Lewis called the meeting to order at 7:30 PM and led those in attendance in the Pledge of Allegiance. Roll Call Mayor Lewis and the following Councilmembers were present: Rich Wagner, Jeanne Barber, Trish Borden, Fred Poe, Sue Singer, Stacey Brothers, and Gene Cerino. Staff members present included: Planning and Community Development Director Paul Krauss, Fire Chief Bob Johnson, City Attorney Daniel B. Heid, Human Resources Director Brenda Heineman, Parks and Recreation Director Daryl Faber, Police Chief Jim Kelly, Community Development Administrator David Osaki, Finance Director Shelley Coleman, Acting Public Works Director/City Engineer Dennis Dowdy, Planner Mitzi McMahan, Assistant Police Chief Bob Lee, and Deputy City Clerk Cathy Richardson. C. Announcements and Appointments 1. Announcements a) Proclamation - DECA Don't Drink and Drive Week Mayor Lewis presented a proclamation to DECA representatives Sarah Orton, Samantha Gibson, and Katrina Snow declaring December 16 through December 20, 2002 as "Don't Drink and Drive Week" in the City of Auburn. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE Public Hearings There were no public hearings scheduled for this evening. B. Closed Record Hearings Application No. VAR02-0003 03.10.5 VAR02-0003 An appeal filed by Kevin Sheehan on the hearing Examiner's decision to conditionally approve an application for variance from Joseph Hafner to allow a placement of a garden shed within the rear yard setback at 1122 "O" Street NE. In order to allow full public participation in the closed record hearing, the hearing was rescheduled to January 6, 2003. Audience Participation This is the place on the agenda where the public is invited to speak to the City Council on any issue. Virclinia Hau~en, 2503 "R" Street SE, Auburn Ms. Haugen reported a sink-hole located on "R" Street SE. When the storm drain backs up it creates a hazard to pedestrians and vehicles due to muddy water. Ms. Haugen requested that the sink- hole be repaired. Acting Public Works Director/City Engineer Dowdy reported that most of the puddles along the western border of "R" Street are not a safety issue as they are located on the parking side of the curb and are not located in the pedestrian path of travel. There are drainage problems on "R" Street due to side street drainage, the placement of manholes and also the undulating character and fiat terrain of "R" Street. Acting Director Dowdy indicated that the repair of "R" Street is not an operations and maintenance issue and that he would refer the problem to the Public Works Committee as a potential project for 2003. Gary Nomensen, Puget Sound Energy (PSE), 3130 S 38th Street, Tacoma Mr. Nomensen stated that he is the Community Relations Manager for PSE. Mr. Nomensen reported that he will be representing the South King County area and wanted to introduce himself to the Mayor and Council. D. Correspondence Certificate of election results for the Klump area proposed annexation to the City of Auburn received December 3, 2002. Certificate of election results for the Steelhead North area proposed annexation to the City of Auburn received December 3, 2002. Certificate of election results for the Steelhead South area proposed annexation to the City of Auburn received December 3, 2002. Certificate of election results for the Totem area proposed annexation to the City of Auburn received December 3, 2002. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chair Singer reported that the Municipal Services Committee met this evening at 5:00. The Committee discussed surplus and contract administration items on this evening's agenda, Ordinance No. 5716 related to false alarms, and Ordinance No. 5724 related to parking fines. The Committee also tabled Ordinance No. 5714 related to crime prevention funding. The next regular meeting of the Municipal Services Committee is scheduled for January 6, 2003 at 5:00 PM. Planning & Community Development Chair Borden reported that Planning and Community Development Committee met December 9, 2002 at 5:30 PM. The Committee received a copy of the Lea Hill Annexation Study and a report on the surface water quality monitoring program. The Committee also discussed the neighborhood matching grant program and received a report on the Lakeland Hills pedestrian staircase construction. The Committee participated in a joint meeting with the Human Services Committee to discuss challenges in reviewing human services proposals and loss of services due to budgetary cutbacks. The Committee also cancelled the December 23, 2003 Planning and Community Development Committee. The next regular meeting of the Planning and Community Development Committee is scheduled for January 13, 2003 at 5:00 PM. Public Works Chair Wagner reported that the Public Works Committee met on December 9, 2002 at 5:30 PM. The Committee discussed and recommends approval of contract administration items, Ordinance No. 5721 related to the electrical franchise with PSE, Ordinance No. 5709 related to sewer system development charges, and Ordinance No. 5720 related to parking spaces on this evening's agenda. The Committee also discussed Emerald Downs public roadway conversion criteria and cancelled the December 23, 2002 Public Works Committee meeting. The next regular meeting of the Public Works Committee is scheduled for January 13, 2003 at 5:30 PM. Finance Chair Poe repot[ed that the Finance Committee met this evening at 6:30. The Committee discussed and recommends approval of claims and payroll, contract administration items, Ordinance No. 5706 related to the 2002 budget amendments, and Resolution No. 3549 related to an Interlocal Agreement with City of ^lgona for court services on this evening's agenda. The Committee also discussed the Municipal Airport budget. The next regular meeting of the Finance Committee is scheduled for January 6, 2003 at 6:30 PM. Council Committee on Committees Councilmember Wagner reported that the Council Committee on Committees met on December 2, 2002 and recommended the Committee assignments outlined in Resolution No. 3557. COUNCILMEMBER REPORTS Puget Sound Regional Council Meeting Councilmember Singer reported that she attended a recent Puget Sound Regional Council meeting. The Secretary of Transportation has determined that the State of Washington is forty-ninth out of fifty states with regard to per capita transportation infrastructure funding. City Logo Councilmember Borden reported that she served on the committee which was tasked with developing a City of Auburn logo and tagline. Councilmember Borden invited Planner Mitzi McMahan to display the proposed logo. Ms. McMahan presented the proposed logo to Councilmembers. Ms. McMahan commended committee stakeholders for their commitment and dedication. Mayor Lewis stated that the proposed logo was designed to accompany the recently adopted City tagline. Councilmember Brothers expressed concern with subtle design and coloration of the background of the proposed logo. Councilmember Poe expressed his disappointment in the proposed logo. Councilmember Wagner suggested using a variation of coloring for the background and more sensible highlighting of the tagline to make them stand out against the lettering of Auburn. Councilmember Borden noted that the tagline will not be used in every application. The Committee attempted to keep the logo simple so that details would be clear in reproduction. Ordinance No. 5709 O4.6.2 An Ordinance of the City Council of the City of Auburn, Washington amending Auburn City Code Section 13.41.030 to clarify Sewer System Development charges and to eliminate the term "Metropolitan Services" and replace it with "Natural Resources". Councilmember Wagner moved and Councilmember Cerino seconded to introduce and adopt Ordinance No. 5709. MOTION CARRIED UNANIMOUSLY. 7-0. Ordinance No. 5714 O1.8; F4.2.8 An Ordinance of the City Council of the City of Auburn, Washington, creating a new Chapter 3.80 of the Auburn City Code relating to crime prevention funding. Ordinance No. 5714 was tabled in Municipal Services Committee. Ordinance No. 5716 F4.3 An Ordinance of the City Council of the City of Auburn, Washington, amending Chapter 9.30 of the Auburn City Code, and repealing Section 15.56.030 of the Auburn City Code, relating to False Alarms. Councilmember Singer moved and Councilmember Wagner seconded to introduce and adopt Ordinance No. 5716 as revised in Municipal Services Committee. Councilmember Singer explained that Ordinance No. 5716 contains an appeal process to the Police or Fire Chief with regard to false alarm fees, which would allow the fees to be dismissed. Councilmember Singer noted that the Ordinance calls for notification of the first false alarm to the alarm user. Councilmember Brothers stated that it is understood that if the alarm user immediately notifies the appropriate emergency agency of an inadvertent false alarm, there is no false alarm fee. Police Chief Jim Kelly reported that there have been approximately 3,700 false alarms in 2002. Councilmember Singer stated that it cost the City approximately $150,000 this year for responses to false alarms. Ordinance No. 5716 will encourage alarm users to correct problems related to false alarms. Each alarm called into Valley Corn (911) costs the City approximately $18 in addition to the cost of staff response to the alarm. Chief Kelly reported that approximately ninety-seven percent of alarms responded to are false. Residential alarms make up a small portion of that number. Most residential alarms are cancelled by the alarm user when a false alarm occurs. Councilmember Wagner moved that the words "as determined by an officer arriving on the premises" to the end of the paragraph of Section 9.30.010. Councilmembers Singer concurred. MOTION CARRIED UNANIMOUSLY AS AMENDED. 7-0. Ordinance No. 5717 O1.8 An Ordinance of the City Council of the City of Auburn, Washington, amending Chapter 9.96 of the Auburn City Code, relating to Trespass and Burglary Tools. Ordinance No. 5720 O4.10 An Ordinance of the City Council of the City of Auburn, Washington, amending Auburn City Code Chapter 10.35.370 and 10.36.390 to create two 15-minute parking stalls on the north side of Main Street Councilmember Wagner moved and Councilmember Cerino seconded to introduce and adopt Ordinance No. 5720. Ordinance No. 5721 A3.14 An Ordinance of the City Council of the City of Auburn, Washington, authorizing an extension of the electrical franchise with Puget Sound Energy (PSE) for a period of six months. Councilmember Wagner moved and Councilmember Poe seconded to introduce and adopt Ordinance No. 5721. MOTION CARRIED UNANIMOUSLY. 7-0. Ordinance No. 5722 03.4.3 An Ordinance of the City Council of the City of Auburn, Washington, adopting the year 2002 Comprehensive Plan amendments. Councilmember Borden moved and Councilmember Singer seconded to introduce and adopt Ordinance No. 5722. MOTION CARRIED. 5-1. Councilmember Brothers voted no and Councilmember Poe abstained. Resolutions Resolution No. 3549 A1:4.1 A Resolution of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn, to execute an Interlocal Agreement continuing the authority of the Auburn Municipal Court as the Municipal Court for the City of Algona, and establishing an amended filing fee schedule. Councilmember Poe moved and Councilmember Cerino seconded to adopt Resolution No. 3549. MOTION CARRIED UNANIMOUSLY. 7-0. Resolution No. 3557 A3.7.1 A Resolution of the City Council of the City of Auburn, Washington, repealing Resolution No. 3401 passed December 17, 2001, and designating the members, powers, duties and meeting times and days of all standing committees of the City Council of the City of Auburn for the year 2003. Resolution No. 3558 A5.3.33 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an Agreement for the South County Area Transportation Board. Councilmember Wagner moved and Councilmember Barber seconded to adopt Resolution No. 3558. MOTION CARRIED UNANIMOUSLY. 7-0. MAYOR'S REPORT Executive Session There was no executive session.
