Flag Salute Mayor Charles Booth called the meeting to order at 7:30 PM and led those in attendance in the Pledge of Allegiance. B. Roll Call Mayor Booth and the following Councilmembers were present: Rich Wagner, Jeanne Barber, Trish Borden, Fred Poe, Sue Singer, Pete Lewis and Stacey Brothers. Staff members present included: Parks and Recreation Director Dick Deal, Fire Chief Bob Johnson, Police Chief Jim Kelly, Personnel Director Brenda Heineman, Public Works Director Christine Engler, Finance Director Diane L. Supler, Planning Director Paul Krauss, Principal Planner David Osaki, Associate Planner B Sanders, City Attorney Michael J. Reynolds, and City Clerk Danielle Daskam. C. Announcements and Appointments 1. Announcements a) Service Recognition for Auburn Library Board Member Kim Harlington Mayor Booth presented Kim Harlington with a plaque commemorating her service on the Auburn Library Board from 1995 to 2000. b) Annual Report from the Auburn Library Board Ms. Nancy Colson, Chair of the Auburn Library Board, presented the annual library report for the year 2000. Page City of Auburn Council Meeting Minutes February 5,2001 Ms. Colson was accompanied by Library Manager Fran Wendtland, Board Member Phillip Jenkins, and past Board member Kim Harlington. Ms. Colson reported on the completion of the new Auburn Library and the transition to the King County Library System. Ms. Wendtland provided the Council with a written report of 2000 library statistics for circulation, meeting room use, computer classes, and other library programs. Ms. Colson thanked the City for their support, and thanked Library Board members, Library staff, and others for their efforts during the past year. c) Boy Scout Troop 341 Immediately following Item IV.D.4 of these minutes, Mayor Booth welcomed Scout Leader Bud Little from Scout Troop 341. Mr. Little was accompanied by Scouts Preston, Tyler and Spencer, who are working towards their Citizenship in the Community Merit Badge. 2. Appointments a) Cemetery Board City Council to consider the appointment of Margaret Wilson to a five-year term to expire December 31, 2005. Councilmember Wagner moved and Councilmember Singer seconded to confirm the appointment of Margaret Wilson to the Cemetery Board. MOTION CARRIED UNANIMOUSLY. 7-0. D. Agenda Modifications Agenda modifications included the transmittal of the text of Ordinance Nos. 5508 and 5510 under Item VII.A.7 and VII.A.8 of these minutes. II. Audience Participation This is the place on the agenda where the public is invited to speak to the City Council on any issue. Alan Keimig, 16 A Street NW, Auburn, WA Mr. Keimig spoke regarding Ordinance No. 5510, which would increase the building heights in the C-2 Central Business District. He urged the Council to adopt Ordinance No. 5510. Mike Weekley, 809 11t~ Street NE, Auburn, WA Mr. Weekley described the condition of the neighborhood on 12th Street NE, which includes several dilapidated houses and a burned house. He proposed that the City and the neighbors pursue an effort to cleanup the neighborhood and initiate some sort of redevelopment for the area. Frances Moses, 1025 I Street NE, Auburn, WA Ms. Moses agreed with Mr. Weekley's comments regarding the 12th Street NE neighborhood. She also expressed frustration with a recent call to 911 and the Valley Comm dispatch center. Bill Kyle, 2001 19t" Drive NE, Auburn, WA Mr. Kyle spoke regarding Ordinance No. 5492 which appears on this evening's agenda. Mr. Kyle expressed support for adoption of the ordinance, which prohibits parking of oversized vehicles in residential districts. Councilmember Poe reported that the Municipal Services Committee discussed Ordinance Nos. 5492 and 5493 earlier this evening. The ordinances will be removed from this evening's Council agenda pending further revisions. Councilmember Poe stated that he anticipates the ordinances will be presented to the Council on February 20, 2001 for adoption. Richard Palin, 32922 33rd Avenue SW, Federal Way, WA Mr. Palin advised that he owns two houses on 12th Street NE. He requested the City's support to improve the neighborhood surrounding 12th Street NE. C. Correspondence No correspondence was received for City Council review. Page 3 City of Auburn Council Meeting3 Minutes February 5,2001 III. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chair Poe reported the Municipal Services Committee met this evening at 5:00. The Committee recommended Council adopt Resolution No. 3320 and recommended further review of Ordinance Nos. 5492 and 5493 before forwarding them to the City Council. The Committee discused a contract extension through the end of the year with RST Disposal. The Committee recommended that the solid waste utility absorb the increased solid waste cost to customers for this year. The Committee also discussed proposed contract and bid specifications for a new solid waste contract. Chair Poe suggested a Council workshop on the solid waste contract and bid proposal would be beneficial. The next regular meeting of the Municipal Services Committee is scheduled for February 20, 2001 at 5:00 PM. B. Planning & Community Development Chair Borden reported the Planning and Community Development Committee met January 22, 2001. The Committee discussed and recommended Council approval of water and sewer availability certificates for Ronald and Susan Severson, interim zoning amendments, annexation of Green River access property, and surplus property. The Committee also discussed park impact fees and the status of the J C Penney building on East Main Street. The next regular meeting of the Planning and Community Development Committee is scheduled for February 12, 2001 at 6:30 PM. C. Public Works Chair Wagner reported the Public Works Committee met on January 22, 2001. The Committee recommended approval of several contract administration items which appear on this evening's agenda. The Committee also discussed transportation impact fees and storm drainage capital projects. The next regular meeting of the Public Works Committee is scheduled for January 12, 2001 at 4:30 PM. The Committee discussed and recommended approval of claims and payroll vouchers, surplus property, Ordinance No. 5503, and Ordinance No. 5504. The Committee also discussed hotel/motel taxes, the Capital Facilities Plan, and 2001 Budget amendments. The next regular meeting of the Finance Committee is scheduled for Tuesday, February 20, 2001 at 6:00 PM. IV. CONSENT AGENDA A. Minutes 1. MOTION CARRIED UNANIMOUSLY. 7-0. V. UNFINISHED BUSINESS There was no item under this section for Council consideration. VI. NEW BUSINESS A. Application No. CUP00-0006 03.10.1 cuPoo-oo06 City Council to consider the request of Auburn Business Park for a conditional use permit to allow the sale of used automobiles within a building located at 3530 "C" Street NE. Planning Director Krauss explained that the applicant has requested a conditional use permit to allow used car sales within a building. Since the car sales operation will be conducted within a building, staff recommended approval of the conditional use permit. Page 8 City of Auburn Council Meetinn Minutes Febmaw 5,2001 Councilmember Borden moved and Councilmember Singer seconded to approve the conditional use permit based upon the Hearing Examiner's Findings of Fact, Conclusion and Conditions; and instruct the City Attorney to prepare the necessary ordinance. Councilmember Poe recommended that the Hearing Examiner's Conditions should be more explicit. For example, Condition 1 should read, "All vehicles for sale shall be within the building at all times." He also recommended that Condition 2 should describe the required drainage system in more detail. Councilmember Borden restated her motion to clarify Condition 1 by adding the words "at all times" and clarify Condition 2 to better define the drainage system. Councilmember Singer concurred. MOTION CARRIED UNANIMOUSLY. 7-0. B. Application Number WSC00-0007 A3.13.8 City Council to consider the request of Ronald and Susan Severson for a Development Agreement for the issuance of water and sewer availability certificate for property located at 30617 122nd Place SE and to approve the Petition for Annexation, Annexation Agreement and Declaration of Covenant. Councilmember Borden moved and Councilmember Singer seconded to approve the Development Agreement which 'will enable the issuance of water and sewer availability certificates to the applicant. In response to questions from Councilmember Wagner, Principal Planner David Osaki explained that the applicant would be required to improve the 30-foot easement if King County through its platting process requires a second access for the plat. If King County does not require a second access to 304th Street, then the developer will not be required to improvement the easement. Councilmember Wagner questioned whether a cul-de-sac should be constructed at the end of the street rather than a "T". Mr. Osaki explained that if a second access is not constructed, the conditions require that the developer "T" the intersection and install a barricade that will prevent vehicles from entering the private Page 9 City of Auburn Council Meetinfi Minutes February 5,2001 easement. The barricade would allow emergency vehicle access if necessary. The intent is to accommodate future street system in the area as properties east and west develop. Fire Chief Johnson explained that generally "T" intersections are not favored by the fire service because a "T" intersection requires backing up a fire apparatus while a cul-de-sac allows a sweeping radius turn. Principal Planner Osaki explained that the barrier would be a knock-down type barricade to allow emergency vehicle access. Councilmember Wagner recommended the construction of a cul- de-sac rather than a "T" intersection. Terry Ferguson, owner's representative from Baseline Engineering, Inc., 1910 64th Avenue West, Tacoma, WA Mr. Ferguson explained that a cul-de-sac was originally provided, but a "T" intersection was included to accommodate future street construction. In response to a question from Councilmember Brothers, Fire Chief Johnson recommended that the condition requiring a barricade include language that the knockdown barricade shall be a type acceptable to the Fire Marshal. Councilmember Borden restated her motion to include the recommendation of the Fire Chief that the knockdown barrier will be acceptable to the Fire Marshal. Councilmember Singer concurred. MOTION CARRIED UNANIMOUSLY, 7-0. VII. ORDINANCES AND RESOLUTIONS A. Ordinances 1. Ordinance No. 5492 O1.8 An Ordinance of the City Council of the City of Auburn, Washington, repealing Auburn City Code Section 10.36.190 entitled "Parking in Residential Districts - Maximum Vehicle Size," Auburn City Code Section 10.36.275 entitled "Prohibited Parking of Semitrailers and Trailers," Auburn City Page10 City of Auburn Council Meetinn Minutes February 5,2001 Code Section 10.36.276 entitled "Authority to Impound," Auburn City Code Section 10.36.277 entitled "Violation- Penalty," and adopting a new City Code Section 10.36.190 entitled "Parking of Semitrailers, Truck Tractors, Trailers, Boats, Camping Trailers and Motorhomes on a Public Roadway or Public Right of Way, including all residential districts within the city of Auburn." Ordinance No. 5492 is under review by the Municipal Services Committee and was withdrawn from the Council agenda. 2. Ordinance No. 5493 O1.8 An Ordinance of the City Council of the City of Auburn, Washington, amending Auburn City Code Section 10.36.360 entitled "Violation - Penalty" by adding Auburn City Code Section 10.36.190 for which a penalty under Section 10.36.360 can be applied. Ordinance No. 5493 is under review by the Municipal Services Committee and was withdrawn from the Council agenda. 3. Ordinance No. 5503 A4.3.1 An Ordinance of the City Council of the City of Auburn, Washington, amending Auburn City Code Section 2.51.020 entitled "Councilmember's Compensation" contained in Chapter 2:51 entitled "Compensation of Officers" to reflect current pay dates for services performed. Councilmember Barber moved and Councilmember Lewis seconded to introduce and adopt Ordinance No. 5503. Councilmember Singer asked for clarification regarding the health insurance benefits provision contained in Section 2.51.010. She explained that it was her understanding that health insurance benefits would be provided but the full cost would be born by the subscribing Councilmember. Page 11 City of Auburn Council Meetin.q Minutes February 5,2001 Personnel Director Heineman explained that currently there is no medical plan available to the Council. Section 2.51.010 of the ordinance provides that if a medical plan becomes available in the future, it would be offered to the Councilmembers under the same conditions offered to unaffiliated employees. In other words, the City and the Councilmembers would share in the cost. Councilmember Lewis recalled that the intent was to give the Councilmembers the ability to purchase group insurance coverage, but was not to be subsidized by the City. Councilmember Brothers recalled Committee discussion of health insurance for Councilmembers. He recollected that the cost of insurance for a Councilmember would be approximately $250; the City would pay approximately $200 and the remaining amount would be paid by the Councilmember. Councilmember Barber disagreed with' Councilmember Brothers' recollection. Councilmember Lewis reiterated that it was never his intent to look for a paid or partially paid health insurance program by the City. Councilmember Wagner moved and Councilmember Poe seconded to amend Section 2.51.020(A) by adding a sentence that reads, "Councilmembers shall pay the full cost of such insurance." MOTION CARRIED. 6-1. Councilmember Brothers voted no. Councilmember Borden stated that policies regarding health benefits for the Council should be consistent with policies for staff. She expressed concern that a Councilmember who could not afford health insurance would be denied such a benefit. Councilmember Singer stated it was her intent that Councilmembers would have the ability to purchase group Page 12 City of Auburn Council Meetinn Minutes February 5,2001 health insurance through the City at the Councilmember's expense. She spoke against the existing ordinance which amounts to an increase in benefits for the Council at the taxpayers' expense. Councilmember Brothers stated that health insurance should not be provided as a Council benefit. He spoke against a publicly paid benefit for the Council. Councilmember Poe expressed support for the amendment to Ordinance No. 5503. THE MAIN MOTION, AS AMENDED, CARRIED UNANIMOUSLY. 7-0. 4. Ordinance No. 5504 04.8.3, F4.3 An Ordinance of the City Council of the City of Auburn, Washington, amending Auburn City Code Chapter 13.48 entitled "Storm Drainage Utility", Section 100, entitled "Charges" to clarify that charges to non-single family parcels are assessed on a monthly basis. Councilmember Wagner moved and Councilmember Lewis seconded to introduce and adopt Ordinance No. 5504. MOTION CARRIED UNANIMOUSLY. 7-0. 5. Ordinance No. 5505 O3.1 ANX01-0001 An Ordinance of the City Council of the City of Auburn, King County, Washington, annexing to the City 4.54 acres of land known as the "Green River Access" for municipal purposes. Councilmember Borden moved and Councilmember Singer seconded to introduce and adopt Ordinance No. 5505. MOTION CARRIED UNANIMOUSLY. 7-0. Ordinance No. 5507 F5.2.15, O4.9.1 PR 562 An Ordinance of the City Council of the City of Auburn, Washington, amending Ordinance No. 5119 by authorizing the Mayor to sign a Local Agency Agreement Supplement between the City and the Washington State Department of Transportation, approving Federal TEA-21 Funds to prepare and implement the South 277th Street Reconstruction project, PR 562. Councilmember Wagner moved and Councilmember Lewis seconded to introduce and adopt Ordinance No. 5507. MOTION CARRIED UNANIMOUSLY. 7-0. 7. Ordinance No. 5508 A3.13.8 An Ordinance of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn to execute a Development Agreement between the City and Ronald and Susan Severson. Councilmember Borden moved and Councilmember Singer seconded to adopt Ordinance No. 5508 with the amendment approved with the Development Agreement for Application Number WSC00-0007 stipulating that the barricade erected at the dead end street shall be a knockdown barrier approved by the Fire Marshal. MOTION CARRIED UNANIMOUSLY. 7-0. 8. Ordinance No. 5510 o3.4.2.1.2 An Ordinance of the City Council of the City of Auburn, King County, Washington, pursuant to RCW 36.70A.390, amending the Auburn City Code Chapter 18.28 by revising Section 18.28.040 entitled "Development Standards," and Section 18.28.060 entitled "Development Standards for Parking Garages" to allow increased building heights and provide development standards for buildings and parking garages located in the C-2 Central Business District which Page 14 City of Auburn Council Meetinn Minutes February 5,2001 has been established as interim zoning, and setting a date for a public hearing. Councilmember Borden moved and Councilmember Singer seconded to introduce and adopt Ordinance No. 5510. MOTION CARRIED UNANIMOUSLY. 7-0. B. Resolutions 1. Resolution No. 3309 A3.16.9, A3.13.4 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and the City Clerk to execute an Agreement for Professional Services between the City and Certified Land Services Corporation for the purpose of providing real property negotiation and relocation assignments during the 2001 year. Councilmember Wagner moved and Councilmember Lewis seconded to adopt Resolution No. 3309. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Resolution No. 3315 A3.16.9 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and the City Clerk to execute an Agreement for Professional Services between the City and Leroy A. Jones, for the purpose of providing coordinating research and information services through the year 2001. Councilmember Wagner moved and Councilmember Lewis seconded to adopt Resolution No. 3315. Resolution No. 3316 04.4.2 A Resolution of the City of Auburn, Washington, amending Resolution 3265, authorizing the Mayor and City Clerk of the City of Auburn, to execute an amendment to the Agreement with Bonnie Tours to act as travel agent for the City's Senior Center Program to change the dates of the Heritage of America Trip. Councilmember Borden moved and Councilmember Singer seconded to adopt Resolution No. 3316. MOTION CARRIED UNANIMOUSLY. 7-0. 4. Resolution No. 3320 04.7.2 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an Agreement for Professional Services for a Litter Control Program between the City of Auburn and Vadis. Councilmember Poe moved and Councilmember Wagner seconded to adopt Resolution No. 3320. MOTION CARRIED UNANIMOUSLY. 7-0. VIII. MAYOR'S REPORT A. Executive Session Mayor Booth recessed the meeting to executive session at 8:48 PM for approximately fifteen minutes in order to discuss personnel and litigation issues.
