APPROVAL OF MINUTES
It was moved by Lea, seconded by Flechsig to approve the Council Minutes of July 19,
1976, with the following correction: Under Street Committee report, page 4, first
paragraph, item #3, should read "15th 5t. S. W., east from "O" Street S. W. to the
Chicago Milwaukee tracks".

PUBLIC HEARINGS
Mayor Kersey declared the Public Hearing open on the request of Ronald W. Buzzard to
rezone from M-2 (Heavy Industrial) to R-4 (Multiple Family) property located at 7, 11,
21, 23, and 25 °'F" Street N. W. (Application #20-76)
It was the decision of the Planning Commission to recommend to the City Council
approval of this request because it will conform to our Comprehensive Land Use ~'1an.
It was moved by Flechsig, seconded by Kitchell, that the Public Hearing be closed.
MOTION CARRIED
It was moved by Flechsig, seconded by Roegner, that the request of Ronald W. .Buzzard
to rezone from M-2 to R-4 be granted and that the City Attorney be instructed to
draw up the necessary ordinance.
Councilman Lea asked about a 4" water line and storm drainage in the area.
Ted Beach'stated that these people are not going to build multi-family units on their
property, and requested the rezone in order to allow mortgage financing of the
existing single family dwellings.

Mayor Kersey declared the Public Hearing open on the request of James L. Parmelee &
Associates to rezone from R-2 (Single Family) to R-4 (Multiple Family) property
located at 922 14th Street N. E. (Application No. 19-76)
It was the decision of the Planning Commission to recommend to the City Council
approval of this request, because it does conform to our Comprehensive Land Use Plan
for medium density multi-family zoning.
It was moved by Craig, seconded by Kitchell that the Public Hearing be closed.

It was moved by Craig, seconded by Flechsig, that the request of James L. Parmelee &
Associates to rezone from R-2 to R-4 be granted and that the City Attorney be instructed
to draw up the necessary ordinance, encompassing the three items in Marv Seabrands
memo to George Schuler.

Mayor Kersey declared the Public Hearing open on the request of Puget Sound Power &
Light Company to rezone from A-1~(Agricultural) to C-3 (Heavy Commercial) with a
Conditional Use Permit to allow an electrical substation on property located on the
west side of Auburn Way North 125 feet north of 37th Street N. E. (Application No.18-76)
It was the decision of the Planning Commission to recommend to the City Council
approval of this request because it does conform with the. Comprehensive Land Use
Plan and provided that the following conditions be included in the Conditional Use
Permit:
1. The .fence surrounding the electrical substation shall be a cyclone type
fence a minimum of 6 feet in height and shall have redwood inserts to

provide additional screening.
2. An Automatic Sprinkling or Soaking system shall be installed in all
the landscaping areas to insure proper irrigation.
3. A cement concrete sidewalk shall be installed along the full frontage
of the property.
4. The driveways between the street right of way line and the fence line
shall be surfaced to eliminate the scattering of gravel over the side-
. walk and into the street.

Mr. Phil Wood, Puget Sound ;Power & Light, Bellevue, stated that the conditions listed
by the Planning Commission are acceptable and that he would be happy to answer any
questions concerning Puget Power's request.
Mr. G. O. Vig, 3705 Auburn !Way North, stated (a) Much money was spent in Forward
Thrust funds to beautify this street and he doesn't feel that the towers from the
substation will help this plan. (b) He feels the Zand should be kept gor commercial
zoning and (c) his house is right next door to the proposed substation and he feels the
humming noise that comes from the transformers will be very noticable.
It was moved by Lea, seconded by Kitchell that the Public Hearing be closed.

~. Councilman Lea questioned Mr. Wood about the noise factor. Mr. Wood stated that at
the property line the noise level would be about 54 decibels and the requirement

Councilman Craig asked Mr. Vig what the location of his house was'in relation-to the
~~ proposed substation. Mr. Vig pointed out the location on a 'map'.
Mr. Wood was asked by Councilman Lea if this was to be a permanent substation. The
answer being .yes. Mr. Wood stated that Puget Power chose this location, because the
transmission lines are on Auburn Way North. Mr. Wood stated the substation would
serve a mile radius, mostly the commercial area, and statod the substation was
needed because of the increasing growth in the area.
After considerable discussion, it was moved by Craig, seconded by Lea to grant the
request of Puget Sound Power & Light to rezone from A-1 to C-3, with a Conditional
Use Permit and that the City Attorney be instructed to draw up the necessary ordinance,
encompassing the four conditions set forth by-the Planning Commission and that the
noise restriction be kept at the proper Ieve1.

Mayor Kersey declared the Public Hearing open on the request of John V. Fairchild to
rezone from R-2 (Single Family) to R-4 (Multiple°Family) for property Located on
the south side of 10th Street N. E. in the 700 block. (Application No. 17-76)
It was the decision of the Planning Cammission to recommend to the City Council
approval of this request because it does conform to our Comprehensive Lan<i 11se Plan
for medium density multi-family dwellings and that consideration sLaulcl bc~ given

30 feet on the south for the continuation of 9th Street N. E.
Mr. Alan Kiemig, 216 "A" Street N. W., representing Mr. Fairchild, was in the audience
and stated he would answer any questions that might come up on this request.
Opal Love, 1325 29th S. E., stated that her property joins the location and if more
apartments are to be built, she would Zike to have a fence put up.
It was moved by Craig, seconded by Lea, that the Public Hearing be closed.
MOTION CARRIED
Councilman Lea questioned the City Attorney about the word "consideration" in the
Planning Commission's recommendations, referring to 'the right of way.
The City Attorney stated that the Council has .been advised that the City cannot

Councilman Lea asked a number of question concerning R-4 zoning and what conditions
the Planning Department considers when considering an R-4 zoning.

Ted Beach explained that it; was based upon solid planning principals and the physical.
Zayout of the property involved.
Councilman Roegner referred to Pat Nevin's memo directed to George Schuler, dated
June 15, 1976, in which he stated that. the sewer and fire .flow may not be adequate.
Councilman Craig stated he has the same concerns, and that we would also .have to
take into consideration the increased traffic flow. Councilman Craig stated there
were too many questions regarding this application and felt that it should be tabled
until the problems are worked out.
Councilman Craig asked what Mr. Nevin's ooncerns were relative to the fire flow.
Mr. Nevins stated .that it becomes very marginal, but until the complex is built,
we do not know for sure if there is any problem.
Councilman FZechsig noted that there had been nothing said about parking, and asked
if our new ordinance covers parking on a street Iike this one. Mr. Beach stated
it did.
Because of all the unanswered questions regarding this application, i~ was moved by
Lea, seconded by Craig that this matter be referred back to the Planning Department
for answers to the questions raised during the hearing.

Mayor Kersey declared the Public Hearing open on the request of Kurtis R. Mayer/
Mayer Built Homes, Inc., to rezone from a Conditional Use Permit to a Conditional Use
Permit (Revised) for property located on 31st Street S. E., between "O" and "R"
Streets S. E. (Application No. 14-76)
It was the. decision of the Planning Commission to recommend to the City Council
approval of this request because it does conform with the City of Auburn Comprehensive
Land Use Plan and that the amended plot plan become a part of the Conditional Use
Permit .
Mr, Warren Daheim, 1204 E. 137th, Tacoma, Attorney representing Mr. Mayer stated
this request was an amendment to the existing Conditional Use Permit, and that this is
in reality a down zoning, asking for 40 units, 10-2 bedrooms, 18-1 bedroom and 12
Studio Apartments.
For the record Mr. Daheim pointed out that in May of this year, the City Council did
give its written response to HUD, in response to their request for comments, and because
of this hoped no member of the City Council had prejudged this matter.
Mr. Daheim stated that Mr. Mayer, Mr. Larry Higgins and Mr. Ed Gannon were present
to answer any questions that might come, up on this matter.
Mr. Kurtis Mayer stated that for the record he would like to put into the minutes of
this meeting the copy of the Annual Goal for Assisted Housing, which the City of Auburn
has joined with King County, and stated he would be happy to answer any questions in
regard to his application.
Mr. George Lindsay, 1611 33rd S. E., representing a group of residents from S. E. Auburn
read and presented to the Mayor and City Council a copy of a petition that has hc~en
signed by 360 concerned citizens.
Mr. George Sagaser, 501 "R" Street N. E. stated his address is not near the propo:~ed
site, and that his objection to this application is based on the fact that 360 peoplc>>
are asking for the Council not to grant this proposal. Mr. Sagaser asked the
Council to listen to the people.
Mr. Clifford Palmer, 1903 33rd 5. E., stated he was against this proposal, because of~
the children in the area and the traffic problem this would create. Fle also :.tared
that the school in the area is ,filled to capacity now, and to put another 40 f~am.ilzes
in this school would be unfair. He would like to see this request turned down.
Mr. Tom Wine, 1220 32nd Street S. E., stated he was against the proposal, .:~s tlx~r-~
were already three low-income housing areas in 5. E. Auburn, and that that area dial
not need another one. He also stated that when 360 people sign a p~':iti.on ::iyanst
this type of thing, there must be valid reasons for them to do so.

Ira McElvin, 1515 35th Street S. E.s_tated he was not for, nor against the proposal, but
wanted to ask !'9r. Mayer some questions. (Z) How much profit do you expect to make?
City Attorney Bereiter stated that this type of question was not in order. Mr. McElvin
withdrew the question. (2) If_ this is going to be subsidized by HUD, are you going
to put a dwelling in like I (Mr. McElvin) am living in, that was not subsidized?
Mr. Mayer stated he was obligated to follow the Building Code and FHA property
standards.
Gloria Gernlein, 1465 32nd S. E., asked Mr. Mayer if he would be willing to live in
the units, or was he going to hire someone to take care of them. Mr. Mayex stated
omeone would be hired to manage the units.
lifford Palmer, 1903 33rd 5. E., stated he would like to keep the density like it is
now, and if the Council would turn this request down, the residents would not have a
problem.
Mr. George Lindsay, asked how high the buildings would be. .They will be two stories,
approximately 21 feet high.
It was moved by Craig, seconded by Lea, that the Public Hearing be closed.

Councilman Lea questioned the City Attorney about financing from HUD, and if HUD would
.solicit people other than Auburn residents to fi1Z these apartments.
r--°Councilman Flechsig stated that if Mr. Mayer was not using Government funds for. f.inanc.iny,
~---but using private funds, the Council would not he concerned, but i_f Government funds
~_were used for the Construction of this, there would be a possibi Lity that none of the
~'""Codes would be adhered to, like the situation on Lea Hi11.
Mayor Kersey stated that Mr. Mayer would get money from the Federal Government to help
people with lessor incomes that do not have sufficient monies to meet the rent.
Mr. Mayer stated this was correct.
ayor Kersey also stated that this had no bearing on the construction of the dwellings,
here would be no Government monies going into theā¢building of it.
City Attorney Bereiter asked the Council Members if there was any prejudice in this
case, due to the question being raised that there may have been some prejudgement on
this application regarding HUD, and asked the Council Members to abstain from voting
if there was. Mr. Bereiter asked for a show of hands if there was any prejudice. The
record wiZ1 show that there was no hands raised.
Councilman Craig stated that he feels that what is really before the Council in considera-
teon of this application is not low income or sub-standard dwellinys, but density, trafi.-ic
and utility problems. Councilman Craig stated the City should exerc.r.se caution and
concern as to where this type of development goes. He feels it would be a detriment to
the neighborhood to allow this type of construction to go in, and encourages Council
Members to vote against it.

Councilman Craig referred to Mr. Schuler's letter of June 2nd, to the Planniny
Commission, in which in summary he recommends that we deny this request. The point
he-makes in this memo is that this would allow 8 more living units, and he feels that
this is significant. 8 more living units would be allowed if the property was
zoned R-4, but the property is not zoned R-4, it is supposedly zoned R-2, witi~ a
Conditional Use Permit. We allowed an existing Conditional Use Permit to Hang on
for seven years, and the property owner now comes in and updates it, and without
having a rezone hearing on rezoning from R-2 to R-4, would .be allowing a density of
more living units by 8 more than would be allowed under R-4. This is what has Zed
im to suggest that we deny this request
Councilman Lea asked Mr. Mayer if he had any finished complexes of this type in the Tacoma
area. Mr. Mayer named 5teiyacoom Woods and several others. Councilman Lea stated
he was familiar with 5teilacoom Woods, and that it was a credit to Mr. Mayer.

Mayor Kersey declared the Public Hearing open on the request of Imperial Homes, Inc.
for a preliminary plat to be known as Imperial Estates and located on the north
side of 14th Street N. E. approximately 127 feet east of "N" Street N. E. (Application
No. P-2-76) ,
It was the decision of the Planning Commission to recommend to the City Council
approval of this request provided that the owner and/or developer submit to the
Public Works Department for their approval, the required plans and specifications
for the public improvements as outlined in their recommendations.
It was moved by Craig, seconded by Flechsig that the Public Hearing be closed.

It was moved by Craig, seconded by Flechsig that the request of Imperial Homes, Inc.
for a preliminary plat be approved, and that the City Attorney be instructed to
draw up the necessary ordinance, encompassing the recommendations of the Planning
Commission.
Councilman Lea asked Pat Nevins about street lights, and if the Developer would
have to put them in. Mr. Nevins stated the Developer would have to put in the
street lights, or put up a bond.

Mayor Kersey declared the Public Hearing open on the request of Stephen A. Hynes to~
rezone from M-2 (Heavy Industrial) to R-TP (Mobile Home Park) a parcel of land
120 x 1290 feet located on 29th Street S. E. in the 700 block. (Application No.16-76)
It was the decision of the Planning Commission to recommend to the City Council
approval of this request provided that the owner be required to file a short sub-
division of this site prior to the issuance of a building permit.
Mr. J. J. Morey, representing Mr. Hynes stated that the short plat had already been
filed, and he would be happy to answer any questions concerning this request.
It was moved by Flechsig, seconded by Lea that the Public Hearing be closed.

Councilman Craig asked where the location of this _request was at, and was informed

It was noted by Mr. Hynes that a permit has been filed to convert the sewer system,
and he is now waiting for the contractor to do the job.
It was moved by Craig, seconded by Flechsig that the request of Stephen A. Hynes to
rezone from M-2 to R-TP a parcel of land 120 x 1290 feet Located on 29th Street 5. E.
in the 700 block be granted and that the City Attorney be instructed to draw up the
necessary ordinance.

It is the recommendation of the Public Works Director that Contract No. 76-06, 1976
Asphalt Overlays, be awarded to Associated Sand & Gravel Co., on their low bid of
$25,813.70. Funding: One-half cent Gas Tax Monies.
It was moved by Lea, seconded by Flechsig, that Contract No. 76-06, for St. Imp.
No. 189, be awarded to Associated Sand & Gravel, Inc., on their low bid of $25,813.70,
and the Mayor and City Clerk be authorized to sign the Contract. Bid bonds to be
returned to Hi-Line Asphalt and Tucci & Sons, Inc., and upon signing of the contract
bid bonds be returned to Lakeside Inds. and Watson Asphalt.

be paid in thirty days provided no liens or claims are filed and clearance is secured
from the State Tax Commission and Department of Labor and Industries.

Councilman Lea asked what kind. of money we were talking about. Ted Beach stated
that Jim Keller was working on the Block Grant program and stated approximately
$10,000.00.
It was moved by Lea, seconded by Craig that authorization be given to the Director
of Public Works to call forbids for Sidewalk Imp. #2, downtown area sidewalk
improvement, using Community Block Grant funds.

PROCLAMATIONS, APPOINTMENTS AND ANNOUNCEMENTS
Mayor Kersey read a letter dated July 29, 1976, for White River Buddhist Church
inviting members of Council to attend the annual "Bon Odori" (Japanese Cultural
Dance Festival) which will. be held on Saturday August 7, 1976.
COUNCIL COMMITTEE REPORTS
MUNICIPAL BUILDING CODES COMMITTEE - Chairman Roegner
It was moved by Roegner, seconded by Kitchell to authorize the Planning Director
to record the deed from the Y.M.C.A. for the ACAP Group Home.

The next meeting of the Municipal Building Codes Committee will be held August 9,
1976, at 7:30 P.M.
PUBLIC SAFETY COMMITTEE - Councilman Roegner
Councilman Roegner reported for the Public Safety Committee, in the absence of
Chairman Anderson.
Councilman Roegner stated that Fire Chief Wi11 Spencer is looking into the replacement
of a fire truck.
The next meeting of the Public Safety Committee will be held August 17, 2976, at
7:30 P.M.'
PLANNING AND BEAUTIFICATION COMMITTEE - Councilman Kitchell
The next Planning and Beautification Committee meeting will be held August 3, 1976,
at 7:30 P.M.
AIRPORT COMMITTEE - Chairman Kitchell
Chairman Kitchell briefly went over the minutes of the Airport Committee meeting
held July 20, 1976.

It was moved by Kitchell, seconded by Lea that the appointment of Dave Morgan,
Robert Van5iclen and Harry Romberg to the Negotiation Committee, and that this committee
be authorized to transact a lease with Pacific Propeller be approved.

UTILITY COMMITTEE - Chairman Craig
The Utility Committee met on July 22, 1976, and the minutes are a matter of public
record.
Water and Sewer delinquencies were discussed, as there was some question as to wlxrthr..r.r
or not sufficient notice and time was being given to customers in regard to water
shut-offs.

from the Water-Sewer construction fund for the water Iine along 25th Street S. E.

The scheduled Utility Committee meeting for August 6th, has been cancelled.
FINANCE DEPARTMENT - Councilman Flechsig
The Finance Committee met on July 29, 1976, and the minutes are a matter of public
record.
It was moved by Flechsig, seconded by Lea that the Voucher Approval List, dated
July 31, 1976, in the amount of $3,449,178.85 be approved for payment.

It was moved by Flechsig, seconded by Craig that the Finance Director be authorized
to reinvest funds as well as other monies received during the month of August, 1976.

Councilman Lea stated that permission was given to the Chamber of Commerce for a
sidewalk sale August 6th and 7th. The request was. approved with the additional
stipulation that "B" Street S. E. be closed from Main Street to the first alley south
to eliminate the traffic congestion.
There will be no Street Committee meeting on Wednesday, August 18th.
Mayor Kersey declared the Public Hearing open to 'consider the adoption of the 1977-1982
City of Auburn Six Year Comprehensive Street Program..
