COUNCIL MEETING MINUTES
April 3, 2000 7:30 PM
I. CALL TO ORDER
A. Flag Salute
Mayor Charles A. Booth called the meeting to order at 7:30 PM and
led those in attendance in the Pledge of Allegiance.
B. Roll Call
Mayor Booth and the following Councilmembers were present:
Stacey Brothers, Pete Lewis, Jeanne Barber, Trish Borden, Fred
Poe and Sue Singer. Councilmember Rich Wagner was excused.
Staff members present included Planning and Community
Development Director Paul Krauss, Fire Chief Bob Johnson, Police
Chief Jim Kelly, City Attorney Michael J. Reynolds, Personnel
Director Brenda Heineman, Finance Director Diane L. Supler,
Public Works Director Christine Engler, Parks and Recreation
Director Dick Deal, Cultural Programs Manager Susan Sagawa,
Cultural Programs Coordinator Lori Corso, and City Clerk Danielle
Daskam.

Mayor Booth read and presented a proclamation
declaring the week of April 9 through 15, 2000 as
Volunteer Week in the city of Auburn to the following
volunteers in recognition of their dedication and

II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE
A. Public Hearings
No public hearing was scheduled for this evening.
B. Audience Participation
This is the place on the agenda where the public is invited to speak
to the City Council on any issue.
Bob Fraser, 3201 20th Avenue Court SE, Puyallup, WA
Mr. Fraser spoke on behalf of Emerald Downs and their request to
hold an annual motorcycle racing event at the thoroughbred horse
racing track. For the past two years the City has permitted Emerald
Downs to hold a one day motorcycle racing event at the track. Mr.
Fraser requested that this year the City allow Emerald Downs to
conduct motorcycle racing on two evenings during one racing event
this year. He noted that last year there were no known complaints
regarding the event. (P/ease refer to Item VII. A.5 of these minutes
for Council action regarding Emerald Downs' request.)

Ms. Sanders expressed concern with the impact of motorcycle
racing on the Emerald Downs horse racing track.
Leona Legler, 923 30th Street NE, Auburn, WA
Ms. Legler reported she heard the motorcycle racing from the
racetrack last year at her home. She stated the racing was noisy,
but she is not opposed to racing once or twice a year.

Mr. Fraser spoke regarding the maintenance and preparation of the
Emerald Downs track surface and the effect of the motorcycles on
the track. He also stated that Emerald Downs is requesting one
annual racing event to be held after the end of thoroughbred horse
racing season.
C. Correspondence

III. COUNCIL COMMITTEE REPORTS
A3.7.6
A. Municipal Services
Chair Singer reported the Municipal Services Committee met this
evening at 5:00. The Committee discussed and recommended
approval of the Fire Department's request to call for bids for a new
fire pumper. The Committee also discussed and recommended
approval of Ordinance No. 5369 providing for Auburn Airport gate
cards and discussed a possible property purchase for the non-
motorized transportation plan. The next regular meeting of the
Municipal Services Committee is scheduled for April 17, 2000 at
6:00 PM.
B. Planning & Community Development
Chair Borden reported the Planning and Community Development
Committee met March 27, 2000. The Committee discussed
Emerald Downs' request for an annual motorcycle racing event.
The Committee recommended approval for Emerald Downs to
conduct the race on an annual basis rather than returning to the
City each year for approval. The Committee recommended
adoption of Resolution No. 3198 for an Agreement with Auburn
Respite and discussed enhancements to the transit station. The

next regular meeting of the Planning and Community Development
Committee is scheduled for April 10, 2000.
C. Public Works
Member Lewis reported the Public Works Committee met March
27, 2000 at 4:30 PM. The Committee discussed and
recommended approval of surplus property, a right-of-way permit
for King County/Metro, and contract administration items. The
Committee also discussed and recommended approval of
Resolution No. 3201, Ordinance No. 5366, and Resolution No.
3203. The Committee also discussed right-of-way vacation fees,
Coal Creek Springs, King County Combined Sewer Overflow Water
Quality Assessment, and capital projects status. The next regular
meeting of the Public Works Committee is scheduled for April 10,
2000 at 4:30 PM.
D. Finance
Chair Barber reported the Finance Committee met this evening at
7:00. The Committee reviewed and recommended approval of
claims and payroll vouchers, surplus property, and Resolution No.
3191. The next regular meeting of the Finance Committee is
scheduled for April 17, 2000 at 6:30 PM.

Councilmember Borden moved and Councilmember Singer
seconded to introduce and adopt Ordinance No. 5364.

2. Ordinance No. 5365

An Ordinance of the City Council of the City of Auburn,
Washington, providing for the rezoning of property located at
the northeast corner of 30th Street NE and Auburn Way
North within the city of Auburn, Washington, changing the
zoning classification thereof from M-1 (light industrial) to C-3
(heavy commercial).
Councilmember Borden inquired regarding the citizen
concerns expressed at the March 20, 2000 Council meeting
relating to vegetation and storm drainage. Planning and
Community Development Director Krauss responded that
the developer will be required to landscape and revegetate
the property which will enhance the aesthetics of Auburn
Way North and comply with the standards for storm
drainage.
Councilmember Borden moved and Councilmember Singer
seconded to introduce and adopt Ordinance No. 5365.

Washington,. approving Federal TEA-21 grant funds with
local matching funds as provided in the Local Agency
Agreement between the city and the Washington State
Department of Transportation for the construction of a signal
at the intersection of "A" Street SW and 2nd Street SW
Councilmember Lewis moved and Councilmember Poe

An Ordinance of the City Council of the City of Auburn,
Washington, authorizing the expenditure of funds, not to
exceed Two Million Dollars ($2,000,000), for the repair and
construction costs necessary to remodel the Auburn Library
into a senior center.
Councilmember Borden moved and Councilmember Singer
seconded to introduce and adopt Ordinance No. 5367.

5. Ordinance No. 5368

An Ordinance of the City of Auburn, Washington, amending
Ordinance No. 4689 and Ordinance 5234 that provided a
conditional use permit to construct and operate a
thoroughbred horse racing facility, to amend Section 2,
Subsection 22 to allow annual motorcycle events to be held
at the Emerald Downs Track.
City Attorney Reynolds noted that in the past, the Council
amended Ordinance No. 4689 for a one-day one year only
event. Ordinance No. 5368 provides for a permanent
change to the Ordinance. He also noted that the
environmental impact statement for the thoroughbred horse

track addressed a specific use, which did not include
motorcycle racing events.
Planning and Community Development Director Krauss
explained staff's evaluation of the net impact of an annual
motorcycle racing event versus a horse racing event. Their
evaluation determined that the impacts are identical. The
only issue determined by Council to be extraordinary is the
noise from the motorcycles. During the past two annual
events, only one complaint was received regarding the
noise.
Councilmember Poe inquired whether Council could rescind
the amendment at a later date. City Attorney Reynolds
stated that once the permission is granted in perpetuity, it
could be difficult to rescind the permitted use.
In response to a question from Councilmember Brothers,
Planning and Community Development Director Krauss
explained that last year staff recommended a permanent
change to the Emerald Downs conditional use permit to
allow the annual event. However, the City Council decided
to continue requiring annual approval for the motorcycle
racing event. This year, staff recommended the permanent
change again and the Planning and Community
Development Committee concurred.
Councilmember Barber expressed preference for reviewing
the request on an annual basis and expressed concern that
this year's request has expanded to two days rather than
one.
Councilmember Poe spoke in favor of reviewing the request
on an annual basis.
Councilmember Borden explained that the Planning and
Community Development Committee did not have the
information provided by City Attorney Reynolds this evening
during their deliberation on Emerald Down's request. She
suggested amending the ordinance to provide approval for
an annual motorcycle racing event at Emerald Downs for the

next two years instead of making it a permanent change to
the conditional use permit.
Councilmember Borden moved and Councilmember Singer
seconded to instruct the City Attorney to draft a resolution to
allow Emerald Downs to hold an annual motorcycle racing
event for a two year period for a two-night event ending at
10:00 PM occurring over one weekend a year.
MOTION CARRIED UNANIMOUSLY. 6-0.
6. Ordinance No. 5369

An Ordinance of the City Council of the City of Auburn,
Washington, adding a new Section 12.56.046 entitled
"Automatic Gate Electronic Cards" to Auburn City Code
Chapter 12.56 entitled "Airport" to set forth electronic card
requirements.
Councilmember Singer moved and Councilmember Lewis
seconded to introduce and adopt ordinance No. 5369.
MOTION CARRIED UNANIMOUSLY. 6-0.
B. Resolutions

A Resolution of the City Council of the City of Auburn,
Washington, authorizing the execution of a Professional
Services Agreement with the Profit Recovery Group,
Commercial Division to provide accounts payable audit and
recovery of overpayments.

3. Resolution No. 3200

A Resolution of the City of Auburn, Washington, amending
Resolution No. 3192 adopted February 22, 2000, authorizing
the Mayor and City Clerk to accept transfer of unimproved
park land commonly known as Park 4 on the eastern edge
of the Lakeland South PUD with the corrected legal
description.
Councilmember Borden moved and Councilmember Singer
seconded to adopt Resolution No. 3200.

Washington, fixing a time for a public hearing on the petition
for vacation of an alley located on the north side of 1st
Street NE and east of North Division Street, within the city of
Auburn, Washington.

Councilmember Borden moved and Councilmember Singer
second to adopt Resolution No. 3202.

6. Resolution No. 3203

A Resolution of the City Council of the City of Auburn,
Washington, authorizing the Mayor and City Clerk to execute
an Agreement for professional Services for 2000 with
Transportation Consulting Northwest to provide on-call traffic
engineering services for the City of Auburn.
Councilmember Lewis moved and Councilmember Singer
seconded to adopt Resolution No. 3203.
MOTION CARRIED UNANIMOUSLY. 6-0.
VIII. MAYOR'S REPORT
A. Executive Session
Mayor Booth recessed the meeting to executive session at 8:26
PM for approximately twenty minutes in order to discuss litigation
and personnel matters. Mayor Booth indicated no action is
anticipated following the executive session.
Mayor Booth reconvened the meeting at 8:54 PM.
