Lewis called the meeting to order at 7:30 PM and led those in attendance in the Pledge of Allegiance. B. Roll Call Mayor Lewis and the following Councilmembers were present: Rich Wagner, Jeanne Barber, Trish Borden, Sue Singer, Stacey Brothers, and Gene Cerino. Councilmember Fred Poe was excused. Staff members present included: Planning and Community Development Director Paul Krauss, Assistant City Attorney Judith Ausman, Teen Coordinator Jim Westhusing, Solid Waste Supervisor Sharon Conroy, Assistant Fire Chief Russ Vandver, Acting Public Works Director/City Engineer Dennis Dowdy, Human Resources Director Brenda Heineman, Assistant Finance Director Lee Hall, Police Chief Jim Kelly, Finance Director Shelley Coleman, Assistant Police Chief Bob Lee, Parks and Recreation Director Daryl Faber, City Clerk Danielle Daskam, and Deputy City Clerk Cathy Richardson C. Announcements and Appointments 1. Announcements a) Proclamation - Civility Week Mayor Lewis presented a proclamation declaring December 2 through December 6, 2002 as "Civility Week" in the City of Auburn. Page1 City of Auburn Council Meeting Minutes December 2, 20n~ Mayor Lewis presented the proclamation to students Colleen Heffiin from Auburn High School, Sabrina Coaty from Auburn Riverside High School, and Allison Angelo from Auburn Riverside High School. The students presented a PowerPoint presentation recapping Civility Week 2001 and new ideas promoting Civility Week 2002, and urged the community to participate in their endeavor to promote civility. b) Proclamation - Miss Auburn Scholarship Pre.qram Mayor Lewis presented a proclamation declaring January 17 and 18, 2003 as a day to recognize the contribution of parents, participants and volunteers for the Miss Auburn Scholarship Program to Co- executive Director Nancy Carr Backus. The following contestants were present: Lauren Ansingh, Krysta Barkus, Samantha Brewer, Megan Callas, Ashley Carmody, Jessica Fowler, Kristin Firth, Brynne Geiszler, Elizabeth Heutmaker, Heather Jeffcoat, Ashley King, Kellie Marin, Allison Miller, Jessica Mitchell, Kerry Read, Brittany Schaeffer, Nichole Tomer, and Heather Tunia. 2. Appointments There were no appointments for Council consideration. D. A.qenda Modifications There were no agenda modifications. II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings 1. Application Number V-04-02 03.9 v-04-02 City Council to conduct a public hearing on a petition for vacation of a portion of 151st Avenue East located east of East Valley Highway. The petition for such vacation was Page 2 City of Auburn Council Meeting Minutes December 2, 2002 filed by two-thirds or more of the property owners abutting that portion of right-of-way sought to be vacated. Acting Public Works Director/City Engineer Dennis Dowdy displayed an aerial photograph of the subject property. Mr. Dowdy explained that all property owners that may or may not be affected by the proposed right-of-way vacation were sent notification. Not all property owners have responded to the notification of the proposed vacation, Mr. Dowdy expressed concern regarding public access in the event adjacent properties were developed. Staff requires additional time to gather the necessary information with regard to intended land use from adjacent property owners prior to making a recommendation. Mayor Lewis opened the public hearing. Frank Rodarte, 17 East Valley Hi,qhway, Auburn Mr. Rodarte stated that he is the applicant of the right-of-way vacation request. Mr. Rodarte reported that a portion of the property to the south of the subject property is very steep and also contains a large area of wetlands and is likely undevelopable, Mr. Rodarte spoke in favor of the right-of- way vacation. Mayor Lewis closed the public hearing. Councilmember Wagner moved and Councilmember Cerino seconded to return Application No. V-04-02 to the Public Works Committee. MOTION CARRIED UNANIMOUSLY. 6-0. 2. 2003 Final Bud,qet F3.17 All persons interested are encouraged to participate in this public hearing by making comments, proposals, and suggestions for the City Council and Mayor to consider prior to adoption of the City of Auburn 2003 Final Budget. Finance Director Shelley Coleman stated that the 2003 final budget contains few changes from the 2003 preliminary Page 3 City of Auburn Council Meeting Minutes December 2, 2002 budget. Ms. Coleman noted Councilmembers were provided with a list of the changes. Changes include an increase in utility taxes and a $1.7 million cut in the general fund to balance the budget and meet declining revenues. Mayor Lewis opened the public hearing. No one in the audience requested to speak. Mayor Lewis closed the public hearing. 3. Solid Waste Rates F4.3 City Council invites public comments on proposed solid waste rates for new services. Solid Waste Manager Sharon Conroy reported that the proposed solid waste rates are for new or additional optional services. Mayor Lewis opened the public hearing. No one in the audience requested to speak. Mayor Lewis closed the public hearing. B. Audience Participation This is the place on the agenda where the public is invited to speak to the City Council on any issue. Vir.cjinia Hau,qen, 2503 "R" Street SE, Auburn Ms. Haugen commended work done by the Municipal Services Committee. Ms. Haugen expressed concern regarding the cost of contract administration items on this evening's agenda, the old Senior Center remodel project, and the City Hall remodel project. Ms. Haugen also spoke in opposition to funds that were allocated to the Small Business Assistance Center. Page 4 City of Auburn Council Meetin;i Minutes December 2, 2002 Mike Morrisette, 4702 Millpond Drive SE, Auburn Mr. Morrisette, Executive Director of the Auburn Area Chamber of Commerce, spoke in favor of the City's support of the Small Business Assistance Center (SBAC). The SBAC helps sustain and expand the local economy. Governments on various levels assist entities that promote economic services. Mr. Morrisette reviewed the various services and programs provided by the SBAC. DeAnna Burnett Keener, 5500 S 360th Street, Auburn Ms. Keener stated that she is the Director/Counselor of the SBAC. Ms. Keener distributed literature related to the SBAC. Ms. Keener spoke in favor of the City's support of the SBAC and enumerated SBA(::; services, programs, and benefits to the community. C. Correspondence No correspondence was received for Council review. III. COUNCIL COMMITTEE REPORTS A3.7,6 A. Municipal Services Chair Singer reported that the Municipal Services Committee met this evening at 5:00. Chair Singer reported that representatives from Freddie's Club spoke regarding the proposed gambling tax increase. The Committee discussed Ordinance No. 5619 related to the Waste Management contract and recommended amending page 5, second line to read "Residences can request a tenant release form once in a year while they are at that address". The Committee also recommended amending Ordinance No. 5715, page 21, Building Permit Fees by rounding fees up to the nearest dollar and tabled Ordinance No. 5716 related to false alarm fees. The next regular meeting of the Municipal Services Committee is scheduled for December 6, 2002 at 5:00 PM. B. Planning & Community Development Chair Borden reported that the November 25, 2002 Planning and Community Development Committee meeting was cancelled. The next regular meeting of the Planning and Community Development Committee is scheduled for December 9, 2002 at 5:00 PM. C. Public Works Chair Wagner reported that the Public Works Committee met November 27, 2002 at 3:00 PM. The Committee discussed Public Page 5 City of Auburn Council Meeting Minutes December 2, 200? Works Department budget reductions, street sweeping costs, and consent items on this evening's agenda. The Committee also discussed Ordinance No. 5712 and Ordinance No. 5713. The next regular meeting of the Public Works Committee is scheduled for December 9, 2002 at 5:30 PM. D. Finance Vice Chair Borden reported that the Finance Committee met this evening at 6:00. The Committee recommended approval of consent items on this evening's agenda, Ordinance No. 5702, and Ordinance No. 5715. The Committee tabled Ordinance No. 5703 related to a gambling tax increase. The Committee also received comments from representatives from Freddie's Club related to the proposed gambling tax increase. The next regular meeting of the Finance Committee is scheduled for December 16, 2002 at 6:30 PM. E. Committee on Committees Chair Wagner reported that the Committee on Committees met this evening at 7:10. The Committee will present committee assignments at the December 16, 2002 Council meeting. IV. ORDINANCES AND RESOLUTIONS A. Ordinances 1. Ordinance No. 5702 F3.17 An Ordinance of the City Council for the City of Auburn, Washington, adopting the budget for the City of Auburn, Washington, for the year 2003. Councilmember Borden moved and Councilmember Cerino seconded to introduce and adopt Ordinance No. 5702. MOTION CARRIED UNANIMOUSLY. 6-0. 2.Ordinance No. 5703 F6.4 An Ordinance of the City Council of the City of Auburn, Washington, amending Auburn City Code Section 3.80.060 entitled "Tax - Levy - Social Card Games" contained in Auburn City Code Chapter 3.80 entitled "Gambling Activities" to increase the tax rate on social card games as defined in RCW 9.46.0282 from twelve percent to fifteen percent effective January 1, 2003. Ordinance No. 5703 was tabled in Finance Committee. 3. Ordinance No. 5708 o3.10.9 An Ordinance of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute a Public Way Agreement between the City and Touch America, Inc. Ordinance No. 5710 O1.2 An Ordinance of the City Council of the City of Auburn, Washington, amending Auburn City Code Chapter 10.36.310 entitled "Prohibited Parking Areas - Southeast Auburn" for the purpose of prohibiting parking along a portion of 21st Street SE Councilmember Wagner moved and Councilmember Cerino seconded to introduce and adopt Ordinance No. 5710. MOTION CARRIED UNANIMOUSLY. 6-0. 5. Ordinance No. 5712 F4.3, O4.11.2 An Ordinance of the City Council of the City of Auburn, Washington, amending Auburn City Code 13.06.360 pertaining to Auburn water rates. Councilmember Wagner moved and Councilmember Cerino seconded to introduce and adopt Ordinance No. 5712. MOTION CARRIED UNANIMOUSLY. 6-0. 6. Ordinance No. 5713 F4.3, 04.6.2 An Ordinance of the City Council of the City of Auburn, Washington, amending Auburn City Code 13.20.440 pertaining to Auburn sewer rates. Councilmember Wagner moved and Councilmember Cerino seconded to introduce and adopt Ordinance No. 5713. MOTION CARRIED UNANIMOUSLY. 6-0. Ordinance No. 5715 F4.3 An Ordinance of the City Council of the City of Auburn, Washington, providing for amendment to the City of Auburn Fee Schedule, and amending Sections 2.09.020, 2.09.025, 2.72.330, 2.72.331, 2.78.010, 2.78.020, 3.32.010, 3.76.010, 12.56.046, 15.08.020, 15.36.010 and 15.36.020 of the Auburn City Code, and creating new Sections 15.08.045 and 15.38.045 of the Auburn City Code, relating to City fees and charges. Councilmember Borden moved and Councilmember Cerino seconded to introduce and adopt Ordinance No. 5715. Councilmember Singer suggested amending Ordinance No. 5715, page 21, Building Permit Fees, by rounding up the fees to the nearest dollar increment. Councilmember Borden amended her motion to provide for rounding up the building permit fees to the nearest dollar increment. There were no objections. MOTION CARRIED UNANIMOUSLY. 6-0. 8. Ordinance No. 5716 F4.3 An Ordinance of the City Council of the City of Auburn, Washington, amending Chapter 9.30 of the Auburn City Code, and repealing Section 15.56.030 of the Auburn City Code, relating to False Alarms. Ordinance No. 5716 was tabled in Municipal Services Committee. 9. Ordinance No. 5718 O4.7.2 An Ordinance of the City Council of the City of Auburn, Washington, amending Chapter 9.66 of the Auburn City Code, relating to nuisance/litter control. Ordinance No. 5719 04.7.5, F4.3 An Ordinance of the City Council of the City of Auburn, Washington, amending Section 8.08.180 of the Auburn City Code, and authorizing the Mayor and City Clerk of the City of Auburn to enter into Amendment I to the "Comprehensive Garbage, Recyclables and Yard Debris Collection Contract" between the City of Auburn and Waste Management of Washington, Inc. (d/b/a RST Disposal), relating to additional solid waste services, the fees and charges therefore and certain clarifications relative thereto. Assistant City Attorney Ausman read the title of Ordinance No. 5719 and added the correction to page 5 made by Councilmember Singer as follows: Page 5, first paragraph, last sentence, to read "Residents can request a tenant release form only once in a year while they are at that address". Councilmember Singer moved and Councilmember Wagner seconded to introduce and adopt Ordinance No. 5719 as amended. MOTION CARRIED UNANIMOUSLY. 6-0. B. Resolutions 1. Resolution No. 3514 (Corrected) O3.1 A Resolution of the City Council of the City of Auburn, Washington, requesting that the annexation of an unincorporated area contiguous to the corporate limits of the City be placed before the voters of the proposed annexation area - Pinnacle Properties. Resolution No. 3550 F5.3 A Resolution of the City Council of the City of Auburn, Washington, approving acceptance of the King County Office of Cultural Resource appropriation and expenditure of grant funds in the amount of Eight Thousand and No/100 Dollars ($8,000.00) and authorizing the Mayor to execute Contract No. D32403D. Councilmember Borden moved and Councilmember Singer seconded to adopt Resolution No. 3550. MOTION CARRIED UNANIMOUSLY. 6-0. 3. Resolution No. 3552 O1.7 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an Agreement between the City of Auburn and Benton County, Washington for housing of inmates in the Benton County Jail. Councilmember Singer moved and Councilmember Wagner seconded to adopt Resolution No. 3552. MOTION CARRIED UNANIMOUSLY. 6-0. 4. Resolution No. 3553 02,3 A Resolution of the City Council of the City of Auburn, Washington, authorizing the City of Auburn, Washington, to join the Regional Disaster Plan for Public and Private Organizations in King County. MAYOR'S REPORT A. Executive Session Mayor Lewis recessed the meeting to executive session at 8:59 PM for approximately twenty minutes to discuss personnel and land acquisition issues. At 9:20 Mayor Lewis announced additional time would be required for the executive session. Mayor Lewis reconvened the regular meeting at 9:23 PM. X.
