Auburn City Council convened at 8:130 p.m. in the Auburn School D;aEstrict Admini$tration Building Board Room. ROLL CALL ~~tJ'NCILMEN PRESENT: Councilmen Roegner, Kitchell, Craig, Larson, Hitchcock, Flechsig and Lea. '~ It was moved by Flechsiy, seconded by Kitchell, that the minutes of the May 1, 1978, council meeting be approved as mailed. ~ MOTION-CARRIED PUBLfC HEARINGS l: ~ayor Kersey declared the public heariny open on the request. of Cox, Porter, aukala and Belles to rezone from R-2 with a Conditional Use Permit for a day care center to R-2 with a Conditional Use Permit to construct four 4-plex multi- family units on a parcel of land approximately 96,000 sq. ft. in size located on "M" St. N.E. i.n the 2100 block. (Application 18-78) The Planning Commission recommends atpproval of-.this request because it will conform. to our Comprehensive Plan far low density development and will conform to the overall site plan approved by the Planning-Commission and City Council in I97b and provided that the following :changes-are made in the site plan to provide additional right of way for 21st,St. N.E. whzeh is being proposed for use as a service access. I. That buildings'1 and 3 be moved 10 feet to the south providing a 10 foot set back from the property-line. Z. That the landscape area adjoining buildings 1,2,3 & 4 be reduced in width by two and one-half feet.. 3. That buildings 2 and 4 be moved 15 feet to the south. Also that that portion of the existing dedicated 21st St. N.E. to be used as access to "M" St. N.E. from the service access be surfaced to City of Auburn Public Works Dept. standards and if approved, the revised site development plan should be attached to and become a part of any ordinance approving the Conditional Use Permit. Jim Cox,. 22.5 - 15th St. S.E., one of the applicants for the rezone, was in the aedience to answer any questions. No one else in the audience spoke for or against the request. (Application 21-7$) The Planning Commission recommends denial of the Rio (Multi-Family) request and approval of an R~3 (Duplex zone classification and that consideration should be given to 'the dedication'of the south five feet of the site for the future widening of 22nd St. N.E. James to rezone from R-2 (Single Family).to R-2 (single Family) wi th a Conditional Use Permit for a profes~ior:al;office on a parcel of land 20,400 sq. ft. irs size Iying between Harvey toad and "K" St. N.E. in the 1000 block. (Application 23-78). The PZanning Commission recommends approval of this request because it wilt conform to our T Comprehensive Plan and zoning ordinance and provided: I. That the off-street parking Zot be arranged to encourage a portion of the traffic to use "K" St. N.E. to exit from the site. ~ ~. Duncan Bonjorni, 3204 Auburn Way North, who will be one of the occupants of the professional office, stated that the only problem that he might foresee is the dedication of the 5 feet. It was possible that the mortgagee may object t0 the dedication of property covered by the mortgage. It was moved by Larson, seconded by Flechsig, that the public hearing be closed. MOTION CARRIED It was tr+oved by Larson, seconded by Flechsig, that the request of H.. T. James ~ to rezone from R-2 to R-2 with a Conditional Use Permit for a professional office be approved and the city attorney instructed to draw up the necessary ordinance including .the recommendations of the Planning .Commission. ROLL CALL VOTE: A11.councilmen voting YES MOTION CARRIED 6. Mayor Kersey declared the. public hearing open on the amendment to Chapters 18.36 and 18.38 of the Auburn City Code. Said amendments to provide new regulations for. the M-1 and M-2 Light and Heavy Industrial Classifications. The Planning Commission recdrhmends approval of the amendment. No one in the audience spoke for or against the amendment. -It was moved by Flechsig, ,seconded by Larson, that the public hearing be closed. Said amendments to include new chapters to provide regulations for the division of land into 4 Lots or Less. Said amendments to be known as the Short Subdivision Ordinance of the City of Auburn. ROLB CALL VOTE: All councilmen voting YES MOTION CARRIED Mayor Kersey declared the public hearing open'on the reconsideration of the request of Darrel Fowler to rezone from R-2 with a Special Property UsefPermit to construct a nursing'home to R- (Multi-Family) a parcel of-Iand 2.69, acres in size lying at the southeast corner of l9th and "F" St. S.E. (Application 1-78). Bob Smythe ,29 1st St. N.E., attorney representing Mr. Fowler, stated that Mr. Fowler and his architect were-also in the audience to answer any questions...- Mr..5mythe explained there were-two .reasons why it was felt that the council should reconsider favorably Mr. Fowler's request: (I) That there was a mistake as to what the petitioner would be willing to do to overcome objectons'of 'the residents and (2) that there was some miaunderstanding as to the several considera- tions that should- be made in. making a decision on the request. The desire<of . the council to harmonize and sympathize with the property owners was but one of the considerations.. Mr.Smythe added that the council should also consider the Planning Commissi-qn's recommendation for approval, the .existing land use, the existing zoning and' that the property conforms to the Comprehensive Land Use Plan. Eugene Cerino, 701.21st St. S.E., one of the property owners to the south,`' spoke against the rezone. sloe Binetti, 609 21st St. S.E., one of the residents in the area, stated that this matter..had come v~~fore the P1ann.i.ng Commission three times already. In November the request'was unanimously rejected. He submitted that notif:~cation of residents withnl00 feet of the property was not close. enough and tlyat there -were ,more pc~opli: in thc~ sur.round.iny area that would be interested in the matter. He asked that: thc~ council reeons.idcar tlzc~ request i.n the .same stead as last time. Bob Burwell,-1915 Dogwood Drive S. E.,-asked how many chances are they going.to get? The request had already been turned down twice. He felt that the develop- meet would add too many people to the area and would devaluate his property. Janice Binetti, 607 21st St. S.E., objected to .the rezone, because the additional 50 units would bring more population thus devaluating their property and the Loss of privacy in their back yard plas creating a hazard for their children. Phil Moore, 920 21st St. S.E., expressed concern over thecongestion that :would result from the development. Richard Fordice, 531 21st St. S.E., stated he took exception`to Mr. Smythe's remarks. MOTION CARRIED Counc.i.lman Craig stated that the original application was denied at the December 6, 1977, 1~lanniny Commission meeting because, "the area is a.Iready too saturated with multi-family units." Councilman Flechsig clarified that Plan No. 2 was the one with 44 units with the south 10O fit. to be zoned for single family residences. Plan No. .1 was fot 52 units with the swimming pool and tennis courts as A buffer. 1 G{raig asked the city attorney if the petitioner has the right. to ask the .council for reconsideration.. Jack B~ereiter responded that rules of parlimentary procedure permits any citizen to ask for reconsideration. Anyone who voted to deny the original request can make a motion to reconsider. it,as was done in this case. It was moved by Craig, seconded by Larson, that the request of Darrel Fowler to rezone from R-Z with a Special. Property Use Permit to construct a nursing home to R-4 be referred to the planning director fox study and ask him to bring back to the. council a recommendation on how the council should go, that the recommendation be limited to the Plan marked No. 2 which outlines single family residences with R-4 zoning in the northerly portion of the property and:. also that the comments of the city engineer be incorporated into the recommendation. ROLL CALL VOTE: Councilmen Craig, Larson, Hitchcock, Flechsig .and Kitchell voting YES. Councilmen Lea and Roegner voting N0. MOTION CARRIED The city clerk was .asked to notify those present at the hearing when the request. would. again come before the council. ,~-~-, CORRESPONDENCE The city clerk read an application for a Conditional Use .Permit from Donald Fl. (Application 28-78) Lt was moved by Larson, seconded by Flechsig, that application 28-78 be referred to the next :regular meeting of the Planning Commission, MOTION CARRIED AUDIENCE PARTICIPATION Joe B.i.nc:tti., 609 ilst St. S.E., askfad if the city-could enact an ordinance that ,would require the notification of people who live within 500 feet from .property to be considered for rezoning rather than the present 200 feet, George Schuler stated that in some cases there would a problem with costs since as many. as several hundred people would have to be notified. Jack Berei-ter advised that state Iaw requires a minimum of 200 feet and gave the suggestion that the problem be referred to the Planning Conunission for-study. BID OPENINGS r---». MOTION CARRIED ;,.„„~, Councilman Roegner noted that the sale of liquor in drug. stores is something he felt wad not .favorable. The council concurred. COUNCIL COMMITTEE REPORTS Municipal Building Committee - Chairman Roegner - No report Planning & Community Deevelopment Committee - Chairwoman- Kitchell - No report Utility Committee - Cahirman Craig May 18, 1978,: Meeting Councilman Craig explained 'the meeting had been a public hearing. to discuss the possible formation of a ULID in the area to be developed by Roland Crabtree. Craig stated that the meeting adjourned with several options-for Mr. Crabtree to consider.- Councilman Lea suggested that in further discussions on the matter possibly the city might consider involvement since it could mean revenue to to the city. Craig also explained discussions with Fri to-Lay Corporation on a possible LID. George Schuler was asked to: once again attempt to form a LID in-the area with the pafticipation of Fri to-Lay. Also there wi1.I be a public hearing on the Draft Environmental Impact Assessment R~porf; June 20, 1978, 7:30 p.m. at the Senior Citizens Center. Public Safety Committee - Chairman Hitchcock - It was moved by Iitchcock, seconded by Flechsig, to authorize the transfer-of the W Police Department radios to the Parks Department. and Street Department with the delegation to be made by the Mayor.. Q MOTION CARRIED It was moved by Hitchcock, seconded by Roegner, that the City of Auburn Police and Fire Departments continue participation in Va11ey Com for .the-year I979. Councilman Roegner outlined the issues that the Public Safety Commute had considered and added that it was the Committee's feeling that those issues had been reasonably resolved and in the long run it would be cheaper for the city to-stay in Va11ey Com. ~.~.t., The subject of wages and personnel was brought up by Councilman Craig and the.moticm: was held over until an .executive session could be held.
