COUNCIL MEETING MINUTES
January 16, 2001 7:30 PM
I. CALL TO ORDER
A. Flag Salute
Mayor Charles A. Booth called the meeting to order at 7:30 PM and
led those in attendance in the Pledge of Allegiance.
B. Roll Call
Mayor Booth and the following Councilmembers were present:
Rich Wagner, Jeanne Barber, Trish Borden, Fred Poe, Sue Singer,
Pete Lewis and Stacey Brothers.
Staff members present included: City Attorney Michael J.
Reynolds, Planning and Community Development Director Paul
Krauss, Public Works Director Christine Engler, Finance: Director
Diane L. Supler, Police Chief Jim Kelly, Fire Chief Bob Johnson,
Personnel Director Brenda Heineman, Parks and Recreation
Director Dick Deal, and City Clerk Danielle Daskam.
C. Announcements and Appointments
1. Announcements
a) Hometown Hero Award
Mayor Booth presented Auburn's Hometown Hero
Award to Koji Norikane in recognition of his numerous
contributions to the community, including service on
the King County Farmland Preservation Program
Committee and the City of Auburn Parks Board. Mr.
Norikane was accompanied by his wife, Mary, their
three children and several grandchildren.

There was no appointment for City Council consideration.
D. Agenda Modifications
Ordinance No. 5502 was added as an agenda modific;ation and
transmitted under Item VII.A.5 of these minutes.
II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE
A. Public Hearings
No public hearing was scheduled for this evening.
B. AudienCe Participation
This is the place on the agenda where the public is invitecl to speak
to the City Council on any issue.
Brian Love, 38 East Main Street, Auburn, WA
Mr. Love identified himself as owner of Tory's Restaurant located at
38 East Main Street in Auburn. Mr. Love spoke in favor of
implementing a citizens review panel that other cities have to
oversee the operation of the city's justice department. He recalled
an incident that occurred at his restaurant on January 13, 2001. He
reported that an Auburn Police Department bicycle officer entered
the restaurant and inquired regarding one of the restaurant's
patrons. The officer made derogatory comments rega~rding the
patron and the business. Mr. Love objected to the officer's actions
describing them as harassment and discrimination. Mr. Love
advised he has forwarded a complaint to the U. S. Department of
Justice as a Title 2, Americans with Disabilities Act violation. Chief
Kelly advised that he was made aware of Mr. Love's complaint.
The incident was investigated and the appropriate action was
taken. Chief Kelly offered to discuss the matter further with Mr.
Love.
C. Correspondence

III. COUNCIL COMMITTEE REPORTS
A3.7.6
A. Municipal Services
Chair Poe reported the Municipal Services Committee met this
evening at 5:00. The Committee reviewed and recommended
approval for the re-advertisement of Project No. C0005 for the
Solids Handling and Decant Facility and Ordinance No. 5500
regarding Airport tie down and rental fees. The Committee also
discussed the solid waste consultant contract. The Committee
recommends that the City accept Waste Management's proposal to
extend their contract from July 1, 2001 to December 31, 2001.
Police Chief Kelly also reported on police staffing and level of
service. The next regular meeting of the Municipal Services
Committee is scheduled for February 5, 2001 at 5:00 PM.
B. Planning & Community Development
Chair Borden reported the Planning and Community Development
Committee met January 8, 2001. The Committee discussed
Ordinance No. 5498, which approves a grant from the ~rWCA for
Afterschool programs. The Committee recommended approval of
Resolution No. 3313 approving an Agreement between Auburn and
Sumner regarding potential annexation areas, and approved the
bid award for Project No. C9062, Brannan Park Sport Field
Relighting. The Committee also discussed legal services relating
to code enforcement issues, the state wetland banking program,
and the proposed YMCA community center. Additionally, the
Committee received a presentation from the Green River
Communify College Small Business Assistance Center. The next
regular meeting of the Planning and Community Development
Committee is scheduled for January 22, 2001 at 6:30 PM.
C. Public Works
Chair Wagner reported the Public Works Committee met January
8, 2001. The Committee discussed several contract administration
items that appear on this evening's agenda. The (::;ommittee
discussed several water depadment issues and began ranking
capital projects for the storm drainage utility. The next regular
meeting of the Public Works Committee is scheduled for January
22, 2001 at 4:30 PM.

D. Finance
Chair Barber reported the Finance Committee met this evening at
6:00. The Committee reviewed claims vouchers and discussed
automatic meter reading, the 2001 Budget, the energy tax, and
computer furniture. The next regular meeting of the, Finance
Committee is scheduled for February 5, 2001 at 6:30 PM.

An Ordinance of the City Council of the City of Auburn,
Washington, approving a contract with School's Out
Consortium/YWCA of Seattle-King County-Snohomish
County to accept Twenty-two Thousand, Five Hundred and
seventy-two dollars ($22,572.00) in grant funds to cover
operation and training costs to continue and expand the
Afterschool Program at Mt. Baker Middle School.
Councilmember Borden moved and Councilmember Singer
seconded to introduce and adopt Ordinance No. 5498.

An Ordinance of the City Council of the City of Auburn,
Washington, approving Burlington Northern Santa Fe
Railway funds as provided in the Construction and
Maintenance Agreement between the City and the
Burlington Northern Santa Fe Railway for PR 562, South
277th Street Reconstruction Project and approving an
amendment revising Article III of said Agreement.
Councilmember Wagner moved and Councilmernber Poe
seconded to introduce and adopt Ordinance No. 5499.

3. Ordinance No. 5500

An Ordinance of the City Council of the City of Auburn,
Washington, amending Auburn City Code Section 12.56.045
entitled "Airport Tie Down, Hangar and Storage Re~ntal Fees"
contained in Auburn City Code Chapter 12.56 entitled
"Airport" authorizing a surcharge in addition to the tie down,
hangar and storage rental fees at the Auburn Municipal
Airport for the purpose of providing increased security.
Councilmember Poe moved and Councilmembe~r Wagner
seconded to introduce and adopt Ordinance No. 5500 with a
change in the surcharge fee amount from $4.00 to :$3.00.
MOTION CARRIED UNANIMOUSLY. 7-0.
4. Ordinance No. 5501

An Ordinance of the City Council of the City of Auburn, King
County, Washington, amending Ordinance No. 5487 entitled
"An Ordinance of the City Council of the City of Auburn
annexing to the city a 40 acre parcel of land known as the
"P-4" park property for municipal purposes", adopted
December 18, 2000 to provide the correct legal description.
Councilmember Borden moved and Councilmember Singer
seconded to introduce and adopt Ordinance No. 5501.
MOTION CARRIED UNANIMOUSLY. 7-0.
5. Ordinance No. 5502
A3.13.4, O4.9.1 PR 562
An Ordinance of the City Council of the City of Auburn,
Washington, amending Ordinance 5449, which authorized
the acquisition of certain property and/or property rights,
acquisition of any necessary easements and/or ,easement
rights and/or temporary construction easements by eminent
domain, provided for the payment thereof; authorized the
City Attorney to prepare a petition for condemnation in the

Superior Court in and for the County of King and for the
prosecution thereof for the acquisition of such property and
property rights of property located at 27605 78th Avenue
South, Kent, WA 98032, Tax Parcel Number 000680-0004

seconded to introduce and adopt Ordinance No. 5502.

B. Resolutions

A Resolution of the City Council of the City olt: Auburn,
Washington, authorizing an amendment to the Agreement
approved by Resolution 2762 which Agreement is entitled
"An Agreement between the cities of Sumner and Auburn
relating to Potential Annexation Area designation" amending
the Agreement to provide that the City of Auburn will accept
ownership and maintenance of the ramps for the Lake
Tapps Parkway at the East Valley Highway and c,f a storm
drainage facility.
Councilmember Borden moved and Councilmember Singer
seconded to adopt Resolution No. 3313.
MOTION CARRIED UNANIMOUSLY. 7-0.
2. Resolution No. 3314

A Resolution of the City Council of the City or' Auburn,
Washington, fixing a time for a public hearing on the petition
for vacation of a portion of the north side of 1 st E;treet SW
between "C' and "D" Streets SW, within the city of Auburn,
Washington.
Councilmember Wagner moved and Councilmember Poe
seconded to adopt Resolution No. 3314.

VIII. MAYOR'S REPORT
A. Storm Drainage Utility Rates
Mayor Booth reported that staff is reviewing the most recently
adopted storm drainage utility .rates. Further information will be
presented at a later date.
B. Executive Session
No executive session was held this evening.
IX. ADJOURNMENT
There being no further business to come before the Council this ~;vening,
the meeting adjourned at 8:50 PM.
