COUNCIL MEETING MINUTES
October 15, 2001 7:30 PM
I. CALL TO ORDER
A. Flag Salute
Mayor Charles A. Booth called the meeting to order at 7:30 PM and
led those in attendance in the Pledge of Allegiance.
B. Roll Call
Mayor Booth and the following Councilmembers were present:
Jeanne Barber, Trish Borden, Fred Poe, Sue Singer, Pete Lewis,
Stacey Brothers, and Rich Wagner.
Staff members present included: Planning and Community
Development Director Paul Krauss, Associate Planner Bill
Mandeville, Human Resources Director Brenda Heineman, City
Attorney Michael J. Reynolds, Public Works Director Christine
Engler, Fire Chief Bob Johnson, Parks and Recreation Director
Dick Deal, Finance Director Shelley Coleman, Police Chief Jim
Kelly, Recreation Coordinator Sharon LaVigne, and Deputy City

C. Announcements and Appointments
1. Announcements
a) Hometown Hem Award
Mayor Booth presented Fred Helser with Auburn's
Hometown Hem Award. Mr. Helser was
accompanied by several family members including his
wife, daughters, sons-in-law, granddaughter, and
sister-in-law, as well as many friends and well-
wishers. Mayor Booth commended Mr. Helser for his

many contributions to the City of Auburn and
surrounding communities.
b) AmeriCorps Team
Assistant Planner Bill Mandeville explained that the
AmeriCorps Team members began their year of
service on September 17, 2000 and have served at
their assigned sites since October 2, 2000. This
September, the members completed over sixty hours
of training which included first aid and CPR, a reading
tutor course, human diversity courses, public and
school safety courses, and courses in team building,
leadership assessment, service project organization,
and facilitating small groups.

Agenda modifications included the corrected text of Ordinance No.
5587 transmitted under Item VII.A. 1 of these minutes and the
addition of Ordinance No. 5594 transmitted under Item VII.A.3 of
these minutes.
II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE
A. Public Hearings
1. Local Law Enforcement Block Grant
F5.4.1
The City of Auburn's application for funding under the
Department of Justice Local Law Enforcement Block Grant
Program has been approved in the amount of $51,434 for
the purpose of reducing crime and improving public safety.
The City of Auburn proposes to utilize the grant to pay
overtime costs for police officers engaged in community
policing activities. Special conditions of the grant award
require the City to encourage participation regarding the
proposed use of the payment under the Local Law
Enforcement Block Grant.
Mayor Booth opened the public hearing.
No one in the audience requested to speak.
Councilmember Poe moved and Councilmember Wagner
seconded to close the public hearing.
MOTION CARRIED UNANIMOUSLY, 7-0,
B. Audience Participation
This is the place on the agenda where the public is invited to speak
to the City Council on any issue.
James Monteith, 1105 18t" St SE, Auburn
Mr. Monteith presented a petition to Councilmembers comprised of
signatures of residents residing in the neighborhood located in the

area of 1820 "L" Street SE. Mr. Monteith referred to incidents in
the neighborhood involving a shooting that occurred on October 2,
2001 and a lock-down of the neighborhood due to police and
SWAT Team activities which occurred on October 4, 2001.
Mr. Monteith stated that the petition included sixty-six signatures
representing forty-one of the forty-five residences within the
neighborhood. Mr. Monteith alleged that drug and criminal
activities have been occurring at the residence located at 1820 "L"
Street SE for some time. There have also been problems with
regard to abandoned vehicles. Mr. Monteith requested action by
the City to eliminate crimes occurring at the residence. Mr.
Monteith pointed out that the neighborhood is in close proximity to
Olympic Middle School, which is a drug free zone.
Darin Westover, 1840 "L" Street SE, Auburn
Mr. Westover stated that his family has been traumatized by the
shooting incident that occurred. at the residence located at 1820 "L"
Street SE. Mr. Westover criticized the actions of the City of Auburn
and the Auburn Police Department with regard to the incident. Mr.
Westover stated that he has witnessed drug use in front of the
residence, which he reported to 911.
Marvin Cory, 1805 "L" Street SE, Auburn
Mr. Cory stated that his residence is located directly across the
street from the residence located at 1820 "L" Street SE. Mr. Cory
stated that problems have existed at the referenced residence for a
number of years.
Rick Marshall, 1830 "L" Street SE, Auburn
Mr. Marshall stated that he lives next door to 1820 "L" Street SE.
Mr. Marshall stated that problems occurring at that residence over
the years include the accumulation of garbage and the theft of his
vehicle. Mr. Marshall thanked the Auburn Police Department for
their assistance over the years, but stated he felt that they were
over zealous with regard to the incident involving the thirteen year
old youth residing at the residence in question. Mr. Marshall
expressed his opinion that earlier intervention by the Auburn Police
Department, the City of Auburn, or Child Protection Services might
have prevented the shooting incident.

Debbie Combs, 1815 "L Street SE, Auburn
Ms. Combs stated that she owns the residence located across the
street from 1820 "L" Street SE. Ms. Combs stated that, several
months ago, she asked the City to intervene if King County
declined to press charges regarding a drug bust that occurred at
the residence in question. Ms. Combs stated that the thirteen year
old youth residing at that residence has not attended school for the
last three years. Ms. Combs pointed out that the neighborhood is
in very close proximity to two schools, Pioneer and Olympic. Ms.
Combs stated that there are many transients in the area and an
abundance of drug activity. Ms. Combs urged Council to use a
portion of the Local Law Enforcement Block Grant Program funds
on the eradication of drug houses.
Vicki Clinton, 14210 SE 23rd Street, Bellevue
Ms. Clinton stated that her parents live in the neighborhood of
1820 "L" Street SE. Ms. Clinton stated that the incident that
occurred at that residence is a disgrace. She feels that the City of
Auburn let down the two boys residing at that residence. Ms.
Clinton stated that the residence is well known for drug trafficking.
The majority of the residents in the neighborhood are senior
citizens and young families and they no longer feel safe within their
homes.
Alfred Marchado, 1815 "L" Street SE, Auburn
Mr. Marchado stated that he lives across the street from 1820 "L"
St SE. Mr. Marchado stated that he has been a resident since
1992, and the drug trafficking has been occurring at the residence
in question since that time. He feels the City of Auburn has let the
neighborhood down and expressed his disappointment in the City
and its officials.
Anthony Stull, 1015 18"~ Street SE, Auburn
Mr. Stull stated that he does not know the residents at 1820 "L"
Street SE. He expressed his displeasure with the City of Auburn
and the desire to see the situation rectified. Mr. Stull stated that
the incident has been very traumatic for his five year old daughter.

Bob Hoyt, 1802 "L" Street SE, Auburn
Mr. Hoyt stated that the situation at 1820 "L" Street SE has created
a hardship for all the residents in the neighborhood. Mr. Hoyt
stated that he is not disappointed in the City of Auburn and he feels
the Police Department has done all that they can. do. Mr. Hoyt
urged Council to assist the Police Department in rectifying the
situation.
City Attorney Michael Reynolds stated that information from Mayor
Booth and Police Chief Jim Kelly confirm that a problem exists at
1820 "L" Street SE. The Auburn Police Department has requested
assistance from the Legal Department with regard to the residence
in question.
Attorney Reynolds explained the following potential remedies to the
situation.
1) Abatement process.
The abatement process can be implemented in a situation
where specific activities are occurring at a residence. The end
result is that the structure is vacated for a period of one year.
The abatement terminates after that period. Some of the
negative aspects to the abatement process are that windows
are boarded up, creating an unsightly appearance, and the
structure is unoccupied. It becomes obvious that the structure
is not occupied and can become a transient facility. The
abatement process is not necessarily an adequate remedy
within a neighborhood.
2) Class "C" Felony.
A Class "C" felony includes the prosecution of an individual who
utilizes their home for narcotics trafficking. If successful, it
would result in the particular resident to be tried and sentenced
in King County Superior Court, which would probably result in
some form of incarceration. Release would probably occur after
a short duration of time. This remedy is totally controlled by
King County. The negative aspects are that this is not a long
term remedy and King County has a significant volume of cases
and could decline the case.

3) Eminent Domain or Condemnation Process.
The eminent domain or the condemnation processes are most
generally used for construction projects, which require the
taking of a citizen's property for things such as road widening.
This is a lengthy process and the city ultimately purchases the
property. There is a provision that allows a condemnation
process in the event a facility is being used for the type of
activities that are occurring at the property in question. The City
could go through the condemnation process, acquire the
property, and place covenants, conditions, and restrictions
(CCR's) on the property upon resell. Upon the sale of the
property, the purchaser would agree to remedy the conditions
addressed by the CCR's. This is may be the best remedy and
would be useful for other properties as well. The simplest
solution would be to set up an abatement condemnation fund
within the budgetary process and would be similar to the
process used for construction projects.
Attorney Reynolds recommended that Council adopt the
eminent domain or condemnation process. The City of Seattle
currently uses this method successfully.
Councilmember Lewis requested additional information from the
Police Department regarding other residences with similar
problems to the activities occurring at 1820 "L" Street SE.
In response to questions from Councilmember Poe, Attorney
Reynolds responded that the City must show cause for eminent
domain or condemnation through a hearing process.
Councilmember Wagner questioned the duration of the process
from implementation until such time as the City would take
possession of a property.
Attorney Reynolds explained that the time span would depend
upon the hearing process and the amount of resistance in the
factual findings. Current case filings at King County Superior
Court are receiving early 2003 trial dates. The condemnation
process usually receives an expedited hearing over other
cases, but the criminal case calendar is expedited as well.

In response to questions from Councilmembers Brothers and
Borden, Attorney Reynolds stated that matters regarding
children are referred to Child Protection Services (CPS) and
they act independently of other agencies.
Police Chief Kelly stated that the woman residing at 1820 "L" St
SE does not have custody of the children living at the
residence. Custody is held by the estranged father of the
children, who lives in Federal Way. The Auburn Police
Department and the City have been working with the
grandparents and the father with regard to the child custody
issues, but neither the City nor CPS are equipped to deal with
this type of issue.
Attorney Reynolds pointed out that the challenge on all
condemnation cases is the human element involved, such as
relocating the resident. Relocation may or may not be required,
depending on method used to abate the property. The City of
Auburn has always attempted to work with the homeowner,
even though the City might not be required to relocate the
resident under federal condemnation guidelines.
Councilmember Lewis recommended that Council determine an
amount needed during the current budgetary cycle to begin the
abatement process.
Councilmember Borden suggested that the issue be referred to
the Municipal Services Committee to discuss it in more detail to
try to achieve a long term solution. Councilmember Borden
requested additional information regarding the financial impacts
and the condemnation and abatement process.
In response to questions from Councilmember Barber, Attorney
Reynolds stated that the first step is to develop an ordinance
which would allow the eminent domain process to begin.
Councilmember Lewis urged those living in the neighborhood to
place 911 calls every time an incident occurs at the location in
question.
Police Chief Kelly advised the residents to continue to call and
report incidents that cause concern. Callers should be aware

that all 911 calls are prioritized, but an officer will respond to the
call. Police Chief Kelly reported that the Police Department has
forty documented police case reports, from 1996 to present, on
the residence located at 1820 "L" Street SE. That number is
disproportionately high compared to other neighborhoods.
Attorney Duncan Wilson, 1400 Talbot Rd S, #-400, Renton
Mr. Wilson explained that he is speaking on behalf of the
Michados. Mr. Wilson expressed his implicit trust in Attorney
Reynolds.
Mr. Wilson expressed the opinion that the abatement process
can force a property owner to make an economic decision to
sell the property rather than let the property sit vacant for twelve
months. Although it prevents the City from placing CCR's on
the property, in most cases, a new property owner resolves the
existing conditions.
Jennifer Stull, 1015 18th Street SE, Auburn
Ms. Stull described an incident regarding bicycles and inquired
what type of activities should be considered suspicious and
require reporting.
Police Chief Kelly stated that any incident that raises suspicion,
including non-emergencies, should be reported to 911.
Robed Zanoni, 1510 24th Street SE, Auburn
Mr. Zanoni stated that Council has the ability to adopt
ordinances and zoning regulations, which might provide a
means to create long-term solutions. Mr. Zanoni questioned if
the drug and seizure law could be enforced regarding the
property in question.
Police Chief Kelly stated that the asset seizure forfeiture law is
very complicated and the burden of proof is very difficult.
Attorney Reynolds concurred with statements made by Attorney
Wilson, but pointed out that the City of Auburn has experienced
abateme,nt situations where property owners do not necessarily
behave in an economically rational manner and have let the
property sit vacant.

In response to statements made by Mr. Zanoni, Attorney
Reynolds stated that actual tracing of the monetary amount
from the drug transaction to the acquisition of the property is
extremely difficult.
Debbie Combs, 1815 "L Street SE, Auburn
Ms. Combs expressed her concern regarding the close vicinity
of the residence in question to the nearby schools and pointed
out that most of the traffic in the neighborhood is children.
Councilmember Poe expressed his appreciation of the citizen
participation and input this evening. Councilmember Poe
assured the citizens that the Police Department is doing
everything allowed within the law and that the situation will be
discussed at the next Municipal Services Committee meeting.
Councilmember Poe requested detailed information from Police
Chief Kelly.
Councilmember Wagner requested additional information from
Attorney Reynolds regarding drug free zones around schools
and what the City can do regarding enforcement.
Councilmember Barber concurred with Councilmember Poe and
confirmed that Council is very concerned regarding the
situation.
Virginia Haugen, 2503 R Street SE, Auburn
Ms. Haugen thanked Attorney Reynolds for his input regarding
possible solutions to the situation at the residence in question.
Ms. Haugen questioned Council regarding the purchase of the
Rail Tavern.
Attorney Reynolds stated that there was some disagreement
regarding the acquisition of the Rail Tavern between the City of
Auburn and the Washington State Auditors office.
Attorney Reynolds explained that under the Open Meetings Act
the action was first taken by Council in a budgetary process
which allocated $500,000 for the purchase of downtown
properties. The action was taken in an open meeting and
passed in a budget ordinance. The wire transfer of funds to the

closing agent for the purchase of the property appeared on the
consent agenda in an open meeting. The actual acquisition
appeared on the accounts in the Finance Department as the
purchase of the Rail Tavern. Due to possible negotiations for
other properties, the ultimate transfer of the property occurred
by resolution in an open meeting approximately sixteen months
after the acquisition.
Mr. Reynolds stated that an executive session is allowed for the
purpose of acquiring real estate if the information would cause
price of the real estate to inflate, and therefor is an exemption
under Open Meetings Act.
Mr. Reynolds stressed that the City was not in a position of
unnecessary risk of loss with regard to the transfer of the Rail
Tavern property. When the property was transferred from the
seller of the Rail Tavern to the nominee, it was transferred in
the deed as nominee for a third party. The third party was
declared on the excise tax affidavit to King County as the City of
Auburn. The nominee did not have authority to convey the
property. The nominee collected all rents and deposited them
in a trust account and provided a monthly accounting of the
trust account to the Finance Department. The trust account
was backed up not only under the rules of the Washington State
Bar Association, but also by an insurance certificate from the
nominee showing the City of Auburn as an additional insured.
In response to questions from Councilmember Brothers,
Attorney Reynolds stated that the transaction saved taxpayers
approximately $50,000. The large number of Council actions
would make it virtually impossible to determine when an item
should be removed from the consent agenda due to public
interest. Mr. Reynolds urged citizens to fully read the Council
agendas. The City will respond to inquiries made regarding any
agenda item.
Virginia Haugen, 2503 "R" Street SE, Auburn
Ms. Haugen expressed concern regarding including a consent
agenda on the Council agenda. She pointed out that citizens
might not pay enough attention to the items contained in the
consent agenda.

Councilmember Borden pointed out that there are many Council
meetings at which there is no public audience or participation.
Councilmember Poe stated that the Rail Tavern purchase was
from budgeted funds and the City operated above board and
followed the requirements of the Open Meeting Act.
C. Correspondence
No correspondence was received for City Council review.
III. COUNCIL COMMITTEE REPORTS

a. Municipal Services
Chair Poe reported that the Municipal Services Committee met this
evening at 5:00 PM. The Committee discussed and recommends
approval of the finalization of the excavation and infrastructure
contract in connection with the new hangar project at the Auburn
Airport, and Ordinance No. 5594 regarding adopting Washington
state laws regarding methamphetamine drug sales limits. The
Committee also discussed Airport ground leases with regard to
repercussions due to the September 11, 2001 incident. The next
regular meeting of the Municipal Services Committee is scheduled
for November 5, 2001 at 5:00 PM.
In response to questions from Councilmember Brothers, Director
Krauss responded that the Airport is capable of handling turbo prop
airplanes, but the City does not sell jet fuel.
B. Planning & Community Development
Chair Borden reported that the Planning and Community
Development Committee met October 8, 2001. The Committee
discussed Urban Separators and grant options regarding updates
of Comprehensive Plans. The Committee also discussed
Comprehensive Plan amendments and Ordinance No. 5587,
development and lease of property at Scootie Brown Park. The
next regular meeting of the Planning and Community Development
Committee is scheduled for October 22, 2001.

C. Public Works
Chair Wagner reported that the Public Works Committee met
October 8, 2001. The Committee discussed a Right-of Way Use
Permit for the City of Auburn Parks Department Community
Halloween Festival and reviewed contract administration items.
The Committee also discussed and recommends approval of
ordinances and resolutions on this evening's agenda. The next
regular meeting of the Public Works Committee is scheduled for
October 22, 2001 at 4:30 PM.
D. Finance
Chair Barber reported that the Finance Committee met this evening
at 6:30 PM. The Committee approved consent agenda items and
received an update on the 2002 Budget. The next regular meeting
of the Finance Committee is scheduled for November 5, 2001 at
6:30 PM.

An Ordinance of the City Council of the City of Auburn,
Washington, authorizing the Mayor and City Clerk to execute
an Agreement for the development and lease of property at
Scootie Brown Park.
Councilmember Borden moved and Councilmember Singer
seconded to introduce and adopt Ordinance No. 5587.
In response to questions from Councilmembers 'Brothers
and Poe regarding the minimum insurance coverage limits,
Attorney Reynolds responded that the City took a more
conservative stance regarding the insurance limits required
due to the joint partnership nature of the agreement and the
addition of construction involved on the project.
Parks and Recreation Director Deal stated that the City
assumes no greater risk or liability than on other public
properties.
Denny Holt, representing Green River Professional Center
(GRPC), stated that GRPC observed that the insurance risk
limits were higher than normal, but did not feel it was
appropriate to take exception to them. GRPC would
appreciate further discussion on normal and customary
insurance limits, builders risk insurance during the term of
construction, and long term liability insurance after
construction. GRPC is pleased with the other changes and
corrections made to the agreement. Mr. Holt requested a
determination as soon as possible.

seconded to withdraw the motion to introduce and adopt
Ordinance No. 5587.

implement the improvement of SR 164 - Auburn Way South
from 6th Street SE to "M" Street SE.
