Flag Salute Mayor Pro Tem Singer called the meeting to order at 7:30 p.m. in the Council Chambers of Auburn City Hall and led those in attendance in the Pledge of Allegiance. B. Roll Call Mayor Pro Tem Singer and the following Councilmembers were present: Rich Wagner, Gene Cerino, Nancy Backus, Bill Peloza, Roger Thordarson and Lynn Norman. Staff members present included: Planning and Community Development Director Paul Krauss, Employee Relations and Compensation Manager John Fletcher, Information Services Director Lorrie Rempher, City Attorney Daniel B. Heid, Police Chief Jim Kelly, Fire Chief Russ Vandver, Parks and Recreation Director Daryl Faber, Public Works Director Dennis Dowdy, Finance Director Shelley Coleman, Planner Bill Mandeville, and City Clerk Danielle Daskam. C. Announcements and Appointments 1. Announcements Mayor Pro Tem Singer announced that Mayor Lewis is in Japan representing the City of Auburn as part of the City's Sister City Program. 2. Agenda Modifications Mayor Pro Tem Singer announced that Resolution No. 3831 relating to the 2005 Parks, Recreation and Open Space Plan is withdrawn from this evening's agenda. The Resolution will be included as part of the May 2, 2005 Council agenda. II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings 1. Local Law Enforcement Justice Assistance Grant F5.4.1 The City of Auburn's application for funding under the Department of Justice Local Law Enforcement Justice Assistance Grant (JAG) Program has been approved in the amount of $40,402 for the purpose of reducing crime and improving public safety. The City of Auburn proposes to utilize the grant to pay overtime costs for police officers engaged in community policing activities. Special conditions of the grant award require the City to encourage participation regarding the proposed use of the grant. Mayor Pro Tem Singer opened the public hearing on the Local Law Enforcement Justice Assistance Grant. There being no one from the audience requesting to speak regarding the grant, Mayor Pro Tem Singer closed the hearing. B. Audience Participation This is the place on the agenda where the public is invited to speak to the City Council on any issue. There was no audience participation. C. Correspondence No correspondence was submitted for Council review. III. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chair Cerino reported that the Municipal Services Committee met this evening at 5:00. The Committee recommended approval of Resolution No. 3854 expressing support for the maintenance and operation of Fort Lewis and McChord Air Force Base. The Page 2 City of Auburn Council Meetina Minutes April 18. 2005 committee also received an update on the golf course clubhouse plans and discussed Auburn City Code Chapter 5.90 relating to condominium conversion, school zone speed limits, cemetery improvements, and the Committee's project matrix. The next regular meeting of the Municipal Services Committee is scheduled for May 2, 2005. B. Planning & Community Development Chair Norman reported the Planning and Community Development Committee met April 11, 2005. The Committee discussed the Critical Areas Ordinance, including buffer zone issues, and home occupation regulations. The next regular meeting of the Planning and Community Development Committee is scheduled for April 25, 2005 at 5:00 p.m. C. Public Works Chair Wagner reported the Public Works Committee met April 11, 2005. The Committee discussed and recommended approval of several contract administration and traffic control items that appear on this evening's Council agenda. The Committee also recommended approval of Resolutions 3851, 3852, and 3853 approving Local Agency Agreements with the Washington State Department of Transportation, Resolution No. 3848 approving an interlocal agreement with the City of Pacific relating to the railroad pedestrian underpass project, and Ordinance No. 5910 authorizing condemnation proceedings for property necessary for the 3rd and Cross Streets improvements. The Committee also received a status report on the new utility billing system and the Auburn Cares Program. The next regular meeting of the Public Works Committee is scheduled for April 25, 2005. D. Finance Chair Backus reported the Finance Committee met this evening at 6:30 p.m. The Committee discussed and recommended approval of claims and payroll vouchers and Ordinance No. 5914 regarding authority of the Mayor. The City Attorney was also asked to investigate the current city code with regard to gender references. The Committee received an update on the utility billing system conversion and plans to convert billing from bi-monthly to monthly beginning the first quarter of 2006. The Committee also discussed Resolution No. 3854 supporting the continued maintenance and operation of Fort Lewis and McChord Air Force Base. Chair Backus announced that Finance Director Coleman and the Finance Department staff have been awarded the Government Finance Page 3 City of Auburn Council Meetina Minutes April 18. 2005 Officers Association's Certificate of Excellence Award for financial reporting. This is the fifteenth consecutive year the Finance Department has received the award. The next regular meeting of the Finance Committee is scheduled for May 2, 2005 at 6:30 p.m. E. Committee on Committees The minutes of the April 4, 2005 Committee on Committees meeting were transmitted to the Council. IV. COUNCILMEMBER REPORTS At this time Councilmembers may report on items not specifically described on the agenda, which are of interest to the community. Councilmember Backus reported that she attended the grand re-opening of the Travelodge Suites and Hotel located at 9 16th Street NW, the Northwest skating competition held at the Skate Connection in Auburn, the Police Officers' Association Annual Banquet, and the press conference where Representative Adam Smith announced his support for a federal allocation of $1 million for the valley cities' wireless internet system project. Councilmember Thordarson reported on a meeting with a news reporter from the Minneapolis newspaper, Star Tribune, and Economic Development Manager Ryan regarding the Auburn Transit Station. The reporter was interested in learning about economic development stimulated by the Transit Center. Councilmember Thordarson also attended the groundbreaking ceremony for Project Ace, a Suburban Cities Association meeting, the Travelodge Suites grand re-opening and the Auburn Police Association's annual banquet. Councilmember Peloza reported on his attendance at the Project Ace ground breaking ceremony, the Metropolitan Solid Waste Management Advisory Committee meeting where discussion centered on solid waste disposal alternatives, the City's Arbor Day celebration at Les Gove Park, a King County Regional Water Quality Committee meeting, the Suburban Cities Association meeting, the memorial service for the late Gertie Sprenger who was a long-time member of the arts community, a Water Resource Inventory Association (WRIA) 9 steering committee meeting, and the Auburn Police Officers' Association annual banquet. Councilmember Wagner reported that he and Mayor Lewis, Councilmember Thordarson, and Director Dowdy visited several area cities to observe examples of paving projects similar to projects that will Page 4 City of Auburn Council Meetina Minutes April 18. 2005 be part of the Save Our Streets program. Councilmember Wagner also attended the recent Suburban Cities Association meeting. Mayor Pro Tem Singer reported she attended a Lodging Tax Advisory Committee meeting and attended the King County Mayors' meeting on behalf of Mayor Lewis. Mayor Pro Tem Singer announced that Representative Adam Smith reported during the recent Auburn Chamber of Commerce luncheon that there will be a major remodel of the Auburn Post Office in the near future. V. CONSENT AGENDA All matters listed on the Consent Agenda are considered by the City Council to be routine and will be enacted by one motion in the form listed. A. Minutes 1. Claims Claims check numbers 340199 through 340631 in the amount of $2,710,568.37 and dated April 18, 2005. 2. Payroll Payroll check numbers 511877 to 512027 in the amount of $652,053.57 and electronic deposit transmissions in the amount of $970,438.21 for a grand total of $1 ,622,491.78 for the pay period covering March 30, 2005 to April 13, 2005. C. Contract Administration 1. Public Works Project Number MS 781 04.9.1 MS 781 City Council approve Change Order #1 in the amount of $6,490 to Contract 04-18 with Signal Electric for work on Project Number MS 781, 2004 Traffic Signal Safety Improvements. Lakeland Hills Way and Mill Pond Drive 04.10 City Council approve an all-way stop control at Lakeland Hills Way and Mill Pond Drive. 2. 53'd Street SE and Randall Avenue 04.10 City Council approve an all-way stop control at 53rd Street SE and Randall Avenue. Council member Wagner moved and Council member Cerino seconded to approve the Consent Agenda. MOTION CARRIED UNANIMOUSLY. 7-0. VI. UNFINISHED BUSINESS There was no unfinished business. VII. NEW BUSINESS There was no new business. VIII. ORDINANCES AND RESOLUTIONS A. Ordinances 1. Ordinance No. 5909 03.10.1 CUP05-0001 An Ordinance of the City of Auburn, King County, Washington, approving the issuance of a Conditional Use Permit to allow a drive-through espresso stand with two drive-through windows and a walk-up window at 802 14th Street Northeast in Auburn, Washington Councilmember Norman moved and Councilmember Cerino seconded to introduce and adopt Ordinance No. 5909. Councilmember Wagner inquired regarding 14th Street access onto Harvey Road. He questioned whether the c- curbing should be extended to limit exits to right turns only. Director Dowdy and City Attorney Heid indicated that the City can install the c-curbing if it is found to be warranted. Councilmember Wagner requested that the issue of the c- curbing and traffic configuration be forwarded to the Public Works Committee for review. Councilmember Norman stated that with the proposed reconfiguration of I street NE, there may be a need to eliminate left turns from 14th Street NE. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Ordinance No. 5910 04.9.1 PR C1006, A3.13.14 An Ordinance of the City Council of the City of Auburn, Washington, declaring public use and necessity regarding the City of Auburn Project No. C1006, 3rd and Cross Street Road Improvements, and authorizing condemnation Councilmember Wagner moved and Councilmember Thordarson seconded to introduce and adopt Ordinance No. 5910. MOTION CARRIED UNANIMOUSLY. 7-0. 3. Resolution No. 3845 03.1 ANX04-0002 A Resolution of the City Council of the City of Auburn, Washington, accepting the sixty percent petition to annex certain property located in Pierce County adjacent to the City's southern boundary and setting a public hearing therefor Councilmember Norman moved and Councilmember Cerino seconded to adopt Resolution No. 3845. Resolution No. 3846 03.1 ANX05-0001 A Resolution of the City Council of the City of Auburn, Washington, accepting the sixty percent petition to annex certain property located in King County adjacent to the City's eastern boundary and setting a public hearing therefor Councilmember Norman moved and Councilmember Cerino seconded to adopt Resolution No. 3846. MOTION CARRIED UNANIMOUSLY. 7-0. 4. MOTION CARRIED UNANIMOUSLY. 7-0. 6. Resolution No. 3852 04.9.1 PR C207 A, F5.4.9 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute a Local Agency Agreement between the City of Auburn (the City) and Washington State Department of Transportation relating to Project No. C207A, A Street NW Extension Councilmember Wagner moved and Councilmember Thordarson seconded to adopt Resolution No. 3852. Resolution No. 3853 04.9.1 PR c501A, 03.4.1.1, F5.4.9 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute a Local Agency Agreement between the City of Auburn (the City) and Washington State Department of Transportation relating to Project No. C501A, Urban Center Transportation Improvements Councilmember Wagner moved and Councilmember Thordarson seconded to adopt Resolution No. 3853.
