Lewis called the meeting to order at 7:30 p.m. and led those in attendance in the Pledge of Allegiance. B. Roll Call Mayor Lewis and the following Councilmembers were present: Rich Wagner, Gene Cerino, Nancy Backus, Bill Peloza, Roger Thordarson and Bill Peloza. Mayor Pro Tem Singer was excused. Staff members present included: Chief of Police Jim Kelly, Parks, Arts and Recreation Director Daryl Faber, Public Works Director Dennis Dowdy, Information Services Director Lorrie Rempher, Interim Planning Director David Osaki, Finance Director Shelley Coleman, Human Resources and Risk Management Director Brenda Heineman, Development Services Coordinator Steven Pitcher, City Attorney Daniel B. Heid and City Clerk Danielle Daskam. C. Announcements and Appointments 1. Announcements There was no announcement. 2. Appointments There was no appointment for Council consideration. D. Agenda Modifications Agenda modifications included a revised Ordinance No. 6117, transmitted under Item VIII.A.6, a page of the exhibit to Resolution No. 4224 which was inadvertently omitted from the agenda packet transmitted under Item VI11.B.3, and a revised agenda bill related to Resolution No. 4227 transmitted under Item VIII.B.5. Page 1 City of Auburn Council Meeting Minutes August 20, 2007 II. CITIZEN INPUT, PUBLIC HEARINGS 8~ CORRESPONDENCE A. Public Hearings 1. Local Law Enforcement Justice Assistance Grant The City of Auburn's application for funding under the Department of Justice Local Law Enforcement Justice Assistance Grant (JAG) Program has been approved in the amount of $41,500 for the purpose of reducing crime and improving public safety. The City of Auburn proposes to utilize the grant to pay overtime costs for police officers engaged in community policing activities. Special conditions of the grant award require the City to encourage participation regarding the proposed use of the grant. Mayor Lewis opened the public hearing at 7:31 p.m. No one in the audience requested to speak regarding the Local Law Enforcement Justice Assistance Grant, and the hearing was closed at 7:32. B. Audience Participation This is the place on the agenda where the public is invited to speak to the City Council on any issue. Those wishing to speak are reminded to sign in on the form provided. Connie Henke, 3221 21St Street SE, Auburn Festival Director for Auburn Good OI' Days Connie Henke and other volunteer members of the Festival Committee expressed appreciation for the City Council's support of the Good OI' Days celebration throughout the year. Ms. Henke reported that she intends to create a task force to study solutions that would ensure order and safety for vendors and participants during the Good OI' Days events. Ms. Henke invited volunteers to serve on the Festival Committee. In jest, the Festival Committee presented Councilmember Peloza with a trash sack and gloves in recognition of Councilmember Peloza's attention and focus on the sanitary conditions of the Good OI' Days celebration. Virginia Haugen, 2503 R Street SE, Auburn Ms. Haugen displayed several real estate and other similar type signs that she reported removing from the public right of way along three blocks of R Street SE this evening. She urged the Council to enforce the City's sign code to control signs. Mayor Lewis and City Page 2 City of Auburn Council Meeting Minutes August 20, 2007 Attorney Heid cautioned Ms. Haugen to call the code enforcement officers rather than remove the signs herself. Code enforcement officers will be able to determine whether a sign is appropriate or in violation of City codes. C. Correspondence 1. Facsimile transmittal from Groen, Stephens, & Klinge LLP, Attorneys at Law to Auburn City Council, City of Auburn, dated and received August 10, 2007. III. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chair Cerino reported the Municipal Services Committee met this evening at 5:00. The Committee discussed several items and forwarded two items to the Council that appear on this evening's agenda. The next regular meeting of the Municipal Services Committee is scheduled for September 4, 2007 at 5:00 p.m. B. Planning & Community Development Chair Norman reported the Planning and Community Development Committee met on August 13, 2007. The Committee recommended approval of Resolution No. 4225 and Ordinance No. 6116. The Committee also discussed several other items of interest. The next regular meeting of the Planning and Community Development Committee is scheduled for August 27, 2007 at 5:00 p.m. C. Public Works Chair Wagner reported the Public Works Committee met August 13, 2007. The Committee recommended approval of several contract administration items that appear on this evening's agenda. The Committee also recommended approval of Ordinance No. 6106, Ordinance No. 6113, and Ordinance No. 6114. The Committee also discussed the Six Year Transportation Improvement Plan, the A Street SE corridor rezone, grants, and Waste Management solid waste service on West Hill. The next regular meeting of the Public Works Committee is scheduled for August 27, 2007 at 2:30 p.m. D. Finance Chair Backus reported the Finance Committee met this evening at 6:30. The Committee approved consent items, including claims Page 3 City of Auburn Council Meeting Minutes August 20, 2007 and payroll vouchers, and discussed a budget amendment, quarterly financial reports, Ordinance No. 6118, and Projects CP0617, the Cemetery Mausoleum Building, and C327A0, the Auburn Golf Course Clubhouse Project. The next regular meeting of the Finance Committee is scheduled for September 4, 2007 at 6:30 p.m. IV. REPORTS. At this time Councilmembers and the Mayor may report on items not specifically described on the agenda, which are of interest to the community. A. From the Council Councilmember Norman reported on her attendance at the ribbon cutting ceremony for the new cemetery columbarium. Councilmember Cerino reported that he and Councilmember Peloza participated in a tour of the Green River/Duwamish River Watershed. Councilmember Thordarson reported that he was pleased to serve as this year's Auburn Good OI' Days Parade Grand Marshal. Councilmember Peloza reported that he and Councilmember Cerino toured the Green River/Duwamish River Watershed where they were able to view the salmon habitat restoration conducted by the Army Corps of Engineers. B. From the Mayor Mayor Lewis announced that a ribbon cutting ceremony was held earlier today celebrating the completion of the M Street SE Improvement Project. Congressman Dave Reichert, Mayor Lewis and Councilmembers were in attendance for the re-opening of the street. Congressman Reichert was instrumental in securing $500,000 in Federal funding for the project. Additional funding came through the City's Save Our Streets Program. V. CONSENT AGENDA All matters listed on the Consent Agenda are considered by the City Council to be routine and will be enacted by one motion in the form listed. A. Ordinance No. 6106 04.10 An Ordinance of the City Council of the City of Auburn, Washington, creating a new section 10.12.405 of the Auburn Page 6 City of Auburn Council Meeting Minutes August 20, 2007 City Code relating to prohibiting motor vehicles from avoiding an intersection Councilmember Wagner moved and Councilmember Thordarson seconded to introduce and adopt Ordinance No. 6106. MOTION CARRIED. 6-0. 2. Ordinance No. 6113 04.10 An Ordinance of the City Council of the City of Auburn, Washington, amending Section 10.36.390 of the Auburn City Code relating to creating atwo-hour parking zone on A Street Southwest Councilmember Wagner moved and Councilmember Thordarson seconded to introduce and adopt Ordinance No. 6113. MOTION CARRIED. 6-0. 3. Ordinance No. 6114 04.10 An Ordinance of the City Council of the City of Auburn, Washington, amending Sections 10.36.490 and 10.36.500 of the Auburn City Code related to commercial and passenger loading zones Councilmember Wagner moved and Councilmember Thordarson seconded to introduce and adopt Ordinance No. 6114. Ordinance No. 6115 03.4.2.1.2 An Ordinance of the City Council of the City of Auburn, Washington, approving a major amendment to the Lakeland Hills South Planned Unit Development Final Development Plan Page 7 City of Auburn Council Meeting Minutes August 20, 2007 Councilmember Norman moved and Councilmember Backus seconded to introduce and adopt Ordinance No. 6115. MOTION CARRIED. 6-0. 5. Ordinance No. 6116 03.8 REZ07-0001 An Ordinance of the City Council of the City of Auburn, Washington, relating to planning; adopting zoning map amendments to implement the Comprehensive Plan and amending the City's Zone Maps accordingly Councilmember Norman moved and Councilmember Backus seconded to introduce and adopt Ordinance No. 6116. MOTION CARRIED. 6-0. 6. Ordinance No. 6117 03.10.1 CUP07-0002 An Ordinance of the City Council of the City of Auburn, Washington, approving a Conditional Use Permit to allow a professional office within an R2 Single Family Residential Zone at 119 M Street NE, Auburn, Washington Councilmember Norman moved and Councilmember Backus seconded to introduce and adopt Ordinance No. 6117. In response to questions from Councilmember Wagner, Development Services Coordinator Pitcher advised that the applicant will be required to pave the existing gravel driveway. Additionally, there is an existing fence the length of the driveway. MOTION CARRIED. 6-0. B. Resolutions 1. Resolution No. 4217 F5.4.1 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Auburn City Council to accept a Page 8 Citv of Auburn Council Meeting Minutes August 20, 2007 Bureau of Justice grant on behalf of the City of Auburn, Washington Councilmember Cerino moved and Councilmember Peloza seconded to adopt Resolution No. 4217. MOTION CARRIED. 6-0. 2. Resolution No. 4223 A3.4 A Resolution of the City Council of the City of Auburn, Washington, expressing its support for the Regional Transportation Investment District (RTID) "Roads and Transit Plan" November 2007 ballot proposition Mayor Lewis offered the opportunity to anyone in the audience to express opposition to Resolution No. 4223. No one in the audience requested to speak regarding the resolution. Councilmember Backus moved and Councilmember Thordarson seconded to adopt Resolution No. 4223. MOTION CARRIED. 6-0. 3. Resolution No. 4224 04.10 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor to execute a Commute Trip Reduction Act Interlocal Agreement between King County and the City of Auburn for the purpose of implementing the Washington State Commute Trip Reduction Act of 1991 Councilmember Wagner moved and Councilmember Thordarson seconded to adopt Resolution No. 4224. MOTION CARRIED. 6-0. 4. Resolution No. 4225 04.4.9.1.2 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and the City Clerk to execute an Agreement for Professional Services between Page 9 City of Auburn Council Meeting Minutes August 20, 2007 the City of Auburn and ESA Adolfson for the purposes of developing a Wetland Mitigation Plan for future development on the remaining open space tract within the Auburn Municipal Airport complex Councilmember Norman moved and Councilmember Backus seconded to adopt Resolution No. 4225. MOTION CARRIED. 6-0. 5. Resolution No. 4227 03.5 PLT06-0006 A Resolution of the City Council of the City of Auburn, Washington, approving a Preliminary Plat Application fora 7 lot residential subdivision known as Lakeland Area 9 within the City of Auburn, Washington Councilmember Norman moved and Councilmember Backus seconded to schedule a closed record hearing for a date to be determined. MOTION CARRIED. 6-0. At 8:02 Mayor Lewis recessed the meeting to executive session and closed session for approximately one hour in order to discuss potential/pending litigation pursuant to RCW 42.30.100(1)(1) and for an update on labor negotiations pursuant to RCW 42.30.140(4). Mayor Lewis extended the executive session twice for a total of twenty additional minutes. At 9:25 p.m. Mayor Lewis reconvened the meeting. IX.
