Lewis called the meeting to order at 7:30 p.m. and led those in attendance in the Pledge of Allegiance. B. Roll Call Mayor Lewis and the following Councilmembers were present: Rich Wagner, Sue Singer, Gene Cerino, Nancy Backus, Bill Peloza, Roger Thordarson, and Lynn Norman. Staff members present included: City Attorney Daniel B. Heid, Parks, Arts and Recreation Director Daryl Faber, Human Resources and Risk Management Director Brenda Heineman, Finance Director Shelley Coleman, Public Works Director Dennis Dowdy, Chief of Police Jim Kelly, Information Services Director Lorrie Rempher, Deputy Police Chief Bob Lee, Planning, Building and Community Director Cindy Baker, Police Officer Eric Armstrong, Economic Development Planner AI Hicks, Human Services Planner Michael Hursh, Senior Planner Chris Hankins, and Deputy City Clerk Cathy Richardson. C. Announcements and Appointments 1. Announcements a) Proclamation "Veterans' Day of Remembrance 200T' Mayor Lewis read the proclamation and declared November 11, 2007 as "Veterans' Day of Remembrance" in the city of Auburn. b) National Guards Recognition of Service Certificate and Medal Page 1 Citv of Auburn Council Meeting Minutes November 5, 2007 Police Officer Eric Armstrong reported on the extraordinary support he received from Police Chief Jim Kelly, the Auburn Police Department "family" and the City of Auburn administration during his service for the National Guards. Officer Armstrong shared several examples of the support he and others received from the City of Auburn and his "police family" when he participated in the National Guards response to the Hurricane Katrina disaster in the Gulf Coast region. He also shared examples of the support he received during several incidents including his involvement in a critical incident in Federal Way and during his deployment to Afghanistan with the National Guards. In recognition of the unwavering support received from Chief Kelly, the Auburn Police Department "family", and the City of Auburn administration, Officer Armstrong presented National Guards Medals of Support to Mayor Lewis and Chief Kelly and read and presented a certificate issued by the Employer Support and National Guards Reserve in recognition of the patriotism demonstrated by Chief Kelly, the Auburn Police Department, and the City of Auburn. a) Committee to End Homelessness King County Project Director Bill Block presented the 2006 Annual Report for the Ten-Year Plan to End Homelessness (Plan) in King County. Mr. Block explained that the Committee to End Homelessness consists of a broad coalition of governments, faith communities, non-profit agencies, business communities, and homeless and formerly homeless individuals. Mr. Block reviewed statistics related to homelessness within King County, reported on efforts and successes of the Plan for year 2006, and displayed a video produced by the Committee to End Homelessness. The Ten Year Plan is an action plan designed to work towards the goal of ending homelessness within King County by year 2015. The video described support services needed and wrap-around services provided to work towards that goal. Mr. Block reviewed key strategies of the Plan and urged the City of Auburn to Page 2 City of Auburn Council Meeting Minutes November 5, 2007 endorse the Ten-year Plan to End Homelessness in King County. Discussion followed including efforts to encourage more prosperous cities to take some of the homeless facilities into their communities, development incentives to developers for housing for the homeless, _ multiple housing units, methods used by King County to garner municipal endorsers, and funding opportunities from King .County to communities or non-profit agencies for homeless shelters or housing. Mayor Lewis reported on efforts between the cities of Enumclaw and Auburn related to creating a "southern arch" consisting of a consortium of cities to engage in partnerships to address the needs of their communities with regard to homelessness. The City of Auburn will be participating in a one-night count of homeless individuals this year. Mayor Lewis stressed the City's efforts with regard to human services and thanked Mr. Block for his presentation. Mr. Block urged the City of Auburn to endorse the Ten-year Plan to End Homelessness in King County. 2. Appointments There were no appointments for Council consideration. D. Agenda Modifications There was no agenda modification. II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings No public hearing was scheduled for this evening. B. Audience Participation This is the place on the agenda where the public is invited to speak to the City Council on any issue. Those wishing to speak are reminded to sign in on the form provided. No one in the audience requested to speak. Page 3 City of Auburn Council Meeting Minutes November 5, 2007 C. Correspondence No correspondence was received. 111. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chair Cerino reported that the Municipal Services Committee met this evening at 5:00. The Committee discussed and recommends approval of a contract administration item related to Project No. CP0725 and Resolution No. 4259. The Committee also discussed the 2007 - 2008 Annexation Budget, Municipal Services Committee's items for the upcoming Council retreat, and Ordinance No. 6129 related to parking. The next regular meeting of the Municipal Services Committee is scheduled for November 19, 2007 at 5:00 p.m. B. Planning & Community Development Chair Norman reported that the Planning and Community Development Committee met on October 22, 2007 at 5:30 p.m. The Committee discussed and recommends approval of Resolution Nos. 4245 and 4244. The Committee received a Community Building/Diversity Consultant update and also discussed Access Track Design Standards, Auburn Golf Course Clubhouse artwork and the Planning and Community Development Committee's matrix and priorities for the upcoming Council retreat, received a presentation on Environmental District/Green Zone, and followed up on the Lea Hill and West Hill zoning hearings. The next regular meeting of the Planning and Community Development Committee is scheduled for November 12, 2007 at 5:30 p.m. C. Public Works Chair Wagner reported that the Public Works Committee met October 22, 2007 at 2:30 p.m. The Committee discussed and recommends approval of contract administration items and Resolution No. 4253. The Committee also discussed the Committee's ten priorities for the upcoming Council retreat, Lake Tapps Parkway left turn restrictions, and Access Track Design Standards. The next regular meeting of the Public Works Committee is scheduled for November 12, 2007 at 2:30 p.m. D. Finance Chair Backus reported that the Finance Committee met this evening at 6:30 p.m. The Committee discussed and recommends approval of claims and payroll vouchers and Ordinance Nos. 6126 and 6127. The Committee also discussed Public Works Project No. CP0725, 2007 - 2008 Annexation Budget, Resolution Nos. Page 4 City of Auburn Council Meeting Minutes November 5, 2007 4256, 4259 and 4244, and M Street Local Improvement District No. 350 process and received an update on quarterly investments. The next regular meeting of the Finance Committee is scheduled for November 19, 2007 at 6:30 p.m. IV. Councilmember Wagner reported that he attended the Prosperity Partnership luncheon and commended the plans that educational leaders have for the State of Washington and the cooperation that the governor and legislature are providing. He also attended the dedication of the Veterans Memorial Park building. Councilmember Backus reported that she attended the farewell event for Commander Woods at the Auburn Police Department. She also participated in Washington Elementary School's "Walk to School Day" event. Over 200 students and parents participated in the event. She also spoke at Washington Elementary School on the subject of public service and her role as a Councilmember together with City of Kent Councilmember Les Thomas. Councilmember Norman reported that she attended the Cities and Schools Forum, White River Valley Museum Harvest Ball Page 5 City of Auburn Council Meeting Minutes November 5, 2007 Prosperity Partnership luncheon, dedication of the Veterans Memorial Park building, and "Walk Your Child to School- Day" with Councilmember Backus. Councilmember Cerino reported on Boeing's Recycling Organization which uses the money earned from their project to support various local organizations and non-profit groups. Councilmember Cerino reported that beautiful, overnight travel bags were provided to the Auburn Special Olympics participants, who were tremendously excited to receive the gift. Councilmember Thordarson reported that he represented Mayor Lewis in welcoming upcoming Police Citizens Academy participants. He also attended the Suburban Cities networking dinner, Regional Transit Committee meeting, Auburn Avenue Theater grand opening, dedication of the Veterans Memorial Park building, Auburn Food Bank breakfast fundraiser, and the 80tH birthday party for Bill Kyle who has been very active in the Auburn community and was instrumental in the reorganization of the Auburn Food Bank. Councilmember Peloza reported that he attended the Suburban Cities networking dinner. He also attended the Water Resource inventory Area (WRIA 9) Management Committee meeting, at which they discussed the 2008 King County Capital Budget. The budget earmarked additional funding in the amount of $275,000.00 for the Green River Watershed Fenster/Potsky Levy Project. He, together with sixty volunteers, participated in planting of native trees for wildlife and salmon habitat at the Auburn Narrows, which is located near State Route 18 and the junction of Green River/Black Diamond Road. He also attended Boeing's event for the donation of travel bags to the Auburn Special Olympics, Auburn Avenue Theater re-opening, White River Valley Museum Harvest Ball, and Auburn Food Bank breakfast fundraiser. Councilmember Peloza announced the Veterans of Foreign Wars Post 1741 open house event this Saturday. B. From the Mayor Mayor Lewis reported that he, several Councilmembers, and King County Councilmember Peter von Reichbauer visited Mary Olsen Farm. First grade students from Dick Scobee Elementary School were on a tour of this working, turn of the century farm. The students were shown various methods related to farming in that era including planting corn, churning butter, pitching hay, and caring for chickens. Mary Olson Farm will be a tremendous asset to future generations. Page 6 City of Auburn Council Meeting Minutes November 5, 2007 Mayor Lewis also reported on the Auburn Area Chamber of Commerce auction at which two bids for "Lunch with the Mayor" garnered $700.00. Mayor Lewis attended forty-seven meetings in the last two weeks including the Auburn Avenue Theater re-opening. He also toured the Auburn Baptist Church Food Bank, read to Gildo Rey Elementary school students, and attended an event at the King Solomon Masons Lodge where they honored outstanding personnel from the City of Auburn and Valley Regional Fire Authority. Mayor Lewis spoke regarding flood insurance issues related to the Federal Emergency Management Administration (FEMA) flood control mapping. FEMA is re-evaluating flood maps across the United States, which could have a significant impact on the cities of Auburn, Kent, Renton, and Tukwila. The Green River Flood. Control District, which was established by the cities of Auburn, Kent, Renton and Tukwila in an effort to control flooding on the Green River, was previously asked to disband by King County in a move towards establishing a countywide solution with regard to dikes and levies along the Green River. The Green River Flood District is the only self-taxing, rate-paying district in King County. Mayor Lewis stressed that flooding in the valley would affect all surrounding cities. Mayor Lewis commented on upcoming King County Council meetings related to this issue and urged citizens to contact King County Councilmember Peter von Reichbauer to voice their opinions. Mayor Lewis also attended the United States Mayor's Conference which was attended by 100 mayors from across the United States. The conference was arranged at the request of Seattle Mayor Greg Nickels in an effort to establish practical applications to stop global warming. Past President Bill Clinton spoke at the conference regarding steps that individuals and communities can take to help reduce the impacts on our global climate. Mr. Clinton also spoke regarding educating citizens about conservation, product efficiency, and managing with less with regards to making changes more economically feasible for everyone. Mayor Lewis reported on simple changes that can be made by everyone and urged cities to take leadership by providing good stewardship and "green" jobs, and by being more environmentally sensitive. Mayor Lewis expressed his pleasure in the outstanding presentation by Mr. Clinton. Page 7 City of Auburn Council Meeting Minutes November 5, 2007 V. Claims Claims check numbers 367685 through 368181 in the amount of $2,290,662.72 and a wire transfer in the amount of $1,153,583.84 and dated November 5, 2007. 2. Payroll Payroll check numbers 521333 to 521457 in the amount of $293,300.43 and electronic deposit transmissions in the amount of $1,010,281.08 for a grand total of $1,305,655.95 for the pay period covering October 8, 2007 to October 31, 2007. C. Contract Administration 1. Public Works Project Number C501A 04.9.1 PR C501A City Council grant permission to advertise for bids for Project No. C501A, Urban Center Transportation Improvements. 2. Project Number CP0725 04.4.1 CP0725 City Council approve Final Pay Estimate #2 to Contract 07- 09 in the amount of $4,259.90, for a total contract price of $39,639.60, with Mechanical and Control Services and accept construction of Project No. CP0725, Server Room Air Conditioning. D. Councilmember Singer moved and Councilmember Wagner seconded to approve the consent items. MOTION CARRIED UNANIMOUSLY. 7-0. VI. UNFINISHED BUSINESS There was no unfinished business. VII. NEW BUSINESS There was no new business. VIII. ORDINANCES AND RESOLUTIONS A. Ordinances 1. Ordinance No. 6126 F4.5.3 An Ordinance of the City Council of the City of Auburn, Washington, creating a new Section 13.20.077 of the Auburn City Code related to sewer service charge proration Councilmember Backus moved and Councilmember Thordarson seconded to introduce and adopt Ordinance No. 6126. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Ordinance No. 6127 F3.21 An Ordinance of the City Council of the City of Auburn, Washington, amending Ordinance No. 6066, the 2007-2008 Biennial Budget Ordinance as amended by Ordinance No. 6086, Ordinance No. 6092, Ordinance No. 6103, Ordinance No. 6119, and Ordinance No. 6124 authorizing amendment to the City of Auburn 2007-2008 Biennial Budget as set forth in Schedule "A" Councilmember Backus moved and Councilmember Thordarson seconded to introduce and adopt Ordinance No. 6127. Resolution No. 4244 03.4.1.7 A Resolution of the City Council of the City of Auburn, Washington adopting the 2008 Community Development Block Grant Action Plan for the Consolidated Plan for years 2005 to 2008 Councilmember Norman moved and Councilmember Backus seconded to adopt Resolution No. 4244. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Resolution No. 4245 A3.13.8 A Resolution of the City Council of the City of Auburn, Washington authorizing the Mayor and City Clerk to execute an Agreement with BHC Consulting Inc to assist the City in updating the City's Development Codes Councilmember Norman moved and Councilmember Backus seconded to adopt Resolution No. 4245. MOTION CARRIED UNANIMOUSLY. 7-0. 3. Resolution No. 4253 A3.13.9 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor to execute a Payback Agreement for Developer's Extension between the City of Auburn and Terrace View Properties LLC Councilmember Wagner moved and Councilmember Thordarson seconded to adopt Resolution No. 4253. At 8:47, Mayor Lewis recessed the meeting for a brief intermission then to executive session for approximately thirty minutes in order to discuss potential/pending litigation pursuant to RCW 42.30.110(1)(1) and property acquisition pursuant RCW 42.30.110(1)(c) with possible Council action following the executive session. At 9:14 p.m., Mayor Lewis reconvened the regular meeting and City Attorney Heid read the following resolutions: Resolution No. 4262 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor to execute a Settlement Agreement with David Allen Davis for disputed costs related to Local Improvement District Number 250 Councilmember Backus moved and Councilmember Thordarson seconded to adopt Resolution No. 4262. MOTION CARRIED UNANIMOUSLY. 7-0. Resolution No. 4258 A Resolution of the City Council of the City of Auburn Washington, authorizing the Mayor to negotiate supplemental interlocal agreements between the cities, counties, and governmental entities involved in the Coalition of Governmental Entities regarding the challenges to the NPDES Phase II Permit Requirements Councilmember Wagner moved and Councilmember Thordarson seconded to adopt Resolution No. 4258.
