CALL TO ORDER
Fiaq Salute
Mayor Booth called the meeting to order at 7:30 PM and led those
in attendance in the Pledge of Allegiance.
Roll Call
Mayor Booth and the following Councilmembers were present:
Pete Lewis, Sue Singer, Jeanne Barber, Trish Borden, Fred Poe,
Gene Cerino, and Rich Wagner.

Councilmember Singer moved and Councilmember

Agenda Modifications
Agenda modifications included several pieces of correspondence
regarding gambling in the city of Auburn transmitted under Item II.C
of these minutes, the addition of Ordinance No. 5238 transmitted
under Item VII.A.6 of these minutes, and corrected Resolution No.
3082 transmitted under Item VII.B.6 of these minutes.
CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE
A. Public Hearinqs
Interlocal Agreements and Fee Schedules Relating to
School Impact Fees for the Auburn and Kent School
Districts
The City Council invites public comments regarding the
Interlocal Agreements and Fee Schedules relating to school
impact fees for the Auburn and Kent School Districts. This
public hearing is a continuation of the public hearing held on
May 3, 1999.
Mayor Booth reopened the public hearing, which was
continued from May 3, 1999 to this evening.

Steve Sheehy, 1712 35th Avenue, Seattle, WA, 98122
Mr. Sheehy identified himself as a land use lawyer and
spoke on behalf of the partnership Investco Financial
Services and Tucci & Sons which is investigating possible
investment in the Lakeland planned unit development. Mr.
Sheehy reported on his meetings with the Auburn School
District officials since May 3, 1999. He had hoped to reach
a compromise with the Auburn School District on the amount
of the proposed impact fees. Auburn School District officials
were unable to negotiate the impact fees since the Auburn
School Board had already established and adopted the fees.
He pointed out that the Auburn School District Capital
Facilities Plan anticipates approximately 900 building
permits and approximately 500 students generated by the
Lakeland planned unit development over the next two years.
Mr. Sheehy advised that the Capital Facilities Plan's
projection for building permits would not be met due to
financial difficulties of The Lakeland Company. He urged
the Council to retain the school impact fee amounts of
$1,425 and $750 as contained in the Lakeland Annexation
Agreement. He hoped that in the future, the partnership of
Investco and Tucci would come to agreement with the
Auburn School District on the assumptions driving the
impact fee schedule.
Chris Hus~, 4224 Waller Road, Tacoma, WA, 98443
Mr. Huss was previously identified by Mr. Sheehy as
corporate counsel representing Tucci& Sons. He
distributed a handout identifying the development fees
currently applicable to the Lakeland planned unit
development as $7,663 per single family unit and $6,866 per
multi-family unit. The Auburn School District's proposed
impact fees would increase the development impact fees to
nearly $10,000 per single family unit. He urged the Council
to consider the information presented.
Councilmember Borden referred to a brochure she received
recently from a local realtor. The brochure spoke to the
demand for single family homes driving the price of homes
to an all-time high. In South King County, the price of a
home has increased by $24,000 over the past two years.

She questioned who receives the benefits from the increase
in home prices due to market factors.
Councilmember Borden recalled a newspaper article on new
home construction that featured Lakeland Hills. Some of the
amenities described in the article for Lakeland were: parks,
playgrounds, trails, convenient access to shopping and
freeways, and good schools. Mr. Huss agreed that the
amenities described are all components of a quality
community. He also commented that the amount of
development fees could also price new construction out of
the market.
Mr. Huss responded to a question from Councilmember
Wagner regarding Mr. Huss's handout and the development
fee for Lake Tapps Parkway. Mr. Huss explained the
amount of $3,228 is a derived cost and not a direct fee. The
cost of constructing the parkway and its related construction
is approximately $11 million. The cost is spread over the
number of units in the development. The improvement is
considered an off-site improvement that does not benefit any
particular neighborhood or development.
Linda Cowan, Superintendent, Auburn School District, 915
4th Street NE, Auburn, WA
Ms. Cowan explained that the impact fee process requires
an annual submittal by the School District to the City
Council. The School District will be adopting a new Capital
Facilities Plan in July, which will then be submitted to the
City as part of the Comprehensive Plan. The School District
was planning for a new high school in 2006. However, with
the assumption of a portion of the Dieringer School District,
the new high school is now planned for opening in 2003.
Sandy Collins, 862 Woodland Way, Kent, WA
Ms. Collins identified herself as a member of the Board for
the Kent School District. She spoke in favor of the proposed
impact fees for the Auburn School District. She spoke of her
experiences in the Kent School District and the Kent School
District's efforts to meet the demands of growth in Kent.
She urged the Council to support the request of both Auburn
and Kent School Districts for school impact fees.

Scott Floyd, 9645 South 232nd Street, Kent, WA
Mr. Floyd identified himself as the chair of the Kent School
District Bond and Levy Committee. He spoke regarding his
experiences with school bond levy proposals and the growth
impact on the Kent School District. He urged the Council to
adopt school impact fees as proposed.
Connie Baseman, 10206 SE 224th Street, Kent, WA
Ms. Baseman reported that she participated on the Kent
School District's Citizens Facilities Planning Committee for
approximately ten years. She spoke in favor of school
impact fees at the levels requested to ensure quality schools
in the Kent School District.
Jan Redding, 9511 SE 207th Place, Kent, WA
Ms. Redding spoke in favor of school impacts fees for the
Kent School District. Approximately 2,000 new students are
expected from the area shared by the City of Auburn and the
Kent School District. She explained that current taxpayers
will continue to bear seventy-five percent of the cost of new
schools. The remaining twenty-five percent comes from
impact fees. She urged the Council to adopt the Kent
school impact fee schedule at the rates requested.
Barbara Poinier, 18149 147th Avenue SE, Renton, WA
Ms. Poinier reported she has been a resident of the Kent
School District for more than twenty years and served on the
Kent Schools Citizens Budget Review Committee, Citizens
Facilities Planning Committee, the Concurrency Task Force.
She noted that the state legislature provided impact fees to
assist schools in meeting demands of growth, and schools
are dependent upon city and county councils to enact the
impact fees. She urged the Council to adopt the Kent
school impact fees as proposed.
Paula Thrush, 10872 SE 318th Place, Auburn
Ms. Thrush identified herself as a long-time resident of the
area and the Auburn School District. She lives in
unincorporated King County where Auburn School District
impact fees have been in effect for some time. She urged
the City Council to approve impact fees requested by the

Auburn School District to ensure the quality of life for
residents of the city of Auburn.
Tim Gilmore, 11818 SE 310th, Auburn, WA
Mr. Gilmore reported that he works for another school district
which does not receive impact fees. He spoke regarding his
observations on the deterioration of schools in the district
where he works. He spoke in favor of implementing school
impact fees for the Auburn School District.
Councilmember Borden moved and CouncJlmember Lewis
seconded to close the public hearing.
MOTION CARRIED UNANIMOUSLY. 7-0.
Councilmember Borden spoke in favor of implementing impact fees
for the Auburn and Kent School Districts. She recalled public
hearing testimony that over the past twelve years, the State's
commitment for school construction has dropped from sixty percent
to thirty-three percent. She also spoke in favor of the amount of
the impact fees requested by the school districts as they have been
discounted and credited for property taxes and state matching
funds. Councilmember Borden urged the Council to set a policy
that would identify the City as the collector of the fee and not the
initiator of the fee. She recommended the City use data to
determine the fee to be collected. She also cautioned the Council
about the City's own conflict of interest in determining school
impact fees, referring to system development charges collected by
the City.
Councilmember Borden moved and Councilmember Barber
seconded to introduce and adopt Ordinance No. 5232.
Councilmember Lewis acknowledged that he initially was not in
favor of an impact fee. However, after reviewing the data and the
actions of the state legislature he changed his position. He spoke
in favor of impact fees in amounts less than those requested by the
school districts and at a consistent amount throughout the city
regardless of the school district.
Councilmember Wagner spoke in favor of the motion to adopt
Ordinance No. 5232. He spoke in favor of the methodology and

calculation of the fair share for school impact fees based on the
data. Councilmember Wagner also pointed out that the ordinance
contains a number of exemptions from the requirements of impact
fees.
Councilmember Singer spoke regarding the differences of opinion
among the Councilmembers regarding impact fees. She
expressed her belief that the City has the authority and
responsibility to review school impact fees. She expressed support
for implementing an impact fee now with intent to review the impact
fee amount later in the year after new Capital Facilities Plans are
submitted by the school district.
Councilmember Cerino acknowledged the schools' needs for
funds. He expressed concern with the possibility of additional
impact fees for transportation and fire. He also expressed concern
with when the fee must be paid: He indicated support for school
impact fees but not for the full amounts requested by the school
districts.
In response to a question from Councilmember Barber, Auburn
Superintendent of Schools Cowan advised that the school district's
Capital Facilities Plan is reviewed annually. The City's ordinance
requires that the school district resubmit the Plan to the City
annually. The data and impact fee amounts may change from year
to year based on growth in school enrollment and construction
plans.
Councilmember Barber expressed her support for school impact
fees as requested by the school districts.
Councilmember Poe expressed his support for the Auburn School
District. He agreed with Councilmember Lewis that impact fees are
an unfair method for raising funds for schools. Councilmember
Poe spoke in favor of a uniform school impact fee in the city of
Auburn for all school districts at a rate less than those submitted by
the Auburn and Kent School Districts.
MOTION FAILED. 3-4. Councilmembers Cerino, Lewis, Poe and
Singer voted no.

Councilmember Lewis moved and Councilmember Cerino
seconded to adopt Ordinance No. 5232 with an amendment to
reflect a school impact fee for a single family house at $2,500.00
and a school impact fee of $1,000.00 per multi-family unit.
Councilmember Poe moved and Councilmember Cerino seconded
to amend Ordinance No. 5232, Section 19.02.070, Fee Collection,
paragraphs A, B, C and D as follows:
Impact fees shall be imposed upon development activity in
the city at the time building permits are issued, based upon
the adopted fee and collected by the city from any applicant
where such development activity requires issuance of a
residential building permit or a manufactured or mobile home

Impact fees are only collected and disbursed within the
boundaries of a school district that has executed an
interlocal agreement with the city of Auburn.
Applicants for single-family and multifamily residential
building permits, and for manufactured or mobile home

the impact fees assessed before the building permit is
issued, using the impact fee schedules then in effect.

The city will impose an application fee of $50.00 per dwelling
unit for a sinqle family, manufactured or mobile residence
and $25.00 per apartment, townhouse or condominium unit
which is subject to and not otherwise exempt from this
chapter to cover the reasonable cost of administration of the
impact fee program. The fee is not refundable and is
collected from the applicant of the development activity
permit at the time of permit issuance.*
Councilmember Poe explained that the purpose of the amendment
is to require payment of all impact fees at the time the building
permit is issued whether it is for a single family residence, mobile or
manufactured home, townhouse, condominium or apartment.

Councilmember Poe reported that a manufactured home requires a
building permit when it is placed on a platted lot or in a mobile
home park.
MOTION CARRIED. 5-2. Councilmembers Barber and Borden
voted no.
Councilmember Singer spoke in favor of the motion to implement
school impact fees at the rate of $2,500 and $1,000.
Councilmember Lewis also spoke in favor of the motion.
Councilmember Borden indicated she would also vote in favor of
the motion. She questioned the basis for the fees since they are
not based on the data presented in the capital facilities plans.
Councilmember Wagner indicated he would also vote in favor of
the motion. He also expressed his hope to see an increase in the
fee later this year.
Councilmember Barber urged the Council to consider increasing
the school impact fees later this year.
MOTION TO ADOPT ORDINANCE NO. 5232 AS AMENDED
CARRIED UNANIMOUSLY. 7-0
Councilmember Borden moved and Councilmember Wagner
seconded to introduce and adopt Ordinance No. 5233.
Councilmember Poe moved and Councilmember Cerino seconded
to amend Ordinance No. 5233 to reflect school impact fees for the
Kent School District at $2,500.00 per single family residence and
$1,000.00 per multi-family unit, and amend Section 19.02.070,
paragraphs A, B. C. and D, to be consistent with Ordinance No.
5232, as follows:

Mr. O'Brien and Mr. Mack appeared before the City Council
representing the members of International Association of Fire
Fighters Local 1352. They thanked the Mayor, City Council and
citizens of Auburn for the opportunity to serve as City of Auburn fire
fighters. Mr. O'Brien advised that members of Local 1352 voted in
favor of a new collective bargaining agreement, which appears
later on this evening's agenda for Council approval.

Chair Poe reported the Municipal Services Committee met this
evening at 6:00 PM. The Committee discussed Ordinance No.
5237 and Resolutions No. 3077, 3082, and 3084. The Committee
also discussed budget goals and received a status report on the
Goedecke property. The next regular meeting of the Municipal
Services Committee is scheduled for June 7, 1999 at 6:00 PM.
Planninq & Community Development
Chair Borden reported the Planning and Community Development
Committee met May 10, 1999. The Committee discussed an
editorial services contract for the Auburn newsletter. The
Committee discussed and recommended approval of the Final Pay
Estimate on the Fenster residence demolition project, countywide
planning policies, and Resolution No. 3086. The Committee also
discussed the Lea Hill annexation and artwork for the skate park.
The next regular meeting of the Planning and Community
Development Committee is scheduled for Monday, May 24, 1999 at
6:30 PM.

Public Works
Chair Wagner reported the Public Works Committee met May 10,
1999. The Committee discussed and recommended approval of
contract administration items appearing on this evening's agenda.
The Committee also discussed the traffic increase at the
intersection of 41st Street and "^" Street SE. The next regular
meeting of the Public Works Committee is scheduled for May 24,
1999 at 4:30 PM.
Finance
Chair Barber reported the Finance Committee met this evening at
6:30 PM. The Committee reviewed and recommended approval of
payroll and claims vouchers, Ordinance No. 5236, and Resolution
No. 3088. The Committee postponed Resolution No. 3083. The
Committee discussed budget goals for the year 2000 and curfew.
The next regular meeting of the Finance Committee is scheduled
for Monday, June 7, 1999 at 6:30 PM.

stimulant card games for an additional six months. On
December 21, 1998, the City Council adopted Ordinance

adoption and will continue in effect for six months unless
repealed, renewed or modified by the City Council after a
public hearing and entry of findings of fact.
