Flag Salute Mayor Lewis called the meeting to order at 7:30 p.m. and led those in attendance in the Pledge of Allegiance. B. Roll Call Mayor Lewis and the following Councilmembers were present: Rich Wagner, Sue Singer, Gene Cerino, Nancy Backus, Bill Peloza, Roger Thordarson, and Lynn Norman. Staff members present included: Police Chief Jim Kelly, Planning and Community Development Director Paul Krauss, Parks and Recreation Director Daryl Faber, Environmental Protection Manager Aaron Nix, Human Resources and Risk Management Director Brenda Heineman, City Attorney Daniel B. Heid, Finance Director Shelley Coleman, Fire Chief Russ Vandver, Information Services Director Lorrie Rempher, Public Works Director Dennis Dowdy, and City Clerk Danielle Daskam. C. Announcements and Appointments 1. Announcements a) Leadership Institute of Puget Sound Distinguished Alumni Award Councilmember Norman stated that she is the Administrative Director of the Leadership Institute of Puget Sound. As a representative of that organization, Councilmember Norman reported that Assistant Police Chief Bob Lee graduated from the Leadership Institute in 2001. Assistant Chief Lee is held in high regard as a leader not only in the Auburn community, but regionally as well. The award represents an outstanding quality and level of leadership achievements. Mayor Lewis read and presented the award to Assistant Chief Lee. On behalf of the City of Auburn, Mayor Lewis expressed pride for Assistant Chief Lee's accomplishments. Mayor Lewis commended Assistant Chief Lee for his dedication to his profession and the community. Assistant Chief Lee was accompanied by his wife, Kären. Assistant Chief Lee expressed his thanks to Mayor Lewis and Councilmembers for acknowledging his receipt of the Distinguished Alumni Award. 2. Appointments City Council confirmed the following Board and Commission appointments: a) Human Services Commission The appointment of Kat Chociej to fill an unexpired term that will expire on December 31,2005. Councilmember Singer moved and Councilmember Wagner seconded to confirm the appointment of Kat Chociej to fill an unexpired term on the Human Services Commission. MOTION CARRIED UNANIMOUSLY. 7-0. b) Urban Tree Board The appointment of Leonard Elliott, Jr. to fill an unexpired term that will expire on December 31, 2005. Councilmember Singer moved and Council member Wagner seconded to confirm the appointment of Leonard Elliott, Jr. to fill an unexpired term on the Urban Tree Board. MOTION CARRIED UNANIMOUSLY. 7-0. Agenda Modifications There was no agenda modification. II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings The public hearing on Annexation Application No. ANX05-0002, previously scheduled for this evening, was rescheduled for August 1,2005. B. Audience Participation This is the place on the agenda where the public is invited to speak to the City Council on any issue. No one in the audience requested to speak. C. Correspondence No correspondence was received. III. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chair Cerino reported that the Municipal Services Committee met this evening at 5:00. The Committee discussed and recommends approval of the contract administration item regarding Project Number C423A, and Resolution Nos. 3861 and 3875. The Committee also discussed draft refund bond ordinances and receiyed a report regarding the Request for Proposals on the Red Light Photo Enforcement project. The next regular meeting of the Municipal Services Committee is scheduled for August 1, 2005 at 5:00 p.m. B. Planning & Community Development Chair Norman reported that the July 11, 2005 Planning and Community Development Committee meeting was cancelled. The next regular meeting of the Planning and Community Development Committee is scheduled for July 25, 2005 at 5:00 p.m. Page 3 City of Auburn Council MeetinCl Minutes July 18. 2005 C. Public Works Chair Wagner reported that the Public Works Committee met on July 11, 2005 at 2:00 p.m. The Committee discussed and recommends approval of contract administration items and Resolution No. 3873. The Committee also discussed system development charges, disposal of fats, oils, and grease (FOG Programs), and transportation issues including policies, freight routes, Transportation Improvement Program 2006-2011 (TIP), and 15th Street NW medians. The next regular meeting of the Public Works Department is scheduled for July 25, 2005 at 3:30 p.m. D. Finance Chair Backus reported that the Finance Committee met this evening at 6:30. The Committee discussed and recommends approval of claims and payroll vouchers and Resolution Nos. 3861, 3870, and 3874. The Committee also received a report on draft refund bond ordinances and discussed Resolution No. 3875. The next meeting of the Finance Committee is scheduled for August 1, 2005 at 6:30 p.m. IV. COUNCILMEMBER REPORTS At this time Councilmembers may report on items not specifically described on the agenda, which are of interest to the community. Mayor Pro Tern Singer reported the she met with the Pacific Lutheran University Dean of Environmental Science and representatives from Green River Community College to discuss development of Auburn's proposed environmental park and with a principal of a high-tech firm about locating in Auburn. She also attended meetings of the Northwest Environmental Business Council, Pacific Northwest Regional Economic Development Council meetings and Nanotech Conference, and toured the new Auburn Mountainview High School on Lea Hill. Councilmember Wagner reported that he and Councilmember Peloza attended the celebration for the completion of the Salmon Recovery Plan for the Puget Sound area. Councilmember Wagner also attended the Janssen's Addition Neighborhood meeting, Municipal Solid Waste Advisory Committee, Rotary Club Spray Park dedication at Les Gove Park, and the ground breaking ceremony for Wesley Homes on Lea Hill. Councilmember Backus reported on attendance at the Kids Free Lunch Program at the Boys and Girls Club on 3ih Street SE. The young individuals receiving meals were very appreciative, considerate, and polite. It was a pleasure to participate in the program. Page 4 City of Auburn Council MeetinQ Minutes JulY 18. 2005 Councilmember Norman complimented the Auburn School District on the new Mountainview High School on Lea Hell. Councilmember Norman also attended the Puget Sound Regional Council Growth Management Board, Northwest Environmental Business Council meeting, and ground breaking ceremony for Wesley Homes on Lea Hill. Councilmember Norman also reported on the opening for the new art exhibit at Auburn City Hall. Councilmember Cerino reported on the tour of the Auburn Mountainview High School. Councilmember Cerino encouraged citizens to visit the school and enjoy the beautiful views of Mount Rainier and the Olympic and Cascade mountain ranges. Councilmember Cerino complimented the Auburn School District on the design of the school. Councilmember Peloza reported that he attended the celebration for the completion of the Salmon Recovery Plan for the Puget Sound area, Water Resources Inventory Area (WRIA 9) Management Committee meeting, White River Valley Historical Society Museum Volunteer Luncheon, Metropolitan Water Pollution Abatement Advisory Committee, Rotary Club Spray Park dedication at Les Gove Park, Regional Water Quality Committee meeting, WRIA 9 Steering Committee meeting, and ground breaking ceremony for Wesley Homes on Lea Hill. Councilmember Peloza also reported on the implementation of the Car Wash Kit Program in the City of Auburn. The kits prevent soapy and contaminant water from entering into the storm drain system and the Green River watershed and contributes to the survival of salmon and other wildlife habitat. The kits are now available to groups sponsoring car wash fundraisers in Auburn. Councilmember Peloza also announced that, in connection with his membership on the National League of Cities Environmental Energy and Natural Resources Committee, he has been invited to Denver, Colorado, by the Environmental Protection Agency to examine concerns related to municipal water security. Mayor Lewis reported on attendance at the White River Valley Historical Society Museum Volunteer Luncheon and Rotary Club Spray Park dedication at Les Gove Park. Mayor Lewis also reported on efforts to encourage nanotech and biotech companies to locate in Auburn, and enumerated many fine qualities of the City and amenities currently located in Auburn. Mayor Lewis pointed out that the City of Auburn has a catalog for the purpose of sharing or gift giving to the City of Auburn for individuals wishing to make donations, which also provides the opportunity to dedicate the donation in the name of their choosing. Some of the donations listed in the catalog are pet litter container station, park bench, Page 5 City of Auburn Council MeetinQ Minutes JulY 18. 2005 community tree, trash container holder, drinking fountain, canine program monthly donation, senior fall prevention items, fire safety materials, stop sticks, safety vests for police dogs, artisans at work and artisan school sponsorships, Sounds of Summer performances, public art, adult and youth scholarships, bike rack, spray pool, fitness trail exercise station sponsorship, picnic table and pad installation, and electronic reader board for the City. Mayor Lewis noted that the catalog can be found on the City's website. Mayor Lewis commended the Auburn community and Councilmembers for their ability to work together for the good of Auburn. V. CONSENT AGENDA All matters listed on the Consent Agenda are considered by the City Council to be routine and will be enacted by one motion in the form listed. A. Minutes 1. Minutes of the June 30, 2005 special City Council meeting. 2. Minutes of the July 5, 2005 regular City Council meeting. B. Vouchers F4.9.2,F4.9.5 1. Claims Claims check numbers 343026 through 343362 in the amount of $1 ,993,785.05 and dated July 18, 2005. 2. Payroll Payroll check numbers 512869 to 513041 in the amount of $683,186.84 and electronic deposit transmissions in the amount of $1,000,080.75 for a grand total of $1,683,267.59 for the pay period covering June 30, 2005 to July 13, 2005. C. Contract Administration 1. Public Works Project Number C423A 04.4.1 C423A City Council approve Final Pay Estimate NO.4 for Contract No. 04-29, with Lincoln Construction and accept construction of Project No. C423A, City Hall Improvements. Public Works Project Number C1014 04.9.1 C1014 City Council award Contract 03-05, Project Number C1014, Auburn Way South Safety Improvements, to Ceccanti, Inc. on their low bid of $1 ,465,228.95. 3. Public Works Project Number C326A 04.9.1 C326A City Council approve Final Pay Estimate #6 to Contract 04- 17 with RW Scott Construction and accept construction of Project No. C326A, C Street SW Roadway Improvements - Contract A. Councilmember Singer moved and Councilmember Wagner seconded to approve the Consent Agenda. MOTION CARRIED UNANIMOUSLY. 7-0. VI. UNFINISHED BUSINESS There was no unfinished business. VII. NEW BUSINESS There was no new business. VIII. ORDINANCES AND RESOLUTIONS A. Ordinances 1. Ordinance No. 5928 03.10.1 CUP05-0002 An Ordinance of the City Council of the City of Auburn, King County, Washington approving a conditional use permit to allow sales and limited service of school busses at 1240 West Main Street in Auburn, Washington Councilmember Norman moved and Councilmember Cerino seconded to introduce and adopt Ordinance No. 5928. Councilmember Wagner referred to the map related to Ordinance No. 5928 and inquired regarding the storm drainage system, the Hearing Examiner requirement for submittal of approved storm water management plan site filtration, and on-site filtration for the parcel. Page 7 City of Auburn Council MeetinCl Minutes July 18. 2005 Director Dowdy stated that the proponent would submit the civil site plans to give the City the opportunity to review them and assure that the conditions for approval are met. Any pollutants, other than pure storm water, would be drained into a sanitary sewer line. Before pollutants are disposed into the sanitary sewer line, the City will review the proponent's plan for an oil/water separator to ensure that water quality standards are met. The City will also conduct a plan review to ensure that storm lines meet City standards and that there is a segregation of stormwater and pollutants. There will be no on-site filtration system. Councilmember Norman expressed concerns regarding pollutant runoff and environmental impacts. Director Dowdy stated that the storm water management plan will address issues of concern expressed by Councilmembers Wagner and Norman. The storm water management plan gives the City the right to inspect the site in the future with regard to water quality criteria for site runoff and enforcement of any violations. In response to questions from Councilmember Wagner regarding use of the graveled area referred to on the map, Director Krauss stated that it is his understanding that the buses will be parked close to the maintenance building. Currently, a variety of vehicles and equipment are parked in the gravel area referred to by Councilmember Wagner. MOTION CARRIED UNANIMOUSLY. 7-0. B. Resolutions 1. Resolution No. 3861 F4.6.1 A Resolution of the City Council of the City of Auburn, Washington declaring certain items of property as surplus and authorizing their disposal Councilmember Cerino moved and Councilmember Peloza seconded to adopt Resolution No. 3861. Resolution No. 3870 A3.9.3 A Resolution of the City Council of the City of Auburn, Washington, approving the Collective Bargaining Agreement between the City of Auburn and the International Association of Machinists and Aerospace Workers, Local 160 for 2005- 2007 Councilmember Backus moved and Council member Norman seconded to adopt Resolution No. 3870. MOTION CARRIED UNANIMOUSLY. 7-0. 3. Resolution No. 3872 03.1 ANX05-0002 A Resolution of the City Council of the City of Auburn, Washington, amending Resolution No. 3869 accepting the sixty percent petition to annex certain property located in King County adjacent to the City's western Boundary and setting a public hearing therefor Councilmember Norman moved and Councilmember Cerino seconded to adopt Resolution No. 3872. MOTION CARRIED UNANIMOUSLY. 7-0. 4. Resolution No. 3873 A3.14 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor to execute an Interlocal Agreement with the City of Bonney Lake for the establishment of a Right-of-way Use Permit with Pierce County Councilmember Wagner moved and Councilmember Thordarson seconded to adopt Resolution No. 3873. MOTION CARRIED UNANIMOUSLY. 7-0. 5. Resolution No. 3874 A4.5.2, A3.16.6 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute Page 9 City of Auburn Council MeetinQ Minutes JulY 18. 2005 a Technical Services Agreement between the City of Auburn and Warren Barber and Fontes, P.S. to procure temporary prosecuting attorney services Councilmember Backus moved and Councilmember Norman seconded to adopt Resolution No. 3874. MOTION CARRIED UNANIMOUSLY. 7-0. 6. Resolution No. 3875 A3.17 A Resolution of the City Council of the City of Auburn, Washington, authorizing the execution of a Lease Agreement between the City of Auburn and the United States of America for rental of office and light industrial space at the General Services Administration (GSA) fire station/shop building, GSA Warehouse Complex, located at 2815 "C" Street SW Councilmember Cerino moved and Councilmember Peloza seconded to adopt Resolution No. 3875. MOTION CARRIED UNANIMOUSLY. 7-0. IX. MAYOR'S REPORT A. Executive Session At 8:25 p.m. Mayor Lewis recessed the meeting, and the Council convened in closed session for the purpose of discussing labor relations pursuant to RCW 43.20.140. The closed session concluded at 8:33 p.m. and the Council immediately recessed to executive session for the purpose of discussing pending litigation and property acquisition for approximately twenty minutes pursuant to RCW 42.30.110(1 )(b) and (i). At 8:53 p.m. Mayor Lewis announced that the executive session would continue for approximately fifteen additional minutes, and at 9:10 p.m. Mayor Lewis continued the executive session for an additional five minutes.
