Lewis called the meeting to order at 7:30 p.m. and led those in attendance in the Pledge of Allegiance. Roll Call Mayor Lewis and the following Councilmembers were present: Sue Singer, Gene Cerino, Bill Peloza, Roger Thordarson and Lynn Norman. Councilmembers Rich Wagner and Nancy Backus were excused. Staff members present included: Planning and Community Development Director Paul Krauss, Employee Relations and Compensation Manager John Fletcher, Acting Fire Chief Russ Vandver, Finance Director Shelley Coleman, City Attorney Daniel B. Heid, Municipal Court Judge Patrick Burns, Parks and Recreation Director Daryl Faber, Police Chief Jim Kelly, Public Works Director Dennis Dowdy, and City Clerk Danielle Daskam. C. Announcements and Appointments 1. Announcements a) The Honorable Patrick Burns presented the Auburn Municipal Court's 2003 State of the Court. Judge Burns noted that case filings continue to increase. In 2003, 13,046 cases were filed compared to 12,916 in 2002. On average, 95 hearings are held each day in the municipal court. Judge Burns also expounded on the court's alternatives to incarceration programs such as the treatment and release program and the electronic Page City of Auburn Council Meetinq Minutes February 2, 2004 II. home monitoring program, which reduce incarceration costs but at the same time increase offender accountability. Judge Burns also noted that the construction of the new court and police building at 340 East Main Street has been a boost for the court and probation staff. The new facility will improve court and probation services and allow additional alternatives to incarceration that cannot be provided now. Additional resources allocated to the court's budget this year, will enable court staff to advance its fine collection procedures. Judge Burns thanked the Mayor and City Council for their continued support. 2. Appointments a) Airport Advisory Board City Council to confirm the appointment of Robert Pautz to fill an unexpired five-year term that will expire on December 31,2006. Councilmember Singer moved and Councilmember Cerino seconded to confirm the appointment. MOTION CARRIED UNANIMOUSLY. 5-0, Agenda Modifications Resolution No. 3685 was added to the agenda under Item VIII.B.8 of these minutes. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A= Public Hearings No public hearing was scheduled. Audience Participation This is the place on the agenda where the public is invited to speak to the City Council on any issue. Rollyn Kidd, 210 13th Street SE, Auburn Page 2 City of Auburn Council Meetinq Minutes February 2, 2004 Mr. Kidd spoke regarding the regulation of motorized scooters. Mr. Kidd was referred to Police Chief Kelly for statutes that could apply to the enforcement of motorized scooters. Anita Cratty, 1835 26th Avenue, Seattle Ms. Cratty spoke regarding the City's proposed Fritz's Law regarding regulation of dangerous dogs. Ms. Cratty opposes breed specific legislation and proposed that the City enforce existing animal control regulations and other nuisance regulations that maintain control over dogs and hold owners responsible for dangerous dogs. She suggested that dogs be classified as dangerous based on their behavior, temperament and each dog's own history, rather than its breed alone. Mayor Lewis and Councilmember Cerino explained that the Municipal Services Committee is currently reviewing options for implementing a dangerous dog ordinance that would make owners responsible for the actions of their pets. The Committee is reviewing sample ordinances from across the state and country, applicable state law, and suggestions from citizens. Councilmember Cerino anticipates the Council Committee to review materials over the next two months and then present a final proposed ordinance to the full Council. Kay Ferrell, 4325 South 239th Place, Kent Ms. Ferrell identified herself as a pet care provider. She spoke in favor of holding owners responsible for the treatment and actions of their pets. She expressed opposition to punishment of pets because of irresponsible owners. Miss Rydeski, 1025 W Main Street, Auburn Ms. Rydeski spoke briefly regarding animal control. Navdeep Walia, 1504 28th Street SE, Auburn Mr. Walia presented his written comments and spoke regarding regulation of specific dog breeds. Mr. Walia expressed opposition to implementation of breed specific legislation. Michelle Aulis, 4248 A Street SE #325, Auburn Ms. Aulis briefly spoke regarding regulation of pit bulls in the City of Auburn and displayed photographs of her pets, two pit bull terriers. Jesse Pettiford, 5 J Street SE, Auburn Page 3 City of Auburn Council Meetinq Minutes February 2, 2004 Mr. Pettiford presented his written comments and spoke regarding the history of pit bull terriers. He suggested community programs to promote responsible pet ownership. He expressed opposition to breed specific legislation. Jennifer Anderson, 11356 SE 298th Place, Auburn Ms. Anderson expressed opposition to breed specific legislation. She is the owner of two pit bull terriers and one foster pit bull terrier. Virginia Haugen, 2503 R Street SE, Auburn Ms. Haugen spoke regarding dog attacks in her neighborhood and pedestrian safety. Nikki Hodqes, 32010 162nd Avenue SE, Auburn Ms. Hodges presented her written comments and testified to the temperament of her adopted pit bull terrier. Connie Gohl, 37620 188th Avenue SE, Auburn Ms. Gohl identified herself as a licensed veterinarian technician. She expressed opposition to breed specific legislation. She argued that bad dogs come in all breeds. She spoke in favor of making owners responsible for the actions of their pets. Frank Rice, 1811 F Street SE, Auburn Mr. Rice spoke in favor of general language to regulate dangerous dogs and other dangerous species. Viri.qnia Hau.qen, 2503 R Street SE, Auburn Ms. Haugen spoke regarding the proposed street vacation in the vicinity of 4th Street SE. Navdeed Walia Mr. Walia inquired regarding the proposed dangerous dog legislation. Mayor Lewis responded that the Municipal Services Committee is studying several options for implementing a dangerous dog ordinance. Councilmember Cerino added that police dogs will be exempt from any proposed dangerous dog legislation. Correspondence No correspondence was been received. Municipal Services Chair Cerino reported the Municipal Services Committee met this evening at 5:00. The Committee discussed the Auburn Police Department accomplishments for 2003 and goals for 2004, the remodel of Fire Station 31, state guidelines for gas-powered scooters, and dangerous dog regulations. The next regular meeting of the Municipal Services Committee is scheduled for February 17, 2004 at 5:00 p.m. Planning & Community Development Vice Chair Norman reported the Planning and Community Development Committee met January 26th. The Committee recommended Council approval of Ordinance No. 5802, which appears later on this evening's agenda. The Committee also received information on the storm water monitoring and inspection program, the city's response to King County's proposed comprehensive plan amendments, the Northeast Auburn Special Plan Area, outdoor storage in the M-1 zoning district, and the Les Gove water spray pool. City of Kent also presented information on their one-stop human services center. The next regular meeting of the Planning and Community Development Committee is scheduled for February 9, 2004 at 5:00 p.m. Public Works Vice Chair Cerino reported the Public Works Committee met January 26th. The Committee reviewed and recommended approval of two interlocal agreements with Lakehaven Utility District (Resolution Nos. 3650 and 3652) and resolutions setting the date for public hearings on petitions for vacation (Resolution Nos. 3677, 3678, and 3679). The Committee also discussed B Street NE parking options and the capital project status report. The next regular meeting of the Public Works Committee is scheduled for February 9, 2004 at 5:30 p.m. Finance Vice Chair Norman reported the Finance Committee met this evening at 6:30. The Committee recommended approval of consent items and Resolution No. 3685. The Committee discussed the Fire Station 31 remodel project and received a sales tax summary for January. The next regular meeting of the Finance Committee is scheduled for February 17, 2004 at 6:30 p.m. Page 5 City of Auburn Council Meetinq Minutes February 2~ 2004 IV. COUNCILMEMBER REPORTS At this time Councilmembers may report on items not specifically described on the agenda, which are of interest to the community. Mayor Pro Tem Singer reported that she and Mayor Lewis attended the January 21st forum of elected officials to discuss human services, particularly Iow income housing in South King County. Mayor Pro Tern Singer also reported on the January 22nd Puget Sound Regional Council Executive Committee meeting where discussion centered on transportation issues and a report on noise mitigation between the Port of Seattle and Highline School District related to the third runway project. Mayor Pro Tern Singer announced that she would be accompanying the new members of the Council at the Association of Washington Cities' new Councilmember conference in Lacey on Friday. Councilmember Peloza reported on the January 22nd presentation by Public Works staff on equipment rental, water, sanitary sewer, storm drainage, transportation and support services programs. Councilmember Peloza also reported on the January 28th Association of Washington Cities Legislative Conference and the January 29th planning workshop presented by Planning Department staff. Councilmember Thordarson reported on the Association of Washington Cities Legislative Conference on January 28 including a session on transportation issues. Mayor Lewis reported on a recent Suburban Cities Association meeting. He announced Councilmember Peloza's appointment to the King County Water Quality Committee, Councilmember Thordarson's appointment to the King County Regional Transit Committee, Councilmember Norman's appointment to the Puget Sound Regional Council Growth Manameent Policy Committee, Mayor Pro Tem Singer's appointment to the Puget Sound Regional Council Executive Board, and Mayor Lewis's appointment to the Regional Policy Committee and the Puget Sound Regional Council Economic Development District Policy Board. Also, Councilmember Cerino is the City's representative on the Pierce County Review Committee. Mayor Lewis reported on his recent testimony before the state legislature on such issues as funding for improvements to State Highway 164, HOT lanes on State Highway 167, and streamlined sales tax. Mayor Lewis announced that Miss Kristine True was crowned the new Miss Auburn on Saturday night. Page 6 City of Auburn Council Meeting Minutes February 2~ 2004 VI, VII, VIII. Mayor Lewis acknowledged the receipt of a letter from the City of Bonney Lake expressing gratitude for the actions of off-duty Auburn Police Officer Arneson in apprehending two theft suspects on January 27, 2004 in Bonney Lake. CONSENT AGENDA All matters listed on the Consent Agenda are considered by the City Council to be routine and will be enacted by one motion in the form listed. A. MOTION CARRIED UNANIMOUSLY. 5-0. Resolutions Resolution No. 3650 A3.14 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor to execute a franchise agreement between Lakehaven Utility District and the City of Auburn, allowing the Lakehaven Utility District to connect install, operate, maintain and repair water system, facilities, and appurtenances in, over, along, across and under the franchise area for the purpose of providing water service Councilmember Cerino moved and Councilmember Singer seconded to adopt Resolution No. 3650. MOTION CARRIED UNANIMOUSLY. 5-0. Resolution No. 3652 O4.11 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor to execute an interlocal agreement establishing water service boundaries between the Lakehaven Utility District and the City of Auburn Councilmember Cerino moved and Councilmember Singer seconded to adopt Resolution No. 3652. Resolution No. 3678 O3.9 V-05-03 A Resolution of the City Council of the City of Auburn, Washington, fixing a time for a public hearing on the petition for vacation of a portion of right-of-way located south of 812 10th Street NE (Olympic Court Apartments), within the City of Auburn, Washington Councilmember Cerino moved and Councilmember Thordarson seconded to adopt Resolution No. 3678. Councilmember Cerino moved and Councilmember Thordarson seconded to adopt Resolution No. 3679. MOTION CARRIED UNANIMOUSLY. 5-0. Resolution No. 3684 F2.4.9 LID 250 A Resolution of the City of Auburn, Washington, fixing a time and place for hearing on the final assessment roll for Local Improvement District No. 250, and directing that notice thereof be given in the manner required by law Councilmember Norman moved and Councilmember Thordarson seconded to adopt Resolution No. 3684. MOTION CARRIED UNANIMOUSLY. 5-0. Resolution No. 3685 F4.3 A Resolution of the City Council of the City of Auburn, Washington, amending the City of Auburn Fee Schedule relating to building permit fees Councilmember Norman moved and Councilmember Thordarson seconded to adopt Resolution No. 3685. MOTION CARRIED UNANIMOUSLY. 5-0. MAYOR'S REPORT Executive Session Mayor Lewis recessed the meeting at 8:49 p.m. to executive session for approximately fifteen minutes for the purpose of discussing real property offer to purchase, pursuant to RCW 42.30.110(c).
