Lewis called the meeting to order at 7:30 p.m. and led those in attendance in the Pledge of Allegiance. Roll Call Mayor Lewis and the following Councilmembers were in attendance: Rich Wagner, Sue Singer, Gene Cerino, Nancy Backus, Bill Peloza, Roger Thordarson, and Lynn Norman. Staff members present included: City Attorney Daniel B. Announcements a) Proclamation - White Cane Days Mayor Lewis declared April 30, 2004 and May 1, 2004 as "White Cane Days" in the City of Auburn and presented the proclamation to Darrel Gordon, President of the Auburn Noon Lions Club. b) Proclamation - Healthy Kids Day Mayor Lewis declared April 24, 2004 as "Healthy Kids Day" in the City of Auburn and presented the proclamation to George Frasier, YMCA Branch Executive. Designation Parks and Recreation Director Daryl Fiber announced that the City of Auburn was recently designated as a Tree City, U.S.A. and presented Mayor Lewis with a plaque commemorating the City's designation as Tree City, U.S.A. e Appointments There were no appointments for Council consideration. D= Agenda Modifications Agenda modifications included an announcement regarding the City's designation as a Tree City, U.S.A. under Item I.C.l.c, correspondence transmitted under Items I1.C.1-4, and a revised Ordinance No. 5829 transmitted under Item VIII.A. 1. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings Closed Record Hearings The following is closed record hearing where any public testimony must be strictly limited to the issues involving the proposals and must also be limited to comments "on the record"..No new or additional evidence may be allowed. Application Number VAR04-0001 A3.23.1 City Council to conduct a closed record hearing on an appeal filed by Kenneth Knott on the Hearing Examiner's decision to deny his application for a variance to allow a six-foot fence in a required yard setback for property located at 1908 2nd Street SE. Utilizing an aerial map of the property, Planner Mitzi McMahan reviewed the applicant's appeal and variance request. The Hearing Examiner issued a decision on March 29, 2004 denying Mr. Knott's request for a variance finding that the applicant did not conform to variance approval criteria 1 through 6 and 8. Staff had recommended approval of the variance finding that: the applicant had satisfied all the criteria for a variance. Ms. McMahan reported that two neighbors voiced opposition to the variance. Page 2 City of Auburn Council Meeting Minutes April 19, 2004 C= In response to questions from Councilmember Thordarson, Ms. McMahan stated that the applicant wishes to increase the fence height to provide privacy and security for his swimming pool. Councilmembers Wagner and Peloza spoke regarding a letter of opposition from the applicant's neighbor related to the turning radius to and from her driveway and difficulties she might encounter if the fence height is increased. Mayor Lewis opened the closed record hearing. Ken Knott, 1908 2nd Street SE, Auburn Mr. Knott noted that a fence currently exists on his property. The request for a variance is to continue the fence line and increase the height of the fence. Mr. Knott spoke in favor of his appeal for a variance to allow a six-foot fence on his property. Mayor Lewis closed the closed record hearing. Councilmember Singer moved and Councilmember Backus seconded to overturn the Hearing Examiner's decision and grant the variance application. MOTION CARRIED UNANIMOUSLY. 7-0. Audience Participation This is the place on the agenda where the public is invited to speak to the City Council on any issue. Heid read the definitions of potentially dangerous and dangerous dogs from Ordinance No. 5829. No fines or fees are imposed, nor is registration required related to potentially dangerous dogs. City Attorney Heid clarified that the current leash law provides for infraction penalties at the county level. Ordinance 5829 would provide local enforcement with regard to penalties and authority pertaining to dogs that are declared dangerous. (See Item VI/I.A. 1 of these minutes for discussion and action3 on this item.) Municipal Services Chair Cerino reported that the Municipal Services Comnr~ittee met this evening at 5:00 p.m. The Committee discussed and recommends approval of surplus property, Ordinance No. 5829, and Resolution No. 3717. The Committee also discussed the Reynolds property easement, proposed Ordinance No. 5841 related to parking enforcement, and the City Hall plaza. The next regular meeting of the Municipal Services Committee is scheduled for May 3, 2004 at 5:00 p.m. Planning & Community Development Chair Singer reported that the Planning & Community Development Committee met on April 12, 2004 at 5:00 p.m. The Committee held three public hearings, and discussed and recommends approval of a contract administration item, Ordinance Nos. 5839 and 5840, and Resolution Nos. 3706, 3708, 3709, 3712, 3715, 3716, 3718, and 3719. The Committee also discussed an adult use ordinance, pedestrian improvement contracts, the community center, vacant houses, downtown design requirements, Page 5 City of Auburn Council Meetin~l Minutes April 19, 2004 IV. and outdoor storage in M-1 zones. The next regular meeting of the Planning & Community Development Committee is scheduled for April 26, 2004 at 5:00 p.m. Public Works Chair Wagner reported that the Public Works Committee met on April 12, 2004 at 5:30 p.m. The Committee discussed right-of-way use permits, and recommends approval of contract administration items, Ordinance No. 5824, and Resolution No. 3713. The Committee also discussed policy for Main Street banners, parking on 62nd Street, school zones, crosswalk treatments, and pavement preservation. The next regular meeting of the Public Works Committee is scheduled for April 26, 2004 at 5:30 p.m. Do Finance Chair Backus reported that the Finance Committee met this evening at 6:30. The Committee discussed and recommends approval of claims and payroll vouchers, a contract administration item, and surplus property. The Committee also received 2004 first quarter reports and a report on a citywide cash receipting system. The next regular meeting of the Finance Committee is scheduled for May 3, 2004 at 6:30 p.rn. at Thomas Academy. COUNCILMEMBER REPORTS At this time Councilmembers may report on items not specifically described on the agenda, which are of interest to the community. Councilmember Peloza reported on his attendance at the April LEOFF Board meeting, the Metropolitan Water Pollution Abatement Advisory Committee, the Auburn Hazard Mitigation Planning meeting, a meeting on the role of an elected official in a large event like the attack on the Pentagon on 9/11, and the monthly King County Water Quality Committee meeting. Mayor Pro Tem Singer reported on her attendance at the Suburban Cities meeting, an Emergency Management meeting on the role of elected officials, a joint meeting of the Planning and Community Development Committee and the Human Services Committee, and a recent national roller skating championship event held in Auburn. Councilmember Cerino reported on his attendance at a meeting of the Pierce County Review Commission. Mayor Lewis reported on Arbor Day events including the City's 'rree City, USA designation and a tree planting anniversary celebration at Les Gove Park. Ordinances Ordinance No. 5829 O3.4.2.1.2 An Ordinance of the City of Auburn, Washington, creating a new Chapter 6.35 of the Auburn City Code related to dangerous dogs (Discussion and action on this Item occurred after Item II. C of these minutes.) Councilmember Singer requested Council consideration of Ordinance No. 5829. Councilmember Cerino noted that Ordinance No. 5829 provides for a rebuttal process in the event a dog is deemed dangerous. Councilmember Cerino also inquired regarding modifying the language under Section 6.35.010(0, paragraph three pertaining to dogs running free. City Attorney Heid recommended specificity with regard to the number of times a dog could be found running free and unrestrained before being deemed dangerous. Councilmember Wagner inquired regarding pollice discretion related to the citation process under Section 6.35.010(f). City Attorney Heid stated that police officers employ a measure of discretion when dealing with any law enforcement issue, which would include enforcement of Section 6.35.010(f) of Ordinance No. 5829. Ordinance No. 5829 also places the responsibility of responding to dogs running free and/or unrestrained with the City. The City has received numerous complaints regarding King County Animal Control's response time. Councilmember Cerino stressed that dogs would not be declared dangerous under specific criteria under Section 6.35.010(0, paragraph two, which includes but is not limited to exclusions for injuries sustained by a person who was committing a willful trespass or who was tormenting or abusing a dog at the time of injury. Councilmember Singer also expressed concerns related to the weight criteria and definitions in Ordinance No. 5829. Councilmember Cerino pointed out that Ordinance No. 5829 provides recourse and enforcement with regard to individuals who are not responsible dog owners. Councilmember Backus requested additional time to review audience comments made this evening. Councilmember Wagner spoke in opposition to imposing a weight specific ordinance. Councilmember Norman suggested requirements for education as part of the penalty for first time offenders. Councilmember Peloza moved and Councilmember Cerino seconded to introduce and adopt Ordinance No. 5829. Councilmember Wagner moved and Councilmember Peloza seconded to amend Ordinance No. 5829, Section 6.35.010 as follows: · Strike Section 6.35.010(1) · Strike the words "is a potentially dangerous dog, as defined in the Chapter, that" from Section 6.34.010(2)(d) · Strike the words "is a potentially dangerous dog, as defined in the Chapter, that" from Section 6.35.010(2)(e) Councilmember Thordarson spoke in favor of Ordinance No. 5829 as amended and stressed the need for enforcemerlt measures in Auburn. Councilmember Peloza read a statement related to the drafting of Ordinance No. 5829. Councilmember Peloza spoke in favor of Ordinance No. 5829 as amended. Councilmember Singer spoke in opposition to Ordinance No. 5829 as amended. Councilmember Singer moved and Councilmember Cerino seconded to table Ordinance No. 5829 and refer it to Committee. Ordinance No, 5840 03.8 REZ04-0002 An Ordinance of the City Council of the City of Auburn, Washington, providing for the rezoning of approximately 39 acres of property located at 1620 H Street NW within the City of Auburn, Washington, changing the zoning classification from M-1 (Light Industrial) to C-3 (Heavy Commercial) Councilmember Singer moved and Councilmember Norman seconded to introduce and adopt Ordinance No. 5840. Resolutions Resolution No. 3706 A3.16.7 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute a contract with Berryman & Henigar for building plans review services Councilmember Singer moved and Councilmernber Norman seconded to adopt Resolution No. 3706. Resolution No. 3709 O4.4.2 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute a Memorandum of Agreement for 2004 between the City of Auburn and Senior Services of Seattle/King County Nutrition Projects (SSS/KC) to provide a federally funded hot meal program for low-.income elderly citizens in the Auburn area Councilmember Singer moved and Councilmember Norman seconded to adopt Resolution No. 3709.
