Lewis called the meeting to order at 7:30 p.m. and led those in attendance in the Pledge of Allegiance. B. Roll Call Mayor Lewis and the following Councilmembers were present: Rich Wagner, Sue Singer, Gene Cerino, Nancy Backus, Roger Thordarson, Bill Peloza, and Nancy Backus. Staff members present included: Planning, Building, and Community Director Paul Krauss; Public Safety Director Jim Kelly; Parks, Arts and Recreation Director Daryl Faber; Public Works Director Dennis Dowdy; Information Services Director Lorrie Rempher; Human Resources and Risk Management Director Brenda Heineman; City Attorney Daniel B. Heid; Fiscal Services Manager Craig Violante; Planner Bill Mandeville; Senior Planner Jeff Dixon; and City Clerk Danielle Daskam. C. Announcements and Appointments 1. Appointments There were no appointments for Council consideration. D. Agenda Modifications There was no agenda modification. II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings Page 1 City of Auburn Council Meetina Minutes Januarv 17. 2006 1. Extension of Moratorium on Transitory Accommodations 03.10.15 Resolution No. 3808, adopted January 18, 2005, established an initial one-year moratorium on the filing with the City or the Courts of any applications for licenses, permits and/or approvals for transitory accommodations. The moratorium was enacted to provide the City with an opportunity to study the issues concerning the siting of such transitory accommodations and prepare appropriate revisions to the City's codes and regulations. The purpose of the public hearing is to consider the extension of the moratorium for an additional six months. Director Krauss noted staff has reviewed regulations of other municipalities with regard to transitory accommodations for the past year and have prepared a draft ordinance. The draft ordinance is being reviewed by the Planning and Community Development Committee and discussed before the Planning Commission. Staff members continue to research the issue within the boundaries of state law and moratoriums and request an additional six months to complete their investigation. Mayor Lewis opened the public hearing. No one in the audience requested to speak. Mayor Lewis closed the public hearing. B. Audience Participation This is the place on the agenda where the public is invited to speak to the City Council on any issue. Alexis Hacker Scholz, 32328 11 oth Avenue SE, Auburn Ms. Scholz indicated that she lives across street from Wesley Homes Retirement Community. Ms. Scholz expressed concerns regardinq traffic safety issues, especially at the intersection of 320th and 11 alii Avenue SE. Ms. Scholz stated that 11 oth Avenue is not wide enough to allow adequate turning area when exiting from 110th Avenue onto 320th Ms. Scholz also expressed concerns that widening of the street will create higher speeds in that area and requested Council review the situation in her neighborhood. Page 2 City of Auburn Council Meetina Minutes Januarv 17. 2006 Jim Hill, 4602 Bridget Avenue SE, Auburn Mr. Hill spoke on behalf of he, his wife and daughter and described an incident involving a vehicle pursuit that occurred at his home. Mr. Hill commended Auburn Police Officers Mark Caillier, Tyler Christian, and Jeff Doll and Canine Officer Roy for their professionalism with regard to apprehending the suspect and their care and concern for the Auburn community. Mayor Lewis expressed appreciation to Mr. Hill for taking the time to share his positive comments regarding the City's public safety officers. C. Correspondence No correspondence was received for City Council review. III. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chair Cerino reported the Municipal Services Committee met this evening at 5:00. The Committee discussed and recommends approval of Ordinance No. 5990, Resolution Nos. 3967 and 3970. The Committee also received an update of the Committee's matrix of projects, and received reports on the analysis of the Police Department workload and jail facility alternatives. The next regular meeting of the Municipal Services Committee is scheduled for February 6, 2006 at 5:00 p.m. B. Planning & Community Development Chair Norman reported that the Planning and Community Development Committee met on January 9, 2006 at 5:00 p.m. The Committee discussed numerous municipal annexations, and the Stipp, Nichols, and Christ Church annexations on this evening's agenda. The Committee also received updates on the sign code ordinance and the sex offender town hall meeting and discussed rental housing inspection access, the Planned Unit Development ordinance, and the Southeast of East Main Street Neighborhood Plan area. The next regular meeting of the Planning and Community Development Committee is scheduled for January 23, 2006 at 5:00 p.m. C. Public Works Chair Wagner reported that the Public Works Committee met on January 9, 2006 at 3:30 p.m. The Committee discussed contract administration items, Ordinance No. 5973, and Resolution No. Page 3 City of Auburn Council Meetina Minutes Januarv 17. 2006 3968. The Committee also discussed fee based wetland mitigations, Public Works grants status, and draft Ordinance No. 5974 relating to connections to municipal water systems with regard to irrigation and private well decommissioning. The next regular meeting of the Public Works Committee is scheduled for January 23, 2006 at 3:30 p.m. D. Finance Chair Backus reported that the Finance Committee met this evening at 6:30. The Committee discussed and recommends approval of claims and payroll vouchers, and Resolution Nos. 3962, 3969, and 3971. The Committee also discussed Ordinance No. 5990, Resolution Nos. 3967 and 3970, and BroadWare CCTV software and hardware. The next regular meeting of the Finance Committee is scheduled for February 6, 2006 at 6:30 p.m. IV. COUNCILMEMBER REPORTS At this time Councilmembers may report on items not specifically described on the agenda, which are of interest to the community. Councilmember Singer reported that she attended the Puget Sound Regional Council Executive Committee, Operations Committee meeting to review budgetary issues and discuss improving public outreach. Councilmember Singer also reported that she and Mayor Lewis will attend a tour of the city with the Auburn Tourism Board on January 18, 2006. Councilmember Singer thanked Public Works staff members for all of their extra work during the City's recent flooding. Councilmember Backus extended congratulations to Councilmember Peloza, Public Safety Director Kelly and Mayor Lewis, all of which celebrate birthdays in January. Councilmember Backus also noted that the Miss Auburn Scholarship Pageant will be held January 27-28,2006 at the Auburn Performing Arts Center. Councilmember Norman reported that she, Mayor Lewis, and several Councilmembers attended a Suburban Cities Association training seminar for elected officials. Councilmember Norman also attended a meeting of the Puget Sound Regional Council Growth Management Policy Board, chaired a 4Culture Arts Advisory Committee, and met with the new City of Auburn Economic Development Manager Dave Baron. Councilmember Cerino reported that he and Mayor Lewis attended the Pierce County Cities and Towns meeting at which Association of Washington Cities (AWC) Executive Director Stan Finkelstein was a Page 4 City of Auburn Council Meetina Minutes Januarv 17. 2006 speaker. Mr. Finkelstein was joined by AWC Assistant Director for Intergovernmental Relations Jim Justin. Mr. Finkelstein and Mr. Justin summarized legislative issues. Also in attendance was Tacoma Pierce County Health Department Director Dr. Federico Cruz-Uribe who spoke regarding the differences between an epidemic and a pandemic. Councilmember Cerino displayed a Pandemic Flu Preparedness Kit distributed by Dr. Cruz-Uribe. Councilmember Thordarson reported on the opening of White River Valley Museum's newest exhibit "Crossing the Cascades". Councilmember Thordarson also reported that he attended a committee meeting on State Route 167 to discuss issues related to hot lanes. Councilmember Thordarson reviewed several changes in bus routes that Metro Transit is proposing in the local area and reported that a public meeting will be held on Thursday, January 26, 2006 from 5:00 p.m. to 8:00 p.m. in Auburn City Council Chambers to receive public comment. Councilmember Peloza reported that he attended Suburban Cities Association orientation for regional committee assignments. Councilmember Peloza noted that he is a member of the Regional Water Quality Committee which is an advisory committee of the King County Council. Councilmember Peloza also attended a town meeting on available resources used to locate the vicinity of registered sex offenders and various educational tools to promote methods for protection against sex offenders, which he co-hosted with Senator Pam Roach. Councilmember Peloza also attended the Water Resource Inventory Area (WRIA 9) Management meeting to discuss future goals and objectives for 2006, and the Daughters of the American Revolution 25th Anniversary celebration of the Lakota Chapter. Councilmember Peloza commended efforts by Environmental Protection Manager Aaron Nix regarding City of Auburn's recent receipt of a grant in the amount of $675,900 through WRIA 9 for the Fenster levee setback and floodplain restoration. Mayor Lewis reported regarding an opportunity he had to visit all three shifts of Auburn firefighters to give an update on issues and events occurring in the City and to receive any input. Mayor Lewis also reported on the Level 3 Flood Watch Warning received from King County last week and invited interested parties to submit their email addresses if they would like to receive notification of future events of this nature. In connection with the flood watch warning, Mayor Lewis made site visits to the levees and dikes in the City and commended the efforts of staff members related to responding and monitoring the situation. Additionally, Mayor Lewis spoke regarding economic developments efforts by the City of Auburn. Page 5 City of Auburn Council MeetinQ Minutes Januarv 17. 2006 V. Claims Claims check numbers 348090 through 348392 in the amount of $1,351,480.17 and claims check numbers 348393 through 347511 in the amount of $1 ,987,481.78 and dated January 17, 2006. 2. Payroll Payroll check numbers 514777 to 514973 in the amount of $729,682.07 and electronic deposit transmissions in the amount of $991 ,822.90 for a grand total of $1 ,721 ,504.97 for the pay period covering January 11, 2006 to January 16, 2006. Application Numbers PUD04-0002 and PL T04-0009 03.5, 03.6 The request of Brian McCabe of Investco Financial Corporation for a planned unit development (PUD) known as "Auburn 40" to rezone a 38.48 acre site from R2 (Single Family Residential) to PUD and preliminary plat approval to subdivide the site into 236 single-family lots and 27 tracts. The site is generally west of the Green River and east of I Street NE, if extended, in the 4200-4300 block. Councilmember Norman moved and Councilmember Cerino seconded to schedule a closed record hearing on a date to be determined. MOTION CARRIED UNANIMOUSLY. 7-0. VIII. ORDINANCES AND RESOLUTIONS A. Ordinances 1. Ordinance No. 5973 04.8 An Ordinance of the City Council of the City of Auburn, Washington, repealing Auburn City Code Chapter 12.44 entitled "Water on Sidewalks" in its entirety Councilmember Wagner moved and Councilmember Thordarson seconded to introduce and adopt Ordinance No. 5973. Ordinance No. 5980 03.1 An Ordinance of the City Council of the City of Auburn, Washington, annexing south of the BPA power lines between 116th Avenue Southeast and 118th Avenue Southeast into the City for municipal purposes Councilmember Norman moved and Councilmember Cerino seconded to introduce and adopt Ordinance No. 5980. MOTION CARRIED UNANIMOUSLY. 7-0. 4. Ordinance No. 5981 03.1 An Ordinance of the City Council of the City of Auburn, Washington, annexing property located on the south side of Mountain View Drive into the City for municipal purposes Council member Norman moved and Councilmember Cerino seconded to introduce and adopt Ordinance No. 5981. Ordinance No. 5986 03.1 ANX05-0003 An Ordinance of the City of Auburn, Washington, annexing approximately five and one-half acres of land located in King County and adjacent to the corporate limits of the City known as the "Community of Christ Church Annexation" Councilmember Norman moved and Council member Cerino seconded to introduce and adopt Ordinance No. 5986. Resolution No. 3962 A3.16.6 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute a Technical Services Agreement between the City of Auburn and SRI Technologies, Inc. to procure temporary staff from January 1, 2006 and continue thereafter on an ongoing basis until terminated Councilmember Backus moved and Councilmember Norman seconded to adopt Resolution No. 3962. Resolution No. 3967 03.4.1.21 A Resolution of the City Council of the City of Auburn, Washington, authorizing the acceptance of grant funds in the amount of Ninety Seven Thousand Five Hundred Eighteen Dollars ($97,518), and to execute an Interlocal Agreement between King County and the City of Auburn to accept said funds for implementation of the 2006 - 2007 Waste Reduction anp Recycling Grant Program Councilmember Cerino moved and Councilmember Peloza seconded to adopt Resolution No. 3967. Resolution No. 3968 04.10 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor to execute a Commute Trip Reduction Act Interlocal Agreement between King County and the City of Auburn for the purpose of implementing the Washington State Commute Trip Reduction Act of 1991 Councilmember Wagner moved and Councilmember Thordarson seconded to adopt Resolution No. 3968. Resolution No. 3970 03.4.1.21 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor to execute a Seattle - King County Department of Public Health Memorandum of Understanding on the Local Hazardous Waste Management Program for 2006 activities in the amount of Eleven Thousand Six Hundred Seventy Six Dollars and Sixteen Cents ($11,676.16) Councilmember Cerino moved and Councilmember Peloza seconded to adopt Resolution No. 3970. MOTION CARRIED UNANIMOUSLY. 7-0. 7. Resolution No. 3971 A5.3.24 A Resolution of the City Council of the City of Auburn, Washington expressing support of Proposition No.1, Auburn School District, Educational Program and Operations Levy Mayor Lewis offered an opportunity to speak regarding Resolution No. 3971. No one in the audience requested to speak. Councilmember Backus moved and Councilmember Norman seconded to adopt Resolution No. 3971. MOTION CARRIED UNANIMOUSLY. 7-0. IX. MAYOR'S REPORT A. Executive Session Mayor Lewis recessed the meeting to executive session at 8:24 p.m. for approximately ten minutes in order to discuss property acquisition and potential litigation.
