Fla,q Salute Mayor Lewis called the meeting to order at 7:30 PM and led those in attendance in the Pledge of Allegiance. B. Roll Call Mayor Lewis and the following Councilmembers were present: Rich Wagner, Fred Poe, Trish Borden, Sue Singer, Stacey Brothers and Gene Cerino. Councilmember Jeanne Barber was excused. Staff members present included: Fire Chief Bob Johnson, City Attorney Daniel B. Held, Planning and Community Development Director Paul Krauss, Community Development Administrator David Osaki, Associate Planner Shirley Aird, Associate Planner Jeff Dixon, Finance Director Shelley Coleman, City Engineer Dennis Dowdy, Parks and Recreation Director Daryl Faber, Human Resources Director Brenda Heineman, Recreation Coordinator Sharon LaVigne, and Deputy City Clerk Cathy Richardson. C. Announcements and Appointments 1. Announcements a) Hometown Hero Award Mayor Lewis presented Auburn's Hometown Hero Award to Roger Thordarson. Thordarson for his many years of involvement in, and service and dedication to the Auburn community. b) Police Officer Recognition and Commendation Mayor Lewis and Police Chief Kelly presented the Medal of Distinction to Officer James Frith and Letters of Commendation to Officers Kyle Bear, Jeff Ferguson, Steve Sills, James Nordenger and Patrick Douglas. Chief Kelly reported that the officers responded to a volatile incident occurring on June 26, 2002. Chief Kelly commended the officers for their bravery and professional conduct during the incident. Their experience, training and expert handling of the high- risk situation prevented serious injury to the officers involved and to any bystanders. 2. Appointments There was no appointment for City Council consideration. D. Agenda Modifications There were no agenda modifications for City Council consideration. II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings There was no public hearing scheduled for this evening. B. Closed Record Hearings A closed record hearing is a hearing where comments are limited to the existing record and no new evidence or information is allowed to be submitted. 1. Case No. HAP02-0002 A3.23.1 An appeal filed by John Underwood on the Hearing Examiner's decision to deny appeal of the Planning Director's decision to issue a Final Mitigated Determination of Non-significance (SEP01-0043) for a project located on the south side of 30th Street NE between I Street NE and Auburn Way North. Councilmember Poe excused himself from the proceedings due to the appearance of fairness doctrine. Councilmember Borden moved and Councilmember Cerino seconded to open the closed record hearing and continue the closed record hearing to the September 3, 2002 City Council meeting. MOTION CARRIED UNANIMOUSLY. 5-0. Councilmember Poe returned to the proceedings at this time. C. Audience Participation This is the place on the agenda where the public is invited to speak to the City Council on any issue. Connie Capitan, 3002 "C" Street SE, Auburn Ms. Capitan spoke on behalf of members of the community known as the "Totem District". Ms. Capitan requested that residents from the "Totem District" stand and be acknowledged. Ms. Capitan stated that they have a petition opposing the annexation of the "Totem District" by the City of Auburn and have gathered signatures of seventy-one residents. Ms. Capitan strongly expressed her opposition to the annexation. Ms. Capitan indicated that she would forward the petition to the Mayor. Gary Torgerson, 2909 "C" Street SE and 208 29th Street SE, Auburn Mr. Torgerson stated that he is a resident of the "Totem District" and he concurred with Ms. Capitan's statements. Mr. Torgerson indicated that the community has many questions regarding Page 3 City of Auburn Council Meeting Minutes August 19, 2002 consequences with regard to utilities, community safety, and zoning issues if the "Totem District" was annexed into the City of Auburn. Planning and Community Development Director Paul Krauss indicated that information sheets with frequently asked questions regarding annexations are available for distribution this evening Many of the concerns voiced by citizens tonight are answered in the information sheets. Director Krauss reported that community meetings will be scheduled for each island annexation area. Cliff Tullis, 16300- 184th Avenue SE, Renton Mr. Tullis stated that he manages two four-plex units located at 31 - 49th Street NE and 45 - 39th Street NE, Auburn. Mr. Tullis distributed materials related to the properties, including a map, proposed ordinance, and judgment establishing easement. Mr. Tullis spoke of problems regarding speed limits, parking issues, and harassment by neighbors with regard to the usage of an easement located adjacent to the properties. Mr. Tullis requested Council assistance with regard to the usage of the easement for ingress and egress purposes and parking. D. Correspondence No correspondence was received for Council review. III. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chair Singer reported that the Municipal Services Committee met this evening at 5:00. The Committee discussed disposal of surplus property that is no longer of use to the City, and City Hall and Senior Center renovations. The Committee also discussed an amendment to the Interlocal Agreement with Yakima County Jail and Resolution No. 3515. The next regular meeting of the Municipal Services Committee is scheduled for Tuesday, September 3, 2002 at 5:00 PM. B. Planninq & Community Development Chair Borden reported that the Planning and Community Development Committee met August 12, 2002 at 5:00 PM. The Committee discussed 2003 recommendations for Human Services providers, the Thuline annexation located in Pierce County, Zoning Page 4 City of Auburn Council Meeting Minutes August '19, 200? Code and Comprehensive Plan amendments, the Transit Station artwork, the Olsen Farm Lease Agreement, and the White River Trail Lighting project. The Committee also discussed temporary signage, and the "M" Street SE preferred alternative. The Committee received a report regarding King County parks that are located in potential annexation areas within the City of Auburn from Parks and Recreation Director Daryl Faber and also received an update on the Dykstra Footbridge project. The next regular meeting of the Planning and Community Development Committee is scheduled for August 26, 2002 at 5:00 PM. C. Public Works Chair Wagner reported that the Public Works Committee met August 12, 2002 at 5:30 PM. The Committee discussed contract administration items, Ordinance Number 5685 related to prohibited parking, and Resolution Numbers 3508, 3511, and 3513 on this evening's agenda. The Committee also discussed the Six Year Transportation Improvement Program and reviewed the Parking Management Study. The Committee also received a report on the Corrosion Control Treatment Facility at Fulmer Field. The next regular meeting of the Public Works Committee is scheduled for August 26, 2002 at 5:30 PM. D. Finance Chair Poe reported that the Finance Committee met this evening at 6:30. The Committee reviewed and recommends approval of claims and payroll, and the disposal of surplus property no longer of use to the City. The Committee also discussed Ordinance Numbers 5686 and 5687 on this evening's agenda and received reports on long-term care insurance, the Yakima County Jail contract revisions, cost of living adjustment, and utility taxes. The next regular meeting of the Finance Committee is scheduled for Tuesday, September 3, 2002 at 6:30 PM. IV. COUNClLMEMBER REPORTS Councilmember Singer requested that the next regular Council meeting agenda include a Resolution in support of Referendum 51. Councilmember Cerino reported that he and Mayor Lewis enjoyed a formal tour of the Port of Tacoma. Attendees included a number of elected and federal officials. The tour presented an opportunity to seek Page 5 City of Auburn Council Meeting Minutes August t9, 200? endorsement of a new post office in Auburn and widening of Highway 167. Councilmember Cerino invited interested parties to attend the South County Area Transportation Board (SCATBd) meeting on August 20, 2002 at 11:00 AM at the City of Federal Way in the Council chambers. The meeting will include discussion regarding widening of State Route (SR) 167 from Interstate (I) 405 to SR512. Mayor Lewis explained that South King County has made great strides with regard to widening of SR167 through joint meetings of South King County and North Pierce County elected officials and staff. Proposed expansion includes the addition of a High Occupancy Vehicle (HOV) lane plus two additional lanes from 1405 to SR18, and the addition of one lane plus an HOV lane from SR18 to SR512. Imprevements to SR167 will alleviate traffic on local arterials within the City of Auburn. V. CONSENT AGENDA A. Minutes 1. Minutes of the August 5, 2002 regular City Council meeting. B. UNFINISHED BUSINESS There was no unfinished business for Council review. VII. NEW BUSINESS A. Application No. CPA02-0003 03.4.3 CPA02-3 City Council to consider emergency amendments to the City of Auburn's Comprehensive Plan to the portion of Chapter 5 entitled "Essential Public Facilities" to include a definition of Secure Community Transition Facilities (SCTF) as Essential Public Facilities and to establish SCTF siting criteria. Application Number ZOA02-0002 O3.4.2.1.2 ZOA002-0002 City Council to consider emergency amendments to the Auburn City Code Title 18, Zoning, relating to the siting of Secure Community Transition Facilities (SCTF). Proposed amendments include the addition of Chapter 18.48.150, entitled "Secure Community Transition Facilities" to set forth specific siting criteria should an SCTF be proposed for location in Auburn. Proposed amendments also include: adding a definition of "Secure Residential Treatment Facility" to Auburn City Code (ACC) 18.04, "Definitions"; adding SCTF's as a Use Requiring a Permit in ACC 18.32, "M1 - Light Industrial District," and ACC 18.34, "M2 - Heavy Industrial District." Director Krauss explained that an SCTF is transitional housing for sexual offenders who have served their prison terms and are now being held in a facility by the State, for an unspecified time, until medical professionals deem them safe to rejoin society. A lawsuit filed and won by individuals that were held in prison for lengthy periods of time beyond their sentence resulted in the Federal Courts ordering the State to implement transitional housing to enable incarcerees to live in community settings. The SCTF's are required to be under 24-hour watch. Director Krauss reported that the State Department of Social and Health Services (DSHS) is under court order to site SCTF's throughout the state based roughly on which community the individuals originated from. King County has the largest population in the State of Washington and it is not unreasonable to assume a number of sexual offenders originated in King County. Director Krauss stressed that a site has not yet been chosen, but it is likely that DSHS will select a site someplace within King County. DSHS also has the right to ignore local ordinances. DSHS implemented September 1, 2002 as the deadline for cities to review and modify their ordinances. Cities and counties are trying to minimize impacts on their communities by making reasonable amendments. There has been a tendency by DSHS and other agencies to site group residences within minority or Iow-income communities. Director Krauss stated that the proposed amendments to the Comprehensive Plan and Zoning Code include language to Page 9 City of Auburn Council Meetin,q Minutes Au.qust 19, 200? contend with SCTF facilities should they be sited in Auburn. The community chosen for an SCTF cannot refuse the facility as it is deemed an essential public facility. The amendments are intended to avoid a SCTF being placed within the City based solely on the Iow cost of property and to avoid having them clustered in areas that currently contain similar group residences. The proposed amendments include a 1,000 foot separation from any other group residence facility. The amendments also include language that states that the passage of the amendments does not waive the right of the City to contest DSHS's ability to preempt a local ordinance. Director Krauss referred Council to page 5 of Ordinance No. 5689, Item 8(h). Item 8(h)2 has two alternatives. Council needs to select the preferred language under 8(h)2. Staff recommends the Planning and Community Development Committee language under the second selection under this item. Director Krauss stated that the City is only allowed to amend its Comprehensive Plan once each year, which is generally done in December. Due to the time constraints imposed by the State, Ordinance No. 5689 is declared an emergency ordinance. In response to questions from Councilmembers Borden and Poe, Director Krauss stated that King County has elected to do nothing with regard to code amendments pertaining to SCTF's. The island annexation areas within the City are under King County's jurisdiction, therefore not protected by City of Auburn ordinances. Conditional Use permits would be required for an SCTF sited within Auburn city limits. Councilmember Poe cited several businesses and areas that are located within M-1 or M-2 zones. Councilmember Poe spoke in opposition to the proposed Comprehensive Plan and Zoning Code amendments. Councilmember Brothers spoke in favor of the Comprehensive Plan and Zoning Code amendments. He feels that, in the event an SCTF is sited in Auburn, the City would be in a better legal position to oppose such a facility. Director Krauss displayed an overhead map of the industrial areas within the City. Director Krauss pointed out that the proposed Page 10 City of Auburn Council Meeting Minutes Au;lust 19, 200? amendments include siting and dispersion criteria for SCTF's, such as the 1,000 foot residential separation requirement. Associate Planner Shirley Aird referred to the overhead map and pointed out various areas depicting the 1,000 foot separation. The proposed amendments include the requirement that SCTF's are to be located, to the extent possible, within a region serving area which is defined in the Comprehensive Plan as the area west of downtown Auburn. Councilmember Brothers requested clarification regarding the City's region serving area and DSHS requirements with regard to siting of a SCTF. Director Krauss explained that the Comprehensive Plan defines the region serving area as those areas that are of equal importance to the region as they are to the City of Auburn. The region serving area is basically the industrial corridor west of downtown Auburn, west of the railroad tracks to West Valley Highway. Ms. Aird reported that DSHS requirements include siting restrictions, such as not being allowed near schools, but require that they must be sited nearby an area with a reasonable commute, services, and job opportunities. SCTF's can be located in rural areas as long as the site meets DSHS criteria. Ms. Aird referred to the overhead map display and pointed out various areas that meet both DSHS and City of Auburn criteria. See Item VIII. A.5 and Item VIII. A.6 for action on these items. VIII. Councilmember Borden moved and Councilmember Singer seconded to introduce and adopt Ordinance No. 5689 with the Planning and Community Development language under Item 8(h)2 on page five as read by Director Krauss, and with added language for a "No Waiver provision" as read by City Attorney Held, as follows: "Whether the State proves by clear, cogent and convincing evidence that 1) a sufficient and reasonable number of alternative sites have been fully, fairly, and competently considered; and 2) such sites were found to be unsuitable for an SCTF for reasons other than the cost of property." Add a new Section 3, with all subsequent Sections being renumbered. "Section 3. No Waiver Provision. The City Council does not, by the adoption of this ordinance, waive or relinquish its rights to challenge the validity of Engrossed Substitute Senate Bill 6594." MOTION CARRIED. 5-1. Amended Resolution No. 3499 03.10 A Resolution of the City Council of the City of Auburn, Washington, requesting that the annexation of an unincorporated area contiguous to the corporate limits of the City be placed before the voters of the proposed annexation area - annexation of a portion of East Auburn Garden Tracts known as the "Steelhead South District". Councilmember Wagner moved and Councilmember Poe seconded to adopt Resolution No. 3508. MOTION CARRIED UNANIMOUSLY. 6-0. 8. Resolution No. 3511 O4.6.1 A Resolution of the City of Auburn, Washington, authorizing execution of a King County Sewer Franchise to provide sewer service to Auburn's west hill. MOTION CARRIED UNANIMOUSLY. 6-0. 10.Resolution No. 3514 O3.1 ANX02-0005 A Resolution of the City Council of the City of Auburn, Washington, requesting that the annexation of an unincorporated area contiguous to the corporate limits of the City be placed before the voters of the proposed annexation area - Pinnacle Properties. Councilmember Borden moved and Counoilmember Singer seconded to adopt Resolution No. 3514. MOTION CARRIED UNANIMOUSLY. 6-0. 11. Resolution No. 3515 03.4.1.7 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor to apply for a Local Law Enforcement Block Grant on behalf of the City of Auburn, Washington.
