Lewis called the meeting to order at 7:30 p.m. and led those in attendance in the Pledge of Allegiance. B. Roll Call Mayor Lewis and the following Councilmembers were present: Rich Wagner, Sue Singer, Gene Cerino, Bill Peloza, Roger Thordarson and Lynn Norman. Councilmember Nancy Backus was excused. Staff members present included: Chief of Public Safety Jim Kelly, Deputy Fire Chief Mike Gerber, Finance Director Shelley Coleman, Information Services Director Lorrie Rempher, City Attorney Daniel B. Heid, Public Works Director Dennis Dowdy, Parks, Art and Recreation Director Daryl Faber, Planning, Building and Community Director Paul Krauss, Building Division Manager Jim Tinner, Community Development Administrator David Osaki, Development Services Coordinator Steven Pilcher, and City Clerk Danielle Daskam. C. Announcements and Appointments 1. Announcements a) Chief of Public Safety Jim Kelly Mayor Lewis congratulated Chief Kelly on his 27-year anniversary of service to the City on May 1, 2006. b) Recognition of Retired of Fire Chief Russ Vandver Mayor Lewis recognized retired Fire Chief Russ Vandver for his years of service to the City. Page 1 City of Auburn Council MeetinQ Minutes Mav 1. 2006 Chief Vandver began his career with the City on January 1, 1971. He comes from a long line of firefighters, as his uncle was the Chief of the Sumner Fire Department, his step-father was with the McChord Fire Department, and his brother was the Deputy Fire Chief for the City of Puyallup. Mayor Lewis stated that in 1971 there were 24 firefighters responding to approximately 400 calls per year in the city of Auburn. Today, the City employs 78 firefighters who respond to approximately 8,000 calls per year. Chief Vandver was one of the first firefighters to attend the Emergency Management Training (EMT) courses and helped set the standard for the level of emergency care given to Auburn citizens. He was also one of the first firefighters to attend the EMT2 course and also the Seattle Police Academy to support arson investigation with commissioned authority. He was promoted to Lieutenant in 1979, Captain in 1981, Battalion Chief in 1986, Assistant Chief in 1997, and Fire Chief in 2003. He was instrumental in the formation of the first Special Operations Division in the region to address hazardous materials and technical rescue incidents. Chief Vandver was recognized as the Auburn Fire Department Officer of the Year in 1982 and again in 1995 and received numerous meritorious awards and letters of commendation during his 35- year career with the City. Mayor Lewis commended Chief Vandver for his dedication to the Auburn community and the fire service profession and thanked for him for his many years service. Chief Vandver thanked Mayor Lewis and Councilmembers for their recognition. Chief Vandver spoke regarding the progression of services provided by the Fire Department and expressed his gratitude for the opportunities provided during his years of service with the City. Chief Vandver was accompanied by his brother. c) Proclamation from Governor Christine Gregoire Proclamation recognizing the City of Auburn's participation in Hurricane Katrina disaster relief services. Page 2 City of Auburn Council MeetinQ Minutes May 1. 2006 Mayor Lewis presented a proclamation from the Washington Association of Building Officials signed by Governor Christine Gregoire recognizing the City of Auburn's participation in disaster relief efforts after the devastation created by Hurricane Katrina. The proclamation recognized the City's participation in the National Emergency Management Assistance Compact System by sending Building Division Manager Jim Tinner to help survey damage caused by the hurricane in the gulf coast. Mr. Tinner joined his Washington colleagues for a two-week deployment to provide damage assessment assistance in Mississippi last October. Mayor Lewis commended Mr. Tinner for his participation in the relief efforts under such deplorable conditions. Mr. Tinner thanked Mayor Lewis and Director Krauss for their support in allowing him to participate in the gulf coast relief efforts. Mr. Tinner expressed his pride in being allowed to serve on behalf of the City of Auburn. d) Le~islative Update 31 s District Representative Jan Shabro updated the Council on legislative issues. Representative Shabro provided the Council with a post-session report. Representative Shabro congratulated the City on the recent award of $3.5 million in Public Works Trust Fund loans to update the City's sewer system. Representative Shabro stated that she serves on four committees including transportation, education, finance, and rules. She indicated that she requested the appointment to the Transportation Committee in an effort to assure that the 31 st District receives its fair share of available transportation funding. As a result, the 31st District is receiving over $190 million, the majority of which is allocated for upgrades to State Route (SR) 167, SR 410, SR 164, and SR 169. SR 167 will be extended to the Pierce County line and will include a High Page 3 City of Auburn Council MeetinQ Minutes May 1. 2006 Occupancy Toll (HOT) lane which allows a single occupancy vehicle to use the High Occupancy Vehicle (HOV) lane for a fee. Representative Shabro reviewed the Regional Transportation Investment District (RTID) and recent legislation which delays bringing any measures before the voters with regards to implementing new transportation taxes until 2007. That legislation included a bill to establish a group to examine and make recommendations related to the governance of transportation. Representative Shabro reported that this is the first year she has served on the Finance Committee. Items of potential impact to the City of Auburn included Streamlined Sales Tax (SST), annexations, and agricultural and educational issues. Representative Shabro spoke regarding the projected budget deficit and the financial challenges it will cause. Representative Shabro distributed a chart of the Capital budget which includes categorical funding sources and available grants. Councilmember Singer inquired regarding the possibility of receiving transportation funding for maintenance of arterial streets. Representative Shabro indicted that available transportation funding is currently designated for larger projects. Mayor Lewis thanked Representative Shabro for her update and the services she provides to the City of Auburn and its citizens. e) Fishing Derby Mayor Lewis introduced Lions Club Immediate Past Zone Chairman Bob Dorgan. Mr. Dorgan reported on the second Annual Fishing Derby for Special Needs Youth on behalf of the Lions C3, District 19C, which was held at the Auburn Mill Pond. Members and their families from nine different Page 4 City of Auburn Council MeetinQ Minutes May 1. 2006 clubs joined together to bring this event to Auburn. Mr. Dorgan thanked Mayor Lewis, Parks Maintenance Manager Mike Miller, Auburn Sports and Marine, and Green River Steelhead Trout Club for their cooperation in organizing this event. The event was attended by Representatives from the 30th and 31 st districts, Senator Tracey Eide, and 66 youth participants and their family members. Every child received a special certificate award and a Polaroid photograph. Mr. Dorgan shared some of the photographs with the Council. Mayor Lewis noted that Mill Pond was a former storm water retention pond. The installation of aerators created a viable habitat for fish life. Mill Pond is now used for a variety of functions. Director Faber reported that a fishing derby for all youth in the Auburn area will be held on May 6, 2006 and a fishing derby for senior citizens in the Auburn area is scheduled for May 13, 2006. Councilmember Cerino pointed out that, at one time, Mill Pond was a functioning mill. 2. Appointments a) Airport Advisory Board City Council to confirm the appointment of Matthew Bauermeister to a three year term to expire December 31, 2008. Councilmember Singer moved and Councilmember Wagner seconded to confirm the appointment of Matthew Bauermeister to the Airport Advisory Board. MOTION CARRIED UNANIMOUSLY. 6-0. b) Planning Commission The appointment of Peter DiTuri to an unexpired term on the Planning Commission for a term ending December 31,2007. MOTION CARRIED UNANIMOUSLY. 6-0. D. Agenda Modifications In addition to the added request to confirm an appointment to the Planning Commission above, the agenda was further modified by adding a call for public hearing on the franchise application from Puget Sound Energy under Item V.C of these minutes, and the removal of Ordinance No. 6018. II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings No hearing was scheduled for this evening. B. Audience Participation This is the place on the agenda where the public is invited to speak to the City Council on any issue. Those wishing to speak are reminded to sign in on the form provided. City Attorney Heid spoke regarding Resolution No. 4016 relating to a ballot measure under Item VIII.B.2 of these minutes. Pursuant to state law, the City Council is entitled to take a collective position on ballot measures, but must do so in a process that provides an opportunity for citizens to comment on the issue in connection with Council action. Julia Short. 12019 SE 316th Court. Auburn Ms. Short indicated that she is involved in nursing education and healthcare within the Auburn area and spoke in opposition to the Valley Medical proposition. Virqinia Hauqen. 2503 R Street SE. Auburn Ms. Haugen commented regarding fence height and site distance issues, and pedestrian safety. Ms. Haugen spoke in opposition to allowing increased height of fences. Kellv Haqqett. 929 23rd Place SE, Auburn Ms. Haggett spoke in support of Ordinance No. 6019 regarding prohibiting parking of commercial vehicles in residential zones. Page 6 City of Auburn Council MeetinQ Minutes May 1. 2006 C. Correspondence No correspondence was received for Council review. III. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chair Cerino reported that the Municipal Services Committee met this evening at 5:00. The Committee discussed and recommends approval Resolution No. 4022. The Committee also discussed Ordinance Nos. 5943, 6014, 6019, and 6020, and school district impact fees. The Committee also updated the Municipal Services matrix. The next regular meeting of the Municipal Services Committee is scheduled for May 11, 2006 at 5:00 p.m. B. Planning & Community Development Chair Norman reported that the Planning and Community Development Committee met April 24, 2006 at 4:30 p.m. The Committee held a public hearing on Application No. WSC04-0030. The Committee also discussed and recommends approval of Ordinance No. 6019 and Resolution No. 4017. The Committee also received reports on the Wayfinding Committee recommendations, the Community Grant matrix, and Interagency Committee for Outdoor Recreation (lAC) grant, and discussed the Downtown Urban Design Zone/Map changes, homeless encampment code changes, and "A" Street Southeast corridor. The next regular meeting of the Planning and Community Development Committee is scheduled for May 8, 2006 at 5:00 p.m. C. Public Works Chair Wagner reported that the Public Works Committee met on April 24, 2006 at 3:30 p.m. The Committee discussed and recommends approval of a call for public hearing on the request of Puget Sound Energy for a franchise agreement for distribution and sale of natural gas, Ordinance Nos. 6013 and 6018, and Resolution Nos. 4018 and 4019. The Committee also discussed the lAC grant, traffic impact fees, and Intelligent Transportation System (ITS) Safety Study, and received an update on capital projects. The next regular meeting of the Public Works Committee is scheduled for May 8, 2006 at 3:30 p.m. D. Finance Vice Chair Norman reported that the Finance Committee met this evening at 6:30. The Committee discussed and recommends approval of claims and payroll vouchers, Ordinance No. 6003, and Page 7 City of Auburn Council MeetinQ Minutes May 1. 2006 Resolution Nos. 4016 and 4020. The Committee also discussed Resolution Nos. 4019 and 4022, and school district impact fees, and received a quarterly investment report. The next regular meeting of the Finance Committee is scheduled for May 11, 2006 at 6:30 p.m. IV. COUNCILMEMBER REPORTS At this time Councilmembers may report on items not specifically described on the agenda, which are of interest to the community. Councilmember Singer reported that the Council held a closed record hearing on April 25, 2006 on the Kersey III project. Councilmember Singer also chaired the Puget Sound Regional Council (PSRC) Operations Committee meeting and attended the PSRC Executive Committee meeting. Councilmember Singer will be representing PSRC at a trade mission to Melborne, Australia. She also had an interview with a reporter from the Puget Sound Business Journal regarding the activities of the Auburn Tourism Board. The Auburn Tourism Board will be reporting to the City Council in June, 2006. Councilmember Wagner represented the City of Auburn at the groundbreaking ceremony the for new 'D' Street interchange in Tacoma, and attended the Cities and Schools Forum, Lions Club auction, Auburn Senior Center Volunteer Luncheon, and a joint meeting with City of Bonney Lake City Council. He also participated in the Puyallup River Watershed Council Biodiversity Tour for a preview of the BioBlitz Project. Councilmember Wagner invited the public to participate in the upcoming BioBlitz on June 2 and 3, 2006. Councilmember Norman reported that she attended various economic development meetings and the Auburn Symphony performance at the Auburn Performing Arts Center. Councilmember Cerino reported that he attended the Pierce County Regional Council meeting at which they prioritized projects in Pierce County in order to apply for funds from the PSRC. Councilmember Thordarson reported that he attended the Buddhist Temple Annual Beef Bowl and Chow Mein Luncheon. The event offered an opportunity to experience the Japanese culture. Councilmember Thordarson encouraged citizens to attend the event next year. Councilmember Peloza reported that he attended a Solid Waste meeting regarding thermal reclamation technology used in Germany. Page 8 City of Auburn Council MeetinQ Minutes May 1. 2006 Councilmember Peloza also attended a Suburban Cities Association Networking meeting at which Senator Patti Murray and King County Executive Ron Sims spoke and shared a brochure distributed at the meeting. He also attended a joint meeting with the City of Bonney Lake City Council. Mayor Lewis reported that he has attended 78 meetings since the last Council meeting. Mayor Lewis reported on the red light photo enforcement program, PhotoSafe. This program is revenue neutral to the City and the main focus of the program is to promote safety in the community. Fines charged for violations are applied towards supporting the PhotoSafe program. Mayor Lewis reported that he attended a joint meeting with the City of Bonney Lake City Council, visited the Junior Achievement Enterprise Village, and met with pastors in the community. Mayor Lewis also attended meetings with King County Executive Ron Sims to discuss annexation issues, the Muckleshoot Indian Tribe, and Suburban Cities Association, and attended the Special Needs Fishing Derby. Mayor Lewis reported on the passing of former Councilmember Skip Kline and his involvement with the City of Auburn. V. Ordinance No. 6003 F3.0 An Ordinance of the City Council of the City of Auburn, Washington, creating a new Chapter 3.02 of the Auburn City Code and thereby establishing a biennial budget process effective January 1, 2007 Councilmember Norman moved and Councilmember Thordarson seconded to introduce and adopt Ordinance No. 6003. MOTION CARRIED UNANIMOUSLY. 6-0. 2. Ordinance No. 6013 A3.13.2 An Ordinance of the City Council of the City of Auburn, Washington, amending Section 12.04.050 of the Auburn City Code relating to the release of city-held easements by the City Engineer Councilmember Wagner moved and Councilmember Thordarson seconded to introduce and adopt Ordinance No. 6013. Ordinance No. 6019 01.8 An Ordinance of the City Council of the City of Auburn, Washington, creating new Sections 18.04.245 and 18.52.065 of the Auburn City Code relating to commercial vehicles Councilmember Norman moved and Councilmember Cerino seconded to introduce and adopt Ordinance No. 6019. Councilmember Wagner moved and Councilmember Peloza seconded to amend Section 2 of the Ordinance creating a new Section 18.52.065 by changing the existing paragraph "B" to "C" and inserting a new paragraph "B" as follows: "B. No person shall park more than one (1) commercial vehicle on any property within the Single Family Residential (RS) zoning district in the City, and no person shall park more than two (2) commercial vehicles on any property within the Rural Residential (RR) zoning district in the City." Councilmember Wagner explained the proposed amendment is recommended by the Municipal Services Committee and provides for parking restrictions in rural residential zones. Resolution No. 4015 A1.7 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Public Works Committee to appoint the City of Auburn representatives to the King County Metropolitan Water Pollution Abatement Advisory Committee Councilmember Wagner moved and Councilmember Thordarson seconded to adopt Resolution No. 4015. Resolution No. 4016 A1.3.1 A Resolution of the City Council of the City of Auburn, Washington, expressing concern about the serious impacts of the proposed annexation of territory in South King County by King County Public Hospital District Number One, Proposition No. 1 - Valley Medical Center Annexation (annexing Maple Valley and Black Diamond areas and providing for taxes for the calendar year 2006 of 59 cents per $1,000 of assessed valuation - Resolution No. 830) Councilmember Norman moved and Councilmember Thordarson seconded to adopt Resolution No. 4016. Mayor Lewis invited members of the audience to speak regarding Resolution No. 4016. No one from the audience requested the opportunity to comment. MOTION CARRIED UNANIMOUSLY. 6-0. 3. Resolution No. 4017 A3.13.8 WSC04-0030 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an Outside Utility Extension Agreement between the City of Auburn and Karnail Singh for extension of water and sewer services to property located at 12017 SE 304th Street Councilmember Norman moved and Councilmember Cerino seconded to adopt Resolution No. 4017. In response to questions from Councilmember Wagner regarding half street improvements, Community Development Administrator David Osaki stated that the half street improvement requirement cited is for SE 304th Street. This is a private tract and the applicant is building a tract that exceeds the City's standards. Councilmember Wagner also inquired regarding the discharge of the private storm water detention vault. Director Dowdy indicated that the discharge follows the natural drainage pattern. MOTION CARRIED UNANIMOUSLY. 6-0. Page 13 City of Auburn Council MeetinQ Minutes May 1. 2006 4. Resolution No. 4018 A3.17 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute a Lease Agreement between the City and Clearwire LLC, for the purpose of leasing property for communication equipment Councilmember Wagner moved and Councilmember Thordarson seconded to adopt Resolution No. 4018. MOTION CARRIED UNANIMOUSLY. 6-0. 5. Resolution No. 4019 04.6.3 PR C516A A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor to execute a Public Works Trust Fund Loan Agreement between the City of Auburn and the Public Works Board for Project No. C516AS, Auburn Way South Sewer, Phase II Councilmember Wagner moved and Councilmember Thordarson seconded to adopt Resolution No. 4019. MOTION CARRIED UNANIMOUSLY. 6-0. 6. Resolution No. 4020 A3.16.3 A Resolution of the City Council of the city of Auburn, Washington, authorizing the Mayor and City Clerk to execute an Agreement with Thompson Smitch Consulting Group, Inc to assist the City to secure water rights from the Washington State Department of Ecology for the purposes of meeting the City's water needs Councilmember Norman moved and Councilmember Thordarson seconded to adopt Resolution No. 4020. MOTION CARRIED UNANIMOUSLY. 6-0. IX. MAYOR'S REPORT A. Executive Session At 8:54 p.m., Mayor Lewis recessed the meeting to executive session for approximately thirty minutes for the purpose of discussing pending litigation and property acquisition. Mayor Lewis reconvened the meeting at 9:21 p.m. X.
