HomeMy WebLinkAbout05-17-1976lJ AUBURN, WASHINGTON MONDAY MAY 17, 1976 The regular meeting of the Auburn City Council convened at 8:00 P.M., in the Auburn City Council Chambers. ROLL CALL Councilmen Present: Councilman Roegner, Kitchell, Crai g, Larson, Anderson and Lea. Councilman Flechsig excused due to a prior committment. It was moved by Larson, seconded by Kitchell that the Council minutes of the May 3, 1976, meeting be approved with the following correction; Page 2, Paragraph 7 should read as follows: "It was moved by Lea, seconded by Larson that the request of Mr. Westby for a rezone from R-3 to C-1 be denied and that a Conditional Use Permit for business and professional offices be granted, and the City Attorney be instructed to draw up the necessary papers, encompassing the recommendations of the Planning Department." MOTION CARRIED APPROVAL OF MINUTES PUBLIC HEARINGS Mayor Kersey declared the Public Hearing open for the purpose of hearing the Developer and/or his agent of a Preliminary Plat to be known as Rivervista Estates, Division No. 1 and the opposition and to determine if said Preliminary Plat should be approved or if it should be referred back to the Auburn Planning Commission for further Public Hearings and reconsideration. City Attorney Bereiter, acting as Hearing Examiner briefly went through the events that have taken place on this request, including plans by Seaport Development to develope the area in March of 1967, which was to include a park and a Green Belt area. Ti1is request went as far as the Planning Commission, with no further follow through, Mr. Bob Stead, 1640 So. 312th St., Attorney, representing Mr. Harkey stated that Mr. Harkey was an employee of Seaport, however, he worked for Seaport at a later date, and purchased this Land after he was on his own. Mr. Jack Hawkins, 223 Auburn Way North, Attorney, representing the people opposed to the Plat filed a petition with the Clerk containing 58 signatures, requesting the Council to honor the original agreement between the City of Auburn and Seaport Development Co. Mr. Stead stated his client, Mr. Harkey has complied with all of t_he stipulations and has taken very great pains to provide the~Community with a pleasant place to live. Mr. Hawkins stated that i f the Council approves the Plat as suhmi tt_ed, it will never be used for a park, and that he and his clients are opposed to the elimination of the park. Mr. Hawkins submitted pictures of the area to the Council and City Clerk. A question was raised as to how big an area was involved and the dollar value of same. It was felt that there was approximately 3.5 acres. Mr. Paul Alexander, 1214 "O'° Street N. E. stated it would be difficult to put a dollar value on the piece of property as it stands right now. Len Chapman, Director of Parks and Recreation stated that if the City had to buy this property, there would be no money available in the budget for _its purchase at the present time. E. stated that several months ago, the residents of "O" Street were approached by someone from the City to find out where they would prefer the park line. He feels this whole matter is a credibility issue, and read excerpts from the Auburn Globe News in regard to the approval of the 1967 request. Mr. Alexander stated he feels that he has been mislead. Mr. Hawkins stated lle does not feel the area has been rezoned for residental use. Councilman Lea questioned Jim Keller of the Planning Department if there is an ease- ment on the bank of the Green River. Mr. Keller stated that the 25 foot easement has been dedicated and the Utility easement has been dedicated also. Councilman Lea asked if the Planning Department and the Engineering Department have any problems with the Plat. Mr. Nevins stated he was not aware of any additional problems After considerable discussion and questions from the Council, it was moved by Lea, seconded by Larson that the Council authorize that the Preliminary Plat be approved as recommended and that the Committee check into the legal description of the property and report back. ROLL CALL VOTE: All Councilmen voting YES MOTION CARRIED CORRESPONDENCE ~ 1. Application for Preliminary Approval of Imperial Estates on 14th N. E. e-- ~. 2. Conditional Use Permit Application from Firdale Village Supply Co. Inc, requesting C,,. change from C-3 to C-3 Conditional Use Permit, property located on the north side of 21st S. E., 136 feet west of "R" Street S. E. (Application No. 15-76) 1.3-: It was moved by Lea., seconded by Larson that items 1 and 2 be referred to the Planning Commission. MOTION CARRIED BID OPENINGS Bids were opened April 27, 1976, at 11:00 A. M., for the Chlorination Station, Water Improvement #99. Bids were received as follows: Pease & Sons Venture Construction Hayes Mech. Austin Sheldrup Const. Co. REMCOA George W. Slater, Co. $ 97,804.75 98,876.70 106,066.58 121,884.75 124,885.80 145,329.80 These bids were accompanied by a 5% Bid Bond and do include 5.3o Washington State Sales Tax. It is the recommendation of the Public Worlcs Department that the contract for construction of the Chlorination Station, plater Improvement #99 be awarded t-o Pease ~ Sons on their. low bid of $92,882.00, plus $4,922.76 sales tax for a total Lump sum bid of $97,804.75, subject to the concurrence of the Department of Social and Health Services and their additional funding. It was moved by Craig, seconded by Larson, that the contract for construction of the Chlorination Station, Water Improvement #99 be awarded to Pease & Sons on their Iow bid of $97,804.75, and that we retain the bid bonds of the two next lowest bidders and return the remaining three, and that the funding come from $30,000 budgeted in inlater Division Budget, $47,850 from Water-Sewer C'onstrurtion Funds, and the remainder from Washington Futures Referendum 27 mon_ic~s; subject_ to aadditional funding ~:r~~p_rov~ J bzl State. Co. $5,301.86 $5,380.83 $1,105.65 Tor-Nado Fence Co. 4,899.19 6,945.86 490.91 San Jose Steel Co. 5,132.53 6,978.53 414.55 These bids were accompanied by a 5% Bid Bond and do include 5.3i Washington State Sales Tax. 130 AUBURN, WASHINGTON MONDAY _ MAY 17, 1976 It is the recommendation of the. Public Works Department that the contract for construction of fencing at Auburn Municipal Airport be awarded to Galbraith Contracting Co. on their low bid on Alternate No. I and Alternate No. 2 for a total sum• of $6,160.00 plus $326.48 sales tax, for a total of $6,486.48. It was moved by Kitchell, seconded by Larson that the contract for fencing at Auburn Municipal Airport be awarded to Galbraith Contracting Company for their low bid of $6,486.48 with funding coming from the Airport Construction Fund. Mayor Kersey announced that on May 30th, at 5:00 P.M., the Veterans of Foreign Wars will hold Memorial Services at the Cr_~metery, and at 6:00 P.M., the American Legion with hold services in the City Park.
