CITY COUNCIL
MEETING MINUTES
AUGUST 16 ,2004 7:30 PM
I. CALL TO ORDER
A. Flag Salute
Mayor Peter B. Lewis called the meeting to order at 7:30 p.m. and
led those in attendance in the Pledge of Allegiance.
B. Roll Call
Mayor Lewis and the following Councilmembers were present:
Rich Wagner, Sue Singer, Gene Cerino, Nancy Backus, Bill
Peloza, Roger Thordarson, and Lynn Norman.
Staff members present included: Planning and Community
Development Director Paul Krauss, City Attorney Daniel B. Heid,
Transportation Planner Joe Welsh, Acting Assistant Fire Chief Mike
Gerber, Police Chief Jim Kelly, City Engineer Dennis Selle, Parks
and Recreation Director Daryl Faber, Risk Management/Human
Resources Director Brenda Heineman, and City Clerk Danielle
Daskam.

II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE

1. Vacation Application Number V-01-04

City Council to conduct a public hearing on the request to
vacate the north/south alleyway located north of First Street
NW, east of "A" Street NW, south of Second Street NW, and
west of North Division Street.
Transportation Planner Joe Welsh reviewed the request for
vacation of an alleyway, which primarily serves City of
Auburn Municipal Court and Police Department, and the
Auburn Regional Medical Center. The alleyway currently
contains water, sewer, and gas utilities, which serve the
Police Department, and an INet Information System
connection to City Hall, which serves the Police Department
and the Municipal Court. The vacation request contains the
ability to retain an easement for utilities, but the utilities may
be abandonable depending on the future use of the
property.
Councilmember Wagner inquired regarding responsibility for
relocation costs in the event the utilities are not
abandon able.
Mr. Welsh stated that the City retains the right to require that
costs associated with relocation of utilities be borne by those
causing the relocation.
Mayor Lewis opened the public hearing.
No one in the audience requested to speak.

B. Audience Participation
This is the place on the agenda where the public is invited to speak
to the City Council on any issue.

Mr. Poage spoke regarding Auburn City Code Section 18.56.070
related to the use and placement of signs such as yard sale, real
estate, and political signs.

Planning and Community Development Director Paul Krauss
explained that yard sale signs are not permitted on public property.
Political signs are allowed on public property during elections and
real estate open house signs can be placed on public right-of-way.
A new sign ordinance is under review related to allowing a-frame
signs in public right-of-way in the downtown business districts.
In response to questions from Mr. Poage related to yard sale signs,
Mayor Lewis invited Mr. Poage to attend the next Planning and
Community Development Committee and Planning Commission
meetings to discuss the proposed sign code.
Mr. Poage also spoke regarding parking in the downtown area and
cited a recent incident involving a police chase on "J" Street. Mr.
Poage expressed concern related to emergency access on narrow
streets when vehicles are parked on both sides of the street. Mr.
Poage suggested limiting parking to only one side of narrow
streets.
Mayor Lewis urged Mr. Poage to utilize the 911 system to report
hazardous situations. Mayor Lewis also suggested that Mr. Poage
speak with residents in the areas he referred to with regard to
parking restrictions.
Steve Nichols, 32516 58th Avenue South, Auburn
Mr. Nichols stated that he was in attendance to address any
questions from Council related to the annexation application on this
evening's agenda.
C. Correspondence
No correspondence was received.
III. COUNCIL COMMITTEE REPORTS

A. Municipal Services
Chair Cerino reported the Municipal Services Committee met this
evening at 5:00. The Committee discussed and recommends
approval of contract administration of Public Works Project No.
C321A. The Committee also discussed school speed zones,
received an update on the progress of the Justice Center
construction, and reviewed budgets for the Fire and Parks and
Recreation Departments, Mountain View Cemetery, and Auburn
Golf Course. The Committee also discussed the Auburn Golf
Course clubhouse and was asked to review cemetery burial fees.

The next regular meeting of the Municipal Services Committee is
scheduled for Tuesday, September 7,2004 at 5:00 p.m.
B. Planning & Community Development
Chair Singer reported that the Planning and Community
Development Committee met on August 9,2004 at 5:30 p.m. The
Committee discussed and recommends approval of Application No.
ANX04-0001, and contract administration items. The Committee
also discussed the Planning and Community Development
Department budget, zoning on "A" Street related to the
Comprehensive Plan, and the Terminal Park plan. The Committee
also received a report on the Auburn Golf Course clubhouse. The
next regular meeting of the Planning and Community Development
Committee is scheduled for August 23, 2004 at 5:00 p.m.
C. Public Works
Chair Wagner reported that the Public Works Committee met
August 9, 2004 at 5:30 p.m. The Committee discussed right-of-
way use permits, surplus equipment items, contract administration
items, the Lea Hill booster pump, annexation position paper
prepared by the Suburban Cities Association, and reviewed
budgets for arterial street fund, local street fund, and the general
fund for the Public Works Dèpartment. The Committee also
discussed the 2005-2010 Six Year Transportation Improvement
Program (TIP), and the speed limit on Emerald Downs Drive. The
next regular meeting of the Public Works Committee is scheduled
for Wednesday, August 18, 2004 at 5:30 p.m.
D. Finance
Chair Backus reported that the Finance Committee met this
evening at 6:30. The Committee discussed and recommends
approval of consent agenda items and Resolution No. 3757. The
Committee also reviewed Mayor/Council and Legal Department
budgets. The next regular meeting of the Finance Committee is
scheduled for Tuesday, September 7,2004 at 6:30 p.m.
IV. COUNCILMEMBER REPORTS
At this time Councilmembers may report on items not specifically
described on the agenda, which are of interest to the community.
Councilmember Singer reported on the special City Council meeting held
August 9, 2004, where the Council discussed planning for bicycle routes
in the City with David Hiller of the Cascade Bicycle Club. Councilmember

Singer also reported on her attendance at a Muckleshoot Tribe reception
held at the White River Amphitheater on August 15th.
Councilmember Backus reported on her participation in the Auburn Good
01' Days activities and at the City's booth for the "Save Our Streets"
program. Councilmember Backus also reported on her attendance at a

August 15th.
Councilmember Wagner reported on his participation at the City's booth
for the "Save Our Streets" program during the Auburn Good 01' Days
weekend. Councilmember Wagner reported that many of the citizens he
spoke to about the street program are in favor of a dedicated fund for
street repair and improvements. Councilmember Wagner also reported
on his attendance at a Muckleshoot Tribe reception held at the White
River Amphitheater on August 15th.
Councilmember Cerino reported on his participation at the City's booth for
the "Save Our Streets" program. He found that many of the citizens he
spoke to about the street program were unaware that the City is solely
responsible for the construction and maintenance of 85 miles of local
streets.
Councilmember Thordarson reported on his participation in the "Save Our
Streets" booth during Auburn Good 01' Days. He reported that it was a
good opportunity to answer questions on many City issues, including the
non-motorized transportation plan. The feedback he received from the
citizens was very positive. Councilmember Thordarson also reported on
his attendance at the Muckleshoot Tribe reception held at the
amphitheater on August 15th.
Councilmember Peloza reported he attended the monthly Law
Enforcement Officers and Fire Fighters Disability Board meeting this
month, the White River Valley Museum open house featuring artwork by
Steve LePenske, and a WRIA 9 meeting which focused on riparian areas
and natural vegetation and promoting an "adopt a river" program.
Councilmember Peloza also reported on his attendance at the Auburn
Good 01' Days activities and the August 15 Muckleshoot Tribe reception.
Mayor Lewis reported on Auburn Good 01' Days events and commended
the volunteers who organize the annual weekend event. Mayor Lewis
reported that the City received a letter from King County Executive Sims
responding to the City's proposal regarding annexation efforts and
possible bonding by the County to accomplish repairs to the infrastructure

in the potential annexation areas. Mayor Lewis also reported on a recent
meeting of the South King County Human Services Forum which is
focusing on human service needs in South King County that are not
already being funded by south county cities. Mayor Lewis reported that a
meeting of the South County Area Transportation Board will be held
tomorrow to discuss transportation funding and a potential advisory ballot
for the Regional Transportation Improvement District.

Agenda and approve the Consent Agenda.

VI. UNFINISHED BUSINESS
Councilmember Norman recused herself from consideration of the
following item related to the Small Business Assistance Center and left
the Council Chambers at this time.

City Council to continue partial rent payment for the Business
Enterprise Center for the period of September 2004 through August
2005 in the amount of $2,000 per month for a total of $24,000.
Councilmember Singer moved and Councilmember Wagner
seconded to continue partial rent payment for the Business
Enterprise Center.
MOTION CARRIED. 6-0.
Councilmember Norman returned to the Council dais at this time.
VII. NEW BUSINESS
A. Annexation Application No. ANX04-0001

City Council to consider the request of Steve Nichols on behalf of
12 property owners to start the annexation process on several
parcels of King County property located west of the current City
limits, west of 59th Avenue South.
Councilmember Singer moved and Councilmember Norman
seconded to authorize the circulation of a 60% petition for
Annexation Application No. ANX04-0001.
MOTION CARRIED UNANIMOUSLY. 7-0.

IX. MAYOR'S REPORT
A. Executive Session
Mayor Lewis recessed the meeting to executive session at 8: 13
p.m. for approximately thirty minutes to discuss pending and
potential litigation.
Mayor Lewis reconvened the regular meeting at 8:39 p.m.

There being no further business to come before the Council, the meeting
