ROLL CALL ., COUNCILMEN PRESENT: Councilmen Roegner, Kitchell, Craig, Larson, Hitchcock, _ Flechsig and Lea.. It was moved by Flechsig, seconded by Kitchell, that t.'re minutes of the M_ay 1, 1978, council meeting be approved as mailed. MOTION CARRIED PUBLIC fiEARING Mayor Kersey declared the continued public hearing open on the proposed vacation of street right of way, situate on a poftion of 25th St. S.E.. in the 2300 block within the corporate limits of the City of Auburn. Jack Bereiter, city attorney, recapped events that had taken place since the last. hearing. He stated there was a mutual concern betwen the Cit}~ of Auburn aril theN Muckleshoot Indian-Tribe for traffic and public safety. problems. The 2'ribe has proposed that in lieu of vacation a blockade be constructed. `The Tribe wag prepared to contract for a cyclone fence faith an emergency exit.. Richard Reich, representing the Muckleshoot Indian Tribe, corrected Bereiter's statement by stating the Tribe was planning a barricade rather then a fence. Bereiter added that after meeting with the Tribe and department heads he would suggest to accept the Tribe`s ptbposal to barricade the street with access for fire and police. purposes in lieu of vacation. This would not, however, resolve jurisdictional problems. Tim Sheldon, Director of Business Development for the Muckleral7oot Indian. Tribe,. proposed a barricade of a three inch sleeve with three foot ggsts every three feet: Landscaping would be provided between the posts.. It would a.~.~ow pedestrian traffic but rio vehicular traffic. The barricade would be secured with a padl©ck which could be cut by the Fire or Pollee Departments in an emergency. f(e~added that the gibe - never: meant the road for vehicular traffic. because it was a deeded road and could not be barricaded. He wondered why 5th Sf. S.E. couldn't be dead-ended. _ Sharon Grammer, 24 h St. S.E. inquired as to why the petition for vacation with 180 signatures had not been used in the procedings. • Gere,ter responded that the petition had been considered to.be an informal petit~mrrs: and the decision was made to go through the avenue of a resq~Z~tion Pam Pulver, 2510 - 24th. Bereiter said ;a rodent appcallate court decision had overturned that ruling. _~ Ms. Pulver said size was willing to amend her feelings if the pity will have control over-,the street. Don Edwards, 2715 24th St. S.E:, wanted to know how the Tribe could. put up a barricade an, dity land, Zand they don't own. As soon as they put it up ,they can take it down.. Bereiter responded that it was his understanding that the barricade would,h~ pu.t at the end of the street on tribal land isa a cooperative effort to resolve tra~'fic problem concerns . Andy Palmer, 25th Street S.E., stated he fe:Zt the tribal council was making an effort to to resolve the traffic problem. Chuck Jones, 25th & Dogwood, asked who would be maintaining the barricade. Also, the street is circu_Zar and couldn't be posted dead end. Leonard Fairfield, 2505 24th St. S.E., said he personally feels the street should be vacated. He felt it is the only effective way to clear up the problem. He expressed concern as to what would hopped if the Tribe should change their mind. If the street'.~~ were to be barricaded, then the city should have some sort of agreement with the Tribe:rv John A11en, 2330 25th St. S.E., was for the vacation and wondered why the Tribe can't find another way to yet on the property. Richard Reich stated as owners of the land abutting 25th St. 5:E. the Tribe objects to the vacation because the city Iacks jurisdiction. He submitted a supplemental memorandum listing objections covered in the first memorandum from the Tribe to the City with the addition of two more objections. Bereiter, addressing himself to A11en Sanders, Tribal attorney, expressed concern i.n the statements given my Mr. Reich since they dealt with jurisdictional problems. A11en Sanders responded that the Tribe has the right to assert jurisdictional rights and the statements made tonight are for the record. The Tribe wants the people living within the Reservation to feel free to come directly to the Tribe. He added that he could see no Iega1 justification to procede with vacation in light of the proposal to barricade. Reich added that the Tribe felt the need to preserve their rights. Bereiter urged the Council not to address the jurisdictional problems and to: A) approve the vacation, B) deny the vacation or C) throw out the vacation for barracadi Councilman Craig emphasized the need to make the citizen's needs the first considerat :"" Reich restated the Tribe's intention to never allow traffic in the area in the first place and the Tribe is putting the posts in in good faith. They would not be putting the barricade in today to take out tomorrow. Sheldon stated there is nothing hidden behind the scenes and the Tribc is being forth- right in their proposal. Susan A11en, 25th Street S.E., said it had been brought up in a meeting that there would be a three-party agreement between the city, the Tribe and the residents.. Bereiter :responded that there was no offer that he was aware of end that he recorirmended to .accept the offer of the Tribe to install, pay for and maintain the barricade. Leonard Fairfield asked. who would have control of the barricade? Reich state the keys to the padlock would be at the Tribal Community Center and it was his understanding the c~mergenc_y vehicles carry cutters that could cut the padlock i n an emergency . It was moved by Craig, seconded by Laron, that the public hearing be closed. MOTION `CARRI '~~- Craig expressed his feelings that the main objective was to provide for'the basic needs of the residents and effectively close traffic to .the area. In vew'bf the Tribal Council's spirit of cooperation that we should have some sbrt of"agreement in writing that would keep the street closed except for emergency traffic. ' -2- AUBURN, WASHINGTON MONDAY MAY 15, 8 George Schuler, director of the planning department, stated -there .would be a problem closing the entire street since. there is one owner whose property abutts the street and would need access. Bereiter asked Schuler if it was feasible to take care of this person and maintain the spirit of cooperation? Schuler stated he was just responding to Craig's suggestion to close"road entirely. Mayor Kersey asked if there was way the street could be marked to prevent vehicular and motorcycle traffic? ~"~ ~? Craig asked. if there was something that could be done to indicate the street was for emergency use only? Bereiter thought the Tribe could agree to something. Hitchcock asked Bereiter if a vacation would mean. that the property would be deeded to the property owners and down the road could conceivably be sold to the Tribe. Bereiter said Hitchock was correct. M~ Craig asked if we passed a resolution could the Tribal Council pass the same resolution `'J saying the same thing. Hitchcock asked Bereiter if the city would lose control if the. street were vacated? Brere.iter answered yes. ~..~, Craig added that if we approve the vacation he sees that we would: 1)' engage the ~ Tribe in a jurisdictional dispute and 2) tie up traffic for several years while l.._ in matter was in the courts. ROLL CALL VOTE: Councilmen Larson and Roegner voting YES Councilmen Hitchcock, Flechsig, Lea, Kitchel^1 and Craig voting NO MOTION FAILED; It was moved by Craig, seconded by Hitchcock, that the. city attorney be instructed to draw up a resolution agreeing with the Muckleshoot Indian Tribe's proposal to barricade the west end of 25th Street S.E. which barricade wi11 a11ow fqr access only of authorized emergency vehicles and which wi11 preclude'a1l~other vehicles and which resolution sha11 retain necessary easements for City of Auburn public.:, utilities and which resolution wi11 invite the Muckleshoot Indian Tribal Council to pass a similar cooperative resolution regarding the barricading of 25th Street S.E.
