Lewis called the meeting to order at 7:30 p.m. and led those in attendance in the Pledge of Allegiance. B. Roll Call Mayor Lewis and the following Councilmembers were present: Rich Wagner, Sue Singer, Gene Cerino, Nancy Backus, Bill Peloza, Roger Thordarson, and Lynn Norman. Staff members present included: City Attorney Daniel B. Heid, Interim Planning, Building and Community Director David Osaki, Police Chief Jim Kelly, Parks, Arts and Recreation Director Daryl Faber, Information Services Director Lorrie Rempher, Public Works Director Dennis Dowdy, Risk Manager Rob Roscoe, Human Resources and Risk Management Director Brenda Heineman, Finance Director Shelley Coleman and Deputy City Clerk Cathy Richardson. C. Announcements and Appointments 1. Announcements a) Proclamation - "Constitution Week" Mayor Lewis declared September 17 - 23, 2007 as "Constitution Week" in the city of Auburn. Mayor Lewis read and presented the proclamation to Daughters of the American Revolution representative Hilda Meryhew. b) Washington Finance Officers Association Professional Finance Officers Award Page 1 City of Auburn Council Meeting Minutes September 4, 2007 Mayor Lewis announced that Finance Director Shelley Coleman is the recipient of the Washington Finance Officers Association's Professional Finance Officers Award. Director Coleman has been the recipient of this award for the last fourteen years. Mayor Lewis presented the award to Director Coleman. Mayor Lewis reported that, due to Director Coleman's efforts, the City of Auburn was also the recipient of the Distinguished Budget Presentation Award for the fiscal year 2007. Mayor Lewis commended the efforts of Director Coleman and the Finance Department staff. 2. Appointments There were no appointments for Council consideration. D. Agenda Modifications Agenda modification included transmittal of revised Resolution No. 4230 distributed prior to the Council meeting. II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings No public hearing was scheduled. B. Audience Participation This is the place on the agenda where the public is invited to speak to the City Council on any issue. Those wishing to speak are reminded to sign in on the form provided. Mickey Fassbind, 5220 Kersey Way SE, Auburn Ms. Fassbind distributed photos showing the impacts of the Kersey project from her property. Ms. Fassbind stated that the Kersey Planned Unit Development has caused a lot of distress and devastation in her neighborhood. Janet Koch, 2815 53~d Street SE, Auburn Ms. Koch stated that she has lived in her home for twenty years. Ms. Koch stated that the clear-cutting of trees above her property has created problems in her neighborhood and has destroyed the windbreak protecting her property. Ms. Koch indicated that she Page 2 City of Auburn Council Meeting Minutes September 4, 2007 and her neighbors lost several trees in the last wind storm. Ms. Koch expressed concerns regarding the thirty-five foot buffer which was to be part of the Kersey development to provide a windbreak and also block the view of the new development. Ms. Koch inquired regarding how long the developers have to maintain the plantings in the buffer. Ms. Koch also expressed displeasure related to the use of compression breaks within the city limits and near her neighborhood, intersection improvements at 53~d Street SE and Kersey Way, and ingress and egress issues related to Ms. Fassbind's property. Jonie Brooke, 5501 Bridgett Avenue SE, Auburn Ms. Brooke indicated that she lives approximately one mile from Ms. Fassbind and expressed concerns regarding the impacts of the Kersey projects in her neighborhood and also impacts related to improvements to Kersey Way. Ms. Brooke also inquired regarding notification of the public hearing on the 2007 Comprehensive Plan Amendments before the Planning Commission tomorrow evening. Interim Director Osaki invited Ms. Brooke to either attend the Planning Commission meeting or to submit written correspondence to express her concerns. Interim Director Osaki reviewed the function of the Planning Commission and also invited Ms. Brooke to attend the Planning and Community Development Committee meetings. Mayor Lewis reviewed the City of Auburn public hearing notice distribution practices and also suggested that Ms. Brooke request to be added to the agenda distribution lists for any boards, commissions, or committees that she may have an interest in. Ms. Brooke expressed her displeasure with the Kersey projects. Bruce Koch, 2815 53~d Street SE, Auburn Mr. Koch requested clarification regarding public hearing notice mailings. Interim Planning Director Osaki stated that the City Code does not specifically mandate the area to be notified but staff tries to notify property owners within 500 feet radius from the exterior of the Page 3 City of Auburn Council Meeting Minutes September 4, 2007 affected properties for Comprehensive Plan Amendments. The applicant is also required to post the property with the notice sign. In response to questions from Mayor Lewis, Interim Planning Director Osaki reported that plantings landscape requirements are inspected by City staff. The applicant or developer is required to tender a maintenance bond on landscaping and trees for any development within the City to insure that the landscaping survives for a one to two year period. Any landscaping that does not survive within the time frame of the bond must be replaced. Mayor Lewis requested a staff presentation at the next Planning and Community Development Committee meeting regarding the buffered area along Kersey Way. C. Correspondence No correspondence was received. III. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chair Cerino reported that the Municipal Services Committee met this evening at 5:00. The Committee discussed and recommends approval of Ordinance No. 6118 and Resolution Nos. 4229, 4232, and 4234. The Committee also discussed a supplemental annexation budget and reviewed the Municipal Services Committee matrix, including the Red Light Photo Enforcement Program and enhanced animal control services. The next regular meeting of the Municipal Services Committee is scheduled for September 17, 2007 at 5:00 p.m. B. Planning & Community Development Chair Norman reported that the Planning and Community Development Committee met August 27, 2007 at 5:00 p.m.. The Committee discussed and recommends approval of Ordinance No. 6120. The Committee also discussed zoning code amendments and received presentations on the theater plan, public art funding options, downtown plaza sidewalk design, development of the downtown urban core, transit oriented development, economic development, and the City Hall Annex block. The next regular meeting of the Planning and Community Development Committee is scheduled for September 10, 2007 at 5 p.m. Page 4 City of Auburn Council Meeting Minutes September 4, 2007 C. Public Works Chair Wagner reported that the Public Works Committee met on August 27, 2007. The Committee discussed and recommends approval of contract administration items and Resolution Nos. 4228 and 4230. The Committee also discussed Ordinance No. 6120, residential uses in industrial zoning areas, 8th and R Street NE traffic signal, and establishment of a retail water service area. The next regular meeting of the Public Works Committee is scheduled for September 10, 2007 at 2:30 p.m. D. Finance Chair Backus reported that Finance Committee met this evening at 6:30. The Committee discussed and recommends approval of claims and payroll vouchers, Ordinance No. 6119, and Resolution Nos. 4229 and 4234. The Committee also discussed Resolution No. 4232 and supplemental annexation budget, and received an update on the long term care policy for LEOFF 1 members. The next regular meeting of the Finance Committee is scheduled for September 17, 2007 at 6:30 p.m. IV. REPORTS At this time Councilmembers and the Mayor may report on items not specifically described on the agenda, which are of interest to the community. A. From the Council Mayor Pro Tem Singer congratulated Parks Department staff members regarding the opening of the Auburn Golf Course Clubhouse and Customer Appreciation Day. Councilmember Wagner also offered his congratulations regarding the opening of the Auburn Golf Course Clubhouse and Customer Appreciation Day. Councilmember Backus also offered her congratulations regarding the opening of the Auburn Golf Course Clubhouse and Customer Appreciation Day and commended staff for the City's great Summer Sounds Programs. Councilmember Norman congratulated Director Coleman on receiving the Washington Finance Officers Association's Professional Finance Officers Award and commended Finance Page 5 City of Auburn Council Meeting Minutes September 4, 2007 Department staff for their efforts related to transitioning from an annual budget to a biennial budget. Councilmember Thordarson congratulated Parks Department staff on Summer Sounds Programs and Auburn Golf Course Clubhouse and Customer Appreciation Day event. Councilmember Thordarson also reported on increased usage of public transportation due to the partial closure of Interstate 5 (I-5). Ridership on the Sounder is still up by approximately 1,000 riders after re-opening of I-5. Councilmember Peloza also offered his congratulations regarding the opening of the Auburn Golf Course Clubhouse and Customer Appreciation Day and commented on the excellent performance by Bobby Medina and his jazz group at the soft opening. Councilmember Peloza reported that the ninth, fifteenth, and eighteenth greens can be viewed from the lounge patio. The lounge and restaurant, which will be called Copper Falls, is due to open in October. The Golf Course Clubhouse project is totally supported by golf related fees. Councilmember Peloza also reported that he, Mayor Lewis, and Director Coleman met with citizens in the Palisades area of Lakeland Hills regarding a water and sewer concern at which they were able to offer a solution. B. From the Mayor Mayor Lewis commended Parks and Finance Departments staff for their efforts related to the opening of the Auburn Golf Course Clubhouse. Mayor Lewis reported that he attended forty-seven meetings during the last two weeks. Mayor Lewis also cautioned commuters to be aware of traffic difficulties occurring due to improvements on Kersey Way. Traffic backups will increase as school starts and other construction projects begin. V. CONSENT AGENDA All matters listed on the Consent Agenda are considered by the City Council to be routine and will be enacted by one motion in the form listed. A. Minutes 1. Public Works Project Number CP0740 04.9.1 CP0740 City Council award Contract 07-15, Project No. CP0740, Citywide Arterial Crack Seal Project, to Doolittle Construction LLC on their low bid of $55,300.00 3. Public Works Project Number CP0724 04.6.3 CP0724 City Council award Contract 07-17, Project No. CP0724, Lea Hill Pump Station Decommissioning, Phase 1, to Nova Contracting Inc. on their low bid of $593,359.00 plus Washington State sales tax of $44,791.83 for a total contract price of $638,150.83. 4. UNFINISHED BUSINESS There was no unfinished business. VII. NEW BUSINESS There was no new business. VIII. ORDINANCES AND RESOLUTIONS A. Ordinances 1. Ordinance No. 6118 04.4.9 An Ordinance of the City Council of the City of Auburn, Washington, amending Chapter 12.56 of the Auburn City Code relating to the Auburn Municipal Airport Councilmember Cerino moved and Councilmember Peloza seconded to introduce and adopt Ordinance No. 6118. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Ordinance No. 6119 F3.21 An Ordinance of the City Council of the City of Auburn, Washington, amending Ordinance No. 6066, the 2007-2008 Biennial Budget Ordinance as amended by Ordinance No. 6086 and Ordinance No. 6092 and Ordinance No. 6103 authorizing amendment to the City of Auburn 2007-2008 Budget as set forth in Schedule "A" Councilmember Backus moved and Councilmember Thordarson seconded to introduce and adopt Ordinance No. 6119. MOTION CARRIED UNANIMOUSLY. 7-0. 3. Ordinance No. 6120 03.4.2.1.2 Page 8 City of Auburn Council Meeting Minutes September 4, 2007 An Ordinance of the City of Auburn, Washington, amending Chapter 18.32 of the Auburn City Code and Section 18.74.030 of the Auburn City Code relating to the M1 Light Industrial Zone Councilmember Norman moved and Councilmember Backus seconded to introduce and adopt Ordinance No. 6120. MOTION CARRIED. 6-1. Councilmember Singer voted no. B. Resolutions 1. Resolution No. 4228 04.12.1 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor to accept a grant from the Washington State Department of Transportation for Safe Routes to School Improvements at Olympic Middle School Councilmember Wagner moved and Councilmember Thordarson seconded to adopt Resolution No. 4228. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Resolution No. 4229 A3.13.4 A Resolution of the City Council of the City of Auburn, Washington, .authorizing the Mayor and City Clerk to execute a Real Estate Transfer/Sale Agreement between the City of Auburn and Raymond Lazor and Nancy Lazor and Harold Gambini and execute a companion agreement, a sublease agreement between the City of Auburn and Harold Gambini Councilmember Backus moved and Councilmember Thordarson seconded to adopt Resolution No. 4229. MOTION CARRIED UNANIMOUSLY. 7-0. 3. Resolution No. 4230 04.9.3 Page 9 City of Auburn Council Meeting Minutes September 4.2007 A Resolution of the City Council of the City of Auburn, Washington, fixing the time and date for a public hearing before the City Council on the 2008-2013 Six-Year Transportation Improvement Program Councilmember Wagner moved and Councilmember Thordarson seconded to adopt Resolution No. 4230. MOTION CARRIED UNANIMOUSLY. 7-0. 4. Resolution No. 4232 F5.2 A Resolution of the City Council of the City of Auburn, Washington, authorizing the acceptance of a grant from the King County Office of Emergency Management in the amount of Twenty Eight Thousand Five Hundred Seventy Dollars ($28,570.00) to provide community emergency response training to Spanish speaking populations and provide general support for the Auburn Community Emergency Response Team, and authorizing the Mayor and City Clerk to execute the necessary agreements to accept said funds Councilmember Cerino moved and Councilmember Peloza seconded to adopt Resolution No. 4232. MOTION CARRIED UNANIMOUSLY. 7-0. 5. Resolution No. 4234 A3.13.4 A Resolution of the City Council of the city of Auburn, Washington, accepting a gift of real property from the United States of America Councilmember Backus moved and Councilmember Thordarson seconded to adopt Resolution No. 4234. MOTION CARRIED UNANIMOUSLY. 7-0. At 8:25, Mayor Lewis announced a five minute break and recessed the meeting to executive session for approximately thirty minutes to discuss property acquisition and potential litigation Mayor Lewis extended the executive session three times for a total of twenty minutes.
