I. CALL TO ORDER

Mayor Peter B. Lewis called the meeting to order at 7:30 PM and
led those in attendance in the Pledge of Allegiance.
Roll Call
Mayor Lewis and the following Councilmembers were present:
Rich Wagner, Trish Borden, Sue Singer, Fred Poe, Stacey
Brothers, Gene Cerino, and Nancy Backus.
The following staff members were present: Planning and
Community Development Director Paul Krauss, Police Chief Jim
Kelly, Parks Planning and Development Manager Dan
Scamporlina, Battalion Chief Mike Gerber, Human Resources
Director Brenda Heineman, City Attorney Daniel B. Heid, Public
Works Director Dennis Dowdy, Finance Director Shelley Coleman,
Senior Planner Al Hicks, and Deputy City Clerk Cathy Richardson.

Multi-Family Tax Abatement Ordinance

City Council to conduct a public hearing concerning the
City's proposed Multi-Family Tax Abatement Ordinance.
The Multi-Family Tax Abatement Ordinance proposes to
offer qualified multi-family developments constructed within
the downtown Residential Target Area the opportunity to
abate property taxes on such multi-family dwellings for a
period of ten years. The purpose of this hearing is to solicit
public comments prior to adoption of a Multi-Family Tax
Abatement Ordinance.

5779 under Item V/II.A. 1 of these minutes.)
Senior Planner Al Hicks explained that the proposed
ordinance would exempt multi-family housing developments
of thirty or more units and located within a specific downtown
area from property taxes for a period of ten years. The
exemption does not include property taxes assessed on the
land on which the units are placed nor on any commercial or
retail development on the ground floor of mixed use
structures. In the past, only large cities were afforded the
opportunity to offer exemptions to multi-family housing
developments. The State legislature recently extended the
opportunity to cities of thirty-thousand or above to implement
the property tax exemption. The cities of Federal Way,
Tacoma, and Puyallup currently offer the property tax
exemption.
In response to questions from Councilmember Brothers, Mr.
Hicks stated that the purpose of the proposed ordinance is
to encourage development and establish residential units in
the downtown area. Studies show that downtown
businesses are benefited by the inclusion of downtown
residential areas.
Councilmember Cerino inquired whether the proposed
ordinance would facilitate density requirements for an Urban
Center designation.
Planning and Community Development Director Paul Krauss
concurred that the proposed ordinance would facilitate

density requirements for an Urban Center designation. The
Urban Center application to King County assumes a certain
density in its downtown area to which a city will grow.
Development in downtown areas is more expensive than in
other areas of a city. The multi-family tax abatement
encourages downtown residential development .and would
entice developers to build in the downtown area. The
implementation of a multi-family tax abatement in the City of
Tacoma has been very successful.
Mayor Lewis opened the public hearing.
Alan Keimiq, 216 "A" Street NW, Auburn
Mr. Keimig stated that he represents Keimig and Associates
Architects who currently have three projects in the planning
process which include thirty or more units. Mr. Keimig
estimated that a property tax abatement would result in an
annual savings of approximately $1000 per unit and would
provide a stimulus for development in the downtown area.
Mr. Keimig urged Councilmembers to approve the multi-
family tax abatement ordinance.
Dee Sanders, 3011 "M" Drive NE, Auburn
Ms. Sanders expressed concern with regard to enforcement
of maintenance of multi-family units developed in the
downtown core.
Vir,qinia Hau,qen, 2503 "R" Street SE, Auburn
Ms. Haugen expressed concern that any multi-family units
developed in the downtown area would evolve into Iow-
income housing. Ms. Haugen urged Councilmembers to
study the issue longer. Ms. Haugen also stated that multi-
family housing units in the downtown area could have many
benefits to downtown business.
Mayor Lewis closed the public hearing.

to the City Council on any issue.

Terri Wagner1 928 30th Street NE, Auburn
Ms. Wagner referenced an article printed in the Auburn Reporter
related to the prohibition of fireworks. Ms. Wagner spoke in favor
of prohibiting fireworks in the City of Auburn. Ms. Wagner stated
that she has received poor response from the Auburn Police
Department related to complaints made regarding fireworks.
Ms. Wagner also stated that she is employed by Auburn Mobile
Chevron and requested assistance with regard to complaints made
and the poor response received from the Auburn Police
Department related to individuals that drive off without paying for
fuel.
Police Chief Jim Kelly reported that various levels of proof are
required with regard to fuel theft before prosecution can be made.
Chief Kelly offered to meet with Ms. Wagner to discuss her
concerns.
Dee Sanders, 3011 "M" Drive NE, Auburn
Ms. Sanders reported that she rode with a Washington State Code
Compliance Officer who is working in the City of Auburn related to
elimination of noxious weeds. Ms. Sanders expressed concern
regarding overgrown weeds and litter on vacant lots and
residences within the City of Auburn.
Vir.qinia Hauqen, 2503 "R" Street SE, Auburn
Ms. Haugen spoke in favor of prohibiting fireworks in the City of
Auburn. Ms. Haugen also spoke in opposition to lease payments
to the Business Enterprise Center.
Deanna Burnett-Keener, 5500 South 360th Street, Auburn
Ms. Burnette-Keener spoke on behalf of the Small Business
Assistance Center (SBAC). Ms. Burnette-Keener thanked the City
of Auburn for its support of the SBAC. Ms. Burnette stated that the
Auburn SBAC was named the number one assistance center in the
State of Washington due to their ability to define partners with
entities such as Green River Community College Adult Education
Center, Puget Sound Leadership Institute, and the Auburn
Chamber of Commerce. Ms. Burnette-Keener stated that the
Business Enterprise Center (BEC) offers many outstanding
services and resources and is being used as a model for
development of a national program for small business centers.

Dick Pickett, 36618 55th Avenue S, Auburn
Mr. Pickett stated that he is the Chairman of the Board for the
Auburn Area Chamber of Commerce. Mr. Pickett spoke in favor of
the City's support of the SBAC. Mr. Pickett stated that the SBAC is
a unique tool for the City of Auburn, improves quality of life, and
provides economic vitality and viability.

COUNCIL COMMITTEE REPORTS

A. Municipal Services
Chair Singer reported that the Municipal Services Committee met
this evening at 5:00. The Committee discussed and recommends
approval of Resolution No. 3628 and Ordinance No. 5787. The
Committee also met with King County representatives regarding a
proposed interlocal agreement relating to taxi regulations. The next
regular meeting of the Municipal Services Committee is scheduled
for August 18, 2003 at 5:00 PM.
Planninq & Community Development
Vice Chair Singer reported that the Planning and Community
Development Committee met July 28, 2003 at 5:00 PM. The
Committee discussed Comprehensive Plan amendments and
received correspondence from the City of Pacific related to their
comprehensive plan amendments for a future Sound Transit
Station and correspondence from the Auburn School District
related to school impact fees. The Committee also discussed
building height requirements in C-1 zones and the purchase by a
non-profit group of property located at 12th and "R" Streets NE.
The next regular meeting of the Planning and Community
Development Committee is scheduled for August 11, 2003 at 5:00
PM.
Public Works
Chair Wagner reported that the Public Works Committee met July
28, 2003 at 3:30 PM. The Committee discussed Right-of-way Use
Permits, contract administration items, and Ordinance No. 5784.
The Committee also discussed dry wells in southeast Auburn. The
next regular meeting of the Public Works Committee is scheduled
for August 11, 2003 at 5:30 PM.

IV.
Finance
Chair Poe reported that the Finance Committee met this evening at
6:30. The Committee discussed and recommends approval of
claims and payroll vouchers and the Business Enterprise Center
allocation. The Committee also discussed and amended
Ordinance No. 5779. The next regular meeting of the Finance
Committee is scheduled for August 18, 2003 at 6:30 PM.
COUNCILMEMBER REPORTS
At this time Councilmembers may report on items not specifically
described on the agenda, which are of interest to the community.
Councilmember Cerino reported that he and Councilmember Wagner met
with representatives from the State Drinking Water Council, King County
Health Department, and the State Environmental Agency regarding the
well failures in southeast Auburn. Councilmember Cerino reported that
the State Environmental Agency will initiate meetings to discuss possible
solutions with regard to well failures.
Mayor Lewis reported that the City is closely monitoring wells and the
failure of wells. An emergency occurred last week in south Auburn related
to the dropping level in one of the main wells in the Lakeland area. Under
the guidance of the Public Works Department, Lakeland residents began
voluntary conservation efforts. Water was transferred to the well from the
Bonney Lake system under the Emergency Fire Flow Protection
Agreement. The City was able to rest the well through the weekend and
the level of the well has begun to rise. Conservation information and
phone numbers can be found on the City's website. Mayor Lewis
commended the efforts of the Public Works and Maintenance and
Operations employees who distributed over nine-hundred flyers door-to-
door on Friday evening.
Mayor Lewis commended the Business Enterprise Center and
acknowledged the positive impacts their efforts have had on the City of
Auburn.

An Ordinance of the City of Auburn, Washington, creating a
new Chapter 3.94 of the Auburn City Code relating to multi-
family property tax exemption
Councilmember Poe moved and Councilmember Backus
seconded to introduce and adopt Ordinance No. 5779 as
amended and distributed prior to the Council meeting.
Councilmember Poe noted that the amendments were as
follows:
Section 3.94.060(E) - The initial application fee was
increased from $150 to $1000.
Section 3.94.080(B) - The amendment application fee was
increased from $150 to $500.
Section 3.94.090(^) - The extension fee was increased from
$150 to $500.
Section 3.94.100(^.1) was amended to read as follows:
An audited statement of expenditures made with respect to
each multifamily housing unit and the total expenditures
made with respect to the entire property, including total
project costs, which statement shall be approved by the City
of Auburn Finance Director.
Councilmember Wagner expressed his desire with regard to
establishing Smart Codes in the City of Auburn to encourage
redevelopment of existing buildings in the downtown area.

Discussion followed regarding owner occupancy, land
exemptions, equitable distribution of costs, and Smart
Codes.
Mayor Lewis referred the subject of the development of
Smart Codes in the City of Auburn to the Planning and
Community Development Committee and requested the
involvement of the Auburn Downtown Association relating to
the development of Smart Codes.
Councilmember Singer encouraged Council to identify
historically significant structures in the downtown area and
also to identify incentives to keep them intact.

Councilmember Singer noted the following amendment to
page three, last sentence, made in the Municipal Services
Committee meeting this evening:

Resolution No. 3628

A Resolution of the City Council of the City of Auburn,
Washington, authorizing the Auburn City Council to accept
grant funds in the amount of Four Hundred Forty-five
Thousand Two Hundred Forty-two Dollars ($445,242.00)
from the U.S. Department of Transportation Federal Aviation
Administration, which grant requires a ten percent
contribution from the City, to fund the rehabilitation of
Runway 16/34 and construction of Runway 16 Holding
Apron (Phase I), and authorizing the execution of the grant
agreement
Councilmember Singer moved and Councilmember Wagner
seconded to adopt Resolution No. 3628.

MAYOR'S REPORT
Executive Session
Mayor Lewis recessed the meeting to executive session at 8:35 PM
for approximately fifteen minutes to discuss land acquisition.
At 8:50 PM Mayor Lewis reconvened the regular meeting.

There being no further business to come before the Council, the meeting
adjourned at 8:50 PM.
