MEETING MINUTES
May 16, 2005 7:30 PM
I. CALL TO ORDER
A. Flag Salute
Mayor Peter B. Lewis called the meeting to order at 7:30 p.m. and
led those in attendance in the Pledge of Allegiance.
B. Roll Call
Mayor Lewis and the following Councilmembers were present:
Rich Wagner, Sue Singer, Gene Cerino, Nancy Backus, Bill
Peloza, Roger Thordarson, and Lynn Norman.
Staff members present included: Parks and Recreation Director
Daryl Faber, Human Resources/Risk Management Director Brenda
Heineman, Fire Chief Russ Vandver, Police Chief Jim Kelly,
Information Services Director Lorrie Rempher, Finance Director
Shelley Coleman, Public Works Director Dennis Dowdy, Assistant
City Attorney Joseph Beck, Planning and Community Development

b) Transportation Plan Cover Design Contest
Mayor Lewis announced the finalists for the
Transportation Plan Cover Design Contest.
The City of Auburn held a contest, open to all high
school students in Auburn to design the new cover for
the Comprehensive Transportation Plan. Ten

students from Auburn High School's Visual
Communications class submitted entries. Three
finalists were selected among the contestants: Heidi
Hohn, Lisa Worden, and Alyson Thieman. The City
Council voted and selected Lisa Worden's entry as
the winner. Her work will cover the new plan, which is
expected to be adopted in late 2005.
c) Proclamation - "National Police Week and
National Peace Officer Memorial Day"
Mayor Lewis declared the week of May 15-21, 2005
as National Police Week in the City of Auburn and
May 15 as National Police Officer Memorial Day in
recognition of the outstanding service and dedication
of the members of the Auburn Police Department.
Mayor Lewis presented the proclamation to Police
Chief Jim Kelly who spoke briefly about the Auburn
Citizens Police Academy and the police volunteer
program.
d) Proclamation - "Auburn Extreme Sports Day"
Mayor Lewis declared June 4, 2005 as Auburn
Extreme Sports Day. Mayor Lewis read and
presented the proclamation to Councilmember (and
Optimist Club member) Roger Thordarson.
Councilmember Thordarson explained that the
emphasis of the event is to promote the use of
bicycle safety helmets.
2. Appointments
There were no appointments for Council consideration.
D. Agenda Modifications
A revised Ordinance No. 5915 was distributed to the Council prior
to meeting.
II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE
A. Public Hearings
No public hearing was scheduled for this evening.
B. Audience Participation
This is the place on the agenda where the public is invited to speak
to the City Council on any issue.

Frank Rice, 1811 F Street SE #2, Auburn
Mr. Rice spoke regarding school zone speed limits. He
commended the Municipal Services Committee for reconsidering
the issue and recommending the elimination of the 24-hour school
zone speed limit. Mr. Rice advocated the installation of
electronically controlled signs to alert drivers of the school zone
speed limit.
Kevin Crossen, 2909 44th Street NE, Tacoma, WA 98402
Mr. Crossen identified himself as the owner of a business known as
Cart Recovery. Mr. Crossen's company contracts with grocery
stores for the recovery of their shopping carts. Mr. Crossen
reported that since the adoption of the City's Ordinance regulating
abandoned shopping carts, he has collected and returned 90 carts
for one store, the Top Foods Store on Auburn Way North. He
requested' the Council consider amending the shopping cart
ordinance to provide an exemption from recovery fees for those
businesses that have an approved cart recovery company under
contract.
C. Correspondence
No correspondence was transmitted to the City Council.
III. COUNCIL COMMITTEE REPORTS
A3.7.6
A. Municipal Services
Chair Cerino reported the Municipal Services Committee met this
evening at 5:00. The Committee discussed and recommended
approval of Ordinance No. 5915 relating to school zone speed
limits, Ordinance No. 5916 repealing Auburn City Code 5.90
relating to condominium conversion, and Ordinance No. 5918
regulating aggressive begging. The Committee discussed other
issues including the operation of the firing range, a proposed
ordinance relating to leaving children unattended in vehicles with
keys, Auburn Municipal Court's treatment release program, airport
land lease appraisals and long-term land leasing, basic life support
transport, and bicycle regulations. The next regular meeting of the
Municipal Services Committee is scheduled for June 6, 2005 at
5:00 p.m.
B. Planning & Community Development
Chair Norman reported the Planning and Community Development
Committee met May 9, 2005. The Committee recommended

approval of the Nichols annexation and discussed downtown
design standards, commercial uses in industrial zones, the sign
code, West Hill annexation and joint development standards with
King County, North Lake Tapps Inter-jurisdictional Plan and a study
with Sumner and Bonney Lake to identify potential annexation
areas, and Transportation Plan cover designs. The Committee
also received an update on the Auburn Environmental Park.
Auburn Environmental Park will be the subject of a public
information forum on June 16, 2005 at 3:00 at the Truitt Building.
The next regular meeting of the Planning and Community
Development Committee is scheduled for May 23, 2005 at 5:00
p.m.
C. Public Works
Chair Wagner reported the Public Works Committee met May 9,
2005 at 3:30 p.m. The Committee reviewed and recommended
approval of a Professional Services Contract for legal services with
respect to Cascade Water Alliance issues, traffic control items, and
contract administration items for the R Street SE utility
improvements project, Auburn Way South sewer project, city-wide
patching project, and sidewalk improvements project. The
Committee also recommended approval of Ordinance No. 5917
relating to parking on 6th Street NE. The Committee discussed
Resolution No. 3858 authorizing a utilities extension agreement
with Kent 160 LLC and the Comprehensive Transportation Plan.
The Committee met in special session on May 13, 2005 to consider
the utilities extension agreement with Kent 160 LLC. The next
regular meeting of the Public Works Committee is scheduled for
May 23, 2005 at 3:30 p.m.
D. Finance
Chair Backus reported the Finance Committee met this evening at
6:30. The Committee reviewed and recommended approval of
claims and payroll vouchers. The Committee also discussed the
Eden Systems project accounting software and received an update
on the Auburn Municipal Court's treatment release program. The
next regular meeting of the Finance Committee is scheduled for
June 6, 2005 at 6:30 p.m.
IV. COUNCILMEMBER REPORTS
At this time Councilmembers may report on items not specifically
described on the agenda, which are of interest to the community.

Councilmember Singer reported on the Muckleshoot Tribal College
dedication and the Lea Hill Elementary DARE graduation, which were
attended by the Mayor and several Councilmembers. Councilmember
Singer also reported that she met with the Suburban Cities Association
Executive Director to discuss common issues for the Puget Sound
Regional Council and the Suburban Cities Association.
Councilmember Wagner spoke regarding the dedication of the
Muckleshoot Tribal College dedication and commended the Tribe on their
new educational facility.
Councilmember Backus reported on the Auburn Cancer Relay for Life
held May 13-14, 2005. Councilmember Backus stated she participated on
the City team, Team Millie Lewis, named in honor of Mayor Lewis's late
stepmother, along with cancer survivors, Councilmembers Norman and
Wagner. Councilmember Backus also reported that she attended a 4H
meeting at the library.
Councilmember Norman reported on the joint meeting of the Planning and
Community Development Committee and the Planning Commission. The
Committee and Commission members spoke at length regarding the
recently adopted critical areas ordinance. Councilmember Norman
thanked the Planning Commission members for their dedication to their
work on the Planning Commission. Councilmember Norman also
commented on her participation in the Auburn Relay for Life and the
National Day of Prayer. Councilmember Norman commended City staff
for their participation in the Auburn Relay for Life activities.
Councilmember Thordarson reported on his attendance at the
Muckleshoot Tribal College dedication and the dedication of the Seventh
Day Adventist Academy's new girls dormitory. Councilmember
Thordarson also commented regarding his participation in the Auburn
Relay for Life activities. He thanked members of the community for their
contributions to the event.
Councilmember Peloza reported on his attendance at the Muckleshoot
Tribal College dedication and congratulated the Muckleshoot Tribe on
their accomplishment. Councilmember Peloza also attended the DARE
graduation and thanked the Council for continuing to fund the DARE
program. Councilmember Peloza reported on a recent meeting of the
Water Resource Inventory Area where discussion focused on the future
operation and funding for the committee for completion of the salmon
habitat plan. Councilmember Peloza noted that Governor Gregoire
recently signed eleven environmental bills, two of which relate to the

Water Resource Inventory Area salmon habitat area. Councilmember
Peloza also reported on his attendance at the King County Metropolitan
Solid Waste Management Advisory Committee meeting. The purpose of
the Solid Waste Management Advisory Committee is to recommend
future export planning for solid waste. Council member Peloza
congratulated Police Chief Kelly for accepting the proclamation for
National Police Week and encouraged citizens to enroll in the Citizens
Police Academy.
Mayor Lewis commended the Council for their participation in the Cancer
Relay for Life and spoke regarding the community involvement in the
event. Mayor Lewis also spoke regarding attendance at the Muckleshoot
Tribal College dedication and the Lea Hill Elementary DARE graduation.
Mayor Lewis announced that through cooperation among the churches in
Auburn, the Auburn School District and the City of Auburn arrangements
have been made to feed children in need this summer. Mayor Lewis also
announced that the City and Green River Community College have
entered into a lease for a portion of the retail space at the Transit parking
garage. Green River Community College will be offering adult education,
regional educational opportunities, and a distance-learning center in the
downtown area. Mayor Lewis reminded those in attendance that the
annual Clean Sweep will be held Saturday, May 21, 2005 beginning at
8:00 a.m. in the downtown area. The Clean Sweep Program will include
the dedication of a new city clock at the corner of Auburn Avenue and
Main Street. The clock was donated by Nelson's Jewelry. Mayor Lewis
also announced that a new program called "Discover Auburn" is in
development and will be appearing on Channel 21. The program will
feature interesting members of the community.

Councilmember Norman moved and Councilmember Cerino
seconded to accept the ten percent annexation petition and
authorize staff to circulate the petition.
MOTION CARRIED UNANIMOUSLY. 7-0.

revised and presented prior to the meeting to include the
following language: "if lights have been installed in

A Resolution of the City Council of the City of Auburn,
Washington, approving the utility extension agreement
between the City of Auburn and Kent 160 LLC
Public Works Director Dowdy presented a revised Exhibit "A"
Utility Extension Agreement to the City Council. The revised
agreement is a result of the Public Works Committee
discussion on May 13, 2005.
Councilmember Wagner moved to adopt Resolution No.
3858 with the following changes:
Page 1, fourth paragraph, remove the words "water and"
Capitalize all references to "Property" and "Owner".
Delete Section 2.4 and renumber the remaining sections.
In Section 3.1, change the second sentence to read: "Such
agreement to provide sanitary sewer service is conditioned
upon the CITY's receiving a franchise from the City of Kent
permitting the CITY to locate and operate sanitary sewer
lines and facilities in Kent rights of way.
In Section 3.1, change the third sentence to begin: "Such
sanitary sewer service will be provided in accordance. . ."
In Section 5.1.4, page 6, substitute all references to Road
"J" as Road uA"
In Section 5.3.2, Exhibit "B" is referenced and should be
included with the agreement.
Director Dowdy noted the addition of Section 6.14 regarding
Recording of Memorandum, which was discussed at the
Public Works Committee.
Councilmember Thordarson seconded the motion.
Councilmember Singer moved to strike the words "the
Mayor" from Section 2.4. Councilmember Thordarson
seconded.
MOTION CARRIED UNANIMOUSLY. 7-0.

In response to a question from Councilmember Peloza
regarding the proposed revisions to the Agreement, Director
Dowdy responded that the revisions are the same as those
presented to the Public Works Committee on May 13, 2005
with the exception of the revisions included in Section 3.1.
Councilmember Wagner noted that the revised Utility
Extension Agreement presented during the meeting this
evening contains more revisions than detailed in his motion.
Councilmember Wagner requested a brief opportunity to
review the revised agreement before proceeding.
Mayor Lewis ordered the meeting to stand at ease at 8:31
p.m. to allow an opportunity to read the revised agreement.
The meeting reconvened at 8:41 p.m.
Councilmember Wagner withdrew his main motion. There
was no objection.
Councilmember Wagner moved to adopt Resolution No.
3858 and the Utilities Extension Agreement dated May 16,
2005. Councilmember Thordardson seconded.
MOTION CARRIED UNANIMOUSLY. 7-0.

No executive session was held.
