Flag Salute Mayor Lewis called the meeting to order at 7:30 p.m. and led those in attendance in the Pledge of Allegiance. B. Roll Call Mayor Lewis and the following Councilmembers were present: Rich Wagner, Sue Singer, Gene Cerino, Nancy Backus, Bill Peloza, Roger Thordarson and Lynn Norman. Staff members present included: Planning, Building and Community Director Cindy Baker; Senior Planner Jeff Dixon; Public Works Director Dennis Dowdy; Information Services Director Lorrie Rempher; Parks, Arts and Recreation Director Daryl Faber; Chief of Police Jim Kelly, City Attorney Daniel B. Heid; Human Resources and Risk Management Director Brenda Heineman; Finance Director Shelley Coleman; and City Clerk Danielle Daskam. C. Announcements and Appointments There were no announcements or appointments. D. Agenda Modifications Agenda modifications included the transmittal of Ordinance No. 6131 under Item VIII.A.2, the addition of Ordinances 6121 and 6122 transmitted under Items VIII.A.4 and VIII.A.5 of these minutes, and the removal of Resolution No. 4256 from the agenda. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE Page 1 City of Auburn Council Meeting Minutes November 19 2007 A. Public Hearings 1. 2007-2008 Biennial Budget F3.21 City Council to conduct a public hearing to receive public comments and suggestions with regard to the .proposed modifications to the 2007-2008 Biennial Budget. Finance Director Coleman presented the staff report for the mid-biennial budget amendment. Ms. Coleman stated the budget amendment was reviewed by Council Committees in October and an initial public hearing was held October 1, 2007. Director Coleman reviewed the property tax levy for 2008. The 2007 assessed valuation is $6,500,000,000 and the total 2008 levy is $9,685,000 for a levy rate of $1.49 per $1,000 valuation. The 2007 assessed value includes $230,300,000 in new construction. The 2008 levy reflects a 39% decrease from the 2007 levy of $15,647,257. Approximately 97% of the levy will be budgeted to allow for uncollectible property tax. The Local Street Fund (Save Our Streets) will receive an allocation of $2,200,000 in property taxes; the General Fund will receive the remaining property tax revenues ($7,485,000). State law requires that the City adopt a property tax levy by November 30tH Director Coleman reviewed the 2007 and 2008 full time employee equivalent changes. Upon annexation to the Valley Regional Fire Authority, the City Council authorized ten additional police officers. Planning and Engineering Departments' staff additions are nearly fully funded by fees for services. Director Coleman noted that the General Fund ending fund balance will be approximately $5,256,528, which represents 11 % of the total 2008 budgeted expenditures. Director Coleman reviewed the timeline for receipt of the annexation sales tax credit should the City Council approve the Lea Hill and West Hill annexations. It is anticipated that the City will receive its first installment of the sales tax credit in September 2008. No one in the audience. requested to address the Council. C. Correspondence 1. November 6, 2007 memorandum addressed to Mayor Lewis and Councilmembers from Street Systems Engineer Wickstrom regarding Local Improvement District No. 350. III. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chair Cerino reported the Municipal Services Committee met this evening at 5:00. The Committee approved consent items, including contract administration items for the Auburn Avenue Theater Renovation and the Veterans Memorial Building projects. The Committee also reviewed and recommended approval of Ordinance No. 6129 relating to parking. The Committee discussed Ordinance 6131 relating to the property tax levy and Ordinances 6121 and 6122 relating to the Lea Hill and West Hill annexations. The Committee also discussed the mid-term biennial budget correction, airport rental rates, public restrooms for the downtown area, and the airport taxiway. The next regular meeting of the Municipal Services Committee is scheduled for December 3, 2007 at 5:00 p.m. B. Planning & Community Development Chair Norman reported the Planning and Community Development Committee met November 13, 2007. The Committee reviewed Resolution No. 4263 regarding the selection of the artist for the Golf Course Clubhouse public art. The Committee discussed Ordinance No. 6129 relating to parking, the downtown sidewalk design guidelines, supplemental annexation budgets, school impact fees, a proposed zoning code amendment to add a definition for supportive Page 3 Citv of Auburn Council Meeting Minutes November 19 2007 definition for supportive housing, the proposed 2007 Comprehensive Plan amendments, proposed code amendments relating to manufactured homes, and updates on the Auburn Avenue Theater and the Les Gove Community Center. The next regular meeting for the Planning and Community Development Committee is scheduled for November 26, 2007 at 5:00 p.m. C. Public Works Chair Wagner reported the Public Works Committee met November 13, 2007. The Committee approved several contract administration items, including the M Street SE Sidewalk LID engineering design, the Auburn Way overlay from 4t" to 4th, final pay estimate for the citywide arterial crack seal project, final pay estimate for the Auburn Way South Safety Improvements, and final pay estimate for the 2007 citywide pavement patching project. The Committee also approved aright-of-way use permit for the Santa House. The Committee reviewed Resolution No. 4260 authorizing the use of the Municipal Research and Services Center small works roster and consultant roster. The Committee also discussed accident victim memorial signs, the 8t" Street/R Street NE signal, the Union Pacific Railroad crossing at 29t" Street NW, parking on 4t" Street in the vicinity of the high school, gateway signs, annexation budgets, downtown sidewalk guidelines, C-curbing on 3rd Street NE, and the Committee's ten highest priority projects for next year. The next regular meeting of the Public Works Committee is scheduled for November 26, 2007 at 2:30 p.m. D. Finance Chair Backus reported the Finance Committee met this evening at 6:30. The Committee approved consent items, including claims and payroll vouchers. The Committee also recommended approval of Ordinance No. 6131 regarding the property tax levy for 2008, Resolution No. 4256 regarding the Municipal Park Construction Fund, Resolution No. 4264 accepting a grant from the Washington State Recreation and Conservation Office, Resolution No. 4265 accepting a grant from King County Parks Youth Sports, Resolution No. 4267 approving a grant application for Brannan Park Field Lighting, and Ordinances 6121 and 6122 regarding the Lea Hill and West Hill annexations. The Committee discussed airport rental rates, budget amendment number 8 (2008 mid-biennial correction), quarterly budget report, Resolution No. 4260 regarding the Municipal Research and Services Center small works and consultant rosters, Project No. CP0747 final pay estimate, Project No. C310A0 change Page 4 Citv of Auburn Council Meeting Minutes November 19 2007 No. C310A0 change orders, and utility account reduction. The next regular meeting of the Finance Committee is scheduled for December 3, 2007 at 6:30 p.m. IV. REPORTS At this time the Councilmembers and Mayor may report on items not specifically described on the agenda, which are of interest to the community. A. From the Council Mayor Pro Tem Singer stated that she was pleased to teach a mock City Council meeting class for the Leadership Institute recently. Councilmember Wagner reported that he attended the Muckleshoot Tribe's groundbreaking for its new 100,000 square foot K-12 school complex. The new school will be located on Highway 164 just west of Cooper's Corner (SE 380tH) Councilmember Backus commended the City and the Parks Department on a successful Veterans Day Parade. Councilmember Backus also reported on her attendance at the National League of Cities (NLC) Conference in New Orleans. She participated as a member of the NLC's National Finance, Administration and Intergovernmental Relations Committee. Councilmember Norman thanked Mayor Lewis and Mayor Pro Tem Singer for participating in the Leadership Institute's Local Governance Day. Councilmember Norman also commented on the City's Veterans Day events honoring veterans and their service to the country. Councilmember Cerino reported on his attendance at the Valley Regional Fire Authority meeting and commented on the success of the Veterans Day Parade and the new Veterans Memorial Building. Councilmember Thordarson commented on the Veterans Day Parade and events. He also reported on his attendance at the National League of Cities Conference in New Orleans where he attended several workshops on such subjects as transportation infrastructure, volunteers, and disaster recovery. Page 5 City of Auburn Council Meeting Minutes November 19 2007 Councilmember Peloza reported on his attendance at the King County Water Pollution Abatement Advisory Committee, the monthly Senior Center Coffee Hour, and the National League of Cities Conference in New Orleans where he participated as a member of the Energy, Environment and Natural Resources Committee. B. From the Mayor Mayor Lewis commented regarding King County's adoption of a county-wide flood control district funded by property tax. The new county-wide district replaces the Green River Flood Control District, which was a flood control district that was funded by property owners in Auburn and three other cities for several years. The new district will provide funding to rebuild and maintain aging levees across King County. Mayor Lewis also commented on the status of the Lea Hill and West Hill annexations.. A census has been taking place on Lea Hill by the City's consultant. The census is required in order to substantiate the 10,000 population threshold for the City to be eligible for the sales tax credit authorized by RCW 82.14.415. The sales tax credit equates to approximately $18 million over ten years. The State indicated that the County's population count is not sufficient to substantiate the threshold; therefore a new census is taking place. Because of the delay created by the need for a census, the City will not have an opportunity to hire additional personnel in anticipation of the effective date of the annexation. Mayor Lewis noted that Ordinances 6121 and 6122, relating to the annexations, can be found later on the agenda. The ordinances are conditioned on the City's eligibility to receive the incentive tax dollars from the State and King County. Mayor Lewis commented on the City's Veterans Day events, including the largest Veterans Day Parade west of the Mississippi River and the attendance of Governor Gregoire. Mayor Lewis reminded citizens that returning veterans must be treated with the honor and respect they deserve, including as much assistance as they need in coming back to the world. V. CONSENT. AGENDA All matters listed on the Consent Agenda are considered by the City Council to be routine and will be enacted by one motion in the form listed. City Council to amend the October 16, 2007 special City Council meeting minutes, page 6, as follows: Leslie Clark, Short Cressman & Burgess, 999 Third Avenue, Seattle Ms. Clark spoke on behalf of Auburn Hills Mobile Home Park. The current zoning under King County for Auburn Hills is R12. Ms. Clark referred to her October 15, 2007 letter faxed earlier in which she outlines three points in opposition to designating the site as LHRMHP and in which she requests the Council designate the property as high density residential with R-4 zoning. (Ms. Clark provided color copies of the same letter just prior to the hearing.) Ms. Clark stated that by designating the property as Mobile Home Park, the City imposes a burden upon the property owner to maintain the property as a mobile home park and prevents the mobile home park from redeveloping as any other use. MOTION CARRIED UNANIMOUSLY. 7-0. 3. Ordinance No. 6135 03.5 PLT07-0004 An Ordinance of the City Council of the City of Auburn, Washington, approving the final plat of Trail Run, Division No. 1 Councilmember Norman moved and Councilmember Backus seconded to introduce and adopt Ordinance No. 6135. At 8:15 p.m. Mayor Lewis recessed the meeting to executive session for approximately twenty minutes in order to discuss potential/pending litigation pursuant to RCW 42.30.110(1)(1) Mayor Lewis extended the executive session an additional 10 minutes. Mayor Lewis reconvened the regular meeting at 8:42 p.m. In response to questions from Mayor Lewis, Public Works Director Dowdy advised that the standards that were in effect at the time of the preliminary plat approval were the local street standards applicable to this particular plat and those approved by the Council. Mayor Lewis inquired of the applicant regarding the safety of the interior alleys, especially when backing from a garage on an alley. Rob Purser, Division President for Centex Homes, Kirkland Mr. Purser explained that Centex Homes has constructed several similar developments, including developments in Page 10 City of Auburn Council Meeting Minutes November 19. 2007 Dupont, Snohomish County, Snoqualmie and Kent. Mr. Purser stated alley loaded units are typically fenced from the back of the house, which is the back of the garage adjacent to the alleyway. Varying depths of driveways from the garage door to the alley are used. Fences cannot extend beyond the garage door so as to protect sight distances. Mr. Purser acknowledged that mature landscaping could interfere with sight distances, but he stated that these lots are not typically heavily landscaped. Director Dowdy added that once the alleys are dedicated as public right-of-way, the City can regulate the alley as any other street. Councilmember Wagner inquired whether the fencing restrictions and specifications are included in the homeowner's agreement. Barbara Yarington, Land Acquisitions Manager of Centex Homes in attendance advised that the covenants, conditions and restrictions (CC&R's) provide that any proposed fences must be approved through the Architectural Control Committee. Mr. Purser advised that the covenants, conditions and restrictions (CC&R's) have not been updated to include the fencing restrictions related to sight distance between the alley and driveways. Mr. Purser offered to include the appropriate language regarding fences as one of the design criteria. In response to questions from Councilmember Peloza and Councilmember Wagner, Mr. Purser proposed to include appropriate verbiage regarding fence restrictions related to sight distance between the alley and driveways and an accompanying illustration in the CC&R's. Mr. Purser advised that the CC&R's are recorded with the County. MOTION CARRIED. 7-0. 4. Ordinance No. 6122 03.1 An Ordinance of the City Council of the City of Auburn, Washington, annexing an unincorporated area in King County, Washington, of approximately 1,215 acres contiguous to the corporate limits of the City known as the "West Hill Annexation Area" of the City of Auburn, effective January 1, .2008, subject to annexation incentive eligibility Councilmember Norman moved and Councilmember Backus seconded to introduce and adopt Ordinance No. 6122. MOTION CARRIED UNANIMOUSLY. 7-0. B. Resolutions 1. Resolution No. 4256 F4.7 A Resolution of the City Council of the City of Auburn, Washington, authorizing the transfer of funds for the purpose of making a loan or loans from the General Fund and/or the Cumulative Reserve Fund to the Municipal Park Construction Fund for up to a three-year period of time Councilmember Backus moved and Councilmember Thordarson seconded to adopt Resolution No. 4256. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Resolution No. 4260 04.8.1, A2.7 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor to execute an MRSC Rosters Contract with the Municipal Research and Services Page 12 City of Auburn Council Meeting Minutes November 19 2007 Center for the purpose of using a shared small works roster and a shared consultant roster Councilmember Wagner moved and Councilmember Thordarson seconded to adopt Resolution No. 4260. MOTION CARRIED UNANIMOUSLY. 7-0. 3. Resolution No. 4261 F4.3 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an Interlocal Services Agreement between the cities of Algona, Auburn and Pacific for Valley Regional Fire Authority fees Resolution No. 4261 was removed from the agenda. 4. Resolution No. 4264 F5.2.20 A Resolution of the City Council of the City of Auburn, Washington, authorizing the acceptance of a State of Washington Recreation and Conservation Office Grant and authorizing the Mayor and City Clerk to execute the necessary contracts to accept said funds Councilmember Backus moved and Councilmember Thordarson seconded to adopt Resolution No. 4264. MOTION CARRIED UNANIMOUSLY. 7-0. 5. Resolution No. 4265 F5.3 A Resolution of the City Council of the City of Auburn, Washington, authorizing the acceptance of a King County Parks Youth Sports Facility Grant and authorizing the Mayor and City Clerk to execute the necessary contracts to accept said funds Councilmember Backus moved and Councilmember Thordarson seconded to adopt Resolution No. 4265.
