HomeMy WebLinkAbout12-18-2006 AUBBRN WASHINGTON CITY COUNCIL MEETING MINUTES December 18, 2006 7:30 PM I. CALL TO ORDER A. Flag Salute Mayor Peter B. Lewis called the meeting to order at 7:30 p.m. and led those in attendance in the Pledge of Allegiance. B. Roll Call Mayor Lewis and the following Councilmembers were present: Rich Wagner, Sue Singer, Gene Cerino, Nancy Backus, Bill Peloza, Roger Thordarson, and Lynn Norman. Staff members present included: Public Works Director Dennis Dowdy; Planning, Building and Community Director Michael Davolio; Finance Director Shelley Coleman; Parks, Arts and Recreation Director Daryl Faber; Information Services Director Lorrie Rempher; City Attorney Daniel B. Heid; Senior Planner Elizabeth Chamberlain; Deputy Fire Chief Mike Gerber; Deputy Police Chief Bob Lee; and City Clerk Danielle Daskam. C. Announcements and Appointments 1. Announcements a) 2007 State Legislative Agenda Government Relations Manager Carolyn Robertson distributed copies of the 2007 Draft State Legislative Agenda. Ms. Robertson noted that Representative Geoff Simpson will sponsor legislation on behalf of the City to place SR 164 on the highways of statewide significance. The City of Auburn has applied for two grants for capital projects and recreational programs; one for Mary Olson Farm and the other for soccer fields, which Ms. Robertson will be monitoring throughout the state funding allocation process. The Page 1 City of Auburn Council Meetin~ Minutes December 18,2006 City will be supporting the Association of Washington Cities Legislative Agenda next year. b) Children's Christmas Party Mayor Lewis announced the names of the Children's Christmas Party coloring contest. The Children's Christmas Party, sponsored by the Travelodge Suites in Auburn and Volunteers of America as well as many other volunteer groups and contributors, is held for children whose parents are unable to spend the holidays with their children. Contest winners were: Sadie, Jarae, Jackson, and Dakota. 2. Appointments There were no appointments for Council consideration. D. Agenda Modifications Resolution No. 4128 was added to the agenda and a revised Ordinance 6069 was distributed prior to the meeting. II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings No public hearing was scheduled for this evening. B. Audience Participation This is the place on the agenda where the public is invited to speak to the City Council on any issue. Those wishing to speak are reminded to sign in on the form provided. Joe Binetti, 609 21st Street SE, Auburn Mr. Binetti recalled his previous comments during the October 16, 2006 Council meeting regarding the condition of H Street SE between 1ih and 21st Streets. He inquired whether there was any new information to report regarding H Street SE. Mr. Binetti also commented on the elimination of audience participation from the televised Council meetings. He spoke in favor of broadcasting the audience participation portion of the Council meeting. Councilmember Wagner stated that he prepared a binder of information related to the proposed local improvement district project for Mr. Binetti. Traffic Engineer Laura Philpot was to contact Mr. Binetti to discuss the information. There is no requirement to broadcast the audience participation portion of the meeting. Comments under audience participation are not and have never been televised since the time Council meeting broadcasts began. Many other cities do not televise the audience participation portion of their meetings. C. Correspondence No correspondence was received for City Council review. III. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chair Cerino reported the Municipal Services Committee met this evening at 5:00 p.m. The Committee approved consent items and recommended approval of Ordinance No. 6069, Resolution No. 4125, and Resolution No. 4127. The Committee discussed Resolution No. 4123, Resolution No. 4124, Resolution No. 4128, an address change for the Wesley Homes development, emergency radio station signal coverage, potential patrol car design changes, and the Auburn Jail study. The next regular meeting of the Municipal Services Committee is scheduled for January 2,2007. B. Planning & Community Development Chair Norman reported the Planning and Community Development Committee met December 11, 2006. The Committee reviewed zoning map amendments (Ordinance No. 6067), Ordinance No. 6068 relating to a transportation impact fee exemption extension, and Resolution No. 4128 establishing a moratorium on used manufactured homes. The Committee discussed a proposed 48- unit condominium development, the downtown urban center rezone, an amendment to posting of public notices, Lakeland Hills addressing, and an update on sidewalk design work. The next regular meeting of the Planning and Community Development Committee is scheduled for January 8, 2007 at 5:00 p.m. C. Public Works Chair Wagner reported the Public Works Committee met December 11, 2006. The Committee renewed right-of-way permits and discussed design standards. The Committee also approved the annual on-call agreements, contract administration items, Resolution No. 4120 relating to a street vacation, and Resolution Page 3 City of Auburn Council Meetin~ Minutes December 18,2006 No. 4122 relating to truck impact fees. The Committee discussed Ordinance No. 6068 relating to exemption of impact fees for downtown development, Ordinance No. 6067 implementing zoning map amendments, the proposed Sunndalen condominium development agreement, an update on Mill Creek restoration, patrol car redesign, an easement relinquishment, and an update on Project No. C322A West Main Street Improvements. The next regular meeting of the Public Works Committee is scheduled for January 8, 2007 at 2:30 p.m. D. Finance Chair Backus reported the Finance Committee met earlier this evening at 6:30. Chair Backus thanked Councilmember Lynn Norman for her service as vice chair of the Committee. Councilmember Norman will be leaving the Finance Committee to serve on the Municipal Services Committee. The Finance Committee approved claims and payroll vouchers, Resolution No. 4123, and Resolution No. 4124. The Committee discussed Ordinance No. 6057, Ordinance No. 6068, Resolution No. 4123, Resolution No. 4124 and Resolution No. 4125. The next regular meeting of the Finance Committee is scheduled for January 2, 2007 at 6:30 p.m. E. Committee on Committees Chair Wagner reported the Committee on Committees met December 4, 2006 and Resolution No. 4126 designating the Council committees for 2007 is on the agenda this evening. IV. REPORTS At this time Councilmembers and the Mayor may report on items not specifically described on the agenda, which are of interest to the community. A. From the Council Mayor Pro Tem Singer reported that she and Mayor Lewis toured Vision House, a facility in Renton which serves as drug and alcohol rehabilitation transitional housing. She also attended the groundbreaking for the Veterans Memorial Park Building, led a Leadership Institute class of a mock City Council meeting, and attended a joint meeting of the transportation, economic development and growth management policy boards of the Puget Sound Regional Council. Mayor Pro Tem Singer expressed gratitude to City staff for their efforts during and after the recent windstorm. Page 4 City of Auburn Council Meetin~ Minutes December 18.2006 Councilmember Wagner reported that he attended a Regional Access Mobility Project meeting in Pierce County where discussion focused on funding for arterial streets and state highways. Councilmember Wagner also attended a Metropolitan Waste Management Advisory Committee meeting where discussion centered on transfer station issues. Councilmember Backus reported that she attended the National League of Cities Conference, where she is a member of the Finance, Administration and Intergovernmental Relations Committee. Councilmember Backus also reported on her attendance at the second Citizens Emergency Response Training (CERT) graduation. Councilmember Norman reported on the groundbreaking ceremony for the new Veterans Memorial Park Building, a ribbon cutting ceremony for the new Multicare Urgent Care Center, and the Santa Breakfast. Councilmember Norman thanked City staff and Puget Sound Energy for their efforts during the recent windstorm and subsequent power outages. Councilmember Norman thanked Councilmember Cerino for his service on the Planning and Community Development (PC D) Committee. Councilmember Cerino is leaving the PCD Committee to serve on the Finance Committee. Councilmember Cerino announced that seven Auburn wrestlers placed in the high school Tri-state wrestling tournament. He congratulated all the Auburn wrestlers. Councilmember Cerino also reported on the Santa Breakfast held at the Auburn Senior Center, where Councilmember Cerino was in charge of making the pancakes. Councilmember Thordarson reported on his attendance at the National League of Cities Conference. Councilmember Thordarson is a member of the National Committee for Human Development and also attended sessions on transportation and infrastructure. Councilmember Thordarson also attended the second Citizens Emergency Response Training (CERT) graduation. Councilmember Peloza reported on his attendance at the National League of Cities Conference where Councilmember Peloza is a member of the Energy, Environment and Natural Resources Committee. Councilmember Peloza also reported on his Page 5 City of Auburn Council Meetin~ Minutes December 18.2006 attendance at the Veterans Memorial Park Building groundbreaking ceremony and thanked the American Legion for their contribution to this project. Additionally, Councilmember Peloza reported on a recent DARE graduation at Washington Elementary and announced that a Christmas lunch will be held tomorrow at the Auburn Senior Center. B. From the Mayor Mayor Lewis commented on the formation of the Valley Regional Fire Authority and noted that this evening is the last Council meeting where a member of the Auburn Fire Department will attend. Mayor Lewis congratulated Deputy Chief Gerber and the Auburn Fire Department for their service to the City. Mayor Lewis also commented on the recent windstorm and power outages and commended the work of city crews, police personnel and fire personnel. Mayor Lewis also expressed appreciation to Puget Sound Energy for their cooperation and attention to providing the City with direct updates of their power restoration work. Mayor Lewis also commented on lack of available funding for transportation improvements and the need for the industrial users to work with community organizations to ensure funding for arterials. Mayor Lewis spoke regarding the new Veterans Memorial Park Building where the Office of Veterans Affairs will maintain an office for South King County. Mayor Lewis also attended the Regional Policy Committee, the Police Volunteers banquet, and the East Pierce County Transportation Coalition meeting. Mayor Lewis announced the General Services Administration's dedication of approximately 8.5 acres of property to the City. The property is currently leased to the City for the location of Fire Station 33. V. Ordinance No. 6057 F3.21 An Ordinance of the City Council of the City of Auburn, Washington, amending Ordinance No. 5970, the 2006 Budget Ordinance as amended by Ordinance No. 6004 and Ordinance No. 6032 authorizing amendment to the City of Auburn 2006 Budget as set forth in Schedule "A" Councilmember Backus moved and Councilmember Norman seconded to introduce and adopt Ordinance No. 6057. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Ordinance No. 6067 03.4.2.1.2 An Ordinance of the City Council of the City of Auburn, Washington, relating to planning; adopting zoning map amendments to implement the Comprehensive Plan and amending the City's zoning maps accordingly Planning, Building and Community Director Davolio reported that earlier this evening the Planning Commission held a public hearing on the remaining 2006 Zoning Map Amendments for Areas X and AA. Staff presented a proposed rezone change for Area X from M-2 Heavy Industrial to C-3 Heavy Commercial and R-4 Multiple Family Residential. The proposed rezone change for Area AA is from R-3 Two-family, Duplex Residential to C-3 Heavy Commercial. Staff recommended approval for both areas. The Planning Commission ultimately recommended denial for Area X. The rezone for Area X is included in Ordinance No. 6067. Area AA will be addressed separately, at a later date. Councilmember Norman moved and Councilmember Cerino seconded to introduce and adopt Ordinance No. 6067. Ordinance No. 6068 F4.3 An Ordinance of the City Council of the City of Auburn, Washington, amending Auburn City Code Section 19.04.070 of the Auburn City Code related to transportation impact fees by amending of the Auburn City Code "Exemptions" to provide for an exemption from the payment of transportation impact fees for development activity in the Downtown Plan Area which exemption shall have a sunset date of June 30, 2007 Councilmember Norman moved and Councilmember Cerino seconded to introduce and adopt Ordinance No. 6068. MOTION CARRIED UNANIMOUSLY. 7-0. 4. Ordinance No. 6069 F4.3 An Ordinance of the City Council of the City of Auburn, Washington, amending Chapter 8.08 of the Auburn City Code relating to solid waste Councilmember Cerino moved and Councilmember Peloza seconded to introduce and adopt Ordinance No. 6069 as revised and distributed earlier. In response to a question from Councilmember Singer, Councilmember Cerino advised that adjustments in fees were made to eliminate, as much as possible, the subsidy of one class of customer by another class of customer. MOTION CARRIED UNANIMOUSLY. 7-0. B. Resolutions 1. Resolution No. 4122 F4.3 A Resolution of the City Council of the City of Auburn, Washington, providing for amendment to the City of Auburn Fee Schedule, to adopt truck-dependant land use supplementary transportation impact fees Councilmember Wagner moved and Councilmember Thordarson seconded to adopt Resolution No. 4122. In response to a question from Councilmember Singer, Finance Director Coleman confirmed that the truck- dependent land use supplementary transportation impact fees will be separately accounted for from other transportation impact fees under a separate account. Resolution No. 4125 A1.3 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor to execute a Seattle - King County Department of Public Health Memorandum of Understanding on the Local Hazardous Waste Management Program for 2007 activities in the amount of Thirteen Thousand Four Hundred Twenty Dollars and Forty Seven Cents ($13,420.47) Councilmember Cerino moved and Councilmember Peloza seconded to adopt Resolution No. 4125. Resolution No. 4127 A3.16.3 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute Amendment No. 1 to Agreement for Professional Services AG-C-286 between the City of Auburn and Harris & Associates, Inc. Resolution No. 4128 A Resolution of the City Council of the City of Auburn, Washington establishing for an initial six months a moratorium on the filing of applications for licenses, permits, and approvals for the siting, placement or installation of used manufactured homes within the City of Auburn, other than in mobile home parks, and setting a public hearing for the 2nd day of January 2007, to consider the moratorium on the filing of applications for certain permits and approvals for the siting, placement or location of used manufactured homes within the City Councilmember Norman moved and Councilmember Cerino seconded to adopt Resolution No. 4128. MOTION CARRIED UNANIMOUSLY. 7-0. 9. Resolution No. 4129 03.4.2.1.2 A Resolution of the City Council of the City of Auburn, Washington, extending for an additional six months a moratorium on the filing of applications for licenses, permits and approvals for commercial and industrial land uses zoned M1 (Light Industrial) and M2 (Heavy Industrial) along and near the east side of the A Street SE corridor and setting a public hearing for the 16th day of January, 2007, to consider the moratorium on the filing of applications for certain licenses, permits and approvals for commercial and industrial land uses in said area Councilmember Norman moved and Councilmember Cerino seconded to adopt Resolution No. 4129.
