TO ORDER Fla.q Salute Mayor Booth called the meeting to order at 7:30 PM and led those in attendance in the Pledge of Allegiance. Roll Call Mayor Booth and the following City Councilmembers were present: Pete Lewis, Sue Singer, Jeanne Barber, Trish Borden, Fred Poe, Gene Cerino, and Rich Wagner. Staff members present included: Planning and Community Development Director Paul Krauss, Parks and Recreation Director Dick Deal, Personnel Director Brenda Heineman, Fire Chief Bob Johnson, Acting Police Chief Jim Kelly, Public Works Director Christine Engler, City Attorney Michael J. Reynolds, Finance Director Diane L. Supler, and City Clerk Danielle Daskam. Announcements and Appointments Announcements The Mayor's presentation of certificates of recognition to members of the Auburn Little League team was postponed until October 4, 1999. Appointments There were no appointments for City Council consideration. Public Hearinqs Application Number ANX0002-99 03.1 ANX0002~99 City Council to conduct a public hearing on a petition for annexation of a 1.5 acre parcel of land located on South 85th Avenue. Planning and Community Development Director Krauss referred to the correspondence received from Mr. DeLaHunt of Select Properties dated September 20, 1999, requesting that the Council table the applicants' petition for annexation so that the applicants could submit a rezone concurrently with the annexation petition. City Attorney Reynolds explained that the applicant must either go forward with the annexation process and then apply for a rezone, or withdraw the application and apply for the annexation and rezone concurrently. Dennis DeLaHunt, 55 Bell Street, Suite 200, Seattle, WA, 98121 Mr. Dennis DeLaHunt of Select Properties spoke on behalf of the applicants, the Elliotts and Codigas. Mr. DeLaHunt indicated the applicants desire to withdraw their application for annexation. He indicated that the applicants misunderstood that the annexation and rezone would be considered concurrently. He requested the withdrawal of the application. Audience Participation Mary Jo Hartman, 20301 SE 353rd, Auburn, WA Ms. Hartman indicated she owns approximately three acres in the area of 8400 South 284th Street and near the area sought to be annexed under Application No. ANX0002-99. Ms. Hartman advised that she filed a claim against the City recently. City Attorney Reynolds advised that the claim was turned over to the City's insurer, Washington Cities Insurance Authority, who will assign an adjuster to contact Ms. Hartman. City Attorney Reynolds also advised that although the annexation petition was withdrawn this evening, the application for annexation may be resubmitted in the future. Correspondence No correspondence was received for City Council review. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chair Poe reported the Municipal Services Committee met this evening at 6:00. The Committee discussed and recommended approval of the bid award for Airport North Hanger Buildings to Kassel Construction, Ordinance No. 5220 regarding airport rental rates, and Ordinance No. 5287 regarding lighter-than-air aircraft. The Committee also discussed airport construction financing and the proposed police and fire budgets. The next regular meeting of the Municipal Services Committee is scheduled for October 4, 1999. Planning & Community Development Chair Borden reported the Planning and Community Development Committee met September 13, 1999. The Committee conducted a hearing on Application No. WSC0017-98. The Committee discussed the Consolidated Plan and recommends the City Council schedule a public hearing on the Plan. The Committee received presentations on the Planning Department and Parks Department budgets. The Committee also discussed a proposed interlocal agreement with King County regarding annexation areas. The Committee also received a brief presentation on the Lea Hill preannexation rezone. Public Works Chair Wagner reported the Public Works Committee met September 15, 1999. The Committee discussed the Aquifer Characterization Study, water and storm drainage rates, traffic signals and pedestrian pushbuttons, and department budgets. The next regular meeting of the Public Works Committee is scheduled to meet September 27, 1999, at 4:30 PM. Finance Chair Barber reported the Finance Committee met this evening at 6:00 PM. The Committee reviewed and recommended approval of claims and payroll vouchers. The Committee discussed the City's telephone system, airport bonds and hangar construction, the Finance Department budget, and the Equipment Rental budget. The next regular meeting of the Finance Committee is scheduled for Monday, October 4, 1999 at 6:30 PM. CONSENT AGENDA A. Minutes Minutes of the September 7, 1999 regular City Council meeting. B. C, Contract Administration Auburn Municipal Airport North Hanger Buildings 04.4.9.2 City Council to award the contract for construction of Auburn Municipal Airport North Hanger Buildings to Kassel Construction on their Iow bid of $1,195,752.98 Amendment No. 2 to Agreement for Professional Services with Economic En.qineerinq Services O4.11 City Council to approve Amendment No. 2 to Professional Services Agreement No. AG-C-14 between the City of Auburn and Economic Engineering Services, Inc. D. Call for Public Hearing Consolidated Plan O3.4.1.7 City Council to call for a public hearing to be held October 18, 1999 on the City of Auburn Consolidated Plan for 2000- 2004. Councilmember Barber moved and Councilmember Wagner seconded to approve the Consent Agenda. MOTION CARRIED UNANIMOUSLY. 7-0. UNFINISHED BUSINESS There were no items under this section for City Council review. NEW BUSINESS Application No. PLT0001-98 03.5 PLT0001-98 City Council to consider the request of Frank and Shirley Gaines for final plat approval of Ashley Avenue, an eight-lot single family subdivision, located at 330 "V" Street SE. Councilmember Borden moved and Councilmember Lewis seconded to approve the final plat and instruct the City Attorney to prepare the necessary ordinance. Page 5 ] I City of Auburn Council Meeting Minutes September 20, 1999 Planning and Community Development Director Krauss advised that the plat improvements have been made to the satisfaction of staff. Councilmember Poe inquired whether the street improvements for the entire width of the street on 3rd Court SE are completed with the plat. Public Works Director Engler advised there are certain improvements on the street including curb and gutter. There was insufficient area to provide a full-width sidewalk. The improvements are complete as instructed, MOTION CARRIED. 6-1 Councilmember Poe voted no. Application Number WSC0017-98 A3.13.8 City Council to consider the request of Robert Porter for a Development Agreement for the issuance of water and sewer certificates for property located at 31920 - 116th Avenue SE and to approve the Petition for Annexation, Annexation Agreement and Declaration of Covenant. Planning and Community Development Director Krauss explained that the property to be serviced is a 13-1ot subdivision. The property is located more than one-quarter mile from existing city limits; and therefor it is inappropriate to require annexation at this time. The project is consistent with City development standards. Mr. Krauss recommended approving the development agreement with the conditions as outlined in the agenda bill report. Councilmember Borden moved and Councilmember Lewis seconded to approve Application Number WSC0017-98. In response to a question from Councilmember Wagner, Public Works Director Engler advised that the developer is required to pay for the cost of extending the sewer trunk or lateral. Ordinances Ordinance No. 5220 04.4.9.3, F4.3 An Ordinance of the City of Auburn, Washington, amending Auburn City Code Chapter 12.56 entitled "Airport", specifically Section 12.56.045 "Airport Tiedown, Hangar and Storage Rental Fees", to increase the rental rates by 10 (ten) percent. Councilmember Poe moved and Councilmember Cerino seconded to introduce and adopt Ordinance No. 5220. MOTION CARRIED UNANIMOUSLY. 7-0. Ordinance No. 5284 03.8 REZ0002-99 An Ordinance of the City Council of the City of Auburn, Washington, providing for the rezoning of property located at 22 "D" Street SW within the city of Auburn, Washington, changing the zoning classification thereof from R-4 (multi- family) to C-3 (heavy commercial). Councilmember Borden moved and Councilmember Lewis seconded to introduce and adopt Ordinance No. 5284. MOTION CARRIED UNANIMOUSLY. 7-0. Ordinance No. 5285 O3.10.1 CUP0003-99 An Ordinance of the City of Auburn, Washington, providing for a Conditional Use Permit to allow a professional office on property zoned R-4 (multi-family) located at 2704 'T' Street NE, within the city of Auburn, Washington. Councilmember Borden moved and Councilmember Barber seconded to introduce and adopt Ordinance No. 5285. MOTION CARRIED UNANIMOUSLY. 7-0. Councilmember Borden moved and Councilmember Lewis seconded to introduce and adopt Ordinance No. 5286. MOTION CARRIED UNANIMOUSLY. 7-0. Ordinance No. 5287 04.4.9 An Ordinance of the City of Auburn, Washington, amending Auburn City Code Chapter 8.36, entitled "Ultralight", specifically Section 8.36.030 "Prohibited Acts", to provide for the operation of "lighter than air aircraft" (hot air balloon) at Auburn Municipal Airport. Councilmember Poe moved and Councilmember Cerino seconded to introduce and adopt Ordinance No. 5287. MOTION CARRIED UNANIMOUSLY. 7-0. Ordinance No. 5288 A3.13.8 An Ordinance of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn to execute a Development Agreement between the City and Robert Porter. Resolutions Resolution No. 3110 O4.2.1 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute a Pole Attachment Agreement with Puget Sound Energy. Councilmember Wagner moved and Councilmember Cerino seconded to adopt Resolution No. 3110. MOTION CARRIED UNANIMOUSLY. 7-0. Resolution No. 3115 A3.13.9 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and the City Clerk to execute a Payback Agreement for Developer's Extension between the City of Auburn and Finkbeiner Development. Councilmember Wagner moved and Councilmember Cerino seconded to adopt Resolution No. 3115. MOTION CARRIED UNANIMOUSLY. 7-0. Resolution No. 3116 A3.13.9 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and the City Clerk to execute a Payback Agreement for Developer's Extension between the City of Auburn and KS Construction. MAYOR'S REPORT IX. Initiative 695 A3.4.2 Mayor Booth inquired whether the Council would like to pursue a resolution with regard to Initiative 695. City Attorney Reynolds explained that if the City Council takes a position by resolution on an initiative, the Council must conduct a public hearing and allow equal opportunity to express opposing views. Councilmember Wagner moved and Counciimember Cerino seconded to schedule a public hearing to be held October 4, 1999 to receive input from citizens on Initiative 695. MOTION CARRIED UNANIMOUSLY. 7-0. Executive Session Mayor Booth recessed the meeting to executive session at 8:10 PM in order to discuss real estate matters. Mayor Booth reconvened the meeting at 8:55 PM.
