Lewis called the meeting to order at 7:30 PM and led those in attendance in the Pledge of Allegiance. B. Roll Call Mayor Lewis and the following Councilmembers were present: Rich Wagner, Jeanne Barber, Fred Poe, Sue Singer, Stacey Brothers and Gene Cerino. Councilmember Trish Borden was excused. Staff members present included: City Attorney Daniel B. Held, Assistant Finance Director Lee Hall, Human Resources Director Brenda Heineman, Parks and Recreation Director Daryl Faber, Police Chief Jim Kelly, Fire Chief Bob Johnson, Public Works Director Christine Engler, Community Development Administrator David Osaki, Associate Planner Shirley Aird, Senior Planner Al Hicks, Recreation Coordinator Sharon LaVigne, and Deputy City Clerk Cathy Richardson. C. Announcements and Appointments 1. Announcements a) Hometown Hero Award Mayor Lewis presented Auburn's Hometown Hero Award to Lillian Kitchell. Ms. Kitchell was accompanied by her daughter Margaret Ann Schneider, cousins Nicio and Fabio from Italy, brother and sister-in-law Al and Sherry May Rossi, sister Audrey, and numerous well-wishers. Mayor Lewis acknowledged the presence of former City of Auburn Mayors Charles A. Booth and Robert Gaines. 2, Appointments There were no appointments scheduled for this evening. D. Agenda Modifications There was no agenda modification. II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings No public hearing was scheduled for this evening. B. Closed Record Hearin.q This is a closed record hearing where any public testimony must be strictly limited to the issues involving the proposal and must also be limited to comments "on the record". No new or additional evidence may be allowed. 1. Application Number CAP02-0001 A3.23.1 City Council consider an appeal filed by Curtiss and Pamela Johnson on the Hearing Examiner's decision to deny a variance application to allow an existing deck to encroach into the rear yard setbacks at 5017 Mill Pond Loop SE. Community Development Administrator David Osaki presented an overhead site plan of the subject property located at 5017 Mill Pond Loop SE depicting the existing deck and the proposed deck addition. Mr. Osaki explained that the applicant submitted a request for a variance to allow the addition of a new deck onto an existing deck. In an R-2 (Single Family Residential) zone the rear yard setback is 25 feet. The existing deck is setback approximately 14 feet from the rear lot line and was inadvertently allowed to be constructed with the residence in the mid 1980's. The Page 2 City of Auburn Council Meeting Minutes July tS, 200? building permit for the house indicated that a deck was included, but the deck was not shown on the site plan. The new deck addition was constructed without obtaining a building permit. The Hearing Examiner denied the variance request based on the criteria for granting of variance requests identified in the Auburn City Code and ordered that the deck addition be removed within 90 days. Mayor Lewis opened the closed record hearing. Pamela Johnson, 5017 Mill Pond Loop SE Ms. Johnson clarified that she was unaware that a building permit was required for construction of a deck. On January 15, 2002, Building Inspector Roger Smith issued a Stop Work Order regarding the deck. Ms. Johnson indicated that she complied with the Stop Work Order. Ms. Johnson explained that she was enlarging the existing deck due the small size and considerable slope of the back yard and the need for additional space for a wheelchair bound relative who lives with her part-time. Ms. Johnson indicated that she has never received any complaints or objections from surrounding neighbors. Discussion followed regarding the slope of Ms. Johnson's back yard, the distance from the existing deck to the existing fence, the stage of construction on the deck addition, and the plans for the deck addition. Mayor Lewis closed the closed record hearing. Councilmember Singer moved and Councilmember Barber seconded to disaffirm the Hearing Examiner's decision denying the variance. Councilmember Singer commented that she disagrees with the Hearing Examiner's decision that the proposed deck addition encroaches further into the rear yard setback than the existing deck and it appears that regulations regarding setbacks for decks have not been applied equally within the general vicinity of the Johnson's residence. Councilmember Singer commended staff with regards to following proper procedures and adhering to the Auburn City Code. MOTION CARRIED UNANIMOUSLY. 6-0. C. Audience Participation This is the place on the agenda where the public is invited to speak to the City Council on any issue. Louis Buckley, 1847 "F" Street SE Mr. Buckley spoke on behalf of the Auburn Kiwanis Club. Mr. Buckley requested Council support of the Kiwanis Club regarding displaying posters depicting America's motto "In (Sod We Trust" in public places. Posters would be supplied by the Auburn Kiwanis Club. Virginia Hau,qen, 2503 "R" Street NE Ms. Haugen thanked Mayor Lewis and Councilmembers for reciting the Pledge of Allegiance at Auburn City Council meetings. D. Correspondence No correspondence was received for Council review. III. COUNCIL COMMITTEE REPORTS A3,7.6 A. Municipal Services Chair Singer reported that the Municipal Services Committee met this evening at 5:00. The Committee reviewed ordinances which appear on this evening's agenda regarding City of Auburn Code changes and tabled Ordinance No. 5679 related to fireworks restrictions. The Committee also discussed garbage tipping fees and Valley Corn, and received an update on EMS transport and a presentation from City Attorney Daniel Heid regarding the City's domestic violence advocate. The next regular meeting of the Municipal Services Committee is scheduled for August 5, 2002 at 5:00 PM. Page 4 City of Auburn Council Meeting Minutes July 15, 200? B. PlanninR & Community Development Vice Chair Singer reported that the Planning and Community Development Committee met July 8, 2002. The Committee held a public hearing on the Vintage Hills 7, LLC Development Agreement, discussed the Safeway Development Agreement, and received a presentation from Safeway representatives on the proposed Safeway development. The Committee also discussed the Comprehensive Plan amendments and received information regarding Secure Community Transition Facilities (SCTF) and the Strategic Plan for the Washington State Liquor Control Board. The next regular meeting of the Planning and Community Development Committee is scheduled for July 22, 2002 at 5:00 PM. C. Public Works Chair Wagner reported that the Public Works Committee met July 8, 2002. The Committee reviewed the contract administration item and changes to the Comprehensive Storm Drainage Plan that appear on this evening's agenda. The Committee received a report on the "M" Street SE Grade Separation project and a presentation of the proposed Safeway project. The Committee also discussed and approved a change to the Water Leak Adjustment Administrative Policy, and received updates on the Auburn Way South Safety Improvements, Comprehensive Sewer Plan, and the new ranking system for storm drainage capital improvements. The next regular meeting of the Public Works Committee is scheduled for July 22, 2002 at 5:30 PM. D. Finance Chair Poe reported that the Finance Committee met this evening at 6:30. The Committee reviewed claims and payroll and Resolution No. 3481 appearing on this evening's agenda. The Committee also received a quarterly report from Assistant Finance Director Lee Hall. The next regular meeting of the Finance Committee is scheduled for August 5, 2002 at 6:30 PM. IV. CONSENT AGENDA A. Minutes 1. Minutes of the July 1, 2002 regular City Council meeting. C. Call for Public Hearing 1. Application Number SEP02-0012 03,7.3 City Council call for a public hearing to be held August 5, 2002 regarding the proposed Development Agreement between the City of Auburn and Safeway, Inc. D. Lodging Tax Advisory Committee Recommendations A3.8.23 1. Funding Policies City Council approve funding conditions recommended by the Lodging Tax Advisory Committee concerning the approval of projects funded through the City's Hotel - Motel Tax. 2. Tourism Promotion Expenditure City Council approve recommendations of the Lodging Tax Advisory Committee to expend $14,179.00 of the City's Hotel - Motel Tax revenues and print and distribute 97,700 copies of a Tourism Promotion Brochure in 855 markets in varied three (3) and six (6) month increments, and compensate the Auburn Chamber of Commerce $1,200.00 for the management thereof. Public Works Proiect Number C1002 04.11.1 PR C1002 City Council award Small Works Contract 02-09, Project Number C1002, Coal Creek Springs Chlorination Systems Upgrade, to S&B Inc. on their Iow bid of $54,380.00 plus Washington State sales tax of $4,785.44 for a total contract price of $59,165.44. Councilmember Barber moved Councilmember Wagner seconded to approve the Consent Agenda. MOTION CARRIED UNANIMOUSLY. 6-0. Councilmember Singer reported that the Seattle to Portland (STP) Bicycle Classic participants enjoyed the welcome signs put together by staff and displayed on the bicycle route through the City of Auburn. Councilmember Singer pointed out that the Auburn signs were the only signage displayed along the two-hundred mile route. Councilmember Singer thanked the Fire Department and Maintenance and Operations staff for their assistance on this event. V. UNFINISHED BUSINESS There were no items under this section for Council consideration. VI. NEW BUSINESS A. Application Number WSC02-0006 A3.13.8 City Council consider the request of Shupe Holmberg, Baima & Holmberg for a Development Agreement, subject to conditions, for the issuance of a sewer availability certificate to the applicant for property located at 29726- 124th Avenue SE. (See Item No. VII. A.3 of these minutes for further action on this item.) Councilmember Singer moved and Councilmember Brothers seconded, based upon findings of fact and conclusions, to approve the development agreement subject to conditions of approval, Page 7 City of Auburn Council Meetin;I Minutes July 15, 200? which will enable the issuance of sewer availability certificate to the applicant. MOTION CARRIED UNANIMOUSLY. 6-0. VII. ORDINANCES AND RESOLUTIONS A. Ordinances 1. Ordinance No. 5674 03.4.1.1o An Ordinance of the City Council of the City of Auburn, Washington, authorizing amendments to the 1990 Comprehensive Drainage Plan. Councilmember Wagner moved and Councilmember Poe seconded to introduce and adopt Ordinance No. 5674. MOTION CARRIED UNANIMOUSLY. 6-0. 2. Ordinance No. 5675 03.4.2.1.2 An Ordinance of the City Council of the City of Auburn, Washington, amending the City of Auburn Comprehensive Zoning Map. Councilmember Signer moved and Councilmember Brothers seconded to introduce and adopt Ordinance No. 5675. MOTION CARRIED UNANIMOUSLY. 6-0. 3. Ordinance No. 5676 A3.13.8 An Ordinance of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn to execute a Development Agreement between the City of Auburn and Vintage Hills 7, LLC. Councilmember Signer moved and Councilmember Brothers seconded to introduce and adopt Ordinance No. 5678 with the following change: Insert the words "or other appropriate fund" on page fourteen, line one, after the words "general fund". Ordinance No. 5682 Ol .8 An Ordinance of the City Council of the City of Auburn, Washington, repealing the current provisions of Title 9 of the Auburn City Code, replacing these provisions with a new Title 9 of the Auburn City Code, relating to Public Peace, Morals and Welfare. Councilmember Singer moved and Councilmember Wagner seconded to introduce and adopt Ordinance No. 5682. MOTION CARRIED UNANIMOUSLY. 6-0. 9. Councilmember Poe moved and Councilmember Cerino seconded to adopt Resolution No. 3501. MOTION CARRIED UNANIMOUSLY. 6-0. VIII. MAYOR'S REPORT A. Executive Session No Executive Session was held. IX.
