CALL TO ORDER Flag Salute Mayor Booth called the meeting to order at 7:30 PM and led those in attendance in the Pledge of Allegiance. Roll Call Mayor Booth and the following Councilmembers were present: Pete Lewis, Sue Singer, Jeanne Barber, Trish Borden, Fred Poe, Gene Cerino, and Rich Wagner. Staff members present included: Parks and Recreation Director Dick Deal, Personnel Director Brenda Heineman, Fire Chief Bob Johnson, Deputy Police Chief Jim Kelly, Public Works Director Christine Engler, Finance Director Diane L. Supler, Assistant Planning Director Lynn Rued, Assistant City Attorney Judith Ausman, and City Clerk Danielle Daskam. C. B. Audience Participation Jeff Masoner, Home Plate Tavern, 144 East Main Street, Auburn Mr. Masoner advised that he submitted an application for a right-of- way land use permit for the Good O1' Days Festival. The permit was not accepted by the Public Works Department because a permit had already been issued to Good OF' Days Inc. Mr. Masoner questioned the issuance of a right-of-way permit exclusively to Auburn Good O1' Days, which is a for-profit organization. Mayor Booth referred Mr. Masoner's question to City Attorney Reynolds who will return on July 26, 1999. Correspondence No correspondence was received for City Council review. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chair Poe reported the Municipal Services Committee met this evening at 6:00 PM. The Committee discussed and recommended approval of Ordinance No. 5262 and Resolution No. 3104. The next regular meeting of the Municipal Services Committee is scheduled for August 2, 1999 at 6:00 PM. Planning & Community Development Chair Borden reported the Planning and Community Development Committee met July 12, 1999. The Committee considered requests for water and sewer availability certificates, which appear later on this evening's agenda. The next regular meeting of the Planning and Community Development Committee is scheduled for July 26, 1999 at 6:30 PM. Public Works Chair Wagner reported the Public Works Committee met July 13, 1999. The Committee discussed the Transportation Improvement Plan. The Committee also recommended approval of the authorization funds for the Third Street interchange (Ordinance No. 5266). The next regular meeting of the Public Works Committee is scheduled for July 26, 1999 at 4:30 PM. Page 2 City of Auburn Council Meeting Minutes July 19, IV. Finance Chair Barber reported the Finance Committee met this evening at 6:00 PM. The Committee reviewed and recommended approval of claims and payroll vouchers, Ordinance No. 5269 and Ordinance No. 5272. The Committee also discussed a proposal for Local Improvement District Administration, the 1998 State Auditor's Report, and mid-year budget adjustments. The next regular meeting is scheduled for August 2, 1999 and will meet at 6:00 PM. CONSENT AGENDA A. Minutes 1. Minutes of the July 6, 1999 regular City Council meeting. Contract Administration Public Works Proiect Number C8050 O4.9.1 C8050 City Council to award Contract No. 99-12, Project Number C8050, South 316th Street - Half Street Improvement, to Woodworth & Company on their Iow bid of $184,016.50 plus Washington State sales tax of $5,553.58 for a total contract price of $189,570.08. Small Works Proiect Number MS 730 Q4.6.3 City Council to award Contract No. 99-19, Small Works Project Number MS 730, Sanitary and Storm Sewer Manhole Casting Replacements, to M. A. Segale on their Iow bid of $38,770.20 including state sales tax. Counc member Barber moved and Councilmember Wagner seconded to approve the Consent Agenda. MOTION CARRIED UNANIMOUSLY. 7-0. UNFINISHED BUSINESS There were no items under this section for City Council review. NEW BUSINESS Application No. WSC0003-97 A3.13.8 City Council to consider the request of Schneider Homes for a Development Agreement for the issuance of sewer availability certificate for property located at 28201 132nd Avenue SE, Auburn, and to approve the Petition for Annexation, Annexation Agreement and Declaration of Covenant. Councilmember Borden moved and Councilmember Singer seconded to approve the Development Agreement enabling the issuance of sewer availability certificates. MOTION CARRIED UNANIMOUSLY. 7-0. Please refer to Item VII. A.2 of these minutes for further action on this item. Application No. WSC0006-99 A3.13.8 City Council to consider the request of Allen and Patricia Kofa for the issuance of water and sewer availability certificates for property located at 106XX SE 300th Street, Auburn, and to approve the Petition for Annexation, Annexation Agreement and Declaration of Covenant. Page 4 City of Auburn Council Meeting Mim!!e_~ July 19, Councilmember Borden moved and Councilmember Singer seconded to remand Application No. WSC0006-99 to the Planning and Community Development Committee. Councilmember Borden explained that during the Committee's hearing on the application, neighborhood residents expressed concerns related to storm drainage. The Committee approved the application with a request to staff to relay the Committee's concerns to King County. Councilmember Borden requested an opportunity for the Planning and Community Development Committee to review the application and the comments to be forwarded to King County. MOTION CARRIED UNANIMOUSLY. 7-0. VII. ORDINANCES AND RESOLUTIONS A. Ordinances Ordinance No. 5262 F5.2 An Ordinance of the City Council of the City of Auburn, Washington, approving acceptance of grant funds from the State of Washington Military Department, Emergency Management Division, in the amount of One Thousand Two Hundred and 00/100 Dollars ($1,200.00) and authorizing execution of Contract No. EM999445 approving the expenditure and appropriation of said grant funds. Councilmember Poe moved and Councilmember Cerino seconded to introduce and adopt Ordinance No. 5262. MOTION CARRIED UNANIMOUSLY. 7-0. Page 5 City of Auburn Council Meeting Minutes July 19, Ordinance No. 5266 F5.2.15, O4.9.1 PR 529 An Ordinance of the City Council of the City of Auburn, Washington, approving Freight Mobility Strategic Investment Board Grant funds and Federal TEA-21 (Section 1118) Grant funds (with local matching funds) as provided in the Local Agency Agreement Supplement between the City and the Washington State Department of Transportation to prepare and implement the SR 18/C Street SW Ramp Modifications/3rd Street SW Grade Separation Project. Councilmember Wagner moved and Councilmember Cerino seconded to introduce and adopt Ordinance No. 5266. Councilmember Wagner congratulated Public Works Department and Planning Department staff for their work in obtaining grant funding for the project. MOTION CARRIED UNANIMOUSLY. 7-0. Ordinance No. 5267 A3.13.8 An Ordinance of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn to execute a Development Agreement between the City and Allen Kofal and Patricia Kofal. This item was remanded to the Planning and Community Development Committee under Item VI.B of these minutes. Ordinance No. 5268 A3.13.8 An Ordinance of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn to execute a Development Agreement between the City and Schneider Homes. Councilmember Borden moved and Councilmember Singer seconded to introduce and adopt Ordinance No. 5268. MOTION CARRIED UNANIMOUSLY. 7-0. Page 6 City of Auburn Council Meetin,q Minutes July 19, Ordinance No. 5269 A3.9.4 An Ordinance of the City Council of the City of Auburn, King County, Washington, approving the Collective Bargaining Agreement between the City and the Auburn Police Guild Commissioned Unit, for 1999-2001. Councilmember Barber moved and Councilmember Lewis seconded to introduce and adopt Ordinance No. 5269. MOTION CARRIED UNANIMOUSLY. 7-0. Ordinance No. 5272 04.7, F4.3 An Ordinance of the City of Auburn, Washington, amending Auburn City Code Section 8.08.260 entitled "Collection Charge - Payment - Nonpayment Action" contained in Chapter 8.08 entitled "Solid Waste" to change delinquency date and penalties in Subsection (A). Councilmember Barber moved and Councilmember Lewis seconded to introduce and adopt Ordinance No. 5272. MOTION CARRIED UNANIMOUSLY. 7-0. Resolutions Resolution No. 3104 F4.8 A Resolution of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn, to execute a Cooperative Purchasing Agreement with King County which allows the City to purchase various medical supplies and equipment using King County's competitively awarded contract. Councilmember Poe moved and Councilmember Cerino seconded to adopt Resolution No. 3104. MOTION CARRIED UNANIMOUSLY. 7-0. Page 7 City of Auburn Council Meetinq Minutes July VIII.
