Flag Salute Mayor Lewis called the meeting to order at 7:30 PM in the Commons Area of Mount Baker Middle School located at 620 37th Street SE in the City of Auburn, Washington. B. Roll Call Mayor Lewis and the following Councilmembers were present: Rich Wagner, Jeanne Barber, Trish Borden, Fred Poe, Sue Singer, Stacey Brothers and Gene Cerino. Staff members present included: Finance Director Shelley Coleman, City Attorney Daniel B. Held, Public Works Director Christine Engler, Human Resources Director Brenda Heineman, Police Chief Jim Kelly, Parks and Recreation Director Daryl Faber, Fire Marshal Dave Smith, Planning and Community Development Director Paul Krauss, Compliance and Facilities Administrator Lynn Rued, Deputy City Clerk Cathy Richardson, and City Clerk Danielle Daskam. C. Announcements and Appointments 1. Announcements a) Proclamation - Optimist Bike Safety Week Mayor Lewis read and presented a proclamation declaring May 11-18, 2002 as "Optimist Bike Safety Week" in the City of Auburn to Jim Fletcher representing the Optimist Club. Page 1 City of Auburn Council Meeting Minutes May 6, 2002 b) Proclamation - Mental Health Month Mayor Lewis read and presented a proclamation declaring the month of May 2002 as "Mental Health Month" in the City of Auburn to Mr. Ken Seng, Chair of the Board Directors for Valley Cities Counseling and Consultation. Mr. Seng thanked the Council for their support of Valley Cities Counseling. c) Proclamation - National Police Week and National Peace Officers Memorial Day Mayor Lewis read and presented a proclamation declaring the week of May 12-18, 2002 as National Police Week in the City of Auburn and May 15, 2002 as National Police Officers Memorial Day in the City of Auburn Chief of Police Jim Kelly. 2. Appointments a) Lod.qin.q Tax Advisory Committee City Council to confirm the appointment of Wilma Pickle representing Valu-lnn to an unexpired term to expire December 31, 2002. Councilmember Wagner moved and Councilmember Barber seconded to approve the appointment of VVilma Pickle to the Lodging Tax Advisory Committee. MOTION CARRIED UNANIMOUSLY. 7-0. D. Agenda Modifications There was no agenda modification. Page 2 City of Auburn Council Meeting Minutes May 6, 2002 II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearin.qs 1. Application Number ZOA01-0006 Amendments to Chapter 18.26, C-1 Light Commercial District 03.4.2.1.2 ZOA01-0006 City Council to conduct a public hearing on proposed amendments to Chapter 18.26, the C-1 Light Commercial Zoning District of the Auburn Zoning code. The amendments include changes to the height requirements and to the provisions regarding multi-family dwelling units. Compliance and Facilities Administrator Rued presented the staff report for Application No. ZOA01-0006 relating to amendments to the C-1 Light Commercial district building height. Currently the Zoning Code allows for a building height of 45 feet in the C-1 zone with additional height allowed with each foot of additional setback. The provision for additional building height for each foot of additional setback in the C-1 zone became an issue when a developer proposed the multi-story Howard Road apartment complex. The City Council then asked the Planning Commission to review the height limits for the C1 zone. The Planning Commission held a hearing on the proposed zoning code change and recommended amending the C-1 zone so that the only place the City would allow a building in excess of 45 feet in the Light Commercial zone would be in the Auburn North Business Area. All other locations of the C-1 zone would have a height limit of 45 feet. The Planning Commission also recommended amendments that would clarify what uses may be allowed on the first floor of a multi- story apartment building. In response to a question from Mayor Lewis, Mr. Rued responded that the Downtown area zoning would continue to allow building height based on the adjacent width of the street. The proposed amendments this evening would not affect the Downtown area building height provisions. Councilmember Wagner inquired regarding staff proposed Subsection 18.26.030(K). Mr. Rued explained that Page 3 City of Auburn Council Meeting Minutes May 6, 2002 Subsection 18.26.030(K) was the initial staff recommendation forwarded to the Planning Commission. Staff recommended to the Planning Commission that in the C-1 zones, other than the North Business Area, taller buildings could be allowed under a conditional use permit. The Planning Commission's recommendation was not to adopt the subsection proposed by staff under Subsection 18.26.030(K) and not adopt the last sentence in Subsection 18.26.040(E). Councilmember Poe spoke in favor of moving Subsection 18.26.020(JJ) to Section 18.26.030 to require a conditional use permit for all apartments. Mayor Lewis opened the public hearing. Marylyn Pederson, 1917 "N" Ct SE, Auburn, WA Ms. Pederson presented the Council with a written statement dated May 6, 2002 regarding Subsection 18.26.020(JJ) and unlimited density. She read excerpts from the statement and expressed support for restricting apartment density. Joann Fonda, 1210 - 20th Ct SE, Auburn, WA Ms. Fonda spoke regarding density and automobile parking facilities. She spoke in favor of moving proposed paragraph "JJ" from Section 18.26.020 to Section 18.26.030 to require a conditional use permit. Mr. Rued explained that the term "no density limitations shall apply" is used to encourage a multi-story, multi-purpose facility to better use the developable land that exists in the City. There are practical limitations, such as setbacks, the amount of parking required, and landscaping, that would govern the density. Candice Young, 1921 "O" Ct SE, Auburn, WA Ms. Young spoke regarding parking requirements related to apartment density. She noted that the current parking ratio is 1.5 spaces per apartment. She questioned the validity of the parking requirement, as she believes the amount of required spaces should be higher. There being no other members of the audience requesting to speak, Mayor Lewis closed the public hearing. Councilmember Borden moved and Councilmember Brothers seconded to instruct the City Attorney to prepare the necessary ordinance which would approve the recommendations of the Planning Commission including the following: Deletion of Subsection 18.26.030(K) "Buildings taller than 45 feet, provided that one foot of additional building setback is provided, from each property line, for each foot of additional height of the building." Deletion of the last sentence of Subsection 18.26.040(E) "Buildings, taller than 45 feet, within all other C-1 zoned areas, must have an approved conditional use permit pursuant to section 18.26.030(K).' Move proposed paragraph "JJ" from Section 18.26.020 to Section 18.26.030 and utilize the term "gross floor area" rather than "leasable floor area." Councilmember Poe commented that the "no density limitation" issue needs to be addressed and the compatibility of paragraph "JJ" with paragraph "A" under Section 18.26.030 needs to be clarified. Councilmember Poe moved and Councilmember Singer seconded to table the motion and refer the amendment to the Planning and Community Development Committee to address the density issue. Audience Participation This is the place on the agenda where the public is invited to speak to the City Council on any issue. Michael Hart, 1408 "W" St NW, Auburn, WA Mr. Hart thanked the Mayor and City Council for bringing the Council meeting to the neighborhoods and implementing a curbside recycling program. He also congratulated the City on the new web page design. Mr. Hart expressed his support for Ordinance No. 5658 regarding noise control. The Ordinance appears later on the Council agenda. Marylyn Pederson, 1917 "N" Ct SE, Auburn, WA Ms. Pederson spoke regarding the City's recycling program and expressed support for expanding the recycling program to include other recyclable items. Virginia Haugen, 2503 "R" St SE, Auburn, WA Ms. Haugen inquired regarding the address for the Planned Unit Development provided for under Ordinance No. 5659. She also inquired regarding the umpiring equipment to be surplused by Resolution No. 3459. Parks and Recreation Director Faber responded that the equipment is listed within the Resolution and consists of various umpiring equipment. He explained that the City does not officiate games any longer, and contracts with the King County Umpires Association for the service. Ms. Haugen thanked the City Council for implementing a curbside recycling program. C, Correspondence No correspondence was received for City Council review. III. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chair Singer reported that the Municipal Services Committee met this evening at 5:00 PM at City Hall. The Committee reviewed the proposed noise ordinance and discussed the jail services contract with Yakima County. The next regular meeting of the Municipal Services Committee is scheduled for May 20, 2002 at 5:00 PM. Page 6 City of Auburn Council Meetin~ Minutes May 6, 2002 B. Planning & Community Development Chair Borden reported the Planning and Community Development Committee met April 22, 2002. The Committee reviewed the Non- motorized Transportation Plan and reviewed Parks Department surplus property described in Resolution No. 3459. The next regular meeting of the Planning and Community Development Committee is scheduled for May 13, 2002 at 5:00 PM. C. Public Works Chair Wagner reported the Public Works Committee met April 22, 2002. The Committee reviewed contract administration items, Ordinance No. 5592 relating to a Franchise Agreement with the City of Bonney Lake, Resolution No. 3463 authorizing an agreement with Lakehaven Utility District for sewer service and Ordinance No. 5657 designating earned interest revenues for street preservation. The Committee also received a report on the groundwater management project and discussed the "M" Street pre-design meetings. The next regular meeting of the Public Works Committee is scheduled for May 13, 2002 at 5:30 PM. D. Finance Chair Poe reported the Finance Committee met this evening at 6:30 PM at Mount Baker Middle School. The Committee reviewed and recommended approval of claims and payroll vouchers, surplus property, and Resolution No. 3465. The Committee also discussed a contract to update the Capital Facilities Plan and alternatives to incameration. The next regular meeting of the Finance Committee is scheduled for May 20, 2002 at 6:30 PM. IV. CONSENT AGENDA A. Minutes 1. Minutes of the April 15, 2002 regular City Council meeting. B. Application Number CUP02-0001 O3.10.1 CUP02-0001 City Council to consider the request of the Church of the Nazarene for a conditional use permit to allow the church to expand their services to an adjacent building located at 1235 29th Street SE on property zoned R-3, Duplex. Councilmember Borden moved and Councilmember Singer seconded to approve the conditional use permit based on the Hearing Examiner's Findings of Fact, Conclusions and Conditions, and to instruct the City Attorney to prepare the necessary ordinance. MOTION CARRIED UNANIMOUSLY. 7-0. VII. ORDINANCES AND RESOLUTIONS A. Ordinances 1. Ordinance No. 5592 A3.14, O4.11 An Ordinance of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute a Franchise Agreement between the City of Bonney Lake and the City of Auburn, allowing the City of Bonney Lake to connect, install, operate, maintain and repair a water system, facilities, and appurtenances in, over, along, across and under the franchise area for the purpose of providing water service. Ordinance No. 5657 F4.23 An Ordinance of the City Council of the City of Auburn, Washington, designating earned interest revenues in the Capital Improvement Projects Fund for street preservation projects and the subsequent transfer of earnings to the City Street Fund. Councilmember Wagner moved and Councilmember Poe seconded to introduce and adopt Ordinance No. 5657. In response to a questions from Councilmember Brothers, Finance Director Coleman explained that Ordinance No. 5657 identifies a revenue source for pavement preservation for projects approved by the City Council. Ms. Coleman estimated that the annual revenue from this source would be $250,000 to $300,000. MOTION CARRIED UNANIMOUSLY. 7-0. 3. Ordinance No. 5658 Ol .8 An Ordinance of the City Council of the City of Auburn, Washington, amending Chapter 8.28 of the Auburn City Code relating to noise control. Councilmember Singer moved and Councilmember Brothers seconded to introduce and adopt Ordinance No. 5658 with the following changes as recommended by the Municipal Services Committee: Section 8.28.010, Item (1) change the words "in possession of" to "who owns or occupies." Section 8.28.010 Items (2)(b), (2)(c) and (2)(d), change the word "possessors" to "occupants". Section 8.28.010 Item (2)(h) and Item (2)(i) replace the word "weekdays" with "any day of the week except Sunday" and change the word "weekends" to "Sundays." Resolution No. 3462 03.5 PLT00-0004 A Resolution of the City Council of the City of Auburn, Washington, approving the preliminary plat of 20.35 acres single family subdivision located easterly of "1" Street in the 3200-3300 block located within the City of Auburn, Washington. Councilmember Borden moved and Councilmember Singer seconded to adopt Resolution No. 3462. MOTION CARRIED UNANIMOUSLY. 7-0. 5. Resolution No. 3463 O4.6.1 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an Interlocal Agreement between the City of Auburn and Lakehaven Utility District for the purpose of providing sewer service to the Canterbury Crossing Development Project. Councilmember Poe moved and Councilmember Cerino seconded to adopt Resolution No. 3465. MOTION CARRIED UNANIMOUSLY. 7-0. VIII. MAYOR'S REPORT A. Executive Session There was no executive session. IX.
