Mayer wished to submit to the council a letter from the King County Asses.~~c>a:`s «ffire showing that the property in question was originally taxed on the basis of n.:?? ~ple family dwellings. Mr. Larry Higgins, 16301 N.E. f3tfr, tie.1 i >•>~ar-, speaking on behalf of Mr. Mayer presented color slides of the area involved in t~~is rt~zone application and of other developments by Mr. Mat'er's company similar tca the _£~r,t~*~s<~d dcrvelopment on 31st Street S.E. He also showed sketcries and graphs `o po.i.nt up the differences between the original application and the present cane, such as 1c~.`~s total parking area, less total land covered by structures, more slza<;tr k,eta~~~e1r barildinys, saving of more existing trees. The effect that this proposes. dc~ve>~c.l,;mc~nt wvulr3 have on existing facilities such as schools, water and sewer lines, and t_rait'ic~ were also discussed. Mr. Higgins assured the council that althouglr this project wc,crld b.' partially financed by the Federal Housing Authority, that whex•e any bu.i ding codes were in conflect between FHA and the City of Auburn , t:ria t t..he taugl,ez~ r;~ ~dc~ c.•ou1 d 13e enforced . Mr. George Lindsay, 16.11 33rd SC. :S.L'., peah.ing fora group of citizens from southeast Auburn wished to restate the.i.x:• ol.a,jections to the proposed rezone on the basis that there are already many apartment complexes existing or being built in the area, that further increases in populat..ion in that area would cause traffic and crime problems, and the existing school and medical facilities were not suffi- cient to serve additional people. lie a.lsa suggested that future plans for develop- ment in this area be accompanied by an environmental impact statement. Mr. Tom Wine, 1220 32nei St. S.R., concurred with Mr. Lindsay and stated that he was very pleased with the way the corznril is handling review of this development. Mr. Don Rankin, 1425 32nd .S.B'. , asked trze city attorney what rights the citizens had should the council approve the rezone permit over their objections. The City Attorney explained the basis for reconsideration of the rezone and citizens rights to petition for thangea of decisions. Ms. Marlene Harbin, 2913 37th Way S.Is'., ar~l~ed what rent would be in these proposed apartments and Mayor Kersey suggested that this was not a proper legal question to ask of the developer. Mr. Bruce Metch, '1532 32nd St. S.E., ar;ked whether an environmental impact statement should be made p.r.ior to approval or ciisaLrl>roval of the rezone application. Mr. Dahiem brought up the point that a pcxrnit had been granted for conditional use of a property ne xt to this proposed s i t:e. It was moved by Flechsig, seconded by C.rai;g treat the public hearing be closed. MOTION CARRIED w 1-- j7 -; ~r i; AUFtURN, WASHINGTON ~ ~ ~ TUESDAY SEP~'EMBER 7, 1976 Councilman Craig commented on the confusion over what was to be considered on the original rezone application and the changes on the revised application. He also expressed 11is concern over the problems of increasing density in the area and over possible future problems in the water and sewer facility capability. Councilman Lea commented that his information about traffic in the area was that facilities are currently at capacity. The City Attorney explained what options the council had in reconsideration of this rezone application and that only those councilmen that had been present during the initial consideration of the rezone could vote on this reconsideration. Mr. Dahiem suggested that he and his client would be willing to allow all council members to vote on the reconsideration. Mr. George Lindsay, representing the citizen group, stated that they would be opposed to that suggestion. It was moved by Craig, seconded by Lea that no action be taken on the rezone application of Kurtis R. Mayer/Mayer Built Homes, Inc., and that the council move onto the next item of business. ROLL CALL VOTE: Councilmen Craig, Lea and Kitchell voting YES. Councilmen Roegner and Flechsig voting NO. Councilmen Larson and Anderson not voting. MOTION CARRIED ~~ .--~ Mayor Kersey declared the Public Hearing apen un the request of Park Associates L`` to rezone from Unclassified to F.-TP (l9obile Home Park) property located on the ~~ ~„ east side of "A" Street S.E., between 37th and 41st Streets S.E. (Application 22-76). The Planning Commission recommends approval of this request because it will conform to our Comprehensive Land Use Plan for medium density multi-family. ~4r. Oliver Anderson, Auburn Manor, spoke in behalf of the request and explained that the residents of the adjacent trailer park wished this rezone so that they might use the area to park their trailers and campers. Mr. George Lindsay stated the objections of the residents of the area to this reaquest. It was moved by Lea, seconded by Roegner that the public hearing be closed. MOTION CARRIED There was further discussion about a right of way involved in the rezone applica- tion and the relation the rezone had to the Comprehensive Land Use Plan. It was moved by Lea, seconded by Kitchell that the request of Park Associates to rezone from Unclassified to R-TP be approved, the Planning Commission recommendations be concurred with and the City Attorney be directed to draw up the necessary ordinance. ROLL CALL VOTE: A11 councilmen voting YES. MOTION CARRIED Mayor Kersey declared the Public Hearing open on the request of Imperial Homes, Inc., to rezone from R-2 (Single Family) to a Conditional Use Permit for property located at 535 12th Street S.E. (Application 23-76) The Planning Commission recommends approval of this request because the single story building should not be detrimental to the adjoining dwellings and will provide a good transi tion between the existing single family and commercial uses and that the plot plans and elevations be attached to and become a part of the permit. COUNCIL COMMITTEE REPORTS MUNICIPAL BUILDING CODES COMMITTEE - Chairman Roegner. It was moved by Chairman Roegner, seconded by Flechsig that the bond issue for the new city hall be introduced and adopted. MOTION CARRIED Chairman Roegner announced that the next regular meeting of the Municipal Building Codes Committee is cancelled. AIRPORT COMMITTEE - Chairman Kitchell It was moved by Kitchell, seconded by Larson that the Advisory Board participate in selection of an appraiser and that negotiations begin as soon as possible on Northern Avigation Easements. MOTION CARRIED It was moved by Chairman Kitchell, seconded by Larson to recommend application for federal planning assistance funds and recommend a concultant,to assist city in fund application and preparation of a Master Plan for .the airport.
