Lewis called the meeting to order at 7:30 p.m. and led those in attendance in the Pledge of Allegiance. Roll Call Mayor Lewis and the following Councilmembers were in attendance: Rich Wagner, Sue Singer, Gene Cerino, Nancy Backus, Roger Thordarson, Bill Peloza, and Lynn Norman. Staff members present included: Human Resources/Risk Management Director Brenda Heineman, Fire Marshall Dave Smith, Parks and Recreation Director Daryl Faber, Planning and Community Development Director Paul Krauss, Police Chief Jim Kelly, Police Officer Matthew Wirt, Public Works Director Dennis Dowdy, Acting Fire Chief Russ Vandver, City Attorney Daniel B. Heid, Finance Director Shelley Coleman, City Clerk Danielle Daskam, and Deputy City Clerk Cathy Richardson. C. Announcements and Appointments 1. Announcements a) Proclamation - Mental Health Month Mayor Lewis declared the month of May, 2004 as "Mental Health Month" in the City of Auburn and presented the proclamation to Valley Cities Counseling and Consultation Development Director Pegi Moll. Ms. Moll thanked Mayor Lewis and Councilmembers for City of Auburn support of Valley Cities Counseling and Consultation. Page City of Auburn Council Meeting Minutes May 3, 2004 Appointments City Council to confirm the following appointments: a) Arts Commission The appointment of Amanda Flanery to fill an unexpired three-year term that will expire December 31,2005. The appointment of Peter Gallagher to fill an unexpired three-year term that will expire December 31, 2004. Councilmember Singer moved and Councilmember Wagner seconded to confirm the appointments of Amanda Flanery and Peter Gallagher to the Arts Commission. MOTION CARRIED UNANIMOUSLY. 7-0, b) Urban Tree Board The appointment of Trish Borden to a three-year term to expire on December 31,2007. Councilmember Singer moved and Councilmember Wagner seconded to confirm the appointment of Trish Borden to the Urban Tree Board. MOTION CARRIED UNANIMOUSLY. 7-0. The appointment of Garna Jones to a two-year term to expire December 31, 2006. The appointment of Michael Harbin, Sr. to a one-year term to expire December 31, 2005. Councilmember Singer moved and Councilmember Wagner seconded to confirm the appointments of Garna Jones and Michael Harbin, Sr. to the Urban Tree Board. MOTION CARRIED UNANIMOUSLY. 7-0. c) Civil Service Commission The reappointment of Charles A. Booth to a six-year term to expire December 31, 2009. Booth to the Civil Service Commission. MOTION CARRIED UNANIMOUSLY, 7-0. Agenda Modifications There was no agenda modification. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A= Public Hearings No public hearing was scheduled. Audience Participation This is the place on the agenda where the public is invited to speak to the City Council on any issue. Michael Grella, 20 - 49th St NE, Auburn, WA Thomas Academy Headmaster Grella welcomed Mayor Lewis and Counciimembers to the Thomas Academy. Shelly Erickson, 5421 Pearl Avenue, Auburn, WA Ms. Erickson spoke regarding the environmental review related to her business located on Howard Road. City Attorney Heid cautioned Ms. Erickson against speaking at the City Council meeting relating to her environmental review (SEPA). In the event of an appeal, Councilmembers could be called upon to act in a quasi-judicial capacity. City Attorney Heid recommended Ms. Erickson make an appointment with Planning and Community Development Director Krauss to discuss her SEPA review. Director Krauss stressed that, with regard to the SEPA determination, Ms. Erickson has the option of appealing the determination to the Hearing Examiner. Director Krauss urged Ms. Erickson to make an appointment to discuss her SEPA application with staff. Glen Bui, American Canine Foundation, 23969 NE State Route 3, Suite G-101, Belfair, WA Mr. Bui commended Mayor Lewis and Councilmembers for their work related to drafting Ordinance No. 5829. Mr. Bui stated that he Page 3 City of Auburn Council Meeting Minutes May 3, 2004 III. believes Ordinance No. 5829 should be used as a model to promote responsible dog ownership and he intends to present it at the next Washington State Legislature session. Jeff North, 5511 Academy Avenue SE, Auburn, WA Mr. North commended Mayor Lewis and Councilmembers for their efforts related to drafting Ordinance No. 5829. Vir,qinia Hau,qen, 2503 "R" Street SE, Auburn, WA Ms. Haugen distributed photographs of historic sites in Auburn for review by Mayor Lewis and Councilmembers. Ms. Haugen urged the preservation of historical buildings. Ms. Haugen also spoke regarding code compliance issues. Mayor Lewis pointed out that the City of Auburn has two code compliance officers for the entire city, making it difficult for them to be aware of every code violation. Mayor Lewis requested that Ms. Haugen report any information related to code violations to City of Auburn code compliance officers. Monica Pleason, 7511 23rd Avenue NVV, Seattle, WA Ms. Pleason stated that she is Secretary of the Cascade Northwest Mastiff Club. On behalf of the Club, Ms. Pleason thanked Mayor Lewis and Councilmembers for their careful consideration related to drafting Ordinance No. 5829 Correspondence No correspondence was received. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chair Cerino reported that the Municipal Services Committee met this evening at 5:00 p.m. The Committee discussed and recommends approval of surplus property items, Ordinance Nos. 5829 and 5841, and Resolution No. 3719. The Committee also discussed the Auburn Municipal Airport runway improvements project and related federal funding, and a parking proposal from Auburn Regional Medical Center. The next regular meeting of the Municipal Services Committee is scheduled for May 17, 2004 at 5:00 p.m. at Auburn City Hall. Page 4 City of Auburn Council Meeting Minutes May 3, 2004 IV, Planning & Community Development Chair Singer reported that the Planning and Community Development Committee met on April 26, 2004 at 5:00 p.m. The Committee discussed and recommends approval of Resolution No. 3723. The Committee took a tour and discussed renovation of the City Hall plaza, and also discussed downtown design standards, an ordinance related to adult uses, and Ordinance No. 5829. The next regular meeting of the Planning and Community Development Committee is scheduled for May 10, 2004 at 5:00 p.m. at Auburn City Hall. Public Works Chair Wagner reported that the Public Works Committee met on April 26, 2004 at 5:30 p.m. The Committee discussed and recommends approval of contract administration items, and Resolution Nos. 3720 and 3722. The Committee also discussed Auburn/Black Diamond Road shoulder improvements, utility code revisions, water system loss, and countywide applications for TEA- 21 funds. The next regular meeting of the Public Works Committee is scheduled for May 10, 2004 at 5:30 p.m. at Auburn City Hall. Finance Chair Backus reported that the Finance Committee met this evening at 6:30. The Committee discussed and recommends approval of claims and payroll vouchers, and surplus property items. The Committee also discussed a sample interfund bond ordinance for Local Improvement District 250, and 2003/2004 first quarter revenue and expenditure comparisons. The next regular meeting of the Finance Committee is scheduled for May 17, 2004 at 6:30 p.m. at Auburn City Hall. COUNCILMEMBER REPORTS At this time Councilmembers may report on items not specifically described on the agenda, which are of interest to the community. Councilmember Singer reported that she and Mayor Lewis met with the Chief Executive Officer of the Auburn Regional Medical Center. She and various Councilmembers also attended a DARE graduation at Pioneer Elementary, an Emergency Management Workshop for King County elected officials, a luncheon hosted by the Parks Commission, a student government class at Auburn High School, Cities and Schools Forum, and the Police Department Awards banquet. Councilmember Singer thanked staff members and department directors for their participation in the Council Retreat on April 30, 2004. Page 5 City of Auburn Council Meeting Minutes May 3~ 2004 Councilmember Thordarson reported that he attended the King County Regional Transit Committee meeting, Healthy Kids Day at the YMCA, a BRAVO! Production of "Eden", King County Committee of the Whole meeting, Mt Baker Reaching Out Fair, Cities and Schools Forum, and a tour of the MultiCare Adult Day Health facility. Mayor Lewis reported that he attended a fund raiser for the Boys and Girls Club in Auburn, the filming of King County Councilmember Julia Patterson related to the Olson Farm grants, Community Volunteer luncheon at the Auburn Senior Center, South King County Human Services Forum, Auburn Gymnastics Western Gymnastics Championship at Seahawk Exhibition Center, DARE graduation at Evergreen Heights Elementary, King Solomon Lodge - Masons Scholarships Banquet, Summer Youth Fair, Association of Washington Cities Streamlined Sales Tax (SST) committee meeting, Department of Revenue meeting related to SST, Jail Advisory Group tour of the Yakima Jail system, Cities and Schools Forum, Junior Fishing Derby at Millpond, and the Seventh Day Adventist Academy new girls dorm ground breaking. UNFINISHED BUSINESS Ordinance No. 5829 o3.4.2.1.2 An Ordinance of the City of Auburn, Washington, creating a new Chapter 6.35 of the Auburn City Code related to dangerous dogs (Ordinance No. 5829 was tabled at the Apdl 19, 2004 City Council meeting.) Councilmember Cerino moved and Councilmember Wagner seconded to remove Ordinance No. 5829 from the table. MOTION TO REMOVE ORDINANCE NO. 5829 FROM THE TABLE CARRIED UNANIMOUSLY. 7-0. Councilmember Cerino moved and Councilmember Wagner seconded to introduce and adopt Ordinance No. 5829. Councilmember Singer moved and Councilmember Thordarson seconded to denominate Ordinance No. 5829 as "Fritz's Law". Councilmember Cerino expressed disappointment regarding Section 6.35.020 of Ordinance No. 5829 related to the lack of a cautionary warning to owners of potentially dangerous dogs or dogs declared dangerous. Mayor Lewis thanked Councilmembers for their efforts related to drafting Ordinance No. 5829. MOTION TO APPROVE AMENDMENT TO ORDINANCE NO. 5829 CARRIED UNANIMOUSLY. 7-0. Councilmember Peloza read a statement related to the drafting of Ordinance No. 5829. Councilmember Peloza stressed that Ordinance No. 5829 provides protection for Auburn citizens regarding dangerous dogs and meaningful enforcement for irresponsible owners. Ordinances Ordinance No. 5841 01.2 An Ordinance of the City Council of the City of Auburn, Washington, amending Sections 10.36.205, 10.36255 and 10.36.360, of the Auburn City Code, relating to parking enforcement Councilmember Cerino moved and Councilmember Wagner seconded to introduce and adopt Ordinance No. 5841. MOTION CARRIED UNANIMOUSLY. 7-0. B. Resolutions Resolution No. 3719 A3.17 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute a one-year extension of the lease of property to King County Department of Public Health for the King County Paramedic Program Councilmember Cerino moved and Councilmember Wagner seconded to adopt Resolution No. 3719. MOTION CARRIED UNANIMOUSLY. 7-0. Resolution No. 3720 O4.6.1 PR C9056 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor to execute a Public Works Trust Fund Loan Agreement between the City of Auburn (the City) and the Public Works Board (the Board) for Project No. C9056, Auburn Way South Sewer, Phase B Councilmember Wagner moved and Councilmember Cerino seconded to adopt Resolution No. 3720. MOTION CARRIED UNANIMOUSLY. 7-0. Page 9 City of Auburn Council Meetinf:l Minutes May 3, 2004 IX. = Resolution No. 3722 03.9 VAC-07-03 A Resolution of the City Council of the City of Auburn, Washington, initiating street vacation proceedings and setting a public hearing to consider the vacation of an alleyway located south of 1st Street SW and west of South Division Street, within the City of Auburn, Washington Councilmember Wagner moved and Councilmember Cerino seconded to adopt Resolution No. 3722. MOTION CARRIED UNANIMOUSLY. 7-0. Resolution No. 3723 A3.16.7, O5.1.2 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and the City Clerk to execute an Agreement for Professional Services between the City of Auburn and Tetra Tech/KCM, Inc., for the purpose of developing a habitat restoration plan for Olson Creek and producing associated construction documents Councilmember Singer moved and Councilmember Norman seconded to adopt Resolution No. 3723. MOTION CARRIED UNANIMOUSLY. 7-0. MAYOR'S REPORT Executive Session No executive session was held. Mayor Lewis thanked Headmaster Grella and the Thomas Academy for hosting the City of Auburn City Council meeting this evening.
