Booth called the meeting to order at 7:32 PM in the Council Chambers of Auburn City Hall, 25 West Main Street, Auburn, Washington. Mayor Booth led those in attendance in the Pledge of Allegiance. B. Roll Call Mayor Booth and the following Councilmembers were present: Rich Wagner, Jeanne Barber, Trish Borden, Sue Singer, Fred Poe, Pete Lewis, and Stacey Brothers. Staff members present included: Assistant City Attorney Judith Ausman, Planning and Community Development Director Paul Krauss, Assistant Planning Director Lynn Rued, Public Works Director Christine Engler, City Engineer Dennis Dowdy, Sewer Utility Engineer Jeff Roscoe, Storm Drainage Engineer Tim Carlaw, Finance Director Diane L. Supler, Employment Manager John Fletcher, Assistant Fire Chief Russ Vandver, Police Chief Jim Kelly, Parks and Recreation Director Dick Deal, and City Clerk Danielle Daskam. C. Announcements and Appointments 1. Announcements a) Hometown Hero Award Mayor Booth presented Auburn's Hometown Hero Award to John and Nancy Nixon. Mr. And Mrs. Nixon were accompanied by their son, Bill, and their daughter, Maryanne. b) South King County Community Network Kay Lasko, Chair of the South King County Community Network located at Renton, Washington, gave a brief presentation on the Network's origins and role in the community. The goal of the Network is to make communities better for youth and their families. The Network works with other human service collaborators to better provide human services to meet the needs of the community. Some of the projects funded by the Network include the Family Community Partnership, Parents and Children Together, and the South King County Violence Prevention Coalition. Ms. Lasko presented the Council with information on the Network's summary of their two year plan and their self-governance strategy model for South King County. c) Recognition of Cal Scarff Mayor Booth presented Cal Scarff with an award commemorating forty-three years of service on the Auburn Park and Recreation Commission. Mayor Booth thanked Mr. Scarff for his leadership and understanding for the needs of the community and for all of his contributions to the community over the years. Parks and Recreation Director Dick Deal and former Parks and Recreation Director Len Chapman were on hand to extend their thanks and best wishes. 2. Appointments There were no appointments for City Council review. D. Agenda Modifications The agenda was modified to include a request to set a date for a public hearing on certain Year 2000 Comprehensive Plan amendments transmitted under Item IV.D.2 of these minutes. Page 2 City of Auburn Council Meeting Minutes October t6, 2000 II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings 1. Application Number V-03-99 03.9 v-03-99 City Council to conduct a public hearing on a petition filed by property owners (Valley Pontiac Buick GMC) for vacation of a portion of street right-of-way abutting Auburn Way North and 30th Street NE. City Engineer Dennis Dowdy presented the staff report. Valley Pontiac has petitioned the vacation of a triangular strip of right-of-way which measurers approximately thirty feet wide by 180 feet in length located at the northeast corner of the intersection of 30th Street NE and Auburn Way North. City Engineer Dowdy reported that the staff evaluation and recommendation are not completed. Therefore, there is no recommendation for action regarding the request of Valley Pontiac. City Engineer Dowdy presented a brief history of the site. Prior to construction of SR 167, this portion of Auburn Way North served as the valley highway. There was a severe bend in the roadway in the vicinity of the' proposed vacation. The State acquired the right-of-way to the west and realigned the roadway during the 1960's. When SR 167 was completed (in the late 1970's), the valley highway was turned over to the City along with the excess right-of-way. The landscaped area of right-of-way on the northeast corner of Auburn Way North and 30th Street NE was maintained by HITCO, the company that had been located adjacent. Since HITCO moved several years ago, the parcel has deteriorated. Across the street, on the southeast corner of the intersection, is the Slaughter monument, which is maintained by the Parks Department. City Engineer Dowdy recommended that the Council conduct the hearing this evening. Since the staff evaluation Page 3 City of Auburn Council Meetin.Q Minutes October 16, 2000 is not complete, staff would need to determine the future needs of the City and any private utility which may be currently using the right-of-way. Staff would expect to work with the Developer to obtain the data necessary for completion of the staff study. City Engineer Dowdy presented overhead slides of the intersection to familiarize the Council with the area. City Engineer Dowdy stated that staff has not been able to determine whether there are old easements that came with the right-of-way and if there are any private utilities within the right-of-way. In response to a question from Councilmember Lewis, Public Works Director Engler explained that a decision to vacate right-of-way on the northeast corner of the intersection and a subsequent intersection requirement may affect the area to the south of the intersection. Councilmember Lewis also noted that the petition for vacation was signed on June 22, 2000 and questioned the delay in receiving a staff recommendation. City Engineer Dowdy reported that staff review is ongoing and therefor not complete. Mayor Booth opened the public hearing. Alan Poe, Poe Engineering, 1314 8th Street NE, Suite 102, Auburn, WA Mr. Poe referred to a full-size set of prints consisting of three sheets. The third sheet of the prints included an overview of the area of Auburn Way North with the current rights-of-way. Sheet B2 consists of the area immediately around the subject property and illustrates the constructed centerline. Mr. Poe proposed that the City retain an easement for any underground utilities or appurtenances that may currently exist or be needed in the future. Sheet B1 illustrates the current preliminary site plan to develop the property. The vacated right-of-way would be incorporated in the development plans. The area requested for vacation is Page 4 City of Auburn Council Meetin.q Minutes October 16, 2000 irregularly shaped, ranging from five feet wide at the north to approximately twenty-four feet at the south end. Ron Claudon, Valley Pontiac GMC, 30441 108th Avenue SE, Auburn, WA Mr. Claudon, representing the petitioner, Valley Pontiac GMC, spoke on behalf of the vacation. He presented several photos of the site using overhead slides. He explained the vacation is needed to develop the site and provide consistency with Auburn Way. There was discussion regarding the existing vegetation. Alan Poe advised that all of the trees at the site are identified on print sheet B1 as either trees to remain or trees to be removed. In response to a question from Councilmembers Wagner and Borden, Mr. Poe advised that Valley Pontiac proposes giving an easement to the City over the entire vacated area. The vacated area will be paved and landscaped and used for automotive display only. The project is in the C-3 zone which requires five feet of street landscaping. Assistant City Attorney Ausman recommended that, if Council does not intend to take action on the petition this evening, the Council continue the hearing to a date certain. Ms. Ausman also requested that the City obtain a supplement to the petition for vacation to comply with City ordinance. The petitioner needs to supply a certification from the corporate secretary that the person who signed the petition is authorized to sign the petition on behalf of Valley Pontiac Buick GMC Inc. City Engineer Dowdy explained the reason for a possible thirty to forty day delay in submitting a staff recommendation. Staff is not prepared to provide information regarding the future traffic demands for the intersection and the likely expansion of the intersection required by the future development along the "1" Street corridor. The City does not have the tools to complete a response regarding the future needs or demands on the intersection. Mr. Dowdy also indicated there are two utilities Page 5 City of Auburn Council Meetin_~ Minutes October 16, 2000 that have not yet responded regarding the proposed vacation. Councilmember Wagner stated that the response from the utilities is moot since the applicant has offered to provide an easement for the entire parcel, and the ability to determine the future traffic demands on the intersection will not likely be determined in the next forty days. Councilmember Wagner suggested closing the public hearing and proceed to action on the petition for vacation. Councilmember Lewis agreed with the comments made by Councilmember Wagner. Councilmember Borden questioned the potential traffic improvements for the intersection. City Engineer Dowdy stated it may be desirable to expand the intersection to provide an additional turn lane on 30th Street NE. Councilmember Singer noted that 30th Street NE is not in the Six Year Street Improvement Program. Councilmember Wagner moved and Councilmember Lewis seconded to close the public hearing. MOTION CARRIED. 6-0. Councilmember Poe abstained. Councilmember Wagner moved and Councilmember Lewis seconded to approve Application No. V-03-99 with the modification to include the entire parcel as a utility easement for the City and to require a supplement of the record to include certification from Valley Pontiac corporate secretary. Closed Record Hearings This is a closed record hearing where any public testimony must be strictly limited to the issues involving the proposal and must also be limited to comments "on the record". No new or additional evidence may be allowed. 1. Application Number PLT00-0002 O3:5 PLT00-0002 City Council to conduct a closed record hearing on the request of Swanson Homes for preliminary plat approval of a 20-lot single family subdivision located on the west side of the 3800 block of Academy Drive. Mayor Booth opened the closed record hearing. Councilmember Wagner noted an Academy booster pump upgrade is slated for the years 2007-2010 for $1.4 million. He questioned whether the subdivision will affect the timing need for the booster pump upgrade. Public Works Director Engler responded that the Comprehensive Water Plan capital improvement program anticipates that all properties will develop to their fullest potential, and the development in question will not affect the timing of the booster pump project. Councilmember Wagner recalled that a sanitary sewer renovation is scheduled for the area. He questioned whether the project will coincide with the plat development. Sanitary Sewer Engineer Jeff Roscoe expressed hope that construction could take place simultaneously. If possible, the City will utilize savings in road restoration by coordinating the projects. Councilmember Wagner questioned whether the development will cause any of the manholes to overflow. Sewer Engineer Roscoe reported that surcharge conditions have occurred in the past. However, no surcharge has occurred since the repai[ of an existing line to eliminate storm infiltration to the sewer line. Mr. Roscoe indicated no surcharge condition is anticipated as a result of the proposed development. Page 7 City of Auburn Council Meetinn Minutes October t6, 2000 Councilmember Wagner questioned the type of storm detention facility proposed for the development. Storm Utility Engineer Tim Carlaw indicated either a wet pond/detention combination or a bioswale with a detention facility is proposed for the development. There is a twenty- four inch storm line that abuts the south property line of the Swanson project which the development can access. Councilmember Poe questioned the ultimate destination for the storm water. Mr. Carlaw confirmed the storm drain empties to the south of Auburn Way South. Marshall Bain, 5307 33rd Street SE, Auburn, WA In response to a question from Councilmember Poe, Mr. Bain stated that the Seventh Day Adventist Academy constructed a sixteen inch storm drain that drained to the Green River, not the White River. Councilmember Poe questioned the capacity of the storm' line along the south property line of the proposed development. Storm Utility Engineer Carlaw reported that the line was reviewed during the Auburn Way South storm improvement and upgrade. The line is not in the comprehensive plan to receive additional work. Mr. Carlaw recalled that the storm line was extended down Auburn Way South in 1993. Staff studied the capacities and integrity of the system for the area in question. The system was determined to be sound. Councilmember Borden moved and Councilmember Singer seconded to close the hearing. MOTION CARRIED UNANIMOUSLY. 7-0. Councilmember Borden moved and Councilmember Singer seconded to approve the preliminary plat based on the Hearing Examiner's Findings of Fact, Conclusions and Conditions, and instruct the City Attorney to preepare the necessary resolution. Application Number REZ00-0003 03.8 REZ00-0003 City Council to conduct a closed record hearing on the request of Swanson Homes, Margaret Wilson, Margaret Darby and Marshal Bain to rezone their collective properties, located on the west side of the 3400 - 3800 blocks of Academy Drive, from the existing R-l, Single Family Residential, to R-2, Single Family Residential. Mayor Booth opened the closed record hearing. No one in the audience requested to speak. Councilmember Borden moved and Councilmember Singer seconded to close the hearing. MOTION CARRIED UNANIMOUSLY. 7-0. Councilmember Borden moved and Councilmember Singer seconded to approve the rezone based on the Hearing Examiner's Findings of Fact, Conclusions and Conditions, and instruct the City Attorney to prepare the necessary ordinance. MOTION CARRIED UNANIMOUSLY. 7-0. C. Audience Participation This is the place on the agenda where the public is invited to speak to the City Council on any issue. For clarification of these minutes, audience participation occurred immediately following Council Committee reports. George Hutchison, 11224 SE 320th Street, Auburn, WA Mr. Hutchison advised that he lives in the Lea Hill area, which was annexed to the city earlier this year, and he is a licensed amateur radio operator. Mr. Hutchison explained that he wants to install a radio tower on his property in excess of the thirty-foot limitation imposed by the City. In a discussion with a City planner, he learned that he would need a variance in order to construct such a radio tower. He also met with Mayor Booth and Assistant Planning Director Lynn Rued recently and was again advised that he would need to pursue a variance for the antenna tower. Mr. Hutchison Page 9 City of Auburn Council Meetin,~ Minutes October 16, 2000 questioned the need for a variance. He contends that the City's zoning ordinance may not be in compliance with state law. Assistant City Attorney Ausman advised that materials from Mr. Hutchison have been received in the City Attorney's office for review. She also cautioned that Mr. Hutchison's request may come before the Council in the future in a quasi-judicial forum. Mr. Hutchison quoted from Federal Communications Commission rule 97.15, which pertains to amateur radio operators. He also referred to a document known as PRB 1, a limited preemption of local zoning laws with regard to radio amateurs, and questioned whether a variance for his radio antenna is required under the preemption law. Assistant City Attorney Ausman advised that the City cannot respond to Mr. Hutchison's questions until a review of the law is completed. She anticipates completing the review next week. D. Correspondence No correspondence was received for City Council review. III. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chair Singer reported the Municipal Services Committee met this evening at 6:00. The Committee reviewed Resolution No. 3271, authorizing an Agreement with The Auburn Reporter for the printing and distribution of the City's newsletter. The Committee also discussed fire and police issues and recycling and solid waste services. The next regular meeting of the Municipal Services Committee is scheduled for November 6, 2000 at 6:00 PM. B, Planning & Community Development Chair Borden reported the Planning and Community Development Committee met on October 12, 2000. The Committee discussed the proposed Comprehensive Plan amendments. The next regular meeting of the Planning and Community Development Committee is scheduled for October 23, 2000 at 6:30 PM. Page 10 City of Auburn Council Meeting Minutes October 16, 2000 C. Public Works Chair Wagner reported the Public Works Committee met October 9, 2000. The Committee reviewed and recommended approval of contract administration items that appear on this evening's agenda. The Committee discussed the City's insurance carriers (Washington Cities Insurance Authority) recommendation to not post steep streets for no skateboarding. The Committee also discussed the 277th Street Project budget and financing for the Sound Transit garage. Chair Wagner reported the Committee also met on October 11, 2000 in a special meeting with the IA2 partners (Water District 111 and Covington Water District) regarding water rights. The next regular meeting of the Public Works Committee is scheduled for October 23, 2000 at 4:30 PM. D. Finance Chair Barber reported the Finance Committee met this evening at 6:30 PM. The Committee reviewed and recommended approval of claims and payroll vouchers. The Committee recommended to change the budget workshop scheduled for October 27, 2000 to November 9, 2000 beginning at 1:00 PM. The Committee also discussed Ordinance No. 5443, Resolution No. 3272, and the proposed 2001 Budget. The next regular meeting of the Finance Committee is scheduled for November 6, 2000 at 6:30 PM. IV. MOTION CARRIED UNANIMOUSLY. 7-0. V. UNFINISHED BUSINESS There is no item under this section for City Council consideration. VI. NEW BUSINESS A. Airport Hangar Land Lease Agreement 04.4.9.1.3, A3.17 City Council to consider Airport Hangar Land Lease Agreements for the construction of private hangars at Auburn Municipal Airport. Planning Director Krauss explained that staff have been in the process of developing a lease for the construction of private hangars at the Auburn Municipal Airport. He reported that the City Attorney has reviewed the lease. Mr. Krauss noted the following corrections to the lease agreement contained in the Council agenda packet: Section .3. Purpose: Add a sentence at the end of the paragraph to read: "Hangar construction plans must be approved by the City and shall be similar in design and quality to those constructed by the City in the year 2000. Section 6. Procedure to Determine Adjusted Rent - Annual, paragaph b, to have the bulleted line read: "(Percentage increase in Price Index) x (Rent being adjusted) + (Current Rent) = (Adjusted Rent) Section 7. Procedure to Determine Adjusted Rent - Fair Market Value, first paragraph, fifth line, change "12 months" to "24 months". Section 8. Security for Rent, to read: "To secure the rent . hereunder, Lessee agrees to furnish to Lessor an amount equal to two month's rent to be retained for the duration of the lease. Councilmember Singer moved and Councilmember Borden seconded to enter into lease agreements for the construction of Page 13 City of Auburn Council Meetina Minutes October 16, 2000 private hangars at Auburn Municipal Airport with the corrections noted. Councilmember Singer pointed out that under Section 4, the last sentence seems to contradict the first sentence. Mr. Krauss stated that obligation to pay rent starts with the issuance of the building permit. A clarification paragraph was added, which is the last paragraph of Section 4, which repeats that rent payments begin with the issuance of a building permit. The provision also requires that the building permit must be applied for within ninety days from the execution of the lease; if not, rents are then payable on the ninety-first day. The last sentence was added to give the lessee more time if the permit was applied for within the ninety days. Councilmember Poe suggested deleting the last sentence of Section 4. Councilmember Singer concurred. Councilmember Poe expressed concern with the provisions of Section 7, Procedure to Determine Adjusted Rent - Fair Market Value. He objected to the appraisal process contained in the lease, which utilizes an arbitrator if negotiations between the City and the lessee are not successful. He also pointed out that the recent appraisal of the property does not reflect the value of the proposed lease property. The appraisal is on the gross area while the City is proposing the lease of a portion of the appraised area. He suggested further changes to the lease agreement before approval. Councilmember Singer expressed a desire to return the agreement to the Municipal Services Committee for further review and recommend hiring specialized outside counsel to review the lease agreement. Councilmember Borden indicated her readiness to vote on the motion. Councilmember Wagner concurred with Councilmember Borden and spoke in favor of the lease agreement as corrected by Director Krauss and Committee Chair Singer. Councilmember Poe noted that Section 6 contains the formula for the rent increases based on the Consumer Price Index, but does not a maximum increase amount. Page 14 City of Auburn Council Meetinn Minutes October 16, 2000 Councilmember Lewis indicated he would not vote for a lease agreement which contains a rent arbitration provision for the Lessee. Planning Director Krauss advised that the City has similar provisions in the three existing leases at the airport. To date, a Lessee has not exercised the arbitration provision. MOTION CARRIED. 4-3 Councilmembers Lewis, Poe, and Singer voted no. B. Cobble Creek Annexation 03.1, ANX00-0004 City Council to consider the annexation petition for the Cobble Creek annexation area and call for a public hearing for November 6, 2000 to consider the annexation and the proposed annexation area's zoning. Planning Director Krauss presented a brief staff report. The annexation consists of ninety-one acres with a population of approximately 250. The City is already responsible for providing utility services to the area. Fire service would be provided through a contract with the fire district. The City would provide police service. Staff recommends the Council accept the petition and call for a public hearing on the annexation and the zoning. Motion by Councilmember Borden, second by Councilmember Singer to accept the annexation petition for the Cobble Creek annexation area and call for a public hearing to be held November 6, 2000 to consider the annexation and the proposed annexation area's zoning. Ordinance No. 5439 O3.10.1 CuPoo-oo04 An Ordinance of the City of Auburn, King County, Washington, providing for a conditional use permit to construct a parking area and play area for the Samoan Assembly of God Church on property zoned C-1 (Light Commercial) located at 16 "G" and 28 "G" Street SW, within the city of Auburn, Washington. Councilmember Borden moved and Councilmember Singer seconded to introduce and adopt Ordinance No. 5349. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Ordinance No. 5440 03.6 PUD0001-99 An Ordinance of the City of Auburn, King County, Washington, providing for a Planned Unit Development (PUD) to construct 84 single family homes on property zoned R-4 (Multi-family) located west of Lakeland Hills at 47th Street SE, within the city of Auburn, Washington. Councilmember Borden and Councilmember Singer seconded to introduce and adopt Ordinance No. 5440. MOTION CARRIED UNANIMOUSLY. 7-0. 3. Ordinance No. 5441 03.8 REZ 19-88 An Ordinance of the City Council of the City of Auburn, Washington, to amend Ordinance No. 4300 entitled "An Ordinance of the City of Auburn, Washington, providing for the rezoning of property located southeasterly of Oravetz Road and westerly of Mill Pond Drive, within the city of Auburn, Washington, changing the zoning classification thereof from R-2 (Single Family) and Unclassified to R-4 (Multi-Family), adopted September 6, 1988, to provide Page 16 City of Auburn Council Meetinn Minutes October 16, 2000 clarification regarding the requirements contained in Condition 1 and Condition 2 of the rezone approval. Assistant City Attorney Ausman read the title of Ordinance No. 5441 and noted a correction in Exhibit A of the Ordinance. In the paragraph identified as "Condition No. 1 ", the second to last line, the words "retaining way" should read "retaining wall". Councilmember Borden moved and Councilmember Singer seconded to introduce and adopt Ordinance No. 5441 as corrected. Councilmember Wagner questioned the need to change Condition No. 1. Assistant Planning Director Rued explained that the amendment is necessary to provide clarification. Councilmember Wagner moved to delete the last sentence in Condition No. 1 contained in Exhibit A. Councilmember Lewis seconded. Councilmember Wagner explained that he believes the proposed amendment to Condition No. 1 opens the door for the developer to request substandard development in order to develop the site, and it leaves a lot of judgment to the City Engineer as to what may be reasonable for the site. Assistant Planning Director Rued advised that the attorney representing Homes by Judi initiated the amendment to Condition No. 1. The purpose of the amendment is to allow the City Engineer to consider the building, utility, retaining wall, and street construction, in addition to the required geotechnical report, for the area to allow reasonable development of the site. Page 17 City of Auburn Council Meeting3 Minutes October 16, 2000 Assistant City Attorney Ausman noted for the record that the amendment to Condition No. 1 necessitates a change in the ordinance to reflect that the clarification is for requirements contained in Condition No. 2 and Condition No. 1 now is unchanged. (For clarification of these minutes, the preceding comments made by Assistant City Attomey Ausman were made immediately following Item VII. B.5 of these minutes.) 4. Resolution No. 3269 O4.11 A Resolution of the City Council of the City of Auburn, Washington, pursuant to the South King County Regional Water Association's revised bylaws, nominating the City Engineer as Director, the Public Works Director as First Alternate, and the Water Utility Engineer as Second Alternate to represent Auburn's concerns and issues at the regular monthly and annual meetings of the South King County Regional Water Association. Resolution No. 3272 A3.11.2.3 A Resolution of the City Council of the City of Auburn, King County, Washington, authorizing the Mayor and City Clerk to execute a Service Agreement between the City of Auburn and Human Resources Services Inc. - Northwest to process the City of Auburn's unemployment services claims. Councilmember Barber moved and Councilmember Lewis seconded to adopt Resolution No. 3272. Employment Manager John Fletcher reported that the City. currently contracts with a third party to service the City's unemployment claims. The City has contracted with the same vendor for the past several years. Resolution No. 3272 provides for an agreement with a new vendor to process unemployment claims with a savings of approximately $3,900 per year. The City has approximately thirty-five unemployment claims annually. MOTION CARRIED. 5-2. Councilmembers Poe and Singer voted no. VIII. MAYOR'S REPORT A.
