Lewis called the meeting to order at 7:30 p.m. and led those in .attendance in the Pledge of Allegiance. B. Roll Call Mayor Lewis and the following Councilmembers were in attendance: Rich Wagner, Sue Singer, Gene Cerino, Nancy Backus, Bill Peloza, Roger Thordarson, and Lynn Norman. C. Announcements and Appointments 1. Announcements a) Auburn Riverside and Mountainview Girls Basketball Teams Mayor Lewis introduced Head Coach Chris Carr who was joined by Assistant Coaches Pete DeBolt, Eva Means, and Cary Davidson. Page 1 Citv of Auburn Council Meeting Minutes April 16, 2007 Head Coach Carr stated that, in only their second year of existence, the Mountainview High School Girls Varsity Basketball team took eighth place at the 2007 WIAA - 3A Girls Basketball tournament. On behalf of the City of Auburn, Mayor Lewis commended the outstanding efforts of the coaches and congratulated the Mountainview High School Girls Varsity Basketball team on their accomplishments and presented the following team members with a certificate and chocolate basketballs on-a- stick created and donated by Gosanko Chocolate Art in their honor: Chioma Amaefule Nicole Ball Nicole Claudon Kirsten Fausko Katie Herren Michelle Mallow Alix Martinet Candice Prigget Hannah Samradottir Kadi Seward Mallory Thiesen Mountainview High School Vice Principal Terri Herren expressed her appreciation to the Auburn community and reported that three of the four coaches are Auburn High School graduates and now work in Auburn, one coach is married to an Auburn High graduate, and all four coaches were her students. b) Proclamation - "Lions White Cane Days" Mayor Lewis declared May 4 and 5, 2007 as "Lions White Cane Days" in the city of Auburn. Mayor read the proclamation and noted that all funds raised through this event are used toward helping the site impaired. 2. Appointments There were no appointments. Agenda Modifications Agenda modifications included removal of contract administration item IV.C.1, a revised Schedule A to Ordinance No. 6092, the addition of Ordinance No. 6093, and the addition of Resolution No. 4178. II. CITIZEN INPUT, PUBLIC HEARINGS ~ CORRESPONDENCE A. Public Hearings 1. 2006 Consolidated Annual Performance and Evaluation Report (CAPER) for the Community Development Block Grant Program 03.4.1.7, F5.4.3 The CAPER is an overall review of housing and community development activities undertaken in Auburn during 2006. Its primary purpose is to inform the citizens of Auburn how and where the federal funds are spent, and assess the program accomplishments as they relate to housing and community development goals set forth in the Consolidated Plan. The purpose of this hearing is to solicit public comments prior to approval of the CAPER and submission of the report to the U.S. Department of Housing and Urban Development. Senior Planner Michael Hursh gave a brief staff report on the purpose of the CAPER and the various social services provided through funding from the Community Development Block Grant Program and revenue -from the City's General Fund. Mayor Lewis opened the public hearing at 7:45 p.m. No one in the audience requested to speak. Mayor Lewis closed the public hearing at 7:46 p.m. 2. Address Changes -Lakeland Hills Area 04.9.2 The City Council to conduct a public hearing on the City's proposal to institute address changes in the Lakeland Hills area in order to bring the addresses in compliance with the City's addressing system. Page 3 City of Auburn Council Meeting Minutes April 16, 2007 Building Division Manager Jim Tinner reported that the purpose of the hearing is to provide the City Council with information to make a determination regarding the proposed address changes and to allow public testimony per Auburn City Code Section 12.52.100. The scope of the changes are 106 buildings consisting of 136 dwellings. The methodology for selecting the proposed changes were based on reviews by representatives from Building, Fire and Police. Address changes are based solely on those which pose a risk for significant delays in emergency services. While other addresses have been identified as anomalous, they did not pose a significant risk of delay in emergency services. Benefits to the proposed changes include the elimination of the need to maintain a separate premise history database in the Valley Communications system, reduction in mail delivery errors, and ability for delivery services and visitors to locate the properties with minimal confusion. Concerns have been expressed by those affected by the address changes related to potential impacts on credit ratings. Staff has informally queried multiple credit granting entities and were assured that the impact on credit ratings will be minimal or non-existent, and City staff are prepared to provide a letter to credit agencies explaining the circumstances regarding the address changes due to corrective action taken by the City. The post office also provided written assurance that they will honor both old and new addresses for a minimum of one full year. Actions by the City and the post office should minimize any financial impact on property owners. Mr. Tinner reported that a public meeting was conducted at Riverside High School in an effort to provide information to and hear concerns from the affected property owners. Fourteen members of the public attended. Mr. Tinner explained that, if the Council approves address changes proposed by staff, notification will be sent to each property owner and over forty public agencies, and road signs requiring changes will be identified. New road signs will include the name of the former roadway. New address assignments will be effective June 1, 2007 and existing addresses may be used until June 1, 2008. The City now employs an electronic mapping system to determine address assignments. Page 4 City of Auburn Council Meeting Minutes April 16, 2007 Councilmember Wagner suggested that, for the convenience of affected citizens, staff provide a letter addressed "to whom it may concern" explaining the situation with regard to credit agency issues in addition to providing a copy of the notification of the address changes to the Post Master. In response to a question from Councilmember Singer, Mr. Tinner stated that selection .criteria for the address changes were only those addresses that would cause a significant delay in emergency response services. There are other addresses that do not precisely follow the grid such as the address referred to in the correspondence from Mr. and Mrs. McGrath. To correct every address would involve renaming several roads which would affect several hundred additional homeowners. All Valley Regional Fire Authority (VRFA) staff are trained on the addressing issues in the Lakeland Hills area. Mayor Lewis pointed out that VRFA staff have participated in the review group. The addressing issues surfaced approximately one year ago. At that time, staff did what was necessary to protect the public with regards to emergency response services. The review group has been meeting for over a year in an effort to produce the correct solutions as presented this evening. Councilmember Singer stressed that she introduced the question in an effort to assure the public that fire and police staff are well trained regarding the addressing in the Lakeland Hills area. Mayor Lewis opened the public hearing at 7:55 p.m. Len DeLeon, 1880 Arapaho Street, Denver, Colorado Mr. DeLeon stated that he has just been appointed the Postmaster in Auburn and that this is his first day on the job. Mr. DeLeon expressed his concerns regarding the proposed secondary addressing for the condominiums in the Lakeland Hills area. Mr. DeLeon stated that using an alpha numeric system could provide a potential for mail delay if the addressees do not use their letter designation properly. Mr. DeLeon gave several examples of potential problems using Page 5 Citv of Auburn Council Meeting Minutes April 16, 2007 an alpha numeric system and requested that the City consider using a numeric system versus an alpha numeric system to eliminate the potential for errors and delays in mail delivery. Andrea Crabtree, Verona North, 860 63~d Street SE, Auburn Ms. Crabtree stated that she resides on one of the streets that will be affected by the address changes. Although she recognizes the need for the address changes, she requested that staff explain what constitutes a significant delay in emergency response services. Ms. Crabtree indicated that her street name has already been changed once. She expressed concern that more changes will be required in the future. Ms. Crabtree inquired regarding monetary issues related to the proposed address changes and requested that the City change all the addresses that are incorrect rather than only a portion. Mayor Lewis stressed that monetary issues did not enter into the discussion regarding the need for the address corrections. Staff determined that making changes to a small number of addresses did not constitute the impact the changes would create for several hundred other addresses. Mr. Tinner stressed that emergency responders are drilled on the addressing in the Lakeland Hills area, were involved in the review process, and concur with the proposed changes. Mr. Tinner also stated that the secondary addresses were not assigned by the City, which does not allow alphabetic characters in secondary addressing. The secondary addresses were recorded in Pierce County and are now in the official recorded records. Councilmember Backus inquired what constitutes a significant delay and response time and also whether the City is correcting the secondary alpha numeric addresses. Mr. Tinner stated that the City can notify Pierce County that the alpha numeric addresses are not the addresses assigned by the City. Mr. Tinner suggested that the emergency responders address the question on the classification of a significant delay. Page 6 City of Auburn Council Meeting Minutes April 16, 2007 Mayor Lewis stated that the issues of significant delay have been left to the judgment of the City's public safety officers. Anomalies on street names exist throughout the City due to various reasons, including annexations. Public safety officers determined that it is safer to use the choices they have provided this evening regarding the proposed address changes. Andrea Crabtree, 860 63~d Street SE, Auburn Ms. Crabtree urged Council to correct all addressing rather than only some of the addressing issues in the Lakeland Hills area. No one else requested to speak. Mayor Lewis closed the public hearing at 8:07 p.m. B. Audience Participation This is the place on the agenda where the public is invited to speak to the City Council on any issue. Those wishing to speak are reminded to sign in on the form provided. Judi Roland, 30724 Green River Road, Auburn Ms. Roland stated that she is a Board member of the White River Valley Museum. Ms. Roland requested that Council support resolutions regarding the Preserve America designation and also extension of the Mary Olson Farm lease. Ms. Roland presented a gift of blackberry jam made from berries produced at the Mary Olson Farm. Mildred Warwick, 25 Pike Street NE, Auburn Ms. Warwick stated that she received a parking ticket for a vehicle parked on a public street with expired license tabs on April 4, 2007. She indicated that she spoke with the officer issuing the ticket with regard to receiving a warning of the infraction. Ms. Warwick stated that the officer responded that ignorance of law is no excuse and that he was obligated to issue the citation once he began writing it. She asked to move her vehicle onto her property and the officer refused her request. Ms. Warwick inquired regarding City policy on issuance of a warning City Attorney Heid stated the every police department must have standards of operation. It is not uncommon for the standards to Page 7 City of Auburn Council Meeting Minutes Agril 16, 2007 state that once the writing of a ticket is commenced, it should not be stopped. Potential problems could occur if standards were not in place to provide fairness to all citizens. City Attorney Heid stated that Ms. Warwick has the opportunity to address the court regarding her ticket. Standards are in place so that every officer operates in the same manner. Police Chief Kelly stated that standards are in place to maintain integrity throughout the department. City of Auburn Police Standards state that once a citation is started for a valid violation, it must be completed and issued. Citations are audited and the standards are in place to maintain the integrity of the audit system. Additionally, moving or driving a vehicle with expired tabs on a public roadway is traffic offense. Ms. Warwick expressed her .displeasure regarding her citation and requested that the City develop standards regarding issuance of warnings. Virginia Haugen, 2503 R Street SE, Auburn Ms. Haugen distributed a petition to the City Clerk containing fifty- two signatures requesting that the City of Auburn replace the sidewalk in front of the ACE Project on Main Street by July 1, 2007. Mayor Lewis stated that the City has already contacted the Cavanaugh family regarding issues related to the ACE Project. C. Correspondence 1. Letter dated March 30, 2007 addressed to Mayor Peter B. Lewis from Pierce Transit Clerk of the Board regarding election of at-large position to the Board of Commissioners for Pierce Transit. 2. Undated letter received via email addressed to Michael Davolio from Ross and Dorianne McGrath regarding address changes in the Lakeland Hills area. III. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chair Cerino reported that the Municipal Services Committee met this evening at 5:00. The Committee discussed Resolution Nos. 4171, 4176 and 4177. The Committee also received an update on Page 8 City of Auburn Council Meeting Minutes April 16, 2007 the Auburn Municipal Airport, and discussed the Solid Waste Fund, Cable Utility Tax, Mountain View Cemetery Mausoleum, and the Veterans building. The Committee also discussed the Goedecke North DOT/Mill Creek bypass and Resolution No. 4178, received a report on the Police Department workload analysis, and updated the Municipal Services Committee matrix. The next regular meeting of the Municipal Services Committee is scheduled for May 7, 2007 at 5:00 p.m. B. Planning & Community Development Chair Norman reported the Planning and Community Development Committee met on April 9, 2007 at 5:00 p.m. The Committee discussed and recommends approval Resolution Nos. 4171, 4172, and 4173. The Committee also reviewed Auburn jail needs related to size, location, time line, and the need for a decision in year 2007. The Committee recommends moving forward using existing studies rather than performing an additional study of jail needs. The Committee also discussed the Parks Department long range plan regarding the Museum and Mary Olson Farm, West Valley Highway pedestrian trail, Les Gove Community Center location, design and funding strategies, southeast Main Street neighborhood improvements on 2"d Street, theater plan and community plan and work performed by Consultant Steven Wright, request for consistency letter from Valley Cities Counseling and Consultation, and public art, and reviewed the Planning and Community Development Committee matrix. The next regular meeting of the Planning and Community Development meeting is scheduled for April 23, 2007 at 5:00 p.m. C. Public Works Chair Wagner reported that the Public Works Committee met April 9, 2007 at 2:30 p.m. The Committee approved aright-of-way permit and discussed and recommends approval of Resolution No. 4175 and Ordinance No. 6093. The Committee also received an update on the Shoreline Master Program, reviewed the CAPER, discussed sub-meter billing, monthly utility billings, the 2006 Save Our Streets (SOS) Program, grant status, projects supported by the Public Works Department, and received a capital project status report. The next regular meeting of the Public Works Committee is scheduled for April 23, 2007 at 2:30 p.m. D. Finance Chair Backus reported that the Finance Committee met this evening at 6:30. The Committee reviewed and recommends Page 9 City of Auburn Council Meeting Minutes April 16, 2007 approval of claims and payroll vouchers, Ordinance No. 6092, and Resolution Nos. 4176, 4177, and 4178. The Committee also discussed Ordinance No. 6094, monthly utility billings, solid waste fund, cable utility tax, Public Works Department additional staff needs, and the Veterans and Cemetery mausoleum buildings. The next regular meeting of the Finance Committee is scheduled for May 7, 2007 at 6:30 p.m. IV. REPORTS At this time Councilmembers and the Mayor may report on items not specifically described on the agenda, which are of interest to the community. A. From the Council Mayor Pro Tem Singer reported on several presentations she has made and an interview she has scheduled with Comcast for broadcast on CNN related to Auburn Tourism. Mayor Pro Tem Singer invited groups to contact her if they would like to hear a presentation on tourism in the City of Auburn. She also attended a Puget Sound Regional Council (PSRC) General Assembly meeting at which she was elected president. She presented an Award for Sustained Leadership to Senator Patty Murray and was privileged to thank Senator Murray on behalf of the PSRC. Mayor Pro Tem Singer spoke regarding attendance at the Auburn Area Chamber of Commerce meeting at which Auburn Senior Planner Michael Hursh was presented the Citizen of the Quarter Award and Pierce County Councilmember Shawn Bunney spoke regarding the Regional Transportation Investment District. Mayor Lewis congratulated Mayor Pro Tem Singer for her election as president of the four-county PSRC. Councilmember Wagner reported that he attended the Regional Access Mobility Partnership meeting which focused on how to generate support for State Route 167 and committee assignments to contact State Legislators. He also attended the PSRC meeting and spoke regarding Senator Murray's speech regarding regional prosperity and transportation. He and Councilmember Backus participated in a Senior Center Open Forum at which they addressed many issues including the Auburn Community Center, planting of laurel bushes on A Street SE, graffiti issues, the sewer survey in the Dogwood area, pedestrian safety, sidewalks, theater, and visual blight. Page 10 City of Auburn Council Meeting Minutes April 16, 2007 Councilmember Backus reported that she attended the Leadership Institute of South Puget Sound Class of 2007 at which the Police Chief of Federal Way spoke very highly of Auburn Police Chief Kelly. Councilmember Backus commended Chief Kelly and thanked him for his great leadership style. Councilmember Backus also spoke regarding challenges provided by many seniors at Senior Center Open Forum. Councilmember Norman reported that she attended the PRSC Growth Management Policy Board, LEOFF Board meeting, and the Auburn Avenue Theater Community meeting led by Consultant Steven Wright. Councilmember Norman commended the Theater Committee for their dedication to the theater. She also attended the YMCA Healthy Kids Day. Councilmember Norman thanked the City of Auburn for providing the open pool days at the YMCA and spoke regarding the appreciation expressed by the community. Councilmember Cerino reported that he attended PSRC Transportation Committee. Councilmember Cerino emphasized the importance and significance of this committee which was officially designated as the lead agency for distribution of transportation funds. Councilmember Cerino stressed the importance of the organization and expressed his pride in Mayor Pro Tem Singer for her election as president of the PSRC. Councilmember Cerino explained that he attends the PSRC Transportation Committee as a representative of Pierce County cities. Mayor Lewis reported that the City of Auburn is the sixth largest city located within Pierce County. Mayor Lewis commended Councilmember Cerino for his representation on the PSRC Transportation Committee and spoke regarding the difficulties and challenges in working with two counties. Councilmember Thordarson reported that he attended the Annual Arbor Day tree planting. A striking fir tree was planted weighing over 500 pounds at Les Gove. He also attended the YMCA Healthy Kids Day and reported on the success of the event and partnering of the various groups. Councilmember Peloza reported that, since the last Council meeting, he has attended ten events on behalf of the City of Auburn. He attended the Annual Auburn Girls and Boys Club Page 11 City of Auburn Council Meeting Minutes April 16, 2007 Breakfast Fundraiser at which over $60,000 was raised and former Seattle Mariner Edgar Martinez was the guest speaker. He also attended the King County Regional Water Quality Committee meeting at which they discussed water quality and the proper disposal of household pharmaceuticals and, when disposed of improperly, their adverse affects on rivers, lakes, streams, fish, and wildlife. Councilmember Peloza also spoke regarding the tree donated by Auburn Garden Club for the Annual Arbor Day tree planting and thanked the Club for their donation. He also attended a King County Solid Waste Advisory Committee at which members discussed future technologies for disposal of solid wastes. Councilmember Peloza reported on the master schedule for closure of Cedar Hills Landfill for year 2016. B. From the Mayor Mayor Lewis spoke regarding the impacts related to the closing of the Cedar Hill Landfill, including increases in solid waste rates. At this time, most cities in the Puget Sound region, excluding Auburn, do not require trash pick up or recycling. Required recycling could extend the life of the landfill as much as five to ten years. Mayor Lewis spoke regarding all the committees and community involvement by Auburn Councilmembers and commended their efforts and thanked them for all their work for the City of Auburn. V. CONSENT AGENDA All matters listed on the Consent Agenda are considered by the City Council to be routine and will be enacted by one motion in the form listed. A. Minutes 1. Minutes of the April 2, 2007 regular City Council meeting. B. Vouchers F4.9.2, F4.9.5 1. Claims Claims check numbers 361357 through 361758 in the amount of $2,786,827.33 and a wire transfer in the amount of $4,064.84 and dated April 16, 2006. Councilmember Singer moved and Councilmember Wagner seconded to approve the consent agenda. MOTION CARRIED UNANIMOUSLY. 7-0. VI. UNFINISHED BUSINESS There was no unfinished business. VII. NEW BUSINESS A. Pierce Transit Board of Commissioners City Council to consider the following nominees and cast its vote for an at-large position on the Pierce Transit Board of Commissioners: Dave Enslow, City of Sumner Jim Rackley, City of Bonney Lake Councilmember Singer moved and Councilmember Wagner seconded to cast the Council's vote for Dave Enslow for an at-large position on the Pierce Transit Board of Commissioners. MOTION CARRIED UNANIMOUSLY. 7-0 VIII. ORDINANCES AND RESOLUTIONS A. Ordinances 1. Ordinance No. 6090 03.5 PLT07-0001 An Ordinance of the City Council of the City of Auburn, Washington, approving the final plat of North Tapps Estates and authorizing the execution of the Bonneville Power Administration Land Use Agreement in connection therewith Councilmember Norman moved and Councilmember Backus seconded to introduce and adopt Ordinance No. 6090. Page 13 City of Auburn Council Meeting Minutes April 16, 2007 Councilmember Wagner referred to the detailed portion relating to the detention pond and requested a staff report Assistant City Engineer Ingrid Gaub reported that the detention pond is located in an easement area owned by the Bonneville Power Administration (BPA) and requires a Land Use Agreement. The preliminary plat conditions were approved by Pierce County, prior to annexation into the City of Auburn, who accepted the location of the pond which encroaches into the BPA easement. In response to questions from Councilmember Wagner, City Attorney Heid stated that Council has the opportunity to approve, disapprove, or remand the final plat. The City of Auburn is bound by the determinations that were developed in connection with the preliminary plat. If Council finds that the preliminary plat conditions have been met, then Council would have to approve the final plat. If Council finds that the preliminary plat conditions have not been met, then Council has the opportunity to reject or remand the final plat back to the developer. In response to questions from Councilmember Peloza, Ms. Gaub reported that the City will assume maintenance of the street lights, but the trees will be maintained by the homeowners association. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Ordinance No. 6092 F3.21 An Ordinance of the City Council of the City of Auburn, Washington amending Ordinance No. 6066, the 2007-2008 Biennial Budget Ordinance as amended by Ordinance No. 6086 and authorizing amendment to the City of Auburn 2007-2008 Budget as set forth in Schedule "A" Councilmember Backus moved and Councilmember Thordarson seconded to introduce and adopt Ordinance No. 6092. Resolution No. 4171 A3.4 A Resolution of the City Council of the City of Auburn, Washington, in support of Preserve America community designation Councilmember Norman moved and Councilmember Backus seconded to adopt Resolution No. 4171. Resolution No. 4172 05.2 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and the City Clerk to execute an addendum with the White River Valley Historical Society to extend the term of the Society's lease of the build environment at Mary Olson Farm for an additional twenty years Councilmember Norman moved and Councilmember Backus seconded to adopt Resolution No. 4172. Resolution No. 4175 04.9.1 A Resolution of the City Council of the City of Auburn, Washington, declaring an emergency with respect to replacement of a traffic signal at the intersection of Auburn Way North and First Street NE Councilmember Wagner moved and Councilmember Thordarson seconded to adopt Resolution No. 4175. MOTION CARRIED UANIMOUSLY. 7-0. 6. Resolution No. 4176 03.1 A Resolution establishing August 21, 2007 as the date of a Special Election on the question of annexation to the City of Auburn, of an unincorporated area known as the "Lea Hill Annexation Area" Councilmember Backus moved and Councilmember Thordarson seconded to adopt Resolution No. 4176. Resolution No. 4178 A3.16.6, A3.16.10 A Resolution of the City Council of the City of Auburn, Washington authorizing an Agreement for Professional Services with Olympic Security Services for security services at the Auburn Municipal Court Councilmember Backus moved and Councilmember Thordarson seconded to adopt Resolution No. 4178. MOTION CARRIED UANIMOUSLY. 7-0. At 9:04 p.m. Mayor Lewis recessed the meeting to executive session to discuss potential litigation and property acquisition for approximately thirty minutes. At 9:38 p.m., Mayor Lewis extended the executive session for approximately twenty minutes. At 9:53 p.m., Mayor Lewis extended executive session for approximately five minutes. At 9:58 p.m., Mayor Lewis extended executive session for approximately five minutes. Mayor Lewis reconvened the meeting at 10:01 p.m. Councilmember Wagner moved and Councilmember Thordarson seconded to introduce and adopt Ordinance No. 6094.
