253 for each multi-family unit. Kent's Capital Facilities Plan calls for an impact fee of $3,744 for a single family home and $1,888 for each multi-family unit. The City Council adopted the school districts' capital facilities plans last year. Auburn City Code Chapter 19.02 establishes the process for adopting impact fees. Later on this evening's agenda are two ordinances adopting the impact fee formula and schedule for each school district and two resolutions approving an interlocal agreement with each school district. Mayor Booth opened the public hearing. Linda Cowan, Auburn School District, 915 4th Street NE, Auburn, WA Ms. Cowan identified herself as the Superintendent of Schools for the Auburn School District. She spoke in favor of the interlocal agreement between the City of Auburn and the Auburn School District and impact fees for the Auburn School District. She explained that when development occurs, the school districts do not receive property or other considerations from developers. Impact fees are the means allowed by the State for school districts' response to growth. Auburn School District has been collecting impact fees for areas of the school district in unincorporated King County. Page 4 City of Auburn Council Meetin.q Minutes May 3, 1999 Ms. Cowan requested that the City adopt the impact fee rate that is used for King County. City Attorney Reynolds recommended that paragraph 8 of the interlocal agreements provide for an effective date forty- five days after adoption to allow for implementation of the impact fees. The first sentence of paragraph 8 should read: "Pursuant to RCW 34.04.040, this Agreement shall become effective after approval by the City and the District or forty- five days, whichever is later." Betty Smith, 101 Milwaukee Boulevard South, Pacific, WA Ms. Smith identified herself as a member of the Auburn School Board. Ms. Smith spoke in favor of impact fees for the Auburn School District, and spoke regarding growth in the Auburn School District and the history of the planning process for the school district. She explained that in 1998 the Auburn and Dieringer School Districts formed a joint district ad hoc committee. The ad hoc committee produced a process by which a portion of the Dieringer School District was transferred to the Auburn School District. The transferred area contains most of Lakeland Hills South and some other undeveloped properties. The buildout within the transferred area is expected to generate 1,778 students within a six year planning period. An additional 1,302 students are projected to come from other areas of the district. The increase in student population requires the district to construct a new senior high school and two new elementary schools. An additional middle school will be required just beyond the six year planning period. The total cost of the new construction is estimated at $93 million with a bond cost of $73.5 million. In response to a question by Councilmember Lewis, Superintendent of Schools Cowan explained that the amount of the impact fee is determined by the jurisdiction. Janice Burke-Nelson, 520 "F" Street SE, Auburn, WA Ms. Burke-Nelson identified herself as a member of the Auburn School Board. She spoke in favor of impact fees. Page 5 City of Auburn Council Meetin.q Minutes May 3, 1999 Donna Foxley, 28 "T" Street NE, Auburn, WA Ms. Foxley identified herself as a member of the Auburn School Board. She spoke in favor of impact fees for the Auburn School District. Bob Poldervart, Auburn School District, 915 4th Street NE, Auburn, WA Mr. Poldervart identified himself as Deputy Superintendent of Auburn School District. Mr. Poldervart addressed questions from Councilmember Borden regarding the impact fee formula, and tax credits and discounts applied to the formula. The formula deducts tax credits and any state matching funds from the cost of new construction. The impact fee formula then applies a fifty percent discount to the fee. Ted Leonard, 15321 SE 344th, Auburn, WA Dr. Leonard identified himself as a member of the Auburn School Board. He spoke regarding the school district:s authority to request impact fees and the current system of financing schools. Dr. Leonard reported that in 1985, the State provided funds for approximately sixty percent of school construction. In 1998, the State's share has been reduced to approximately thirty-three percent and is declining. The Growth Management Act authorizes impact fees as a tool for funding school facilities, and the Auburn School District has prepared a comprehensive Capital Facilities Plan in compliance with the Growth Management Act. Dan Rollins, 907 51st Street SE, Auburn, WA Mr. Rollins advised that he served on ad hoc committees for the Auburn School District, one of which recommended the construction of a fourth high school for Auburn. He spoke regarding the growth in Auburn and the need for school facilities. Mike Hamilton, 10605 SE 293rd, Auburn, WA Mr. Hamilton identified himself as the Chair of the Joint Dieringer-Auburn School District Committee that studied the transfer of the Lakeland South property from the Dieringer Page 6 City of Auburn Council Meetin.q Minutes May 3, 1999 School District to the Auburn School District. The committee recommended the transfer finding that the Auburn School District was better prepared to handle the impact of the number of students that would come from the Lakeland South area. The transfer was ultimately approved by both school districts. Mr. Hamilton urged the Council to approve the impact fees to address the rate of growth in the school district. Steve Sheehy, 1712 35th Avenue, Seattle, WA, 98122 Mr. Sheehy identified himself as a land use lawyer speaking on behalf of Investco Financial Services & Tucci & Sons Inc. Investco and Tucci have formed a partnership and are looking to purchase the 885-acre Lakeland Master Planned Community owned by Chuck Henderson and The Lakeland Company. The partnership hopes to make a decision on the purchase by June 30, 1999. Mr. Sheehy advised that all construction at Lakeland has ceased due to significant financial difficulties encountered by The Lakeland Company. Mr. Sheehy acknowledged that the Lakeland Master Planned Community will have a significant effect on the Auburn School District. Mr. Sheehy referred to the annexation agreement executed between Lakeland and the City of Auburn in May, 1998, which provides that The Lakeland Company will not object to an impact fee ordinance, and The Lakeland Company will not challenge the impact fee ordinance so long as the amount is $1,425 per single family unit and $750 per multi-family unit. If the City anticipates exceeding that amount, the agreement provides that The Lakeland Company will have an opportunity to challenge the ordinance. Mr. Sheehy noted that the $1,425 and $750 impact fee was based on the Pierce County impact fee schedule. Mr. Sheehy requested the Council continue the public hearing for two weeks to give Investco and Tucci an opportunity to comment on the impact fee schedule. Ray Vefik, 3010 M Drive NE, Auburn, WA Mr. Vefik identified himself as a member of the Auburn School Board. He spoke in favor of school impact fees for the Auburn School District. Page 7 City of Auburn Council Meetin;i Minutes May 3, 1999 Fred Hi,qh, Kent School District, 12033 SE 256th Street, Kent, WA, 98031 Mr. High identified himself as the Executive Director of Finance for the Kent School District. Mr. High explained that the City of Auburn and the Kent School District share an area where approximately 2,500 homes are expected to be built and 1,500 students will live. He spoke in favor of school impact fees to help offset the cost of new school construction. Linda Cowaq, Auburn School District Superintendent Cowan explained that time is a consideration for the Auburn School District and urged Council to make a decision on impact fees for the Auburn School District this evening. City Attorney Reynolds referred to comments made by Mr. Sheehy. Mr. Reynolds acknowledged that the annexation agreement between The Lakeland Company and the City of Auburn involving the area then in the Dieringer School District did provide for impacts fees in the amount of $1,425 and $750. However, the agreement did provide that The Lakeland Company would have the same standing as any other citizen should the school district or the City modify the rate. Mr. Reynolds pointed out that the proposed school impact fee for the area is the amount provided for in the Auburn School District's capital facilities plan unless modified by the City. Councilmember Poe expressed concern with impact fees and the added cost to constructing a new home in Auburn. Bob Poldervart, Auburn School District Mr. Poldervart explained that part of the impact fee computation includes the number of anticipated students from each housing unit. The Auburn School District used a King County average for the computation of anticipated student ratio. Mr. Poldervart also noted that the price of property in the urban growth zone has increased significantly, thereby increasing the cost of new school construction even more. Page 8 City of Auburn Council Meetin.q Minutes May 3, 1999 Councilmember Cerino expressed concern with the equity of impact fees. Councilmember Lewis indicated a desire to hear comments on the proposed school impact fees from the potential buyers of the Lakeland area. He also spoke in favor of a consistent impact fee throughout the city of Auburn regardless of the school district. In response to a question from Councilmember Cerino regarding determining the school impact fee for a specific address, Public Works Director Engler advised that the City's Geographic Information System would designate each address with the appropriate school district which would relate to the designated impact fees. Councilmember Wagner inquired whether there has been any consideration to imposing impact fees on all land, vacant or otherwise. Mr. Fred High of the Kent School District responded that the Growth Management Act permits assessment of fees against residential property only. Councilmember Wagner questioned the effect of Auburn City Code Section 19.02.080F on the agreement between The Lakeland Company and the City. City Attorney Reynolds advised that the agreement indicates how it will be treated. The agreement provides that in the event the City enacts a school impact fee that would increase the impact fee rate above the contract rate, which was the Pierce County rate, The Lakeland Company would have the ability to object to the rate as any other concerned party. Councilmember Poe questioned the impact fees for mobile home parks. Assistant Planning Director Rued advised that mobile home sites are considered single family units and impact fees would be collected upon site plan approval. Fred Hi.qh, Kent School District Mr. High explained that the Kent School District has a number of inter-jurisdictional relationships with other cities and districts and the differing fees in each jurisdiction based on each taxing authority's needs. Councilmember Lewis reminded that the City Council received a request to continue the public hearing for two weeks. City Attorney Reynolds reiterated the request to provide for an effective date forty-five days after adoption to allow for implementation of the impact fees. MOTION FAILED. 3-4. Councilmembers Cerino, Lewis, Poe and Singer voted no. Councilmember Lewis moved and seconded to continue the hearing meeting on May 17, 1999. Councilmember Poe to the next Council Councilmember Wagner questioned the justification for a continuance of the hearing. Councilmembers Borden and Barber spoke against continuance of the hearing. Councilmember Cerino spoke in favor of continuing the hearing and allowing the potential purchasers of the Lakeland area, Investco and Tucci & Sons, an opportunity to comment on the school impact fees. MOTION CARRIED. 4-3. Councilmembers Barber, Borden and Wagner voted no. Audience Participation Bob Frazier, 3501 20th Avenue Court SE, Puyallup, WA Mr. Frazier advised that he works for Emerald Downs. He spoke in favor of Emerald Downs request to amend Ordinance No. 4689 to allow for miscellaneous temporary events at the Emerald Downs Racetrack. The amendment to Ordinance No. 4689 will allow Emerald Downs to conduct events such as a circus, promotional car sales, and other temporary events. Planning and Community Development Director Krauss advised that the amendment is not a prohibition against events occurring on racing days. Correspondence No correspondence was submitted for City Council review. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chair Poe reported the Municipal Services Committee met this evening. The Committee discussed and recommended approval of Resolution No. 3076 approving a caretaker lease at Mountain View Cemetery, Ordinance No. 5229 amending cemetery fees and charges, and surplus airport property. The next regular meeting of the Municipal Services Committee is scheduled for Monday, May 17, 1999 at 6:00 PM. Planninq & Community Development Chair Borden reported the Planning and Community Development Committee met April 26, 1999. The Committee held a public hearing on Application No. WSC0016-98, which appears on this evening's agenda as the request of Mountain Trails LLC. The Committee discussed and recommended approval of the request to amend Ordinance No. 4689 regarding temporary events at the Emerald Downs Racetrack. The Committee also discussed the year 2000 budget goals and the possible move to a two-year budget, the future of specific apartment complexes in Auburn, and the conversion of the existing library building to a senior center. The next regular meeting of the Planning and Community Development Committee is scheduled for May 10, 1999 at 6:30 PM. Public Works Chair Wagner reported the Public Works Committee met April 26, 1999. The Committee discussed and recommended approval of contract administration items and surplus property. The Committee also attended a joint meeting with Covington and Water District No. 111. The next regular meeting of the Public Works Committee is scheduled for Monday, May 10, 1999 at 4:30 PM. The Committee discussed and recommended approval of claims and payroll vouchers, surplus property, and Ordinance No. 5235. The Committee also discussed the curfew ordinance, fire fighter collective bargaining agreement, street sweeper purchase, and Eden Systems financial system. Assistant Planning Director Rued explained the application is for a conditional use permit for a drive-through restaurant located at 1801-1815 Howard Road. The Hearing Examiner recommended approval of the application. Application No. WSC0016-98 ^3.13.8 City Council to consider the request of the VVhite Mountain Trails LLC for the issuance of water availability certificate for property located at 11825 288th Street, Kent, and to approve the Petition for Annexation, Annexation Agreement and Declaration of Covenant. This item was removed from the agenda at the request of Planning and Community Development Director Krauss due to document errors. Amendment of Ordinance 4689 O3.10.1, 03.3.4 City Council to consider an amendment to Ordinance No. 4689 to allow for miscellaneous temporary events at the Emerald Downs Racetrack. Councilmember Borden moved and Councilmember Lewis seconded to amend Ordinance No. 4689 to allow for miscellaneous temporary events at the Emerald Downs Racetrack. Councilmember Singer questioned whether the proposed temporary uses would be limited to the off-season at Emerald Downs. Planning and Community Development Director Krauss suggested amending the proposed language to more clearly state the temporary events that would be allowed under an administrative temporary use permit. Ordinance No. 5234 03.10.1, 03.3.4 An Ordinance of the City of Auburn, Washington, amending Ordinance No. 4689 that provided a conditional use permit to construct and operate a thoroughbred horse racing facility, to amend Section 2, Subsection 22 to allow temporary events to be held at the Emerald Downs Track. Planning and Community Development Director Krauss proposed the following change to Ordinance No. 5234 to more clearly state the temporary events that would be allowed under an administrative temporary use permit. Page 18 City of Auburn Council Meeting Minutes May 3, 1999 Under Section 1 of Ordinance No. 5234, paragraph Ordinance No. 4689 is amended to read: This permit shall allow for a thoroughbred horse racing facility and its attendant and accessory uses. Temporary events such as car sales, car shows, carnivals, circuses or fairs may be allowed. Other similar temporary events, excluding any racing event, may be allowed as determined bv the Plannino Director. The temporary event must be clearly incidental to the racetrack and it cannot 22 of generate any more traffic, noise, or other impacts that what were previously analyzed and approved for the racetrack itself. Each temporary event must receive an administrative temporary use permit pursuant to Section 18.46.060(B) of the Zoning Ordinance and otherwise meet all applicable re.qulations of the City. During the off-racing season, satellite (simulcast) racing is permitted. No other forms of gambling than pari-mutuel wagering for live and satellite horse racing shall be allowed. During the off- season, the restaurants, meeting rooms and related facilities may be used for non-racing functions. All other uses must be as allowed by the underlying zoning on the property.
