HomeMy WebLinkAbout04-17-1978i AUBURN, WASHINGTON MONDAY APRIL 17, 1978 The regular meeting of the Auburn City Council convened at B:OO p.m., in the Auburn School District Administration Building Board Room. ROLL CALL COUNCILMEN PRESENT: COUNCILMEN EXCUSED: Councilmen Roegner, Kitchell, Larson, Hitchcock, Flechsig and Lea. Councilman Craig. It was moved by Flechsig, seconded by Roegner, that the minutes of the April 3, 1978, council meeting be appraved as mailed. PUBLIC HEARINGS MOTION CARRIED Mayor Kersey declared the public hearing oper. on the proposed vacation of street right-of-way, situate on a portion of 25th Street Southeast, within the corporate Limits of the City of Auburn. Richard Reich, 38111 - 172nd Street, representing the Muckleshoot Indian Tribe, stated they objected to the proposed vacation because the City of Auburn lacks jurisdiction. He submitted a Memorandum and Resolution No. 78-23-7 in opposition to the vacation. Jack Bereiter, city attorney, asked W if the Resolution was stating that there was a procedural defect. Reich replied Q it was and that specific reasons were covered in the memorandum. Bereiter questioned George Schuler on the item in the Tribe's Memorandum regarding an incorrect street "Q number in the City of Auburn's Resolution No. 879 calling for a public hearing. George Schuler stated that there had been an error in that it was described as 24th Street 5.E. rather than 25th Street S.E. Jack Bereiter recommended that the matter be returned to the Planning Department to reissue the Notice of Public Hearing for the May 15th council meeting. It. was moved by Lea, seconded by Roegner, to continue the public hearing to May 15 and instruct the Planning Department to re-advertise the hearing. MOTION CARRIED AUDIENCE PARTICIPATION Sabrina (no last name given), 25th Street 5.E., stated the proceedings were not clear to her at a11. It sounded to her that citizens were not permitted to use Muckleshoot property but the Muckleshoot's were permitted to use theirs. Jack Bereiter responded by saying that there were legal procedures to follow and he had given the city his opinion that the City of Auburn did have jurisdiction over the property in question for fire, police and zoning. He also stated that the postponement tonight was because there had been a challenge to those legal procedures. James Kimbrough, representing Darrel Fowler, asked if it were possible to bring Mr. Fowler's rezone application before the council this evening. Mayor Kersey stated that public notice must be given first. RECOMMENDATIONS The Department of Planning and Community Development recommends the following for call for public hearing: 1. The request of Darrel Fowler to rezone from R-2 with a Special Property Use Permit for a nursing home to R-4 (Multi-Family) property located on the south- east corner of 19th and "F" Streets S.E. (Application No. 1-78). 2. The request of Wm. Finkbeinex-sand R. C1i.fford to rezone from Unclassified to M-1 (Light Industrial) a parcel of land 12 acres in size lying between the West Valley Highway and the Va11e~~ Freeway north S. 288th St. extended. (Application 5-78). 3. The request of Urban Development Co. to rezone from M-2 (Heavy Industrial) to R-TP (Mobile Home Par. k) a parcel of Iar~d 17.22 acres in size located at the northeast corner of 37th and "D" Streets S.E. Leonard and David Turpin to rezone from R-2 with a Special Property Use Permit for medical offices to R-4 for Multi-Family on a parcel of land 3.16 acres in size lying on the north side of 18th St. N.E. between "I" and "L" Streets N.E. (Application No. 15-78). 5. The request of Frank Roland and Sam Jolson to rezone from R-2 (Single Family to R-4 (Multi-Family) a parcel of Zand approximately 6 acres in size Lying on both sides of 37th St. S. E. in the 900 and 1000 blocks. (Application No. 16-78). 6. The request of John D. Wadkins to rezone from R-2 (Single Family) to R-4 (Mu1ti- F'amily) a parcel of Land 13,679. sq. ft. in size on the north side of 4th Street N. F,. approximately 113 feet west of "M" Street N.E. (Application No. 17-78). 7. The request of Imperial Homes, Inc. for approval of a preliminary plat to be known as "Chinook Addition" located on the east end of 20th 5t. S. E. in the 3300-3400 blocks. .(Application No. P-3-78). It was moved by Flechsig, seconded by Hitchcock, that a public hearing be held May 1, 1978, before the city council at the Auburn School District Administration Building, at 8:00 p.m. on Applications 1,5, 14, 15, I6, 17 and P-3-78. MOTION CARRIED The Department of Planning and Community Development recommends the following for council approval: The request of Norval H. Latimer for approval of a Final Plat to be known as Auburn Park of Industry located on a parcel of land approximately 24 acres in size located at the .southwest corner of 15th 5t. N.W. and the West Valley Highway. (Application No. P-1-77). The Planning Commission recommends approval of this final plat and the chairman and secretary be authorized to sign the face of the plat and that upon receipt by the Planning Department of certifica- teon that all the public improvements have been installed and accepted by the Public Works Department or that the necessary performance bond or other form of assurance has been filed that the Mayor be authorized to sign the face of the plat. It was moved by Hitchcock, seconded by Loa, to approve the Final Plat known as Auburn Park of Industry and that upon receipt by the Planning Department of certi- fication that all the public improvements have been installed and accepted by the Public Works Department or that the necessary performance bond or other form of assurance has been filed that the Mayor be authorized to sign the face of the plat and that the city attorney be instructed to prepare the necessary ordinance. ROLL CALL VOTE: A11 councilmen voting YES AfOTION CARRIED The Department of Public Works recommends the following for Council approval: 1. Authority to call for bids for the demolition of the May Apartments (E. Main & "D" Streets) for parking lot construction. It was moved by Lea, seconded by Larson, to authorize Public Works to call for bids for the demolition of the May Apartments. ROLL CALL VOTE:. A11 councilmen voting YES MOTION CARRIED 2. Change Order No. 4A to St. Imp. 187, East Main Street Construction, increase in the amount of $13,383.17. Existing water line from Auburn Way to approximately '~" 480 feet east was found to be too shallow to allow street construction and because of type of. pipe could,;,not be relocated. It was moved by Lea, seconded by Larson, that Change Order No. 4A to St. Imp. 187 for an increase of $13,383.17 be approved. ROLL CALL VOTE: AZI councilmen voting YES. MOTION CARRIED 3. MOTION CARRIED Planning & CommunitU Development Committee - Vice Chairman Larson It was moved by Larson, seconded by Kitchell, to authorize the Mayor to sign a joint application with the City of. .Renton to obtain $50,000.00 in unallocated block grant funds to undertake the Rental Housing Rehabilitation Program. ROLL CALL VOTE: A11 councilmen voting YES MOTION CARRIED It was moved by Larson, seconded by Kitchell, to approve the request of the One-Stop- Mix-Shop fora Class E and F liquor license. MOTION CARRIED Utility Committee - Councilman Larson It was moved by Larson, seconded by Flechsig, to approve the request of Roland Crabtree for approval of a Prel.im_inary Plat for the plat to be known as Lakeland Hi11s Division No. 2 with the conditions of the April 6, 1978, letter from Roland .Crabtree. Finance Committee - Chairman Flechsig It was moved by FIecl~sig, seconded by Lea, to approve voucher disbursements on checks 1320 through 1473 in the amount of $1,886,955.05 and payroll for the period ended 3/26/78 on checks 1050 through 1301_in the amount of $144,453.52. ROLL CALL VOTE: All councilmen voting YES MOTION CARRIED It was moved by Flechsig, seconded by Lea, that the cash transfers for the month of March and the adjustment of utility bills totaling $13.71 (credit), listing attached as part of these minutes, be approved. MOTION CARRIED Lea announced a special meeting of the street committee on April 24 at 7:30 p. m. to discuss the H.U.D. Flood Way Map and the Valley Interim Policy and Regulatory Plan for storm drainage. OLD BUSINESS It was movE~d by Hitchcock, seconded by Roegner, that Ordinance No. 3258, entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO TILE INSTALLATION AND MAINTENANCE OF SMOKE DETECTORS IN OCCUPANCIES THAT ARE RENTED, LEASED OR LET", be adopted. (Introduced April 3, 1978). ROLL CALL VOTE: A11 councilmen voting YES MOTION CARRIED Larson added that it is to be made clear that if the owner of unit cannot get in to check the smoke detectors that a letter to the Fire Department indicating he had made every effort to do so would prevent him from being liable in case of fire.
